<official-title display="yes">To amend the Native American Business Development, Trade Promotion, and Tourism Act of 2000 to establish the Tribal Development Corporation Feasibility Study Group.</official-title>

<section id="HD47AB59D6CFE4E3EB6A5612CE0FC0011" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tribal Development Corporation Feasibility Study Act of 2005</short-title></quote>.</text></section> 
<section id="HF0752929DD1B4D2795143EC6F66184B5" section-type="subsequent-section"><enum>2.</enum><header>Indian economic development feasibility study</header><text display-inline="no-display-inline">Section 4(b) of the Native American Business Development, Trade Promotion, and Tourism Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/4303">25 U.S.C. 4303(b)</external-xref>) is amended—</text> 
<paragraph id="HC06B438E4A194846B11DCEA5C0ECF734"><enum>(1)</enum><text>by redesignating paragraph (6) as paragraph (7); and</text></paragraph> 
<paragraph id="H99BF32033B574DA88E4C31B0588C2579"><enum>(2)</enum><text>by inserting after paragraph (5) the following:</text>

<paragraph id="H0FBCC0AB6CCC45C4A1DAD14B4662D598"><enum>(6)</enum><header>Tribal development Corporation feasibility study</header> 
<subparagraph id="HB5605BBF699E4388B6B670258BE0062"><enum>(A)</enum><header>In general</header><text>The Secretary shall establish the Tribal Development Corporation Feasibility Study Group (referred to in this paragraph as the <quote>Group</quote>).</text></subparagraph> 
<subparagraph id="HDD7A0A90E08D4C0FB70247DA983901E7"><enum>(B)</enum><header>Members</header><text>The Group shall be comprised of 12 members, as follows:</text> 
<clause id="H8E9A532D1E0E4522BCD08DDB7DFA06D9"><enum>(i)</enum><header>Representatives of Indian Tribes</header><text>Five members of the Group shall be representatives of federally recognized Indian tribes.</text></clause> 
<clause id="H34BC33985285429BAFC9BF3B25C1C657"><enum>(ii)</enum><header>Representatives of the Alaska Native Community</header><text>Three members of the Group shall be representatives of the Alaska Native Community.</text></clause> 
<clause id="H99D09AA7D5DC43038DEDB90060A39829"><enum>(iii)</enum><header>Representative of the Native Hawaiian Community</header><text>One member of the Group shall be a representative of the Native Hawaiian Community.</text></clause> 
<clause id="H8D9602C0D2E24B369737B03EDB06A8DE"><enum>(iv)</enum><header>Representative of the private sector</header><text>Two members of the Group shall be representatives of nongovernmental economic activities carried out by private enterprises in the private sector.</text></clause> 
<clause id="HA49C6E8157044999A3522E6FA6F83C48"><enum>(v)</enum><header>Federal officials</header><text>One member of the Group shall be a representative of the Department of the Treasury with demonstrated experience in international economic development and international financial institutions.</text></clause></subparagraph> 
<subparagraph id="HA2BD3DCE0A79443D950085453856AECE"><enum>(C)</enum><header>Chairperson</header><text>The members of the Group shall select a Chairperson.</text></subparagraph> 
<subparagraph id="HBE8472B03D36484D9B007400732300D"><enum>(D)</enum><header>Personnel and services</header> 
<clause id="H6F0A02D039824C3B888D4200EFA8179C"><enum>(i)</enum><header>In general</header><text>The Chairperson of the Group may appoint and terminate such personnel as are necessary to enable the Group to perform its duties.</text></clause> 
<clause id="H4E4C0921898B4549951D478829DFA2E0"><enum>(ii)</enum><header>Procurement of services</header><text>The Chairperson may procure such services as are necessary to enable the Group to perform the duties of the Group.</text></clause></subparagraph> 
<subparagraph id="H4EBD9B55579E4E26A2CD4F28C4816D5"><enum>(E)</enum><header>Study</header> 
<clause id="HCE35B72718B642DDAEF9C1DFA140951"><enum>(i)</enum><header>In general</header><text>Not later than 270 days after the date of enactment of this subparagraph, the Group shall—</text> 
