<official-title>To provide benefits to domestic partners of Federal employees.</official-title>

<section section-type="section-one" id="HDB89232A5F054983A07B16F7BE629DD" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Domestic Partnership Benefits and Obligations Act</short-title></quote>.</text></section> 
<section id="HBE6CE16E128C4B8FABB44BD944F35F7D"><enum>2.</enum><header>Benefits to domestic partners of Federal employees</header> 
<subsection id="HE1084CF5DC1A4631A27D2B42CE12E800"><enum>(a)</enum><header>In general</header><text>A domestic partner of an employee shall be entitled to benefits available to and obligations imposed upon a spouse of an employee.</text></subsection> 
<subsection id="HAE11C26859264831BFDE2DC45F39DCE8"><enum>(b)</enum><header>Certification of eligibility</header><text>In order to obtain benefits under this Act, an employee shall file an affidavit of eligibility for benefits with the Office of Personnel Management certifying that the employee and the domestic partner of the employee—</text> 
<paragraph id="H8C5E128FC0724241A0695BB7DA21F3B5"><enum>(1)</enum><text>are each other’s sole domestic partner and intend to remain so indefinitely;</text></paragraph> 
<paragraph id="HF33AA1B0F5864A909102935C50DFD19"><enum>(2)</enum><text>have a common residence, and intend to continue the arrangement;</text></paragraph> 
<paragraph id="H00591A5921A1433BB71B8D8D5DC1B53B"><enum>(3)</enum><text>are at least 18 years of age and mentally competent to consent to contract;</text></paragraph> 
<paragraph id="H22536FF8B9294115A549D0BDE223BC10"><enum>(4)</enum><text>share responsibility for a significant measure of each other’s common welfare and financial obligations;</text></paragraph> 
<paragraph id="HB6B7EE84D41D4FCFB81FC5B938EB00B2"><enum>(5)</enum><text>are not married to or domestic partners with anyone else;</text></paragraph> 
<paragraph id="H12E88D351B6442A8A2620958D29E5404"><enum>(6)</enum><text>understand that willful falsification of information within the affidavit may lead to disciplinary action and the recovery of the cost of benefits received related to such falsification; and</text></paragraph> 
<paragraph id="H3F2474E7FD784A2C99A2754C00F8FCF4"><enum>(7)</enum> 
<subparagraph id="HD46CC06659EE44BC8E9C937B62B85F20" display-inline="yes-display-inline"><enum>(A)</enum><text>are same sex domestic partners, and not related in a way that, if the 2 were of opposite sex, would prohibit legal marriage in the State in which they reside; or</text> </subparagraph> 
<subparagraph indent="up1" id="HC4B74F4C765B48C691B578BC3B93F0B6"><enum>(B)</enum><text>are opposite sex domestic partners, and are not related in a way that would prohibit legal marriage in the State in which they reside.</text></subparagraph></paragraph></subsection> 
<subsection id="HAB1AE8C429084987B634D23F34A0CFBE"><enum>(c)</enum><header>Dissolution of partnership</header> 
<paragraph id="H6BFEA96E049949B890A941E0B3A02BE1"><enum>(1)</enum><header>In general</header><text>An employee or domestic partner of an employee who obtains benefits under this Act shall file a statement of dissolution of the domestic partnership with the Office of Personnel Management not later than 30 days after the death of the employee or the domestic partner or the date of dissolution of the domestic partnership.</text></paragraph> 
<paragraph id="HD3E5977F1EE3468B8BBE5FDF0247B821"><enum>(2)</enum><header>Death of employee</header><text>In a case in which an employee dies, the domestic partner of the employee at the time of death shall be deemed a spouse of the employee for the purpose of receiving benefits under this Act.</text></paragraph> 
<paragraph id="H91B9B1DD8815414D960500C4EF387392"><enum>(3)</enum><header>Other dissolution of partnership</header> 
<subparagraph id="H40FC5B77188D4266B762D7F4B6BAB5D"><enum>(A)</enum><header>In general</header><text>In a case in which a domestic partnership dissolves by a method other than death of the employee or domestic partner of the employee, any benefits received by the domestic partner as a result of this Act shall terminate.</text></subparagraph> 
<subparagraph id="HECAE9766C5BB4B29AFB56BA9AC7BCF95"><enum>(B)</enum><header>Exception</header><text>In a case in which a domestic partnership dissolves by a method other than death of the employee or domestic partner of the employee, any health benefits received by the domestic partner as a result of this Act shall continue for a period of 60 days after the date of the dissolution of the partnership. The domestic partner shall pay for such benefits in the same manner that a former spouse would pay for such benefits under applicable provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/89">chapter 89</external-xref> of title 5, United States Code.</text></subparagraph></paragraph></subsection> 
