<official-title>To amend title I of the Housing and Community Development Act of 1974 to withhold community development block grant funds from States and communities that do not prohibit the use of the power of eminent domain that involves the taking of the property from private persons for commercial or economic development purposes and transfer of the property to other private persons.</official-title>

<section id="HCFEEEB9F206A4AFF83A764F5C8F3397D" section-type="section-one"><enum>1.</enum><header>Prohibition on use of eminent domain to obtain property for commercial development by private persons</header><text display-inline="no-display-inline">Title I of the Housing and Community Development Act of 1974 is amended—</text> 
<paragraph id="HEC567640BF1A43ECAF6F1D87DD195500"><enum>(1)</enum><text>in section 104 (<external-xref legal-doc="usc" parsable-cite="usc/42/5304">42 U.S.C. 5304</external-xref>)—</text> 
<subparagraph id="H3AD94935B05049058425F400BECBD831"><enum>(A)</enum><text>in subsection (b)—</text> 
<clause id="H9C5D6611819E43C000B6066028D44CD1"><enum>(i)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></clause> 
<clause id="HB5B9EE2D67744A20947E90722C4F3ECA"><enum>(ii)</enum><text>by redesignating paragraph (6) as paragraph (7); and</text></clause> 
<clause id="H88F5E0AB2C474C46B72965B3345C67FD"><enum>(iii)</enum><text>by inserting after paragraph (5) the following new paragraph:</text>

<paragraph id="H8CD47D0CD7ED493FB3276915879E0025"><enum>(6)</enum><text>the grantee (or, in the case of a grantee that is a unit of general local government, the State in which such unit is located) has in effect laws, regulations, or policies referred to in paragraph (1) or (2), as appropriate, of subsection (n); and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="H975DCB37433F4CBFB4D6455FD04FFC7"><enum>(B)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="H2DAAD5736A9D4E72B99215FEACC375CB"><enum>(n)</enum><header>Prohibition on use of eminent domain to obtain property for commercial development by private persons</header> 
<paragraph id="H30DFE4DD5B42441B90CCB409ECDBBE84"><enum>(1)</enum><header>Units of general local government</header><text display-inline="yes-display-inline">No funds made available for grants under section 106 for fiscal year 2006 or any fiscal year thereafter may be obligated or expended to any unit of general local government unless such unit of general local government (or the State in which such unit of general local government is located) has in effect and is enforcing laws, regulations, or policies that prohibit the use of the power of eminent domain by the unit of general local government (or in the case of laws, regulations, or policies of a State, by the State and by any political subdivision of the State), that involves the taking of the property from private persons for commercial or economic development purposes and transfer of the property to other private persons.</text></paragraph> 
<paragraph id="H49C207FF6F1045C096D5F45999753D07"><enum>(2)</enum><header>States and other grantees</header><text display-inline="yes-display-inline">No funds made available for grants under section 106 for fiscal year 2006 or any fiscal year thereafter may be obligated or expended to any State, Indian tribe, or insular area unless such State, Indian tribe, or insular area has in effect and is enforcing laws, regulations, or policies that prohibit the use of the power of eminent domain by such State and by any political subdivision of the State, such Indian tribe, or such insular area, respectively, that involves the taking of the property from private persons for commercial or economic development purposes and transfer of the property to other private persons.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H1ADB6EA44C084770BC8CB7B4ECEF8C9C"><enum>(2)</enum><text>in section 106 (<external-xref legal-doc="usc" parsable-cite="usc/42/5306">42 U.S.C. 5306</external-xref>)—</text> 
<subparagraph id="HECA0C4ACE9464C54A83404F2FE7DBA3"><enum>(A)</enum><text>in the last sentence of subsection (a)(1), by striking <quote>and (k)</quote> and inserting <quote>(k), and (n)(2)</quote>; </text></subparagraph> 
<subparagraph id="H2FAC24728B9D43DDA7E5E5F9BFDD66E6"><enum>(B)</enum><text>in subsection (c), in the first sentence of paragraph (1), by striking <quote>or (d)</quote> and inserting <quote>(d), or (n)(2)</quote>; and</text></subparagraph> 
<subparagraph id="HD09D06D03A6C46C0A6EDAA4240957025"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (d)(3)(C), by striking <quote>or (d)</quote> and inserting <quote>(d), or (n)(1)</quote>.</text> </subparagraph></paragraph></section>
