<section id="H2B6E224266AE472190E2F9A02A1C7A7" section-type="section-one"><enum>1.</enum><header>Reauthorization of United States Grain Standards Act</header> 
<subsection id="HD03CD9446AE344B48CCCA0CBB5B4A333"><enum>(a)</enum><header>Inspection and supervisory fees</header><text display-inline="yes-display-inline">Section 7(j)(4) of the United States Grain Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/7/79">7 U.S.C. 79(j)(4)</external-xref>) is amended by striking <quote>September 30, 2005</quote> and inserting <quote>September 30, 2010</quote>.</text></subsection> 
<subsection id="H2E2AE00A014245DB9C48287D87164DE7"><enum>(b)</enum><header>Weighing and supervisory fees</header><text display-inline="yes-display-inline">Section 7A(l)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/79a">7 U.S.C. 79a(l)(3)</external-xref>) is amended by striking <quote>September 30, 2005</quote> and inserting <quote>September 30, 2010</quote>.</text></subsection> 
<subsection id="H7CFDA6C3B10C47DE996035B95E4EEC85"><enum>(c)</enum><header>Limitation on administrative and supervisory costs</header><text display-inline="yes-display-inline">Section 7D of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/79d">7 U.S.C. 79d</external-xref>) is amended by striking <quote>2005</quote> and inserting <quote>2010</quote>.</text></subsection> 
<subsection id="H2973BE2FC5C648BB89BAC2DB336C9F21"><enum>(d)</enum><header>Authorization of appropriations</header><text>Section 19 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/87h">7 U.S.C. 87h</external-xref>) is amended by striking <quote>2005</quote> and inserting <quote>2010</quote>.</text></subsection> 
<subsection id="HF045C33B46384C2FAE9727207B8BEC6F"><enum>(e)</enum><header>Advisory committee</header><text>Section 21(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/87j">7 U.S.C. 87j</external-xref>) is amended by striking <quote>September 30, 2005</quote> and inserting <quote>September 30, 2010</quote>.</text></subsection> 
<subsection id="HA91F556EEE1C47DFA35253C9A6FC6F8F"><enum>(f)</enum><header>Effective date</header><text>The amendments made by this section shall take effect as of September 30, 2005.</text></subsection></section> 
<section id="H88FACE5029B84861A641D55565D762A3" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Performance of official inspection and weighing activities at export port locations of grain under United States Grain Standards Act</header> 
<subsection id="H123B6DBC1F724CC0A700400021752286"><enum>(a)</enum><header>Official inspection authority and funding</header><text>Section 7 of the United States Grain Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/7/79">7 U.S.C. 79</external-xref>) is amended—</text> 
<paragraph id="H9396F57B84804E6B0046C423AA73C8F4"><enum>(1)</enum><text>in subsection (e)—</text> 
<subparagraph id="H7B9948814AB14B50A23FC888F56C9CE0"><enum>(A)</enum><text>by striking <quote>(e)(1) Except as otherwise provided in paragraph (2) of this subsection</quote> and inserting the following:</text>

<paragraph id="HA506BA3D638046338763BCC87CB7717B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise provided in paragraphs (2) and (3)</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H44B5CB4933B94B1FA138E35F58008BEC"><enum>(B)</enum><text>by striking paragraph (3) and inserting the following:</text>

<paragraph id="H4922958209054608B1FA78BBF69F356"><enum>(3)</enum><header>Use of private entities</header> 
<subparagraph id="HBF6EF14E88BC4EFBA6A11FCB8130A1C5"><enum>(A)</enum><header>In general</header><text>If the Secretary determines that a person or private entity is qualified to perform official inspection and meets the criteria of subsection (f)(1)(A), the Secretary may use the person or private entity to perform all or specified functions involved in official inspection (other than appeal inspection and such other functions as may be specified in the regulations prescribed under subparagraph (B)) at export port locations.</text></subparagraph> 
<subparagraph id="HE7D2D906AC914A24A074EE4436C22DBA"><enum>(B)</enum><header>Requirements</header> 
<clause id="H9C2BDDF34C8D4DCC91DEDA5CCEBF512D"><enum>(i)</enum><header>Regulations</header><text>A person or private entity described in subparagraph (A) shall be subject to such rules, regulations, instructions, and oversight as the Secretary may prescribe.</text></clause> 
<clause id="H39AFA3EE77544AA4AF038D2D72F4FD5F"><enum>(ii)</enum><header>Responsibility of Secretary</header><text display-inline="yes-display-inline">Notwithstanding the use of persons or private entities to perform specified functions involved in official inspections at export port locations, official inspection shall continue to be the direct responsibility of the Secretary.</text></clause></subparagraph> 
<subparagraph id="H8984C15D6F70409CB56E2EB1E4A95885"><enum>(C)</enum><header>Termination</header><text display-inline="yes-display-inline">The use of a person or private entity to perform official inspections at an export port location under subparagraph (A)—</text> 
<clause id="H8105671C573D403D8B09FEE723491A4"><enum>(i)</enum><text display-inline="yes-display-inline">shall terminate at the such time as specified by the Secretary, but not later than the date that is three years after the date of the initial performance of official inspections by the person or private entity at the export port location; and</text></clause> 
<clause id="H2E67724923D041269D33F6726401BE33"><enum>(ii)</enum><text display-inline="yes-display-inline">may be terminated by the Secretary, at the discretion of the Secretary, at any time after notice to the person or private entity without opportunity for a hearing.</text></clause></subparagraph> 
<subparagraph id="H156D53675BD94132B001B36BEC1DE3C"><enum>(D)</enum><header>Renewal</header><text>The use of a person or private entity to perform official inspections at an export port location under subparagraph (A) may be renewed in accordance with the regulations prescribed under subparagraph (B).</text></subparagraph> 
<subparagraph id="H31A6D36311CA4ABCA99EF5857654D16F"><enum>(E)</enum><header>Reporting requirement</header><text display-inline="yes-display-inline">Not later than February 15 of each even-numbered year, the Secretary shall submit to Congress a report detailing the Secretary’s use of the authority provided by subparagraph (A), during the preceding two-year period, to contract with persons or private entities to perform official inspections at export port locations. Each report shall identify each export port location at which the persons and private entities are used, the number of official inspection personnel utilized, and the types of official inspection and official weighing functions performed.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph>

