<section section-type="section-one" id="H928EEF6623FE4519AF673FB982F5BE4D" display-inline="no-display-inline"><enum>1.</enum><header><deleted-phrase reported-display-style="strikethrough" committee-id="HBA00">Short title</deleted-phrase></header><text display-inline="no-display-inline"><deleted-phrase reported-display-style="strikethrough" committee-id="HBA00">This Act may be cited as the <quote><short-title>Small Public Housing Authority Act</short-title></quote>.</deleted-phrase></text></section> 
<section id="H6E6B2071BEC84CC3857FCFD70425BD00"><enum>2.</enum><header>Public housing agency plans for certain small public housing agencies</header><text display-inline="no-display-inline">Section 5A(b) of the <act-name parsable-cite="USHA">United States Housing Act of 1937</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1437c-1">42 U.S.C. 1437c–1(b)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H1BAC0DDB7CC44C2B9955109F1B71E07F"><enum>(3)</enum><header>Exemption of certain small phas from filing requirement</header> 
<subparagraph id="HE42F1965D9254BE6824B6373F156E345"><enum>(A)</enum><header>In general</header><text>Notwithstanding paragraph (1) or any other provision of this Act—</text> 
<clause id="H49BCA46907224B42A78EE622D6888ECF"><enum>(i)</enum><text>the requirement under paragraph (1) shall not apply to any qualified small public housing agency; and</text></clause> 
<clause id="H0EB316C5458A4374B78D00C07F9DE880"><enum>(ii)</enum><text>any reference in this section or any other provision of law to a <quote>public housing agency</quote> shall not be considered to refer to any qualified small public housing agency, to the extent such reference applies to the requirement to submit a public housing agency plan under this subsection.</text></clause></subparagraph> 
<subparagraph id="HAFB0FE371E7542B9A5E56CCCB6289384"><enum>(B)</enum><header>Definition</header><text>For purposes of this paragraph, the term <term>qualified small public housing agency</term> means a public housing agency that meets all of the following requirements:</text> 
<clause id="H7B871F4B4E19455792CD5CBD4EF4EE1"><enum>(i)</enum><text>The sum of (I) the number of public housing dwelling units administered by the agency, and (II) the number of vouchers under section 8(o) of the <act-name parsable-cite="USHA">United States Housing Act of 1937</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>) administered by the agency, is 250 or fewer.</text></clause> 
<clause id="H3153E64DACC34E1DBDCB52AB16681C68"><enum>(ii)</enum><text>The agency is not designated pursuant to section 6(j)(2) as a troubled public housing agency.</text></clause> 
<clause id="H252B6FC9D7994A669F002BF2FCB02320"><enum>(iii)</enum><text>The agency provides assurances satisfactory to the Secretary that notwithstanding the inapplicability of the requirements under this section relating to resident advisory boards and public hearings and notice, residents of public housing administered by the agency will have an adequate and comparable opportunity for participation and notice regarding establishment of the goals, objectives, and policies of the public housing agency.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>

<section section-type="section-one" id="H2C07CE8F6A524DD98E2E7C9BF1A59800" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Public Housing Authority Act</short-title></quote>.</text></section> 
<section id="HAAEA016313CD4848A8EEBF292FF7A0DF"><enum>2.</enum><header>Public housing agency plans for certain small public housing agencies</header> 
<subsection id="HDADEE33569DA4C6084B9DFB25BA2EA99"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5A(b) of the <act-name parsable-cite="USHA">United States Housing Act of 1937</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1437c-1">42 U.S.C. 1437c–1(b)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H97181E35F275459296D99F6BBCFA2DC9"><enum>(3)</enum><header>Exemption of certain small phas from filing requirement</header> 
<subparagraph id="HB7A81665D0CC4D7D008F66FF05681F80"><enum>(A)</enum><header>In general</header><text>Notwithstanding paragraph (1) or any other provision of this Act—</text> 
<clause id="H7D50E71F88AE4428AE467004AA67CA35"><enum>(i)</enum><text>the requirement under paragraph (1) shall not apply to any qualified small public housing agency; and</text></clause> 
<clause id="HD9950EA98FDB4F90B78741E6666B2590"><enum>(ii)</enum><text>except as provided in subsection (e)(4)(B), any reference in this section or any other provision of law to a <quote>public housing agency</quote> shall not be considered to refer to any qualified small public housing agency, to the extent such reference applies to the requirement to submit an annual public housing agency plan under this subsection.</text></clause></subparagraph> 
<subparagraph id="H37D05E19A39C4189BA77F1CA4F708E16" display-inline="no-display-inline"><enum>(B)</enum><header>Civil rights certification</header><text display-inline="yes-display-inline">Notwithstanding that qualified small public housing agencies are exempt pursuant to subparagraph (A) from the requirement under this section to prepare and submit an annual public housing plan, each qualified small public housing agency shall, on an annual basis, make the certification described in paragraph (15) of subsection (d) of this section, except that for purposes of such small public housing agencies, such paragraph shall be applied by substituting <quote>the public housing program of the agency</quote> for <quote>the public housing agency plan</quote>.</text></subparagraph> 
