<official-title>To amend titles XVIII and XIX of the Social Security Act with respect to reform of Federal survey and certification process of nursing facilities under the Medicare and Medicaid Programs.</official-title>

<section id="HBA52375F9E2D4A71B6ACFC47943B72D3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare and Medicaid Nursing Facility Quality Improvement Act of 2005</short-title></quote>.</text></section> 
<section id="H44BB41B5181F455289F799196872235F"><enum>2.</enum><header>Quality improvement for nursing facilities under the medicare and medicaid programs</header> 
<subsection id="HEC7CD29E323B4D12A192A2105498F658"><enum>(a)</enum><header>Incentives for immediate improvement and protection of needed training programs</header> 
<paragraph id="H3EA5ACF3C98144D1A135BE07A3C8741"><enum>(1)</enum><header>Medicare program</header><text>Section 1819(f)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(f)(2)</external-xref>) is amended—</text> 
<subparagraph id="H0FDE51462BAC4685A7EFC700C38B7923"><enum>(A)</enum><text>in subparagraph (B)—</text> 
<clause id="H307839A31C5845109EA2CD94F78D0315"><enum>(i)</enum><text>by adding <quote>and</quote> at the end of clause (i);</text></clause>

<paragraph id="HC0BDBF9FE88E4185B749001DE980A36E"><enum>(2)</enum><header>Medicaid program</header><text>Section 1919(f)(2) of such Act (42 U.S.C.1396r(f)(2)) is amended—</text> 
<subparagraph id="H7DF7C56D1CCA45A8B818F5005CAC7C21"><enum>(A)</enum><text>in subparagraph (B)—</text>

<subsection id="H43879EBBF2234DFD852E72DD98B27127"><enum>(b)</enum><header>Specified remedies</header> 
<paragraph id="H32EC39180AF6473FA3C392ED76374691"><enum>(1)</enum><header>Medicare program</header><text>Section 1819(h)(2)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(h)(2)(B)</external-xref>) is amended—</text> 
<subparagraph id="HBD04B2C2A259466FB1E1BEE9BA04F148"><enum>(A)</enum><text>by redesignating clause (iii) as clause (iv); and</text></subparagraph> 
<subparagraph id="HCA123C0DFDF54A4FA570DE6F48A52E05"><enum>(B)</enum><text>by inserting after clause (ii) the following new clause:</text>

<clause id="H0BE58F14F76146D6ADC44C1200A7C395"><enum>(iii)</enum><header>Disapproval of nurse aide training and competency evaluation programs</header><text display-inline="yes-display-inline">In consultation with the State, the Secretary may disapprove nurse aide training and competency evaluation programs offered by the facility.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> </paragraph> 
<paragraph id="H5DF23297E41145C5A1009CDDC00CC42"><enum>(2)</enum><header>Medicaid program</header><text>Section 1919(h)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(h)(2)(A)</external-xref>) is amended—</text> 
<subparagraph id="H889B8202BECA4742851573AC69160021"><enum>(A)</enum><text>by redesignating clauses (iii) and (iv) as clauses (iv) and (v), respectively; and</text></subparagraph> 
<subparagraph id="HFE1C46AE0A9F48FE9EC06EB6FCFD5F68"><enum>(B)</enum><text>by inserting after clause (ii) the following new clause:</text>

