<official-title>To amend the Nicaraguan Adjustment and Central American Relief Act to identify and register certain Central Americans residing in the United States.</official-title>

<section section-type="section-one" id="H10B153FE958E496CA1E59E2E8222420" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Central American Security Act</short-title></quote>.</text></section> 
<section id="H6117C8141DC94CCC853139732FF3FCCB"><enum>2.</enum><header>Adjustment of status for certain nationals from El Salvador, Guatemala, and Honduras</header><text display-inline="no-display-inline">Section 202 of the Nicaraguan Adjustment and Central American Relief Act (title II of <external-xref legal-doc="public-law" parsable-cite="pl/105/100">Public Law 105–100</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref> note) is amended—</text> 
<paragraph id="H16160C2FF69E470D845100A23349894F"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="subsection" style="OLC">Nicaraguans and Cubans</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Nicaraguans, Cubans, Salvadorans, Guatemalans, and Hondurans</header-in-text></quote>;</text></paragraph> 
<paragraph id="H0E13091E47BF4C328EE8EB5A53F572E"><enum>(2)</enum><text>in subsection (a)(1)(A), by striking <quote>April 1, 2000</quote> and inserting <quote>two years after the date of promulgation of a final rule implementing the Central American Security Act</quote>;</text></paragraph> 
<paragraph id="H0B32DCF5CE3C4DDA9F9209E4D9E30471"><enum>(3)</enum><text>in subsection (b)(1), by striking <quote>Nicaragua or Cuba</quote> and inserting <quote>Nicaragua, Cuba, El Salvador, Guatemala, or Honduras</quote>; and</text></paragraph> 
<paragraph id="HC2C74858304D416DB0D3E42200E704E8"><enum>(4)</enum><text>in subsection (d)(1)(E), by striking <quote>April 1, 2000</quote> and inserting <quote>two years after the date of promulgation of a final rule implementing the Central American Security Act</quote>.</text></paragraph></section> 
<section id="HD6CF4B60DB6F4DF98DEEB3E811E9FE52"><enum>3.</enum><header>Applications pending under amendments made by Section 203 of the Nicaraguan Adjustment and Central American Relief Act</header><text display-inline="no-display-inline">An application for relief properly filed by a national of Guatemala or El Salvador under the amendments made by section 203 of the Nicaraguan Adjustment and Central American Relief Act which was filed on or before the date of the enactment of this Act, and on which a final administrative determination has not been made, shall, at the election of the applicant, be considered to be an application for adjustment of status under the provisions of section 202 of the Nicaraguan Adjustment and Central American Relief Act, as amended by this Act, upon the payment of any fees, and in accordance with procedures, that the Secretary of Homeland Security shall prescribe by regulation. The Attorney General and the Secretary of Homeland Security may not refund any fees paid in connection with an application filed by a national of Guatemala or El Salvador under the amendments made by section 203 of that Act.</text></section> 
<section id="H1A1D43E13CBB48C4ADF6CDB33E3A93C"><enum>4.</enum><header>Technical amendments to the Nicaraguan Adjustment and Central American Relief Act</header> 
<subsection id="H65CF5F9B6D8845BA9E0095F819BE5C54"><enum>(a)</enum><header>In general</header><text>Section 202 of the Nicaraguan Adjustment and Central American Relief Act (title II of <external-xref legal-doc="public-law" parsable-cite="pl/105/111">Public Law 105–111</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref> note) is amended—</text> 
<paragraph id="H688C56D4E77F4D3AA1D46965AC692F17"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="HD9A4508CF4F74E9C997845EF6E00F745"><enum>(A)</enum><text>by inserting before the period at the end of paragraph (1)(B) the following: <quote>, and the Secretary of Homeland Security may waive the grounds of inadmissibility specified in paragraphs (1)(A)(i) and (6)(C) of section 212(a) of such Act for humanitarian purposes, to assure family unity, or when it is otherwise in the public interest</quote>; and</text></subparagraph> 
<subparagraph id="H873F67D4CB7B46B6B024C74FED8E47C9"><enum>(B)</enum><text>by amending paragraph (3) to read as follows:</text> 
<quoted-block id="HE3D1769B45354CFD9B2CBE805D819732"> 
