<official-title>To amend the Higher Education Act of 1965 to provide an interest-free deferment of student loan repayment for Federal student loan borrowers during active military service.</official-title>

<section id="HD40B47B7735A47869F7913128CC5AB00" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Higher Education Loan Program for Our Troops Act</short-title></quote> or the <quote><short-title>HELP Our Troops Act</short-title></quote>.</text> </section> 
<section id="HAC5FADC6D82F42F6B926783978FE652E" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Deferment of student loans during active military service</header> 
<subsection display-inline="no-display-inline" id="H190D43408B4F411AA1F47446E46984F"><enum>(a)</enum><header>Federal family education loans</header><text>Section 428(b)(1)(M) (<external-xref legal-doc="usc" parsable-cite="usc/20/1078">20 U.S.C. 1078(b)(1)(M)</external-xref>) is amended—</text> 
<paragraph id="H2FBC798B649F4EB0B184B9DAD6973BAE"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of clause (ii);</text></paragraph> 
<paragraph id="H0F4AF9BFB8EC40498D485748835E7CC9"><enum>(2)</enum><text>by redesignating clause (iii) as clause (iv); and</text></paragraph> 
<paragraph id="H8518B29CE4504B9780FB83C5CB29D3C8"><enum>(3)</enum><text>by inserting after clause (ii) the following new clause:</text>

<clause id="H98E38013CF024AA6B11C353D7D042366"><enum>(iii)</enum><text>not in excess of 3 years during which the borrower—</text> 
<subclause id="H811DC6EF8BE54606A100450698B16F5D"><enum>(I)</enum><text>is serving on active duty during a war or other military operation or national emergency; or</text></subclause> 
<subclause id="H82E35F22CC8D4C50819B06B72CDF795D"><enum>(II)</enum><text>is performing qualifying National Guard duty during a war or other military operation or national emergency; or</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HF0EF2A7AB72E4106BA18D0B5943DDBE1"><enum>(b)</enum><header>Direct loans</header><text>Section 455(f)(2) (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e(f)(2)</external-xref>) is amended—</text> 
<paragraph id="H15A457A1D1294C4291258FDBFF00A4D7"><enum>(1)</enum><text>by redesignating subparagraph (C) as subparagraph (D); and</text></paragraph> 
<paragraph id="H7A717CECE4534BE4B0473B187FC9925F"><enum>(2)</enum><text>by inserting after subparagraph (B) the following new subparagraph:</text>

<subparagraph id="H4DD95BE111D94D60A263D56081002D46"><enum>(C)</enum><text>not in excess of 3 years during which the borrower—</text> 
<clause id="H605A80B2D15842FAB854823230721FDC"><enum>(i)</enum><text>is serving on active duty during a war or other military operation or national emergency; or</text></clause> 
<clause id="H7E36AC52A03C4D74AB8C42E8DD1D7C0"><enum>(ii)</enum><text>is performing qualifying National Guard duty during a war or other military operation or national emergency; or</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H9CBFE571814A414A836CABED93788BE"><enum>(c)</enum><header>Perkins loans</header><text>Section 464(c)(2)(A) (<external-xref legal-doc="usc" parsable-cite="usc/20/1087dd">20 U.S.C. 1087dd(c)(2)(A)</external-xref>) is amended—</text> 
<paragraph id="HC8FBAE3D660045F0893EBB2DF0890803"><enum>(1)</enum><text>by redesignating clauses (iii) and (iv) as clauses (iv) and (v), respectively; and</text></paragraph> 
<paragraph id="H800848A3BEBE440F98089100F500CA48"><enum>(2)</enum><text>by inserting after clause (ii) the following new clause:</text>

<clause id="HAA6A09CCD8E24A0D8DEC1E9083711F7"><enum>(iii)</enum><text>not in excess of 3 years during which the borrower—</text> 
<subclause id="H39136174D0A74746849CD116CF50FE00"><enum>(I)</enum><text>is serving on active duty during a war or other military operation or national emergency; or</text></subclause> 
<subclause id="H9831267FAE3B4A20ABD351AA64EF1347"><enum>(II)</enum><text>is performing qualifying National Guard duty during a war or other military operation or national emergency;</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H82C34E792C124A33BB7D002E00821F42"><enum>(d)</enum><header>Definitions</header><text>Section 435 (<external-xref legal-doc="usc" parsable-cite="usc/20/1085">20 U.S.C. 1085</external-xref>) is amended by inserting after subsection (m) the following new subsection:</text>

<subsection id="HB073540CEF7146CC853B307C7FA856F9"><enum>(n)</enum><header>Definitions for military deferments</header><text>For purposes of this part and parts D and E:</text> 
<paragraph id="H1B610371813C49A0B7B04B0785E466FA"><enum>(1)</enum><header>Active duty</header><text>The term <term>active duty</term> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(d)(1)</external-xref> of title 10, United States Code, except that such term does not include active duty for training or attendance at a service school.</text></paragraph> 
<paragraph id="H5404847B1D764C5CAC00D209997698A4"><enum>(2)</enum><header>Military operation</header><text>The term <term>military operation</term> means a contingency operation as such term is defined in <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(a)(13)</external-xref> of title 10, United States Code.</text></paragraph> 
<paragraph id="HE1324918A53D4E838939D6E6EA9BF0EF"><enum>(3)</enum><header>National emergency</header><text>The term <term>national emergency</term> means a national emergency declared by the President of the United States.</text></paragraph> 
<paragraph id="H5FAAD9EDA41C4044AECF79A3D3EEB132"><enum>(4)</enum><header>Serving on active duty</header><text>The term <term>serving on active duty during a war or other military operation or national emergency</term> means service by an individual who is—</text> 
<subparagraph id="H382D8C05E990464EB7F9782D58E75C10"><enum>(A)</enum><text>a Reserve of an Armed Force ordered to active duty under section 12301(a), 12301(g), 12302, 12304, or 12306 of title 10, United States Code, or any retired member of an Armed Force ordered to active duty under section 688 of such title, for service in connection with a war or other military operation or national emergency, regardless of the location at which such active duty service is performed; and</text></subparagraph> 
<subparagraph id="H28C72F636A54469798DBB598FECDCD3F"><enum>(B)</enum><text>any other member of an Armed Force on active duty in connection with such emergency or subsequent actions or conditions who has been assigned to a duty station at a location other than the location at which such member is normally assigned.</text></subparagraph></paragraph> 
<paragraph id="H1B26C7F82D00455D8CDF45C5F9773D4"><enum>(5)</enum><header>Qualifying National Guard duty</header><text>The term <term>qualifying National Guard duty during a war or other military operation or national emergency</term> means service as a member of the National Guard on full-time National Guard duty (as defined in <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(d)(5)</external-xref> of title 10, United States Code) under a call to active service authorized by the President or the Secretary of Defense for a period of more than 30 consecutive days under <external-xref legal-doc="usc" parsable-cite="usc/32/502">section 502(f)</external-xref> of title 32, United States Code, in connection with a war, another military operation, or a national emergency declared by the President and supported by Federal funds.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H575C0BA45EC94128983D3FF6D109EA60"><enum>(e)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to loans for which the first disbursement is made on or after July 1, 1993, to an individual who is a new borrower (within the meaning of section 103 of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1003">20 U.S.C. 1003</external-xref>)) on or after such date.</text></subsection></section>
