<section id="H01D68C26971C42879BD6F83FA377103" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stronger Families Act</short-title></quote>.</text></section> 
<section id="HC93D1E09A00D4164B0629E1200F671E"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text> 
<paragraph id="HCFDEB7E66C474990A64ED0009FDE1578"><enum>(1)</enum><text display-inline="yes-display-inline">By enacting the Adoption and Safe Families Act of 1997 (<external-xref legal-doc="public-law" parsable-cite="pl/105/89">Public Law 105–89</external-xref>) and the Adoption Assistance and Child Welfare Act of 1980 (<external-xref legal-doc="public-law" parsable-cite="pl/96/272">Public Law 96–272</external-xref>), the Congress recognized the need to align Federal incentives with the desired goal of providing abused and neglected children safe, permanent homes.</text></paragraph> 
<paragraph id="H5A4053540DCF4996BA00E8F90C7C16F"><enum>(2)</enum><text display-inline="yes-display-inline">According to the nonpartisan Pew Commission on Children in Foster Care composed of former Members of Congress of both parties and other child welfare experts, between 1997 and 2002, adoptions increased by 64 percent, and each state, the District of Columbia, and Puerto Rico has earned an award for increasing adoptions.</text></paragraph> 
<paragraph id="H8422E7E6BA7844C889209DCE06351B00"><enum>(3)</enum><text display-inline="yes-display-inline">Adoption represents only one avenue to permanency for children in the foster care system, affecting only 9 percent of children in foster care in 2003. Adoption is not a viable option for many children in foster care. Children living with relatives are less likely to use adoption, and courts explicitly rule out this permanency option for thousands of children each year.</text></paragraph> 
<paragraph id="HA155A055E43A41C1A18C5CCE55547CF2"><enum>(4)</enum><text display-inline="yes-display-inline">Moreover, adoption is not equally available to children of all races and ethnicities. African-American children live in kinship care arrangements more than in other types of care arrangements and have a lower rate of adoption than other children, making reunification and legal guardianship important permanency options for this population.</text></paragraph> 
<paragraph id="H31B83E080D2648629756B239C6A74F3E"><enum>(5)</enum><text display-inline="yes-display-inline">Reunification and guardianship are central avenues by which any child in foster care may enter stable, caring homes. In 2002, 54 percent of children in foster care were reunified with their parents and 4 percent obtained legal guardianship.</text></paragraph> 
<paragraph id="HF3160A4E276B4FFBB8A2D868DA526D4E"><enum>(6)</enum><text display-inline="yes-display-inline">Moreover, Federal guidelines create a financial disincentive to legal guardianship because all Federal support ceases once guardianship is established, presenting an overwhelming hardship for caretakers given the known health and mental health problems of children who have been in foster care. Research indicates that 30 to 40 percent of youth in foster care experience chronic medical problems.</text></paragraph> 
<paragraph id="HD3F2C8A8052B4CBC92DF296F1866F03E"><enum>(7)</enum><text>To help meet the needs of foster children with special needs who are adopted, approximately $308 per month in Federal funds is provided to their adoptive families. The Federal Government pays approximately $383 per month to cover all adoption assistance program costs, including monthly payments to families, administration, and training.</text></paragraph> 
<paragraph id="H17E0DD251E924AB598C1171824933BF2"><enum>(8)</enum><text display-inline="yes-display-inline">Remaining in foster care when stable, permanent homes are available places unnecessary burdens on States, caseworkers, and families, requiring regular court appearances, quarterly case reviews, monthly caseworker visits, and government involvement in routine family activities and decisions.</text></paragraph> </section> 
<section id="HC6102200A3F448F8B2DE3D00373EE300"><enum>3.</enum><header>Permanency incentive payments</header> 
<subsection id="H9C816F26A70D4F8AA154281E8F7E49FF"><enum>(a)</enum><header>In general</header><text>Section 473A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673a">42 U.S.C. 673a</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="HB6790FDDE4924D5F9DEEA65452D6735C" display-inline="no-display-inline"> 
