<official-title>To extend eligibility for refugee status of unmarried sons and daughters of certain Vietnamese refugees.</official-title>

<section section-type="section-one" id="HF558789F72A7417AA2F8E691EEC7E7A7" display-inline="no-display-inline"><enum>1.</enum><header>Eligibility for refugee status</header> 
<subsection id="H68EA7A47ED1849299C67D1CB10DDC3BA"><enum>(a)</enum><header>Eligibility for In-country refugee processing in Vietnam</header><text>For purposes of eligibility for in-country refugee processing for nationals of Vietnam during fiscal years 2006 and 2007, an alien described in subsection (b) shall be considered to be a refugee of special humanitarian concern to the United States (within the meaning of section 207 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>)) and shall be admitted to the United States for resettlement if the alien would be admissible as an immigrant under the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (except as provided in section 207(c)(3) of that Act).</text></subsection> 
<subsection id="H95F2461164944DE0B46F5D8072C88D00"><enum>(b)</enum><header>Aliens covered</header><text>An alien described in this subsection is an alien who—</text> 
<paragraph id="H59AF98D6B95F464600A545E326A6247D"><enum>(1)</enum><text>is the son or daughter of a qualified national;</text></paragraph> 
<paragraph id="H21406C28651F40CD97CECCEEC5CC34D"><enum>(2)</enum><text>is 21 years of age or older; and</text></paragraph> 
<paragraph id="H6E6F450392BC4145A9E89D566826B85B"><enum>(3)</enum><text>was unmarried as of the date of acceptance of the alien’s parent for resettlement under the Orderly Departure Program or through the United States Consulate General in Ho Chi Minh City.</text></paragraph></subsection> 
<subsection id="H88B87B12911743189000B9531498F12E"><enum>(c)</enum><header>Qualified national</header><text>The term <term>qualified national</term> in subsection (b)(1) means a national of Vietnam who—</text> 
<paragraph id="HB0134461713E4CCEA373B3A400188E25"><enum>(1)</enum> 
<subparagraph display-inline="yes-display-inline" id="H45AC7AABB49845B39DAA228D95FA9480"><enum>(A)</enum><text>was formerly interned in a re-education camp in Vietnam by the Government of the Socialist Republic of Vietnam; or</text></subparagraph> 
<subparagraph indent="up1" id="H0A794F79893A427600463E134033C36B"><enum>(B)</enum><text>is the widow or widower of an individual described in subparagraph (A);</text></subparagraph></paragraph> 
<paragraph id="H1D8ECFB22B4A4CAA90A75CE68B781605"><enum>(2)</enum> 
<subparagraph display-inline="yes-display-inline" id="H771FCFECF23C4D81BD40B30006D0501D"><enum>(A)</enum><text>qualified for refugee processing under the Orderly Departure Program re-education subprogram; and</text></subparagraph> 
<subparagraph indent="up1" id="H65CDBA1903D749A9BBF8C79DC59174EC"><enum>(B)</enum><text>is or was accepted under the Orderly Departure Program or through the United States Consulate General in Ho Chi Minh City—</text> 
<clause id="H6742AEE583024C71B85296A050C26472"><enum>(i)</enum><text>for resettlement as a refugee; or</text></clause> 
<clause id="H33B62B44467E489100D593FFA800EE95"><enum>(ii)</enum><text>for admission to the United States as an immediate relative immigrant; and</text></clause></subparagraph></paragraph> 
<paragraph id="H1BF48B4103E84C62A5D2942DEDD9E3D0"><enum>(3)</enum> 
<subparagraph display-inline="yes-display-inline" id="H180D00E19AE64BD1ABC9B3E1D2921D88"><enum>(A)</enum><text>is presently maintaining a residence in the United States or whose surviving spouse is presently maintaining such a residence; or</text></subparagraph> 
<subparagraph indent="up1" id="HAE5943707882474EAB6EF4194E007EAB"><enum>(B)</enum><text>was approved for refugee resettlement or immigrant visa processing and is awaiting departure formalities from Vietnam or whose surviving spouse is awaiting such departure formalities.</text></subparagraph></paragraph></subsection></section>
