<section id="HF6B9D714CF2148A1891520580034305C" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Railroad Track Modernization Act of 2005</short-title></quote>.</text></section> 
<section id="H423C0B7350914C4890DE50F4A5C44056"><enum>2.</enum><header>Capital grants for railroad track</header> 
<subsection id="H3CC9E1545E674E638FCC280707AD3C46"><enum>(a)</enum><header>Amendment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/223">Chapter 223</external-xref> of title 49, United States Code, is amended to read as follows:</text>

<toc-entry level="section">22301. Capital grants for railroad track</toc-entry></toc> 
<section id="H913D1A3D52514BE696E851CAD7D231A3"><enum>22301.</enum><header>Capital grants for railroad track</header> 
<subsection id="H48A2D826587242D5ADAEA52FC0FF157E"><enum>(a)</enum><header>Establishment of program</header> 
<paragraph id="H1C95F8D9776D482E81DF1D42EA7C8500"><enum>(1)</enum><header>Establishment</header><text>The Secretary of Transportation shall establish a program of capital grants for the rehabilitation, preservation, or improvement of railroad track (including roadbed, bridges, and related track structures) of class II and class III railroads. Such grants shall be for rehabilitating, preserving, or improving track used primarily for freight transportation to a standard ensuring that the track can be operated safely and efficiently, including grants for rehabilitating, preserving, or improving track to handle 286,000 pound rail cars. Grants may be provided under this chapter—</text> 
<subparagraph id="H4D8CF04DA51B452B93FCEF80B286C12B"><enum>(A)</enum><text>directly to the class II or class III railroad; or</text></subparagraph> 
<subparagraph id="H45B34B7339F746649808477D89C1A2CE"><enum>(B)</enum><text>with the concurrence of the class II or class III railroad, to a State or local government.</text></subparagraph></paragraph> 
<paragraph id="H712D34961F3043C189007095BCEC3FD"><enum>(2)</enum><header>State cooperation</header><text>Class II and class III railroad applicants for a grant under this chapter are encouraged to utilize the expertise and assistance of State transportation agencies in applying for and administering such grants. State transportation agencies are encouraged to provide such expertise and assistance to such railroads.</text></paragraph> 
<paragraph id="H4BCA500133FB4FEFAE5FCEFBCC6B34A4"><enum>(3)</enum><header>Interim regulations</header><text>Not later than December 31, 2005, the Secretary shall issue temporary regulations to implement the program under this section. Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5 does not apply to a temporary regulation issued under this paragraph or to an amendment to such a temporary regulation.</text></paragraph> 
<paragraph id="H289A73C37FBC41C79272ACEF38FB11A1"><enum>(4)</enum><header>Final regulations</header><text>Not later than October 1, 2006, the Secretary shall issue final regulations to implement the program under this section.</text></paragraph></subsection> 
<subsection id="H88D11A53FDFF43F380409D64705DD79E"><enum>(b)</enum><header>Maximum Federal share</header><text>The maximum Federal share for carrying out a project under this section shall be 80 percent of the project cost. The non-Federal share may be provided by any non-Federal source in cash, equipment, or supplies. Other in-kind contributions may be approved by the Secretary on a case by case basis consistent with this chapter.</text></subsection> 
<subsection id="H423CD5C1E5414FDFB38E6C45C624BE22"><enum>(c)</enum><header>Project eligibility</header><text>For a project to be eligible for assistance under this section the track must have been operated or owned by a class II or class III railroad as of the date of the enactment of the <short-title>Railroad Track Modernization Act of 2005</short-title>.</text></subsection> 
<subsection id="H10F57CA9F4B54F4CA244D189D5C2E788"><enum>(d)</enum><header>Use of funds</header><text>Grants provided under this section shall be used to implement track capital projects as soon as possible. In no event shall grant funds be contractually obligated for a project later than the end of the third Federal fiscal year following the year in which the grant was awarded. Any funds not so obligated by the end of such fiscal year shall be returned to the Secretary for reallocation.</text></subsection> 
<subsection id="H55823159E35940168EB48B82415193EF"><enum>(e)</enum><header>Employee protection</header><text>The Secretary shall require as a condition of any grant made under this section that the recipient railroad provide a fair arrangement at least as protective of the interests of employees who are affected by the project to be funded with the grant as the terms imposed under section 11326(a), as in effect on the date of the enactment of the <short-title>Railroad Track Modernization Act of 2005</short-title>.</text></subsection> 
<subsection id="H1951DFB379FB49FB95C1CA700000046"><enum>(f)</enum><header>Labor standards</header> 
<paragraph id="H8B61629183B54A1CA3A9C712CACE4351"><enum>(1)</enum><header>Prevailing wages</header><text>The Secretary shall ensure that laborers and mechanics employed by contractors and subcontractors in construction work financed by a grant made under this section will be paid wages not less than those prevailing on similar construction in the locality, as determined by the Secretary of Labor under the Act of March 3, 1931 (known as the <act-name parsable-cite="DBA">Davis-Bacon Act</act-name>; <external-xref legal-doc="usc" parsable-cite="usc/40/276a">40 U.S.C. 276a et seq.</external-xref>). The Secretary shall make a grant under this section only after being assured that required labor standards will be maintained on the construction work.</text></paragraph> 
<paragraph id="H2B139EDF26F643B7BBA7619600381448"><enum>(2)</enum><header>Wage rates</header><text>Wage rates in a collective bargaining agreement negotiated under the Railway Labor Act (<external-xref legal-doc="usc" parsable-cite="usc/45/151">45 U.S.C. 151 et seq.</external-xref>) are deemed for purposes of this subsection to comply with the Act of March 3, 1931 (known as the <act-name parsable-cite="DBA">Davis-Bacon Act</act-name>; <external-xref legal-doc="usc" parsable-cite="usc/40/276a">40 U.S.C. 276a et seq.</external-xref>).</text></paragraph></subsection> 
<subsection id="H39B480F1428C431D91473899B936738E"><enum>(g)</enum><header>Study</header><text>The Secretary shall conduct a study of the projects carried out with grant assistance under this section to determine the public interest benefits associated with the light density railroad networks in the States and their contribution to a multimodal transportation system. Not later than March 31, 2007, the Secretary shall report to Congress any recommendations the Secretary considers appropriate regarding the eligibility of light density rail networks for Federal infrastructure financing.</text></subsection> 
<subsection id="H45E77B6D7FFA421A9461CDA0548F9614"><enum>(h)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary of Transportation $350,000,000 for each of the fiscal years 2006 through 2008 for carrying out this section.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