<section id="HD428642CE87F44D0A8CE90E6792F89EE"><enum>473A.</enum><header>Permanency incentive payments</header> 
<subsection id="H92D121FAD9A04D42B795A3F7954C9EB4"><enum>(a)</enum><header>Grant authority</header><text>Subject to the availability of such amounts as may be provided in advance in appropriations Acts for this purpose, the Secretary shall make a grant to each State that is an incentive-eligible State for a fiscal year in an amount equal to the permanency incentive payment payable to the State under this section for the fiscal year, which shall be payable in the immediately succeeding fiscal year.</text></subsection> 
<subsection id="HAD5D2611B0384B8400E6AA3EEBFA76CF"><enum>(b)</enum><header>Incentive-eligible State</header><text>A State is an incentive-eligible State for a fiscal year if—</text> 
<paragraph id="H6D42E8911D504A86000048FC8E7CFC62"><enum>(1)</enum><text>the State has a plan approved under this part for the fiscal year;</text></paragraph> 
<paragraph id="H3B5FFC8767794373ACF555262DCF869E"><enum>(2)</enum> 
<subparagraph display-inline="yes-display-inline" id="H98CECAF935AD42F3B468552DC2977400"><enum>(A)</enum> 
<clause id="H8C700D995B724A47B25107BD9BAFA5FB" display-inline="yes-display-inline"><enum>(i)</enum><text>the foster child adoption rate for the State for the fiscal year exceeds the base foster child adoption rate for the State for the fiscal year; or</text></clause> 
<clause id="H490574710CF945F8A5112D7500D3B935" indent="up2"><enum>(ii)</enum><text>the older child adoption rate for the State for the fiscal year exceeds the base older child adoption rate for the State for the fiscal year;</text></clause></subparagraph> 
<subparagraph id="H883CD928759E4514A8F0576FD1491E6" display-inline="no-display-inline" indent="up1"><enum>(B)</enum> 
<clause id="H4A10F438D420476FAFFC91A5D36F00E9" display-inline="yes-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the guardianship placement rate for the State for the fiscal year exceeds the base guardianship placement rate for the State for the fiscal year; or</text></clause> 
<clause id="H12D39CF19D1B4B90009D1EE3F21D4FD5" display-inline="no-display-inline" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the older child guardianship placement rate for the State for the fiscal year exceeds the base older child guardianship placement rate for the State for the fiscal year; or</text></clause></subparagraph> 
<subparagraph id="H726057F7484D43D894C475F94766357C" indent="up1" display-inline="no-display-inline"><enum>(C)</enum><text>the reunification rate for the State for the fiscal year exceeds the base reunification rate for the State for respect to the fiscal year;</text> </subparagraph> </paragraph> 
<paragraph id="HD6EA24E7EDB64DADB8D6823B7F9070DE"><enum>(3)</enum><text>the State is in compliance with subsection (c) for the fiscal year;</text></paragraph> 
<paragraph id="H1D88766F5A1E4452AB6618B802AD2B39"><enum>(4)</enum><text>the State provides health insurance coverage to any child with special needs (as determined under section 473(c)) for whom there is in effect—</text> 
<subparagraph id="H4D8923ABF16A4C2F80E2933DB563C4FB"><enum>(A)</enum><text>an adoption assistance agreement between a State and the adoptive parent or parents of the child; or</text></subparagraph> 
<subparagraph id="H91D1659E59AE43770093D6D5B42496EA"><enum>(B)</enum><text>a guardianship agreement between a State and the legal guardian or guardians of the child; and</text></subparagraph></paragraph> 
<paragraph id="H100AED9B7DB240E187D96430FD5EC05B"><enum>(5)</enum><text>the fiscal year is fiscal year 2006 or 2007.</text></paragraph></subsection> 
<subsection id="HFEC05CD0646344E0A8147DDBE646FD00"><enum>(c)</enum><header>Data requirements</header> 
<paragraph id="HE9A993FFB4714EAE9056FC3ECA3FC263"><enum>(1)</enum><header>In general</header><text>A State is in compliance with this subsection for a fiscal year if the State has provided to the Secretary the data described in paragraph (2)—</text> 
<subparagraph id="H51D3030E01404935A99E5F693CF2A073"><enum>(A)</enum><text>for fiscal years 2004 and 2005 (or, if the 1st fiscal year for which the State seeks a grant under this section is after fiscal year 2006, the 2 fiscal years most immediately preceding such 1st fiscal year); and</text></subparagraph> 