<subsection id="H291C2F16082E43FC88AEC9466B19E9A1"><enum>(d)</enum><header>Confidentiality</header><text>Any information submitted to the Office of Personnel Management under subsection (b) shall be used solely for the purpose of certifying an individual’s eligibility for benefits under subsection (a).</text></subsection> 
<subsection id="H053CF7DE0F664833BD00863F25A96D5"><enum>(e)</enum><header>Definitions</header><text>For purposes of this Act:</text> 
<paragraph id="H5341FCD97B324B3FAAB281097500DD08"><enum>(1)</enum><header>Domestic partner</header><text>The term <term>domestic partner</term> means an adult person living with, but not married to, another adult person in a committed, intimate relationship.</text></paragraph> 
<paragraph id="HD8D52764737649B898E8DF6CAC071120"><enum>(2)</enum><header>Benefits</header><text>The term <term>benefits</term> means benefits under—</text> 
<subparagraph id="H6C0401F69CEF412AB8D6D2B5FB002F62"><enum>(A)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code (relating to compensation for work injuries);</text></subparagraph> 
<subparagraph id="HD10141872ACF4420864426D2C53EE52"><enum>(B)</enum><text>subchapter III of chapter 83 of such title (relating to the Civil Service Retirement System);</text></subparagraph> 
<subparagraph id="HF639CEC3C3D84B1FB020019EFBA155EE"><enum>(C)</enum><text>chapter 84 of such title (relating to the Federal Employees’ Retirement System);</text></subparagraph> 
<subparagraph id="HA4506BD7FBF0460CB4D8ED7FE35617B6"><enum>(D)</enum><text>chapter 87 of such title (relating to life insurance); and</text></subparagraph> 
<subparagraph id="H91C5D396FC3745C996A432F4D6FD8664"><enum>(E)</enum><text>chapter 89 of such title (relating to health insurance).</text></subparagraph></paragraph> 
<paragraph id="HBB9B35D960344DDBA746811BE4229551"><enum>(3)</enum><header>Employee</header><text>The term <quote>employee</quote> has the meaning given such term by—</text> 
<subparagraph id="H9EF621C4969F4DCC8BF3CA6B8334A066"><enum>(A)</enum><text display-inline="yes-display-inline">section 8101(1) of title 5, United States Code, when used with respect to benefits described in paragraph (2)(A);</text></subparagraph> 
<subparagraph id="H944EE4613E26483983C451FED1F27451"><enum>(B)</enum><text>section 8331(1) of such title, when used with respect to benefits described in paragraph (2)(B);</text></subparagraph> 
<subparagraph id="HB48135AE60BC401082AD4D5E450920CB"><enum>(C)</enum><text display-inline="yes-display-inline">section 8401(11) of such title, when used with respect to benefits described in paragraph (2)(C);</text></subparagraph> 
<subparagraph id="H04142175D2314393AAB13D875991E3F7"><enum>(D)</enum><text display-inline="yes-display-inline">section 8701(a) of such title, when used with respect to benefits described in paragraph (2)(D); and</text></subparagraph> 
<subparagraph id="HA285FEE6474D4678A733D5D3A52FF969"><enum>(E)</enum><text>section 8901(1) of such title, when used with respect to benefits described in paragraph (2)(E).</text></subparagraph> </paragraph> 
<paragraph id="H019D461A55F944ABA7226BA34688925B"><enum>(4)</enum><header>Obligations</header><text>The term <term>obligations</term> means any duties or responsibilities that would be incurred by the spouse of an employee.</text></paragraph></subsection></section> 
<section id="H39334ADB8E8940B1B99D28B1E6695BD3"><enum>3.</enum><header>Exemption from tax for employer-provided fringe benefits to domestic partners</header> 
<subsection id="H7DE0AC9DF5BE427F97E9B900D0AAD83B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/106">Section 106</external-xref> of the Internal Revenue Code of 1986 (relating to contributions by employer to accident and health plans) is amended by adding at the end the following new subsection:</text>

<subsection id="H5BA9CB2975AE413297F9246BF1FF04E3"><enum>(e)</enum><header>Treatment of domestic partners</header><text>The provisions of section 2 of the <short-title>Domestic Partnership Benefits and Obligations Act</short-title> shall apply to employees and domestic partners of employees for purposes of this section and any other benefit which is not includible in the gross income of employees by reason of an express provision of this chapter.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H7E0F0AAD24C54037BAB8063C2C340026"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply to taxable years beginning after December 31, 2005.</text></subsection></section>
