<section section-type="section-one" id="HB63E69C93324494D91BAFCA900704093" display-inline="no-display-inline"><enum>1.</enum><header>Presumption of service-connection for certain veterans with Hepatitis C</header> 
<subsection id="HC330E8DAA9C746EEA1ABE562DCA861E7"><enum>(a)</enum><header>Presumption</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/1112">Section 1112</external-xref> of title 38, United States Code, is amended by adding at the end the following:</text>

<subsection id="HD2FBC1FB15D041848BD1687B96441EE8"><enum>(d)</enum>
<paragraph id="HAF7D217DD4A3499D805574A5358D6844" display-inline="yes-display-inline"><enum>(1)</enum><text>For the purposes of <external-xref legal-doc="usc" parsable-cite="usc/38/1110">section 1110</external-xref> of this title, and subject to the provisions of <external-xref legal-doc="usc" parsable-cite="usc/38/1113">section 1113</external-xref> of this title, the disease Hepatitis C becoming manifest to a degree of 10 percent or more in any veteran described in paragraph (2) after active military, naval, or air service covered by that paragraph shall be considered to have been incurred in or aggravated by such service, notwithstanding that there is no record of evidence of that disease during such service.</text> </paragraph>
<paragraph indent="up1" id="HB2B8370081B34D06918F21F4A4E56271"><enum>(2)</enum><text>Paragraph (1) applies in the case of the following:</text> 
<subparagraph id="HE1854FBB8FAB4F63A89747B3D4BA7E12"><enum>(A)</enum><text>Veterans who received during a period of service before December 31, 1992, a transfusion of blood or blood products.</text></subparagraph> 
<subparagraph id="HA43DDF46C89F4E14872FBFA1336637D6"><enum>(B)</enum><text>Veterans who were exposed to blood on or through the skin or a mucous membrane during a period of service.</text></subparagraph> 
<subparagraph id="HBD967649FEAE4AA5BB006643CFB9E48F"><enum>(C)</enum><text>Veterans who underwent hemodyalisis during a period of service.</text></subparagraph> 
<subparagraph id="H1378001772884913A8134CCCE3836842"><enum>(D)</enum><text>Veterans who experienced a needle-stick accident or medical event involving a needle, not due to the veteran’s own willful misconduct, during a period of service.</text></subparagraph> 
<subparagraph id="H389090E2478B4937AF01B03FCDAF2901"><enum>(E)</enum><text>Veterans diagnosed with unexplained liver disease during a period of service.</text></subparagraph> 
<subparagraph id="H3D3D0472F3854913BB1479D400D90889"><enum>(F)</enum><text>Veterans who experienced an unexplained liver dysfunction value or test during a period of service.</text></subparagraph> 
<subparagraph id="HDAF77938FB5247A99C5F8815DCCCC6"><enum>(G)</enum><text>Veterans who served in a health-care position or specialty during a period of service under such circumstances as the Secretary shall prescribe for purposes of this subsection.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE2E9C0FEE95543539C8F6864D908F147"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act. No benefit may be paid or provided by reason of that amendment for any period before such date.</text></subsection></section>