<subparagraph id="H7CCBA1DAF6AC448D9043995483AA1657"><enum>(B)</enum><text>for each fiscal year that succeeds the 2 fiscal years specified or referred to in subparagraph (A) and that precedes the fiscal year referred to in this paragraph in the matter preceding subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="H0A73F0B1A7634905AFDCFC1C4461C0D3"><enum>(2)</enum><header>Determination of permancy placement rates based on afcars data</header><text display-inline="yes-display-inline">The Secretary shall determine the rates of each type of adoption, guardianship placement, and reunification described in this section in each State with respect to each of fiscal years 2006 and 2007 on the basis of data meeting the requirements of the system established pursuant to section 479, as reported by the State and approved by the Secretary by August 1 of the succeeding fiscal year.</text></paragraph> 
<paragraph id="H43B2FA3521904C9A82BD70B3587E2F27"><enum>(3)</enum><header>No waiver of afcars requirements</header><text>This section shall not be construed to alter or affect any requirement of section 479 or of any regulation prescribed under such section with respect to reporting of data by States, or to waive any penalty for failure to comply with such a requirement.</text></paragraph></subsection> 
<subsection id="HF5685E38A38F4D0DBD1FB7F97B494DC3"><enum>(d)</enum><header>Permanency incentive payment</header> 
<paragraph id="H7D747A4C9B214272AF596700BDDFCE27"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the permanency incentive payment payable to a State for a fiscal year under this section shall be equal to the sum of—</text> 
<subparagraph id="H2DD8AE378F854C0D94E43BE2D9C4C21"><enum>(A)</enum><text display-inline="yes-display-inline">$3,000, multiplied by the amount (if any) by which the sum of the number of foster child adoptions, the number of guardianship placements, and the number of reunifications for the State for the fiscal year exceeds the sum of—</text> 
<clause id="HA61E986D7378472797C4B2F17400199D"><enum>(i)</enum><text>the number of foster child adoptions for the State for the fiscal year multiplied by the base foster child adoption rate for the State for the fiscal year;</text></clause> 
<clause id="H29B5A42FF26441FF9B6DF26C00D8F724"><enum>(ii)</enum><text>the number of guardianship placements for the State for the fiscal year multiplied by the base guardianship placement rate for the State for the fiscal year; and</text></clause> 
<clause id="HFF2BB49A6F944B9AB692BAAF00C3C8D3"><enum>(iii)</enum><text>the number of reunifications for the State for the fiscal year multiplied by the base reunification rate for the State for the fiscal year;</text></clause></subparagraph> 
<subparagraph id="H939AE6C351384D36B23D582731B347C9"><enum>(B)</enum><text display-inline="yes-display-inline">$1,500, multiplied by the amount (if any) by which the sum of the number of special needs adoptions that are not older child adoptions and the number of special needs guardianship placements that are not older child guardianship placements for the State for the fiscal year exceeds the sum of—</text> 
<clause id="H5CBA3E861AC04035A7BBB1714F46723"><enum>(i)</enum><text display-inline="yes-display-inline">the number of special needs adoptions that are not older child adoptions for the State for the fiscal year, multiplied by the base rate of special needs adoptions that are not older child adoptions for the State for the fiscal year; and</text></clause> 
<clause id="H7014488375944A9FB6791D2FF7607236"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of special needs guardianship placements that are not older child guardianship placements for the State for the fiscal year, multiplied by the base rate of special needs guardianship placements that are not older child guardianship placements for the State for the fiscal year; and</text></clause></subparagraph> 
<subparagraph id="H1CED563943814E12897E3B3C4383F402"><enum>(C)</enum><text>$3,000, multiplied by the amount (if any) by which the sum of the number of older child adoptions and the number of older child guardianship placements for the State for the fiscal year exceeds the sum of—</text> 
<clause id="H2F5F0CF520DF467AA85551FC350721BD"><enum>(i)</enum><text>the number of older child adoptions for the State for the fiscal year, mutiplied by the base older child adoption rate for the State for the fiscal year; and</text></clause> 
<clause id="HEA7F4A43D21D40E5BD00EE82068ED222"><enum>(ii)</enum><text>the number of older child guardianship placements for the State for the fiscal year, mutiplied by the base older child guardianship placement rate for the State for the fiscal year.</text></clause></subparagraph></paragraph> 
