<official-title>To provide for the efficacy of television ratings services, and for other purposes.</official-title>

<section id="H060C878B0EDD453EA0C2E9F751176C1C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Television Viewer Consumer Protection Act of 2005</short-title></quote>.</text></section> 
<section id="H7A3FC1A053364B4C87C06CF3A2EA6B91"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds and declares the following:</text> 
<paragraph id="HC6BAB79C11CF4650A51B6775CF78A6C2"><enum>(1)</enum><text>Television ratings inform television operators and advertisers with respect to the size and demographic makeup of audiences for television programming.</text></paragraph> 
<paragraph id="H4D1F4D0381024C8B88BA82CA9000FC30"><enum>(2)</enum><text>Television operators rely upon these ratings to fulfill their obligation to serve the public interest.</text></paragraph> 
<paragraph id="H495CCF92217040839635D0779CCBC3D8"><enum>(3)</enum><text>Television viewers will receive the most representative variety of television programs if television ratings measurement services provide data that accurately reflects viewing by all demographic groups.</text></paragraph> 
<paragraph id="HE3522DD1087343FC982DDEE9B2DE1E22"><enum>(4)</enum><text>Inaccurate ratings systems that undercount minority, young, family, and rural television viewers will adversely affect these populations if television operators air fewer telecasts that are intended to serve such viewers as a result of such inaccurate ratings.</text></paragraph> 
<paragraph id="H9B9A5E993E5343F4AABF45A0EF2C1ECD"><enum>(5)</enum><text>The interests of viewers of television programming will be best secured by an industry oversight system that guarantees accurate ratings of television shows.</text></paragraph> 
<paragraph id="H8F693400FC284E3E00C2F0C8CED42BE2"><enum>(6)</enum><text>A body to ensure such oversight was established at the behest of Congress in the 1960s to guarantee the accuracy of television ratings.</text></paragraph> 
<paragraph id="HF3B1B72F1F07431F9764D6CD0050461B"><enum>(7)</enum><text>It is in the public interest to ensure that this body has the necessary authority to fulfill its critical role.</text></paragraph></section> 
<section id="H1A28B8347F154BEDAF53D768987C168C"><enum>3.</enum><header>Prohibition</header> 
<subsection id="HA4E2EF2C0C6C4D9AB236AAD857B7FE95"><enum>(a)</enum><header>Accreditation required</header><text>No television ratings service may sell, offer to sell, or otherwise provide, in or affecting interstate commerce, data from a television ratings measurement system that produces, or is designed to produce, television ratings data to be used commercially as currency ratings unless that system has been accredited by the Media Rating Council.</text></subsection>
<subsection id="HE803EA71A64F48BB927813BC4F21E26E"><enum>(b)</enum><header>Dispute resolution</header><text>Any dispute between a television ratings service and the Media Rating Council shall be resolved in accordance with the provisions of section 4.</text></subsection></section> 
<section id="H70DCBA5B25344E9787EABA6E8D2D385C"><enum>4.</enum><header>Dispute resolution</header> 
<subsection id="H177057FA1C9A4A919476EECFA7C5322"><enum>(a)</enum><header>Rules for dispute resolution</header><text>Any dispute between a television ratings service and the Media Rating Council shall be resolved according to the commercial rules then in effect of the American Arbitration Association.</text></subsection>
<subsection id="H08C737BED4A049BEA16406B1142879CD"><enum>(b)</enum><header>Formation of arbitration panel</header><text>Upon a complaint by either a television ratings service or the Media Rating Council, an arbitration panel shall be appointed from a list of arbitrators submitted by the American Arbitration Association.</text></subsection>
<subsection id="HCB02B30725484CE3009236A51892D2FA"><enum>(c)</enum><header>Decisions binding</header><text>Any decision reached by the arbitration panel shall be binding upon the parties.</text></subsection></section> 
<section id="H0D9DCD50613846D28999C92F02F61C34"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act:</text> 
<paragraph id="HFBFC2F77D518479EBCEA4800DF1C0070"><enum>(1)</enum><header>Currency ratings</header><text>The term <term>currency ratings</term> means data produced by television ratings measurement systems that are widely used by a significant portion of television operators and advertisers to determine the commercial value of advertising on television.</text></paragraph> 
<paragraph id="HE5DF6C2A6A6F4E09B7BAD097E9226ED"><enum>(2)</enum><header>Media rating council</header><text>The term <term>Media Rating Council</term> means—</text> 
<subparagraph id="HDA06402CE0C74708B1ECF411898D11F7"><enum>(A)</enum><text>the organization formed by the television industry in 1964 to represent the interests of advertisers and television operators in accurate ratings of television programming; or</text></subparagraph> 
<subparagraph id="H049BF1894CEC4616B346F6CCEA4683F3"><enum>(B)</enum><text>any other entity formed for the purpose of accrediting television ratings services pursuant to the provisions of section 3 and that has been approved for such purpose by the Federal Communications Commission.</text></subparagraph></paragraph> 
<paragraph id="H33D0269EA04A4A7DB7FFF9000016F28F"><enum>(3)</enum><header>Television ratings measurement system</header><text>The term <term>television ratings measurement system</term> means any system designed to measure the viewing habits of television viewers and to produce commercially usable data based on such measurements.</text></paragraph></section>
