<section commented="no" display-inline="no-display-inline" id="HBAA4A12D014E41EF9F71FE3505005B9B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>United States Workers Protection Act of 2005</short-title></quote>.</text></section>
<section commented="no" display-inline="no-display-inline" id="H859DE7FFD61A4C4FB547C9FCB7BE3203" section-type="subsequent-section"><enum>2.</enum><header>Limitations on off-shore performance of contracts</header>
<subsection commented="no" display-inline="no-display-inline" id="HE51F0F5FB6A148708B30198180C4761B"><enum>(a)</enum><header>Limitations</header>
<paragraph commented="no" display-inline="no-display-inline" id="H994B6462570D4F09BF117276B447EA56"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/403">41 U.S.C. 403 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section commented="no" display-inline="no-display-inline" id="H730EA95822D245978FC7C3AE750573FF" section-type="subsequent-section"><enum>42.</enum><header>Limitations on off-shore performance of contracts</header>
<subsection commented="no" display-inline="no-display-inline" id="H3AB69D6D99D1411EAC98B99E08A4CBB8"><enum>(a)</enum><header>Conversions to contractor performance of Federal activities</header><text display-inline="yes-display-inline">An activity or function of an executive agency that is converted to contractor performance under Office of Management and Budget Circular A–76 may not be performed by the contractor or any subcontractor at a location outside the United States except to the extent that such activity or function was previously performed by Federal Government employees outside the United States.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HFE5B085B5D09449697494E2EA6C698C7"><enum>(b)</enum><header>Other Federal contracts</header>
<paragraph commented="no" display-inline="yes-display-inline" id="H38BFD6E78BE7439983A6319378501D73"><enum>(1)</enum><text display-inline="yes-display-inline">A contract that is entered into by the head of an executive agency may not be performed outside the United States except to meet a requirement of the executive agency for the contract to be performed specifically at a location outside the United States.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD38319A19C094B248685908BDC00131" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The prohibition in paragraph (1) does not apply in the case of a contract of an executive agency if—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H527E91C3B7584652853D6667EE254CF5"><enum>(A)</enum><text display-inline="yes-display-inline">the President determines in writing that it is necessary in the national security interests of the United States for the contract to be performed outside the United States; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HC3F0F888316242DF99B520C844117660"><enum>(B)</enum><text display-inline="yes-display-inline">the head of such executive agency makes a determination and reports such determination on a timely basis to the Director of the Office of Management and Budget that—</text>
<clause commented="no" display-inline="no-display-inline" id="H37CAFD5E07864821BEC9DA2E8E1600A9"><enum>(i)</enum><text display-inline="yes-display-inline">the property or services needed by the executive agency are available only by means of performance of the contract outside the United States; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H1FE4EB33D2FB41699B9213AF77D10009"><enum>(ii)</enum><text display-inline="yes-display-inline">no property or services available by means of performance of the contract inside the United States would satisfy the executive agency's need.</text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H0937948C246744398380673681774402" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Paragraph (1) does not apply to the performance of a contract outside the United States under the exception provided in subsection (a).</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H0987B6F410634F6A8BCF052055B3C061"><enum>(c)</enum><header>State contracts</header>
<paragraph commented="no" display-inline="yes-display-inline" id="H2C836BF6E984484491F11EE27BB8025"><enum>(1)</enum><text display-inline="yes-display-inline">Except as provided in paragraph (2), funds appropriated for financial assistance for a State may not be disbursed to or for such State during a fiscal year unless the chief executive of that State has transmitted to the Administrator for Federal Procurement Policy, not later than April 1 of the preceding fiscal year, a written certification that none of such funds will be expended for the performance outside the United States of contracts entered into by such State.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H5722CDE68A2A4906B2886000B1328CB4" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The prohibition on disbursement of funds to or for a State under paragraph (1) does not apply with respect to the performance of a State contract outside the United States if—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HA3E7445C4A11434E9CC5793F6C47EC3"><enum>(A)</enum><text display-inline="yes-display-inline">the chief executive of such State—</text>
<clause commented="no" display-inline="no-display-inline" id="HE72DDBE995F4431FB688CE9BA2553745"><enum>(i)</enum><text display-inline="yes-display-inline">determines that the property or services needed by the State are available only by means of performance of the contract outside the United States and no property or services available by means of performance of the contract inside the United States would satisfy the State's need; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HC30520F6FC7E49E49E3B4DB3326886D8"><enum>(ii)</enum><text display-inline="yes-display-inline">transmits a notification of such determination to the head of the executive agency of the United States that administers the authority under which such funds are disbursed to or for the State; and</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H4DA09376834241BFBAF8950317F080F7"><enum>(B)</enum><text display-inline="yes-display-inline">the head of the executive agency receiving the notification of such determination—</text>