<paragraph id="HC0C8487BDA0B47059D7265F35D006CBA"><enum>(2)</enum><header>Pro rata adjustment if insufficient funds available</header><text>For any fiscal year, if the total amount of permanency incentive payments otherwise payable under this section for a fiscal year exceeds the amount appropriated pursuant to subsection (h) for the fiscal year, the amount of the permanency incentive payment payable to each State under this section for the fiscal year shall be—</text> 
<subparagraph id="H6CB60483C7824253BD466F18D6AABB1F"><enum>(A)</enum><text>the amount of the permanency incentive payment that would otherwise be payable to the State under this section for the fiscal year; multiplied by</text></subparagraph> 
<subparagraph id="HFE0DFF380F90472100E834C4219CB47"><enum>(B)</enum><text>the percentage represented by the amount so appropriated for the fiscal year, divided by the total amount of permanency incentive payments otherwise payable under this section for the fiscal year.</text></subparagraph></paragraph></subsection> 
<subsection id="H2882F217348E48CCAE53C5AF79A2B4F9"><enum>(e)</enum><header>2-year availability of incentive payments</header><text>Payments to a State under this section in a fiscal year shall remain available for use by the State through the end of the succeeding fiscal year.</text></subsection> 
<subsection id="H00B6B48E1F5C44CBBEC6264F89688942"><enum>(f)</enum><header>Limitations on use of incentive payments</header><text>A State shall not expend an amount paid to the State under this section except to provide to children or families any service (including post-permanency services) that may be provided under part B or E. Amounts expended by a State in accordance with the preceding sentence shall be disregarded in determining State expenditures for purposes of Federal matching payments under sections 423, 434, and 474.</text></subsection> 
<subsection id="HD7C3E3A4DA3543EEAA60A233243BFF1D"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H4CD61852EAA14B88B04C43BA45E1E37"><enum>(1)</enum><header>Foster child adoption</header><text display-inline="yes-display-inline">The term <term>foster child adoption</term> means, with respect to a State and a fiscal year, a final adoption of a child if—</text> 
<subparagraph id="H7056FA256E2D4FE3B09000B02BFDBF70"><enum>(A)</enum><text>at the time of adoptive placement, the child was in foster care under the supervision of the State; and</text></subparagraph> 
<subparagraph id="H6F57B80A00024D1BBAADA4E88C006E76"><enum>(B)</enum><text>during the fiscal year, the period for which the adoption has lasted has become 12 months.</text></subparagraph></paragraph> 
<paragraph id="HEB08621173974FF583C10B19E34A2C7"><enum>(2)</enum><header>Special needs adoption</header><text display-inline="yes-display-inline">The term <term>special needs adoption</term> means, with respect to a State and a fiscal year, a final adoption of a child if—</text> 
<subparagraph id="H5E8409509588476B8C90C69836D3EF5B"><enum>(A)</enum><text>there is in effect for the child an adoption assistance agreement entered into by the State under section 473;</text></subparagraph> 
<subparagraph id="H723B071AB76D4E039D93A2A7B18E5BB7"><enum>(B)</enum><text>the child is a child with special needs for purposes of this section; and</text></subparagraph> 
<subparagraph id="HA04CAAF183E44F6881C2D7D9215D06B"><enum>(C)</enum><text>during the fiscal year, the period for which the adoption has lasted has become 12 months.</text></subparagraph></paragraph> 
<paragraph id="H2CFC29E2CBB94C8F9E3B2BBD37EE290"><enum>(3)</enum><header>Older child adoption</header><text display-inline="yes-display-inline">The term <term>older child adoption</term> means, with respect to a State and a fiscal year, the final adoption in the State of a child who has attained 9 years of age if—</text> 
<subparagraph id="HAF6E701899F44E7BB7A700FC25009501"><enum>(A)</enum> 
<clause id="HAD2E66AD7E934F0C9E33D1FF4331C75" display-inline="yes-display-inline"><enum>(i)</enum><text>at the time of the adoptive placement, the child was in foster care under the responsibility of the State; or</text></clause> 
<clause id="H45F11B127AC848859056F8501763444B" indent="up1"><enum>(ii)</enum><text>an adoption assistance agreement for the child is in effect under section 473 with respect to the child; and</text></clause></subparagraph> 
<subparagraph id="H695F88FF626945BD002EBF4627683FA8"><enum>(B)</enum><text>during the fiscal year, the period for which the adoption has lasted has become 12 months.</text></subparagraph> </paragraph> 
