<official-title>To designate Angola under section 244 of the Immigration and Nationality Act in order to make nationals of Angola eligible for temporary protected status under such section.</official-title>

<section id="H96552C9432214B349F111D88AB002938" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Angolan Temporary Protected Status Act of 2005</short-title></quote>.</text></section> 
<section id="HB881FE02EA6E400FBD3FD387003409B5"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text> 
<paragraph id="H85AFA7D674C64EBDAC218E00796659B7"><enum>(1)</enum><text>Angola has just recently emerged from 41 years of conflict, including a 14-year struggle for independence followed by 27 years of civil war.</text></paragraph> 
<paragraph id="H3807BF9728D34AC28B9590A245452FA1"><enum>(2)</enum><text>As much as <fraction>1/3</fraction> of the population of Angola was displaced by warfare and now needs to be resettled, amounting to some 4,000,000 internal and external refugees.</text></paragraph> 
<paragraph id="H9495236C13BB41DEAD33409C14816237"><enum>(3)</enum><text>The government established by the Lukasa Protocol is currently struggling to meet the needs of its people in the face of continued unrest and food shortages.</text></paragraph> 
<paragraph id="H6075C882F8874487B62E99BDE215985D"><enum>(4)</enum><text display-inline="yes-display-inline">Daily conditions throughout the country mirror the collapse of administrative infrastructure as well as weak social institutions; hospitals are without medicines or basic equipment, schools are without books, and public employees often lack the basic supplies for day-to-day work.</text></paragraph> 
<paragraph id="HECBC99A721EE432AB200BE0060C9778E"><enum>(5)</enum><text>National elections to create a freely elected government may still be several years away.</text></paragraph> 
<paragraph id="H9ADBA210A6284069998D5D6DCAD814FB"><enum>(6)</enum><text>An insurgency group, the Front for the Liberation of the Enclave of Cabinda (FLEC), remains active in Cabinda province, where Amnesty International has reported instances of human rights abuses such as indiscriminate killings, setting fire to villages, and rape.</text></paragraph> 
<paragraph id="H542F47497C67417882EDCB54ACE908F6"><enum>(7)</enum><text>The Department of State has identified Angola as a place of <quote>considerable risk</quote> for travel, due to banditry, extensive use of land mines during the war, and poor government infrastructure and security capabilities.</text></paragraph></section> 
<section id="H62BAE43154234AE69879D3B1FCF5A718"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of the Congress that, in view of the difficulties facing the Angolan people in the aftermath of their civil war, Angola qualifies for designation under section 244(b)(1)(A) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a(b)(1)(A)</external-xref>), pursuant to which Angolan nationals would be eligible for temporary protected status in the United States.</text></section> 
<section id="HF0B3D72B713C4CB38E007CDE948D78F0"><enum>4.</enum><header>Designation for purposes of granting temporary protected status to angolans</header> 
<subsection id="H0DAB2CAAE62B40AC8ED79954D1F2C00"><enum>(a)</enum><header>Designation</header> 
<paragraph id="HB730E05B326149A3AED35079F6E59384"><enum>(1)</enum><header>In general</header><text>For purposes of section 244 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>), Angola shall be treated as if it had been designated under subsection (b) of that section, subject to the provisions of this section.</text></paragraph> 
<paragraph id="H94C6094916244273B7768323F8B5B740"><enum>(2)</enum><header>Period of designation</header><text>The initial period of such designation shall begin on the date of enactment of this Act and shall remain in effect for 1 year.</text></paragraph></subsection> 
<subsection id="H29421C0D750542A1B1D83B703F849B04"><enum>(b)</enum><header>Aliens eligible</header><text>In applying section 244 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>) pursuant to the designation made under this section, subject to section 244(c)(3) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a(c)(3)</external-xref>), an alien who is a national of Angola meets the requirements of section 244(c)(1) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a(c)(1)</external-xref>) only if—</text> 
<paragraph id="HBAB7052856424A7CB7D77460357BD67E"><enum>(1)</enum><text>the alien has been continuously physically present in the United States since the date of enactment of this Act;</text></paragraph> 
<paragraph id="H738E371481294E88AC254000B7EE26A7"><enum>(2)</enum><text>the alien is admissible as an immigrant, except as otherwise provided under section 244(c)(2)(A) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a(c)(2)(A)</external-xref>), and is not ineligible for temporary protected status under section 244(c)(2)(B) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a(c)(2)(B)</external-xref>); and</text></paragraph> 
<paragraph id="HA55F4741DE55445188E7111EE9C561F7"><enum>(3)</enum><text>the alien registers for temporary protected status in a manner that the Secretary of Homeland Security shall establish.</text></paragraph></subsection> 
<subsection id="H3C1D6E36E8164668B4669567E8191D4"><enum>(c)</enum><header>Consent to travel abroad</header><text>The Secretary of Homeland Security shall give the prior consent to travel abroad described in section 244(f)(3) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a(f)(3)</external-xref>) to an alien who is granted temporary protected status pursuant to the designation made under this section, if the alien establishes to the satisfaction of the Secretary of Homeland Security that emergency and extenuating circumstances beyond the control of the alien require the alien to depart for a brief, temporary trip abroad. An alien returning to the United States in accordance with such an authorization shall be treated the same as any other returning alien provided temporary protected status under section 244 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>).</text></subsection></section>