<clause commented="no" display-inline="no-display-inline" id="HBAB89BA3A1824DA2B5C9681E6C9ED1A0"><enum>(i)</enum><text display-inline="yes-display-inline">confirms that the facts warrant the determination;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HAA21E070FA1942B0BC15D0063397967"><enum>(ii)</enum><text display-inline="yes-display-inline">approves the determination; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HCD0E41D975C74725B69271623F8B8FB9"><enum>(iii)</enum><text display-inline="yes-display-inline">transmits a notification of the approval of the determination to the Director of the Office of Management and Budget.</text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H691CC71E61FE42B7A32028655975F211" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In this subsection, the term `State' means each of the several States of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, the Virgin Islands, Guam, American Samoa, and the Trust Territory of the Pacific Islands.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H3BF61359E712401CB210FF00E7F7FC3"><enum>(d)</enum><header>Inapplicability of limitations</header><text display-inline="yes-display-inline">The limitations in subsections (b) and (c) shall not apply to procurement covered by the Agreement on Government Procurement of the World Trade Organization (as described in section 101(d)(17) of the Uruguay Round Agreement Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3511">19 U.S.C. 3511(d)(17)</external-xref>)).</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HD1DFA3324B1C49E3B5A7BEF24FB1815F"><enum>(e)</enum><header>Responsibilities of OMB</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H6048ED74841D45C6B2A5E6F5C5F5428E"><enum>(1)</enum><text display-inline="yes-display-inline">maintain—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HD4A5A24E293444C4A932202F866FBE08"><enum>(A)</enum><text display-inline="yes-display-inline">the waivers granted under subsection (b)(2), together with the determinations and certifications on which such waivers were based; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H0CE527779C724167AFA13C00A85D20BB"><enum>(B)</enum><text display-inline="yes-display-inline">the notifications received under subsection (c)(2)(B)(iii); and</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H7D535052506B462AB6BFF9BB60F590CB"><enum>(2)</enum><text display-inline="yes-display-inline">submit to Congress promptly after the end of each quarter of each fiscal year a report that sets forth—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H7B962276A93D4D97825862A2C94E758"><enum>(A)</enum><text display-inline="yes-display-inline">the waivers that were granted under subsection (b)(2) during such quarter; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H81CDE700C88E4304B0005386D99705D0"><enum>(B)</enum><text display-inline="yes-display-inline">the notifications that were received under subsection (c)(2)(B)(iii) during such quarter.</text></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HEC6BB8293C544BD3A689AC70A171D69F"><enum>(f)</enum><header>Annual GAO review</header><text display-inline="yes-display-inline">The Comptroller General shall—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HAA61E91F7BF14A40842D64131310D6B8"><enum>(1)</enum><text display-inline="yes-display-inline">review, each fiscal year, the waivers granted during such fiscal year under subsection (b)(2) and the disbursements of funds authorized pursuant to the exception in subsection (c)(2); and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H8948CC08D88747998DC299C3035D8C4"><enum>(2)</enum><text display-inline="yes-display-inline">promptly after the end of such fiscal year, transmit to Congress a report containing a list of the contracts covered by such waivers and exception together with a brief description of the performance of each such contract outside the United States.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H861C103F1F234047B354AF8338E908C5"><enum>(2)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections in section 1(b) of such Act is amended by adding at the end the following new item:</text>

<toc-entry level="section">Sec. 42. Limitations on off-shore performance of contracts</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HDD28E5D898B44EF9874FD8069754BE87"><enum>(b)</enum><header>Inapplicability to States during first two fiscal years</header><text display-inline="yes-display-inline">Section 42(c) of the Office of Federal Procurement Policy Act (as added by subsection (a)) shall not apply to disbursements of funds to a State during the fiscal year in which this Act is enacted and the next fiscal year.</text></subsection></section>
<section commented="no" display-inline="no-display-inline" id="H5ADDC9C95BBE416F9C1BAA5C03B448F" section-type="subsequent-section"><enum>3.</enum><header>Repeal of superseded law</header>
<subsection commented="no" display-inline="no-display-inline" id="H59DBE4670E1A40D6942425E4FC692CB4"><enum></enum><text display-inline="yes-display-inline">Section 647 of the Transportation, Treasury, and Independent Agencies Appropriations Act, 2004 (division F of <external-xref legal-doc="public-law" parsable-cite="pl/108/199">Public Law 108–199</external-xref>) is amended by striking subsection (e).</text></subsection></section>
<section commented="no" display-inline="no-display-inline" id="HF56FB141BBE44DFABFC2F5075195CDC" section-type="subsequent-section"><enum>4.</enum><header>Effective date and applicability</header>
<subsection commented="no" display-inline="no-display-inline" id="H1C85AE10A1AC4692A5B303CAC7F6982"><enum></enum><text display-inline="yes-display-inline">This Act and the amendments made by this Act shall take effect 30 days after the date of the enactment of this Act and, subject to subsection (b) of section 2, shall apply with respect to new contracts entered into on or after such date.</text></subsection></section>