<paragraph id="H095E4520015E409C9F7DA8A2C7D95D00"><enum>(4)</enum><header>Guardianship placement</header><text display-inline="yes-display-inline">The term <term>guardianship placement</term> means, with respect to a State and a fiscal year, the placement of a child with a caretaker pursuant to a legal guardianship if—</text> 
<subparagraph id="H8DB9959DD70C4466B7021BAA15968400"><enum>(A)</enum><text>immediately before the placement, the child had been in foster care under the responsibility of the State for no less than 12 months;</text></subparagraph> 
<subparagraph id="H63D2E7898E91440FB7A976C9D15F596C"><enum>(B)</enum><text>the State has determined that neither being returned home nor being adopted is an appropriate permanency option for the child; and</text></subparagraph> 
<subparagraph id="H7A4472CF38024594ACE0794D4C9DB5C1"><enum>(C)</enum><text>during the fiscal year, the period for which the placement has lasted has become 12 months.</text></subparagraph></paragraph> 
<paragraph id="H5D0D13CA1768421388395FFE254ECBF8" display-inline="no-display-inline"><enum>(5)</enum><header>Special needs guardianship placement</header><text display-inline="yes-display-inline">The term <term>special needs guardianship placement</term> means, with respect to a fiscal year, a guardianship placement, with respect to the fiscal year, of a child with special needs.</text></paragraph> 
<paragraph id="HC20D984DFA7B422E816C00D6006972F7" display-inline="no-display-inline"><enum>(6)</enum><header>Older child guardianship placement</header><text display-inline="yes-display-inline">The term <term>older child guardianship placement</term> means, with respect to a State and a fiscal year, a guardianship placement of a child who has attained 9 years of age if, at the time of the guardianship placement, the child was in foster care under the supervision of the State.</text></paragraph> 
<paragraph id="HDED95F98BE7148CCA100FE98A178A0E6"><enum>(7)</enum><header>Reunification</header><text display-inline="yes-display-inline">The term <term>reunification</term> means, with respect to a State and a fiscal year, the reuniting of a child who is in foster care under the responsibility of the State with the family from whom the child was removed if—</text> 
<subparagraph id="HD85817C25B964C009D00CADF860209C1"><enum>(A)</enum><text>immediately before the reuniting, the child had been in such care for not less than 1 month; and</text></subparagraph> 
<subparagraph id="H5A776368F5FD4F7ABD6D4FD5918E4128"><enum>(B)</enum><text>during the fiscal year, the period for which the child has remained reunited with the family has become 12 months</text></subparagraph></paragraph> 
<paragraph id="HAB821843C7754627B0F0CDD7FEA75C6C" display-inline="no-display-inline"><enum>(8)</enum><header>Foster child adoption rate</header><text display-inline="yes-display-inline">The term <term>foster child adoption rate</term> means, with respect to a State and a fiscal year, of the children in foster care under the responsibility of the State, the percentage who became subject to a foster child adoption during the fiscal year.</text> </paragraph> 
<paragraph id="H09417FCAF59743F18176FC8400285B94"><enum>(9)</enum><header>Base foster child adoption rate</header><text>The term <term>base foster child adoption rate</term> means, with respect to a State and—</text> 
<subparagraph id="HC0DFA736703F4C66BD9F00F2E79A97F"><enum>(A)</enum><text>fiscal year 2006, the foster child adoption rate for the State for fiscal year 2005; or</text></subparagraph> 
<subparagraph id="H9CD4D56344B4422AAC2831C6FEF3D65"><enum>(B)</enum><text>any subsequent fiscal year, the foster child adoption rate for the State for the fiscal year for which the rate is the greatest in the period that begins with fiscal year 2005 and ends with the fiscal year preceding that subsequent fiscal year.</text></subparagraph></paragraph> 
<paragraph id="H2D7B312FA2CC488FA674B8F135EB4214" display-inline="no-display-inline"><enum>(10)</enum><header>Older child adoption rate</header><text display-inline="yes-display-inline">The term <term>older child adoption rate</term> means, with respect to a State and a fiscal year, of the children in foster care under the responsibility of the State, the percentage who—</text> 
<subparagraph id="H6F04816FFCF64774AB2F1801D7B79DD4"><enum>(A)</enum><text display-inline="yes-display-inline">have attained 9 years of age; and</text></subparagraph> 
