<official-title>To amend title 49, United States Code, to direct the Secretary of Homeland Security to extend a requirement for the prescreening of air passengers to international flights that overfly the United States.</official-title>

<section id="H73411D29CA4841C2A34557E1B509EDBF" section-type="section-one"><enum>1.</enum><header>Prescreening of international passengers</header> 
<subsection id="H9C85CF777827434AAE23A64DE01C57A9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/44909">Section 44909(c)(6)(A)</external-xref> of title 49, United States Code, is amended by inserting after <quote>international flight to or from the United States</quote> the following <quote>, and for any international flight that overflys the United States,</quote>.</text></subsection> 
<subsection id="H89E6565325BD4A88AEF9A6F016FA6F28"><enum>(b)</enum><header>Definitions</header><text>Section 44909(c)(6) of such title is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H22E9182FFCFC41C089ACD42500AF47F" display-inline="no-display-inline"> 
<subparagraph id="H1EC57577A6494A13A7413C8F1E15DC08"><enum>(C)</enum><header>Definitions</header><text>In this subsection, the following definitions apply:</text> 
<clause id="H8730F7BA6C81468F9BDFEA28C43BAC"><enum>(i)</enum><header>International flight that overflys the United States</header><text display-inline="yes-display-inline">The term <quote>international flight that overflys the United States</quote> means any flight departing from a place outside the United States that transits the territorial airspace of the United States en route to a place outside the United States. </text></clause> 
<clause id="H2C3A19BCFBE04142A2C5D874E58D5460"><enum>(ii)</enum><header>Territorial airspace of the united states</header><text display-inline="yes-display-inline">The term <quote>territorial airspace of the United States</quote> means the airspace over the United States and the airspace overlying the territorial waters between the United States coast and 12 nautical miles from the United States coast.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H925F0EC327A244118BCA663CBD2252B4"><enum>(c)</enum><header>Rulemaking</header><text>Not later than 60 days after the date of enactment of this Act, the Secretary of Homeland Security, or a designee of the Secretary, shall issue a notice of proposed rulemaking to carry out the amendments made by this section.</text> </subsection></section>