<subclause id="H5F3C1D2BC25C48DA8B0541E7AC63025"><enum>(I)</enum><text>conduct a study to determine the feasibility of establishing an Indian Tribal Development Corporation (referred to in this subparagraph as the <quote>Corporation</quote>); and</text></subclause> 
<subclause id="HDB5896EF300F460C97DE57D1158FE1BD"><enum>(II)</enum><text>submit to the Committee on Indian Affairs and the Committee on Appropriations of the Senate and the Committee on Resources and the Committee on Appropriations of the House of Representatives a report that describes the results of the study and any recommendations of the Group for further legislative action.</text></subclause></clause> 
<clause id="HDF9FC8BCE76E4EFE8177BEB13F5BE27B"><enum>(ii)</enum><header>Contents</header><text>The report shall contain—</text> 
<subclause id="H8D458C2AD19E48A089688469AF30008D"><enum>(I)</enum><text>a discussion and determination of the financial feasibility of the Corporation, including whether the Corporation can be, over the long term, financially self-sustainable;</text></subclause> 
<subclause id="H6D4E42FE8F10474AA44EAFAEB392FC2C"><enum>(II)</enum><text>a discussion and determination of the probable economic impact of the Corporation, including a demonstration of the quantitative and qualitative economic impact on Native American communities;</text></subclause> 
<subclause id="HF475868CC2BC4A72A6184B2749C91B00"><enum>(III)</enum><text>a discussion and determination of the best alternatives in the structure, organization, and lending terms and conditions of the Corporation, including the most appropriate structure of capital contributions to best serve, and be acceptable to, Native interests;</text></subclause> 
<subclause id="HE81FAE41BB9E45BD0014BA8EF9A21BB6"><enum>(IV)</enum><text>a discussion and determination of the basic terms and conditions under which funding would be provided to member Indian tribes;</text></subclause> 
<subclause id="H93CC0D76A632456E84F304C2C5A2567D"><enum>(V)</enum><text>a discussion of nonfinancial and advisory activities to be undertaken by the Corporation, including the use of diagnostic studies by the Corporation to—</text> 
<item id="H21E4FD86D23D4FA0B407E24D7E245042"><enum>(aa)</enum><text>identify tribal, Federal, or State policies and legal and regulatory conditions and infrastructure deficiencies that impede investment, both private and public, needed to promote non-gaming economic development;</text></item> 
<item id="H2A11C2FFDAA04D2A905D7BF812F52EF9"><enum>(bb)</enum><text>provide specific recommendations for remedial actions that can be undertaken by an Indian tribe to overcome such inhibitors of investment; and</text></item> 
<item id="H21014C3C23AF4E72BE4D9E9C5EB03DF4"><enum>(cc)</enum><text>identify and establish the terms for pre-appraisal studies of investment opportunities, both private and public, that can be developed and promoted by an Indian tribe; and</text></item></subclause> 
<subclause id="HAA550987B0924FB6AD103940A9B9A56F"><enum>(VI)</enum><text>a discussion and determination of—</text> 
<item id="HFF957B49B8DA41F1B1650020A2D0EBB"><enum>(aa)</enum><text>the capital structure of the Corporation, including the optimal level of initial capital contributions by both Indian tribes and the United States Government; and</text></item> 
<item id="HA0E423AFE926431A84AD90C337409DE2"><enum>(bb)</enum><text>the financial instruments that will be required by the Corporation to ensure its success.</text></item></subclause></clause></subparagraph> 
<subparagraph id="HFC577A9C5C7F4908AF3543D6AF8CFCA"><enum>(F)</enum><header>Termination of study Group</header><text>The Group shall terminate 120 days after the date on which the Group submits the report under subparagraph (E).</text></subparagraph> 
<subparagraph id="HA5D9B8D0CD3343EE87BE1DE5C9EDD00"><enum>(G)</enum><header>Authorization of appropriation</header><text>There are authorized to be appropriated to carry out this paragraph $500,000.</text></subparagraph> 
<subparagraph id="H3C136B4108264FD7A512C4D71B59B224"><enum>(H)</enum><header>Matching requirement</header><text>Federal funds made available to carry out this paragraph must be matched dollar-for-dollar with non-Federal funds.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