<subparagraph id="H06886274079A4BCB9CF29600204CC4A9"><enum>(B)</enum><text>became subject to an older child adoption during the fiscal year.</text></subparagraph></paragraph> 
<paragraph id="H96040BB59E244784BEF95916C0BA51D"><enum>(11)</enum><header>Base older child adoption rate</header><text>The term <term>base older child adoption rate</term> means, with respect to a State and—</text> 
<subparagraph id="H134EA85EB1814E498DF89D51D21D329C"><enum>(A)</enum><text>fiscal year 2006, the older child adoption rate for the State for fiscal year 2005; and</text></subparagraph> 
<subparagraph id="H9D636C830FB546DF816820878B67C5E3"><enum>(B)</enum><text>any subsequent fiscal year, the older child adoption rate for the State for the fiscal year for which the rate is the greatest in the period that begins with fiscal year 2005 and ends with the fiscal year preceding that subsequent fiscal year.</text></subparagraph></paragraph> 
<paragraph id="H85CCD225D46E414C8FCFAFE38D476BD6" display-inline="no-display-inline"><enum>(12)</enum><header>Guardianship placement rate</header><text display-inline="yes-display-inline">The term <term>guardianship placement rate</term> means, with respect to a State and a fiscal year, of the children in foster care under the responsibility of the State, the percentage who became subject to a guardianship placement during the fiscal year.</text></paragraph> 
<paragraph id="H953CDC5E3A2B49CDB47DFBF397C824C0" display-inline="no-display-inline"><enum>(13)</enum><header>Base guardianship placement rate</header><text>The term <term>base guardianship placement rate</term> means, with respect to a State and—</text> 
<subparagraph id="HDD5663B54D0D4F43B9962D47F8411DE4"><enum>(A)</enum><text>fiscal year 2006, the guardianship placement rate for the State for fiscal year 2005; or</text></subparagraph> 
<subparagraph id="H4B63F8D00FB84E9598B14CDF261FFCC"><enum>(B)</enum><text display-inline="yes-display-inline">any subsequent fiscal year, the guardianship placement rate for the State for the fiscal year for which the rate is the greatest in the period that begins with fiscal year 2005 and ends with the fiscal year preceding that subsequent fiscal year.</text></subparagraph></paragraph> 
<paragraph id="H00075615621843AC97A2B128DB31B604" display-inline="no-display-inline"><enum>(14)</enum><header>Older child guardianship placement rate</header><text display-inline="yes-display-inline">The term <term>older child guardianship placement rate</term> means, with respect to a State and a fiscal year, of the children in foster care under the responsibility of the State, the percentage who—</text> 
<subparagraph id="H40237D7B10E346CDA23F1CB37D143C4"><enum>(A)</enum><text>have attained 9 years of age; and</text></subparagraph> 
<subparagraph id="H43BF1870C3EB49FCB3B1D2AEF769701E"><enum>(B)</enum><text>during the fiscal year, became subject to an older child guardianship placement.</text></subparagraph></paragraph> 
<paragraph id="HB0A50D957E2346B1B61C6766F1AF732E"><enum>(15)</enum><header>Base older child guardianship placement rate</header><text>The term <term>base older child guardianship placement rate</term> means, with respect to a State and—</text> 
<subparagraph id="HEB8081D87A5E40DC8B81D84DFCCF3D"><enum>(A)</enum><text display-inline="yes-display-inline">fiscal year 2006, the older child guardianship placement rate for the State for fiscal year 2005; or</text></subparagraph> 
<subparagraph id="H7EF3AF0C4C71459E9914C003F304C6D8"><enum>(B)</enum><text display-inline="yes-display-inline">any subsequent fiscal year, the older child guardianship placement rate for the State for the fiscal year for which the rate is the greatest in the period that begins with fiscal year 2005 and ends with the fiscal year preceding that subsequent fiscal year.</text></subparagraph></paragraph> 
<paragraph id="H0D52E0B733E349B500F8F7E3EC92A178"><enum>(16)</enum><header>Reunification rate</header><text display-inline="yes-display-inline">The term <term>reunification rate</term> means, with respect to a State and a fiscal year, of the children in foster care under the responsibility of the State, the percentage who become subject to a reunification during the fiscal year.</text></paragraph> 
<paragraph id="HA752A6A03206448C88F8BDBDA93E3773" display-inline="no-display-inline"><enum>(17)</enum><header>Base reunification rate</header><text>The term <term>base reunification rate</term> means, with respect to a State and—</text> 