<subparagraph id="HCCD11983EB8349B69411EF1087A200CF"><enum>(A)</enum><text>in paragraph (1)—</text> 
<clause id="HC9A598AEFBDF452EA900C85301277BD"><enum>(i)</enum><text>in the matter preceding subparagraph (A)—</text> 
<subclause id="HBE27549DB39F4D1D97EF8C0E1889688"><enum>(I)</enum><text>by inserting <quote>or private entity</quote> after <quote>or any person</quote>; and</text></subclause> 
<subclause id="H040D6030E5F741BD81A9603180EC31A7"><enum>(II)</enum><text>by striking <quote>or person</quote> and inserting <quote>, person, or private entity</quote>; and</text></subclause></clause>

<subparagraph id="H6B5732FCB03E4E3D8CCCBE4929E3C6B"><enum>(B)</enum><text>in paragraph (4), by striking <quote>or person</quote> and inserting <quote>, person, or private entity</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H588C2D652EBB4B2CB77F8CC74C7B7638"><enum>(3)</enum><text>in subsection (j)—</text> 
<subparagraph id="HE3661B8B6C7B47DC882FE45B27EE73A1"><enum>(A)</enum><text>in the first sentence of paragraph (2), by inserting <quote>and private entity</quote> after <quote>each State agency</quote>; and</text></subparagraph> 
<subparagraph id="H1503DBB1D04B4BDF937E45823100B873"><enum>(B)</enum><text>in the first sentence of paragraph (4), by striking <quote>and State agencies</quote> and inserting <quote>and delegated State agencies and private entities</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H5CA92BC500D44FDBBCB8217614500603"><enum>(b)</enum><header>Weighing authority</header><text>Section 7A of the United States Grain Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/7/79a">7 U.S.C. 79a</external-xref>) is amended—</text> 
<paragraph id="HCCA56BAA36F74723B1E4E546F675D637"><enum>(1)</enum><text>in subsection (c)(2)—</text> 
<subparagraph id="HEDFDAAB103B6408BBB16F6586E17FC00"><enum>(A)</enum><text>in the first sentence—</text>

<paragraph id="HEDA862FC6CD64799005237CC78183CE6"><enum>(1)</enum><text>by inserting <quote>or private entities</quote> after <quote>State agencies</quote>; and</text></paragraph> 
<paragraph id="HC8C7CA2F79164779874E13CDCF00BA7B"><enum>(2)</enum><text>by inserting <quote>or private entities</quote> after <quote>all persons</quote>.</text></paragraph></subsection></section> 
<section id="H69ED4D14BA144CF6A96EDFBB993CEED5"><enum>3.</enum><header>Inapplicability of geographic boundaries for designated official agencies</header> 
<subsection id="H9FCC4BEE3B984FEB8CFF41483BFDCF95"><enum>(a)</enum><header>Official inspection</header><text display-inline="yes-display-inline">Subsection (f) of section 7 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/79">7 U.S.C. 79</external-xref>) is amended—</text> 
<paragraph id="HEA3988FD1F4A472182F9AAD1C492CCD8"><enum>(1)</enum><text>in paragraph (2), by striking <quote>Not more than one official agency designated under paragraph (1) or State delegated authority under subsection (e)(2)</quote> and inserting <quote>Subject to paragraph (5), not more than one official agency designated under paragraph (1)</quote>; and</text></paragraph> 
<paragraph id="HFFB600D3D2804EAFA77E02BF54AF0000"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H197A22C5D0F746A690F984FC2CEC72F" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">The geographic boundary limitations applicable to official agencies under paragraph (2) do not apply to export port locations, and the Secretary may use more than one person or private entity selected under subsection (e)(3) to perform official inspections at an export port location.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H3440C33053574D28A586F695A6E4B720"><enum>(b)</enum><header>Official weighing</header><text>Subsection (i) of section 7A of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/79a">7 U.S.C. 79a</external-xref>) is amended—</text> 
<paragraph id="H146A581F40F34141A5892C3952BF8FAD"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>Not more than one designated official agency referred to in paragraph (1) or State agency delegated authority pursuant to subsection (c)(2)</quote> and inserting <quote>Subject to paragraph (3), not more than one designated official agency referred to in paragraph (1)</quote>; and</text></paragraph> 
<paragraph id="H5B73D6B63DBD4F17B0725FEE466C65DF"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>