<subsection id="H5B16C29FF04E4DE1AE586CC47B80D9C4"><enum>(c)</enum><header>Promoting innovation and quality improvement through state waivers</header> 
<paragraph id="H6BBEA82A9F934F0100FB2FD6F7AD5D09"><enum>(1)</enum><header>Medicare program</header><text>Section 1819(g) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(g)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H62BE6EB797204AE688CBC1BDD3708D62"><enum>(6)</enum><header>Waiver demonstration authority to promote innovation and quality improvement</header> 
<subparagraph id="H870A7D529C72497B96AF7750F11D0506"><enum>(A)</enum><header>In general</header><text>At the request of a State, but not to exceed a total of 3 States, the Secretary may waive provisions of this subsection relating to survey and certification procedures in order to test and implement innovative alternatives to the survey process otherwise applicable. The Secretary shall provide special consideration to the application of alternative procedures that increase the use of outcome measures, the incorporation of quality of life measures, and improve consistency and accuracy in deficiency determinations and survey results. The Secretary shall approve a waiver request if applicant demonstrates significant potential for improving the quality of care, quality of life, and safety of residents.</text></subparagraph> 
<subparagraph id="H15B3A438B00C41B7BB548503D0C6A3C1"><enum>(B)</enum><header>Consideration of views of stakeholders</header><text>The Secretary shall only consider waiver applications under this paragraph from a State under this paragraph if the State has convened and consulted with appropriate stakeholders in the State, including representatives of nursing facilities, consumers groups, the State long term care ombudsman, labor organizations (and where such organizations are not present in the industry, other employee representatives), and licensed health care providers, to assist in developing their alternative system. In determining whether to grant such waivers the Secretary shall take into consideration the views of the stakeholders convened by the State.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HB0182E04C87E4633883EA4B2A2044114"><enum>(2)</enum><header>Medicaid program</header><text>Section 1919(g) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(g)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HAA4E2D845FB447DF91B0CD2BD0633102"><enum>(1)</enum><header>Medicare program</header><text>Section 1819(h)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(h)(2)</external-xref>) is amended—</text> 
<subparagraph id="H7CC2323541854DF387AF3D9D7B7EDBE1"><enum>(A)</enum><text>in subparagraph (D), by striking <quote>If</quote> and inserting <quote>Subject to subparagraph (F), if</quote>;</text></subparagraph> 
<subparagraph id="H361DB41D219540D19BBDE79759A87B00"><enum>(B)</enum><text>in subparagraph (E), by striking <quote>In</quote> and inserting <quote>Subject to subparagraph (F), in</quote>; and</text></subparagraph> 
<subparagraph id="HBABD2569474744CD98C6EBDC8B7800"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="HC55439BC3FB84B3B8E19A0A913EE72BA"><enum>(F)</enum><header>Continuation of payments pending remediation when flexibility needed to protect residents</header><text>The Secretary may continue payments, over a period not longer than 12 months after the effective date of the findings, under this title with respect to a nursing facility not in compliance with a requirement of subsection (b), (c), or (d), if—</text> 
<clause id="HDCD72B14D4B443F092CC56A4A409436C"><enum>(i)</enum><text>the State survey agency finds that ceasing payments is not in the best interests of residents and that continuation of payments would not jeopardize residents’ health and safety;</text></clause> 
<clause id="H93AC0F20F5CF4FB98D4C85298D2417B0"><enum>(ii)</enum><text>the State survey agency finds that it is more appropriate to take alternative action to assure compliance of the facility with the requirements than to terminate the certification of the facility; and</text></clause> 
<clause id="H23E13B747AC74DD88DC46825E3718700"><enum>(iii)</enum><text>the State has submitted a plan and timetable for corrective action to the Secretary for approval and the Secretary approves the plan of corrective action.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H6AA7234028A64B5386F3596CE7788FE5"><enum>(2)</enum><header>Medicaid program</header><text>Section 1919(h)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(h)(2)</external-xref>) is amended—</text> 
<subparagraph id="H678F6B83DB52486488B72D35FE15013"><enum>(A)</enum><text>in subparagraph (C), by striking <quote>If</quote> and inserting <quote>Subject to subparagraph (G), if</quote>;</text></subparagraph> 
<subparagraph id="H4C328183642B427BB81FC14091EB7D22"><enum>(B)</enum><text>in subparagraph (D), by striking <quote>In</quote> and inserting <quote>Subject to subparagraph (G), in</quote>; and</text></subparagraph>