<subparagraph id="HA5B4EA4A311E485A0080BE47B46F9738"><enum>(A)</enum><text>fiscal year 2006, the reunification rate for the State for fiscal year 2005; or</text></subparagraph> 
<subparagraph id="H5A069F6803A347A1989FD119E304B51"><enum>(B)</enum><text>any subsequent fiscal year, the reunification rate for the State for the fiscal year for which the rate is the greatest in the period that begins with fiscal year 2005 and ends with the fiscal year preceding that subsequent fiscal year.</text></subparagraph></paragraph> 
<paragraph id="H38E801AEC2344F258611E56F19A9D1B6"><enum>(18)</enum><header>Base rate of special needs adoptions that are not older child adoptions</header><text>The term <term>base rate of special needs adoptions that are not older child adoptions</term> means, with respect to a State and—</text> 
<subparagraph id="H771049991A6C40BFB700A421CECD33C1"><enum>(A)</enum><text>fiscal year 2006, the rate of special needs adoptions that are not older child adoptions for the State for fiscal year 2005; or</text></subparagraph> 
<subparagraph id="H5487B9D84B9347CDABA15DF600848E96"><enum>(B)</enum><text>any subsequent fiscal year, the rate of special needs adoptions that are not older child adoptions for the State for the fiscal year for which the rate is the greatest in the period that begins with fiscal year 2005 and ends with the fiscal year preceding that subsequent fiscal year.</text></subparagraph></paragraph> 
<paragraph id="HCFBDE330DDF24486BC43E00003A936F6" display-inline="no-display-inline"><enum>(19)</enum><header>Rate of special needs adoptions that are not older child adoptions</header><text display-inline="yes-display-inline">The term <term>rate of special needs adoptions that are not older child adoptions</term> means, with respect to a State and a fiscal year, of the children in foster care under the responsibility of the State, the percentage who—</text> 
<subparagraph id="H7953FC18DA7F4413B85B8FF6E8796FF"><enum>(A)</enum><text>are children with special needs;</text></subparagraph> 
<subparagraph id="HC579C412B9334B82B393ABF903AE2046"><enum>(B)</enum><text>have not attained 9 years of age; and</text></subparagraph> 
<subparagraph id="H271027593F46407C9392951700D41136"><enum>(C)</enum><text>during the fiscal year, became subject to a special needs adoption.</text> </subparagraph></paragraph> 
<paragraph id="H9131075C00FB46D9B01C00B7CA86C571"><enum>(20)</enum><header>Base rate of special needs guardianship placements that are not older child guardianship placements</header><text>The term <term>base rate of special needs guardianship placements that are not older child guardianship placements</term> means, with respect to a State and—</text> 
<subparagraph id="H631BB1CD213D45BC9B2E3733E438B05"><enum>(A)</enum><text display-inline="yes-display-inline">fiscal year 2006, the rate of special needs guardianship placements that are not older child guardianship placements for the State for fiscal year 2005; or</text></subparagraph> 
<subparagraph id="HF352BBD23FF24F23B6679CDB0A07D00"><enum>(B)</enum><text display-inline="yes-display-inline">any subsequent fiscal year, the rate of special needs guardianship placements that are not older child guardianship placements for the State for the fiscal year for which the rate is the greatest in the period that begins with fiscal year 2005 and ends with the fiscal year preceding that subsequent fiscal year.</text></subparagraph></paragraph> 
<paragraph id="HD2E5090A30F144AA90188043EBDE75B1"><enum>(21)</enum><header>Child with special needs</header><text> For purposes of this section, a child shall not be considered a child with special needs unless—</text> 
<subparagraph id="H607B3F34DA1340A99845EF91B6E92088"><enum>(A)</enum><text display-inline="yes-display-inline">the State has determined that the child cannot or should not be returned to the home of his parents; and</text></subparagraph> 
<subparagraph id="H3541DEAA975A41BAB200E1E18CB7FDC3"><enum>(B)</enum><text display-inline="yes-display-inline">the State had first determined that there exists with respect to the child a specific factor or condition (such as his ethnic background, age, or membership in a minority or sibling group, or the presence of factors such as medical conditions or physical, mental or emotional handicaps) because of which it is reasonable to conclude that such child cannot be placed with <quote>adoptive parents or</quote> a guardian without providing medical assistance under title XIX.</text></subparagraph></paragraph> </subsection> 