<paragraph id="H3F640F4C1ACA4C0BB254B00970003CF8"><enum>(3)</enum><header>Relationship of application to certain orders</header><text>An alien present in the United States who has been ordered excluded, deported, or removed, or ordered to depart voluntarily from the United States under any provision of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> may, notwithstanding such order, apply for adjustment of status under paragraph (1). Such an alien may not be required, as a condition of submitting or granting such application, to file a separate motion to reopen, reconsider, or vacate such order. Such an alien may be required to seek a stay of such an order in accordance with subsection (c) to prevent the execution of the order pending the adjudication of the application for adjustment of status. If the Secretary of Homeland Security denies a stay of a final order of exclusion, deportation, or removal, or if the Secretary renders a final administrative determination to deny the application for adjustment of status, the order shall be effective and enforceable to the same extent as if the application had not been made. If the Secretary grants the application for adjustment of status, the Secretary shall cancel the order.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H4D69ABD3195448D48B2E6199DD65E7B"><enum>(2)</enum><text>in subsection (b)(1), by adding at the end the following: <quote>Subsection (a) shall not apply to an alien lawfully admitted for permanent residence, unless the alien is applying for relief under that subsection in deportation or removal proceedings.</quote>;</text></paragraph> 
<paragraph id="H194E6DE8D9124AF68B53447190EA5CE0"><enum>(3)</enum><text>in subsection (c)(1), by adding at the end the following: <quote>Nothing in this section requires the Secretary of Homeland Security to stay the removal of an alien who is ineligible for adjustment of status under this section.</quote>;</text></paragraph> 
<paragraph id="H693534966EA84A81AB003BDE042DA7DD"><enum>(4)</enum><text>in subsection (d)—</text> 
<subparagraph id="H08C7504CCDCD4F94B79B9E96FADA0411"><enum>(A)</enum><text>by amending the heading by striking <quote><header-in-text level="subsection" style="OLC">Spouses and children</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Spouses, children, and unmarried sons and daughters</header-in-text></quote>;</text> </subparagraph> 
<subparagraph id="HD8B383B5EF4C4BB7A46DE497F8774FF1"><enum>(B)</enum><text>by amending the heading of paragraph (1) by striking <quote><header-in-text level="paragraph" style="OLC">In general</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Adjustment of status</header-in-text></quote>;</text> </subparagraph> 
<subparagraph id="H3FBD0D7F79F04CE0BE461E8DF3DEA4A6"><enum>(C)</enum><text>by amending paragraph (1)(A) to read as follows:</text> 
<quoted-block id="H38C3411D4F9A4419BA42B42DC75E8C67"> 
<subparagraph id="H3FE4020F82504270B302C2EBBD502E16"><enum>(A)</enum><text display-inline="yes-display-inline">the alien entered the United States on or before the date of the enactment of the Central American Security Act;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H811A3BE9F6ED487EA417B35D54F243AB"><enum>(D)</enum><text>by amending paragraph (1)(B) to read as follows:</text> 
<quoted-block id="HC3936673394F4BC6A15085C615CDB93E"> 
<subparagraph id="H5249C8B27DA74E609956C34FDB66E685"><enum>(B)</enum><text>the alien—</text> 
<clause id="H29F06E7111AB4D808910183EF103BCEB"><enum>(i)</enum><text>is the spouse, child, or unmarried son or daughter of an alien whose status is adjusted to that of an alien lawfully admitted for permanent residence under subsection (a) or pursuant to the amendments made by section 203, except that—</text> 
<subclause id="H2014A5BED537487FBDE6CAA1C9F4F7B1"><enum>(I)</enum><text>any determination of whether the alien satisfies the age requirement in the matter preceding subparagraph (A) of section 101(b)(1) shall be made using the age of the alien on the date on which the principal alien filed for adjustment under subsection (a) or pursuant to the amendments made by section 203;</text></subclause> 
<subclause id="H65034F9C81DC4CFAADD5D300B57D496"><enum>(II)</enum><text display-inline="yes-display-inline">in the case of such a spouse, stepchild, or unmarried stepson or stepdaughter, the spouse, stepchild, stepson, or stepdaughter shall be required to establish that the qualifying marriage was entered into before the date of the enactment of the Central American Security Act; and</text></subclause> 
<subclause id="H6340A06812BD44E1BE7F7E220722F619"><enum>(III)</enum><text>in the case of such an unmarried son or daughter, the son or daughter shall be required to establish that the son or daughter has been physically present in the United States for a continuous period beginning not later than December 1, 1995, and ending not earlier than the date on which the application for adjustment under this subsection is filed; or</text></subclause></clause> 
<clause id="H6D02EE2310FD40A39700C7573DC1639C"><enum>(ii)</enum><text>was, at the time at which a principal alien filed for adjustment under subsection (a) or pursuant to the amendments made by section 203, the spouse or child of such principal alien, the status of such principal alien is adjusted to that of an alien lawfully admitted for permanent residence under subsection (a) or pursuant to the amendments made by section 203, and the spouse, child, or child of the spouse has been battered or subjected to extreme cruelty by such principal alien;</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H6A76C43E787D40E9AE3DC18D718D51AF"><enum>(E)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block id="HD574F32F1A5D471E91A18F4BD05BDEB"> 