<subparagraph id="HF3B74AB4CA114EDFAF9C869503474DAD"><enum>(C)</enum><header>Definition</header><text>For purposes of this section, the term <term>qualified small public housing agency</term> means a public housing agency that meets all of the following requirements:</text> 
<clause id="H70B6C2B52607452CA8E99418D2094DD5"><enum>(i)</enum><text>The sum of (I) the number of public housing dwelling units administered by the agency, and (II) the number of vouchers under section 8(o) of the <act-name parsable-cite="USHA">United States Housing Act of 1937</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>) administered by the agency, is 250 or fewer.</text></clause> 
<clause id="H26E81CA310544B1ABF29FC1FAA3C853B"><enum>(ii)</enum><text>The agency is not designated pursuant to section 6(j)(2) as a troubled public housing agency.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H673F0D107704443691A45425A28CB3EC"><enum>(b)</enum><header>Resident participation</header><text>Section 5A of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437c-1">42 U.S.C. 1437c–1</external-xref>) is amended—</text> 
<paragraph id="HBE2B3E2ABE274B51B12008DF3C1E19F1"><enum>(1)</enum><text>in subsection (e), by inserting after paragraph (3) the following:</text> 
<quoted-block style="OLC" id="H25C555C58ECC4328904B668C4F9CDF63" display-inline="no-display-inline"> 
<paragraph id="H39D8E85E574846C6BB81CE34102F4EC9"><enum>(4)</enum><header>Qualified small public housing agencies</header> 
<subparagraph id="H29839E28B76548B3BD94C400B8FC65A0"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), nothing in this section may be construed to exempt a qualified small public housing agency from the requirement under paragraph (1) to establish one or more resident advisory boards. Notwithstanding that qualified small public housing agencies are exempt pursuant to subsection (b)(3)(A) from the requirement under this section to prepare and submit an annual public housing plan, each qualified small public housing agency shall consult with, and consider the recommendations of the resident advisory boards for the agency, in any determinations and actions of the agency regarding establishing goals, objectives, and policies of the agency.</text></subparagraph> 
<subparagraph id="H75D4F531E9314A148FBBE391F403ABB8"><enum>(B)</enum><header>Applicability of waiver authority</header><text>Paragraph (3) shall apply to qualified small public housing agencies, except that for purposes of such small public housing agencies, subparagraph (B) of such paragraph shall be applied by substituting <quote>the functions described in the second sentence of paragraph (4)(A)</quote> for <quote>the functions described in paragraph (2)</quote>.</text></subparagraph></paragraph> 
<subsection id="H19189905300A4CF88ED146314DBAA2EB"><enum>(f)</enum><header>Public hearings</header></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H8D6BA45C49364FCDAE39194D57F0F932"><enum>(2)</enum><text>in subsection (f) (as so designated by the amendment made by paragraph (1) of this subsection), by adding at the end the following new paragraph: </text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HDB4DB114FDE2455097B79C427C3111F0"> 
<paragraph id="H4252091B9F8E4EEDAFB5545850920617"><enum>(5)</enum><header>Qualified small public housing agencies</header> 
<subparagraph id="H4AF97BE082C043D30037C62B79A8D948"><enum>(A)</enum><header>Requirement</header><text>Notwithstanding that qualified small public housing agencies are exempt pursuant to subsection (b)(3)(A) from the requirement under this section to conduct a public hearing regarding the annual public housing plan of the agency, each qualified small public housing agency shall, not less than annually, conduct a public hearing to discuss the goals, objectives, and policies of the agency, and any changes to such goals, objectives, and policies, and to invite public comment regarding such issues.</text></subparagraph> 
<subparagraph id="H7B9EA60F55814022AF008D1071AE8548"><enum>(B)</enum><header>Availability of information and notice</header><text>Not later than 45 days before the date of such a hearing, the qualified small public housing agency shall—</text> 
<clause id="H7111F3B4A1D540E58E0588D47E33F3CC"><enum>(i)</enum><text>make all information relevant to the hearing and any determinations of the agency regarding the goals, objectives, and policies of the agency to be considered at the hearing available for inspection by the public at the principal office of the public housing agency during normal business hours; and</text></clause> 
<clause id="H53C723312642467297FC422170789D90"><enum>(ii)</enum><text>publish a notice informing the public that (I) the information is available as required under clause (i), and (II) a public hearing under subparagraph (A) will be conducted.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