<subsection id="HA3869413AC784E4BA8AA522D5DA17100"><enum>(h)</enum><header>Limitations on authorization of appropriations</header> 
<paragraph id="H042980449BA449A89359E0007D5F0024"><enum>(1)</enum><header>In general</header><text>For grants under subsection (a), there are authorized to be appropriated to the Secretary $43,000,000 for each of fiscal years 2006 through 2008.</text> </paragraph> 
<paragraph id="H5FD9E795D5FE45689B584B5DD776006C"><enum>(2)</enum><header>Availability</header><text>Amounts appropriated under paragraph (1), or under any other law for grants under subsection (a), are authorized to remain available until expended, but not after fiscal year 2008.</text></paragraph></subsection> 
<subsection id="HEBC0C2522EEA45D0A073A7AC8C65DB31"><enum>(i)</enum><header>Technical assistance</header> 
<paragraph id="H57F4F8EA182548438FDCAD39C7B8E4FF"><enum>(1)</enum><header>In general</header><text>The Secretary may, directly or through grants or contracts, provide technical assistance to assist States and local communities to reach their targets for increased rates of adoptions, guardianships, and reunifications for children in foster care.</text></paragraph> 
<paragraph id="H3C8FCA61655F4075832976CF65EEF007"><enum>(2)</enum><header>Description of the character of the technical assistance</header><text>The technical assistance provided under paragraph (1) may support the goal of encouraging more adoptions out of the foster care system when adoptions promote the best interests of children, and more permanency placements of other kinds out of the foster care system when such other kinds of placements promote the best interests of children, and may include the following:</text> 
<subparagraph id="HD74D0029F3A44EA78F3B213FE7C7A375"><enum>(A)</enum><text>The development of best practice guidelines for expediting termination of parental rights.</text></subparagraph> 
<subparagraph id="HEB5CA9E25D074992A8BA6042C4CFAB63"><enum>(B)</enum><text>Models to encourage the use of concurrent planning.</text></subparagraph> 
<subparagraph id="H2968C0D9B6644752B6C499AE11BA39ED"><enum>(C)</enum><text>The development of specialized units and expertise in moving children toward adoption, guardianship, or reunification as a permanency goal through the use of established best practices in these areas.</text></subparagraph> 
<subparagraph id="HA4B0E19767784FB4A8A1FF534D6D5097"><enum>(D)</enum><text>The development of risk assessment tools to facilitate early identification of the children who will be at risk of harm if returned home.</text></subparagraph> 
<subparagraph id="H4989D42934634758B5D278D89395E706"><enum>(E)</enum><text>Models to encourage the fast tracking of children who have not attained 1 year of age into pre-adoptive placements.</text></subparagraph> 
<subparagraph id="HEE16B01730584451B87E9CEE275F8240"><enum>(F)</enum><text>Development of programs that place children into pre-adoptive families without waiting for termination of parental rights.</text></subparagraph></paragraph> 
<paragraph id="HE462A7C7999E494F82000645362C1FA1"><enum>(3)</enum><header>Targeting of technical assistance to the courts</header><text>Not less than 50 percent of any amount appropriated pursuant to paragraph (4) shall be used to provide technical assistance to the courts.</text></paragraph> 
<paragraph id="H50D4807F26FB4E83899F8196ABC0061"><enum>(4)</enum><header>Limitations on authorization of appropriations</header><text>To carry out this subsection, there are authorized to be appropriated to the Secretary not to exceed $10,000,000 for each of fiscal years 2006 and 2007.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H60D2B9092F5246568B73B3B60800B295"><enum>(b)</enum><header>Determination of whether AFCARS can be used to provide data necessary for calculating permanency incentive payments; authority to prescribe additional regulations if required</header><text display-inline="yes-display-inline">The Secretary shall determine whether the system established pursuant to section 479 of the Social Security Act is capable of being used to collect the data necessary to enable permanency incentive payments to be calculated under section 473A of such Act in a timely manner, and if not, the Secretary shall prescribe such regulations as may be necessary to make the system so capable.</text></subsection> 
<subsection id="H6FBE1255FE3E4910B130BF671F760062"><enum>(c)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on October 1, 2005.</text></subsection></section>