<paragraph id="H2E3A0C22B60F46CCBAD9F53314600000"><enum>(4)</enum><header>Eligibility of certain spouses and children for issuance of immigrant visas</header> 
<subparagraph id="H32AED73B1A6E4FE7B8587FBC49B3E632"><enum>(A)</enum><header>In general</header><text>In accordance with regulations to be promulgated by the Secretary of Homeland Security and the Secretary of State, upon approval of an application for adjustment of status to that of an alien lawfully admitted for permanent residence under subsection (a) or pursuant to the amendments made by section 203, an alien who is the spouse or child of the alien being granted such status may be issued a visa for admission to the United States as an immigrant following to join the principal applicant, if the spouse or child—</text> 
<clause id="HE3A36ACCD0FB4365A97901DDDED6E470"><enum>(i)</enum><text>satisfies the requirements in paragraphs (1)(B) and (1)(D); and</text></clause> 
<clause id="H0C11DBCD77BC42E5A9A9C08C71A29F84"><enum>(ii)</enum><text>applies for such a visa within a time period to be established by such regulations.</text></clause></subparagraph> 
<subparagraph id="H3D0828CA2A9941F489D1F63912028D3B"><enum>(B)</enum><header>Retention of fees for processing applications</header><text>The Secretary of State may retain fees to recover the cost of immigrant visa application processing and issuance for certain spouses and children of aliens whose applications for adjustment of status under subsection (a) have been approved. Such fees—</text> 
<clause id="H94FC1F10F3DF4AA9A2D78795077BCBE6"><enum>(i)</enum><text>shall be deposited as an offsetting collection to any Department of State appropriation to recover the cost of such processing and issuance; and</text></clause> 
<clause id="H4B9DDD0A92774B3400A4D6646600002D"><enum>(ii)</enum><text>shall be available until expended for the same purposes of such appropriation to support consular activities.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HF2CC91E87A7F4997BD557163DB100032"><enum>(5)</enum><text>in subsection (g), by inserting <quote>or an immigrant visa under subsection (d)(4)</quote> after <quote>pursuant to this section</quote>; and</text></paragraph> 
<paragraph id="H1F4BBAED69F4486C9EFA76AEF4B557D6"><enum>(6)</enum><text>by adding at the end the following new subsection:</text> 
<quoted-block id="H5F5815C987B24D66B26C9E598EA07F22"> 
<subsection id="H91BBF92CECA049E4BBA4085BC9DA7EBC"><enum>(i)</enum><header>Statutory construction</header><text>Nothing in this section authorizes any alien to apply for admission to, be admitted to, be paroled into, or otherwise lawfully return to the United States, to apply for, or to pursue an application for adjustment of status under this section without the express authorization of the Attorney General or the Secretary of Homeland Security.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H24CD57E0F5174D49B55100008563D155"><enum>(b)</enum><header>Effective date</header><text>The amendments made by paragraphs (1)(B), (2), and (6) of subsection (a) shall be effective as if included in the enactment of the Nicaraguan Adjustment and Central American Relief Act. The amendments made by paragraphs (1)(A), (3), (4), and (5) of such subsection shall take effect on the date of the enactment of this Act.</text></subsection></section> 
<section id="HB02C567DFA604D4B9C00B84FE6B593C"><enum>5.</enum><header>Security and criminal background investigations</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, no applicant for relief under this Act, or the amendments made by this Act, is eligible to receive a waiver from any security or criminal background investigation required to process an application under section 202 of the Nicaraguan Adjustment and Central American Relief Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref> note). All applicants seeking relief under this Act, or the amendments made by this Act, shall submit fingerprints to the appropriate government agency in order to facilitate such processing.</text></section> 
<section id="HE5D08EC28EB2486FBCEFC5BF82A33AC"><enum>6.</enum><header>Motions to reopen</header><text display-inline="no-display-inline">Notwithstanding any time and number limitations imposed by law on motions to reopen, a national of Cuba or Nicaragua who, on the date of the enactment of the Act, has a final administrative denial of an application for adjustment of status under section 202 of the Nicaraguan Adjustment and Central American Relief Act, and who is made eligible for adjustment of status under that Act by the amendments made by this Act, may file one motion to reopen an exclusion, deportation, or removal proceeding to have the application reconsidered. Any such motion shall be filed within 180 days of the date of the enactment of this Act. The scope of any proceeding reopened on this basis shall be limited to a determination of the alien’s eligibility for adjustment of status under the Nicaraguan Adjustment and Central American Relief Act.</text></section>