<subsection id="HE6F68CEE28E146BB8E6F57BBEA2745A9"><enum>(e)</enum><header>Access to informal dispute resolution process</header> 
<paragraph id="HFD024AE83BF940FB8B3467BB8CA0B363"><enum>(1)</enum><header>Medicare program</header><text>Section 1819(g)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(g)(1)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H6CCC6914628F4552A700008339217960"><enum>(F)</enum><header>Establishment of informal, independent dispute resolution process</header><text>Each State shall establish an informal dispute resolution process that allows facilities to settle disputes involving compliance with the standards established under this section. Such process shall rely on independent third parties, not related to the State survey agency or the facilities, in resolving disputes.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HEF99DBAB98CB4C0D9700B807AC483FA7"><enum>(2)</enum><header>Medicaid program</header><text>Section 1919(g)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(g)(1)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

<paragraph id="H10F8D5FD86F04DBD8E00F8D80071409B"><enum>(1)</enum><header>Medicare program</header><text>Section 1819(h) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(h)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HAADE67EFC8DB4BA094F843D53160129F"><enum>(7)</enum><header>Fostering improvement of facilities with poor compliance histories</header><text>The Secretary shall provide incentives for operators with histories of good compliance to acquire facilities with poor compliance histories. Such incentives shall be designed to promote the sustained provision of high-quality care and shall only be made available in the case of bona fide, arm’s-length sale of facilities with poor compliance histories.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H2BD058DDC5D2426CBFF6598BD3AF589F"><enum>(2)</enum><header>Medicaid program</header><text>Section 1919(h) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(h)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<subparagraph id="HF6FD9541A1014EF0AA46CECFE1BDAD1"><enum>(A)</enum><text>each individual newly hired as a nursing home surveyor, as part of the individual’s basic training, is assigned full-time to a participating nursing facility for at least 5 days within a 7-day period to observe actual operations outside of the survey process before the individual begins oversight responsibilities;</text> </subparagraph> 
<subparagraph id="HA8386C550351480800E1DE32068C5606"><enum>(B)</enum><text>such individual shall not assume oversight responsibility during this training period and such observations may not be the sole basis of a deficiency citation against the facility; and</text></subparagraph> 
<subparagraph id="HF27C84B1179746ACB8F103AFE0E2FD60"><enum>(C)</enum><text>such individual shall not be assigned as a member of a survey team for the facility in which the individual received training for two standard surveys following the training period in the facility.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HAD7D0429C0434FF4B79EF941FE3064C5"><enum>(2)</enum><header>Medicaid program</header><text display-inline="yes-display-inline">Section 1919(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(e)</external-xref>), as amended by subsection (h)(2), is amended by adding at the end the following new paragraph: </text>

<paragraph id="HB634D10D3AF3405994A3D0CED0ADAB6E"><enum>(9)</enum><header>Facility-based training for new surveyors</header><text>The State shall establish a process for assuring that—</text> 
<subparagraph id="HC313394E0ACE4014BD02008823B3AF3"><enum>(A)</enum><text>each individual newly hired as a nursing home surveyor, as part of the individual’s basic training, is assigned full-time to a participating nursing facility for at least 5 days within a 7-day period to observe actual operations outside of the survey process before the individual begins oversight responsibilities;</text> </subparagraph> 
<subparagraph id="H1A370C5C13744D288F095D6814C9D588"><enum>(B)</enum><text>such individual shall not assume oversight responsibility during this training period and such observations may not be the sole basis of a deficiency citation against the facility; and</text></subparagraph> 
<subparagraph id="HFFECA084178F45D488EC6FDCA7BAAA2F"><enum>(C)</enum><text>such individual shall not be assigned as a member of a survey team for the facility in which the individual received training for two standard surveys following the training period in the facility.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H17833D52D05644968B45D9005D8BF00"><enum>(j)</enum><header>Effective date</header><text>The amendments made by this section shall take effect one month after the date of the enactment of this Act, except in cases where regulations are needed to implement these amendments and in such cases shall be effective 6 months after such enactment date.</text></subsection></section>
