<section id="HFA83F0DB49064FF490DEB749F5D481CC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State High Risk Pool Funding Extension Act of 2005</short-title></quote>.</text></section> 
<section id="H112617D94A164BC680E5FE4B2B1BE700"><enum>2.</enum><header>Extension of funding for operation of state high risk health insurance pools</header> 
<subsection id="H32478A2092F4420D9BC6917DCD1EB58F"><enum>(a)</enum><header>Extension of seed grants</header><text display-inline="yes-display-inline">Section 2745 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-45">42 U.S.C. 300gg–45</external-xref>) is amended—</text> 
<paragraph id="H920F957D5F5141E299A8E8FA446C8FE1"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), in the subsection heading by inserting <quote><header-in-text level="subsection" style="OLC">Extension of</header-in-text></quote> before <quote><header-in-text level="subsection" style="OLC">Seed</header-in-text></quote>; and</text></paragraph> 
<paragraph id="HF001D4B16B0F450092C5D3B430F70700"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)(1), by inserting <quote>and $15,000,000 for the period of fiscal years 2005 and 2006</quote> after <quote>$20,000,000 for fiscal year 2003</quote>.</text></paragraph></subsection> 
<subsection id="HA7FA1DB52AEB494CA414781D2DAA78C8"><enum>(b)</enum><header>Funds for operations</header><text display-inline="yes-display-inline">Section 2745 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-45">42 U.S.C. 300gg–45</external-xref>) is amended—</text> 
<paragraph id="H770F5CA3ABC546B0AFA0FEBCA95476B7"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)—</text> 
<subparagraph id="H53B24C48C7E4406E95EFA3E7B000E9BD"><enum>(A)</enum><text display-inline="yes-display-inline">in the subsection heading by striking <quote><header-in-text level="subsection" style="OLC">Matching</header-in-text></quote>; and</text></subparagraph> 
<subparagraph id="H41777FE4598C407F879CF000D0DB712F"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraph (2) and inserting the following: </text> 
<quoted-block style="OLC" id="H1B8D0BED0A4F4D13931EDE93F54FF85" display-inline="no-display-inline"> 
<paragraph id="HA260ABF4F48848CFB78C63C400BE2763"><enum>(2)</enum><header>Allotment</header><text display-inline="yes-display-inline">The amounts appropriated under subsection (c)(2) for a fiscal year shall be made available to the States (or the entities that operate the high risk pool under applicable State law) as follows:</text> 
<subparagraph id="HE92C64327CDB4186A002C4682180F4E1"><enum>(A)</enum><text display-inline="yes-display-inline">An amount equal to 50 percent of the appropriated amount for the fiscal year shall be allocated in equal amounts among each eligible State that applies for assistance under this subsection.</text></subparagraph> 
<subparagraph id="H14E99D6436984505A687818DCF7F47C"><enum>(B)</enum><text display-inline="yes-display-inline">An amount equal to 25 percent of the appropriated amount for the fiscal year shall be allocated among the States so that the amount provided to a State bears the same ratio to such available amount as the number of uninsured individuals in the State bears to the total number of uninsured individuals in all States (as determined by the Secretary).</text></subparagraph> 
<subparagraph id="H2AC2CBE66AC54A709D02AF7F99AE7C9D"><enum>(C)</enum><text display-inline="yes-display-inline">An amount equal to 25 percent of the appropriated amount for the fiscal year shall be allocated among the States so that the amount provided to a State bears the same ratio to such available amount as the number of individuals enrolled in health care coverage through the qualified high risk pool of the State bears to the total number of individuals so enrolled through qualified high risk pools in all States (as determined by the Secretary).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HB1C965C0231F4276826C005FFC3B3353"><enum>(2)</enum><text display-inline="yes-display-inline"> in subsection (c)(2), by striking <quote>$40,000,000</quote> and all that follows through the period and inserting <quote>$75,000,000 for each of fiscal years 2005 through 2009 to make allotments under subsection (b)(2).</quote>.</text></paragraph></subsection> 
<subsection id="HDE698079FCC5472AA8F8EF51794594E2"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 2745 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-45">42 U.S.C. 300gg–45</external-xref>) is amended—</text> 
<paragraph id="HAE7E558BA9134F91BA0920FFFEE68BA"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d), by inserting after <quote>2744(c)(2)</quote> the following: <quote>, except that with respect to subparagraph (A) of such section a State may elect to provide for the enrollment of eligible individuals through an acceptable alternative mechanism,</quote>; and</text></paragraph> 
<paragraph id="H2D280D7E649A4433BB5782B38F00E05F"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following: </text> 
<quoted-block style="OLC" id="HDACFC7BBB90C48FC88F4BFC9AB585386" display-inline="no-display-inline"> 
<subsection id="H2C0CFF38F5A942B9B312F700C6388090"><enum>(e)</enum><header>Standard risk rate</header><text display-inline="yes-display-inline">In subsection (b)(1)(A), the term <term>standard risk rate</term> means a rate—</text> 
<paragraph id="H6D3067FE6EE3490F852033C6C9589608"><enum>(1)</enum><text display-inline="yes-display-inline">determined under the State high risk pool by considering the premium rates charged by other health insurers offering health insurance coverage to individuals in the insurance market served;</text></paragraph> 
<paragraph id="HE6E3D67A544D4007B20088FD41AAD18D"><enum>(2)</enum><text display-inline="yes-display-inline">that is established using reasonable actuarial techniques; and</text></paragraph> 
<paragraph id="H14DA68E91EF64312991419D4C0AB12BF"><enum>(3)</enum><text display-inline="yes-display-inline">that reflects anticipated claims experience and expenses for the coverage involved.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H9ECA14F81F0A403F8B35DBAD28CA3894"><enum>3.</enum><header>IOM study of developing standard model for certification of uninsurability</header> 
<subsection id="HE28CB515827749F1BEA03BEE20E0833E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall enter into a contract with the Institute of Medicine for a study on the development of a standard model for the certification, for purposes of State high risk health insurance pools, of individuals as being uninsurable and thereby eligible for health benefits coverage through such a pool.</text></subsection> 
<subsection id="H3214F4C66DD749A8A28CCBC5AAA5DEE0"><enum>(b)</enum><header>Report</header><text>Under such contract, the Institute of Medicine shall submit a report on the study to the Secretary and to the Congress.</text></subsection></section> 
<section id="HFED3824D7EC64A0DAA94C5FB677C61AF"><enum>4.</enum><header>Increase in trade adjustment assistance refundable tax credit</header> 
<subsection id="H6A1699A18C324C02A8AEC3309E3001F"><enum>(a)</enum><header>In general</header><text>Sections <external-xref legal-doc="usc" parsable-cite="usc/26/35">35(a)</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/26/7527">7527(b)</external-xref> of the Internal Revenue Code of 1986 are each amended by striking <quote>65 percent</quote> and inserting <quote>80 percent</quote>.</text></subsection> 
<subsection id="H47DC52E8E47A41C8906B525FAF8BC28E"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply with respect to taxable years beginning after December 31, 2004.</text> </subsection></section>
