<section id="HED469D09911A4BC3BA20817ED37758FC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hybrid HOV Access Act of 2005</short-title></quote>. </text></section> 
<section id="H15C3F9750D054DEEB8B0A018E7FB8B50" section-type="subsequent-section"><enum>2.</enum><header>HOV facilities</header> 
<subsection id="H29E9939786F245DBAD5EAF8264D858CC"><enum>(a)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text> 
<quoted-block id="H5202EB3E3ACE4CDBB300BE9CB7ABB72C" style="USC"> 
<section id="HB53B52FCDF364DB2A53514F7A8BC13B4"><enum>165.</enum><header>HOV facilities</header></section> 
<subsection id="H27DBB6DABEEC4EC09366AA656BA242AA"><enum>(a)</enum><header>In general</header> 
<paragraph id="H201924EF10C74A3B861001BC00B4C311"><enum>(1)</enum><header>Authority of state agencies</header><text>A State agency that has jurisdiction over the operation of a HOV facility shall establish the occupancy requirements of vehicles operating on the facility.</text></paragraph> 
<paragraph id="HED2D794D4403400E9017E28CF411870"><enum>(2)</enum><header>Occupancy requirement</header><text>Except as otherwise provided by this section, no fewer than 2 occupants per vehicle may be required for use of a HOV facility.</text></paragraph></subsection> 
<subsection id="H13E69D15DC01423C97B8853C4372ECAE"><enum>(b)</enum><header>Exceptions</header><text>Notwithstanding the occupancy requirements of subsection (a)(2), the following exceptions shall apply with respect to a State agency operating a HOV facility:</text> 
<paragraph id="HE8AB65EB70954548AB33C3B0C5817F65"><enum>(1)</enum><header>Motorcycles and bicycles</header> 
<subparagraph id="HC2BA0D333EF24F6DBA97A32E37BB4847"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the State agency shall allow motorcycles and bicycles to use the HOV facility.</text></subparagraph> 
<subparagraph id="H8CE87B0802FF4722BA76DC7B83C07A"><enum>(B)</enum><header>Safety exception</header><text>A State agency may restrict use of the HOV facility by motorcycles or bicycles (or both) if the agency certifies to the Secretary that such use would create a safety hazard and the Secretary accepts the certification. The Secretary may accept a certification under this subparagraph only after the Secretary publishes notice of the certification in the Federal Register and provides an opportunity for public comment.</text></subparagraph></paragraph> 
<paragraph id="HC121AA8957B542E3877D19AF1576D60"><enum>(2)</enum><header>Public transportation vehicles</header><text>The State agency may allow public transportation vehicles to use the HOV facility if the agency—</text> 
<subparagraph id="H5EBB9736B09F44F28DDCB9C90859DE6E"><enum>(A)</enum><text>establishes requirements for clearly identifying the vehicles; and</text></subparagraph> 
<subparagraph id="H962BC28E2FD9485EBB9C2B6413F6FAAD"><enum>(B)</enum><text>establishes procedures for enforcing the restrictions on the use of the facility by such vehicles.</text></subparagraph></paragraph> 
<paragraph id="HF2B2F0BF8EE14C3BB0F5E44A883581"><enum>(3)</enum><header>High occupancy toll vehicles</header><text>The State agency may allow vehicles not otherwise exempt pursuant to this subsection to use the HOV facility if the operators of such vehicles pay a toll charged by the agency for use of the facility and the agency—</text> 
<subparagraph id="HB27C2F53685D44D9AD66DE2600C8C9E9"><enum>(A)</enum><text>establishes a program that addresses how motorists can enroll and participate in the toll program;</text></subparagraph> 
<subparagraph id="H49ACC1952A144F20A5E8D5B926AFA184"><enum>(B)</enum><text>develops, manages, and maintains a system that will automatically collect the toll; and</text></subparagraph> 
<subparagraph id="H6B581C2D2DB0433A8FD7D37374EF000"><enum>(C)</enum><text>establishes policies and procedures to—</text> 
<clause id="HF03ED6DC02AF4D6A858464BEF871F328"><enum>(i)</enum><text>manage the demand to use the facility by varying the toll amount that is charged;</text></clause> 
<clause id="HA2A1E53B126B40649D2D3DEB3C4FD043"><enum>(ii)</enum><text>enforce violations of use of the facility; and</text></clause> 
<clause id="HD18BB5354DD24378BCB353AB0380AB80"><enum>(iii)</enum><text>permit low-income individuals to pay reduced tolls.</text></clause></subparagraph></paragraph> 
<paragraph id="H269C7DD6B3324879BABD502788067385"><enum>(4)</enum><header>Low emission and energy-efficient vehicles</header> 
<subparagraph id="H4134B3D8F27E4301B92C3F3CBBFA53D5"><enum>(A)</enum><header>Inherently low-emission vehicle</header><text>Before September 30, 2009, the State agency may allow vehicles that are certified as inherently low-emission vehicles pursuant to <external-xref legal-doc="regulation" parsable-cite="cfr/40/88.311">section 88.311-93</external-xref> of title 40, Code of Federal Regulations, and are labeled in accordance with section 88.312-93 of such title, to use the HOV facility if the agency establishes procedures for enforcing the restrictions on the use of the facility by such vehicles.</text></subparagraph> 
<subparagraph id="H139AD6AEF80C4A209F27D0FE8E356851"><enum>(B)</enum><header>Other low emission and energy-efficient vehicles</header><text display-inline="yes-display-inline">Before September 30, 2009, the State agency may allow vehicles certified as low emission and energy-efficient vehicles under subsection (e), and labeled in accordance with subsection (e), to use the HOV facility if the agency—</text> 
<clause id="H5F420EBF52FB464A9FFBA5B5A48244A4"><enum>(i)</enum><text>establishes a program that addresses how those qualifying low emission and energy-efficient vehicles are selected and certified;</text></clause> 
<clause id="H92A8849B73E84FD0A061A7BD59DCD535"><enum>(ii)</enum><text>establishes requirements for labeling qualifying low emission and energy-efficient vehicles (including procedures for enforcing those requirements);</text></clause> 
<clause id="H96987CBDCE6B461791E4B4950050FBB5"><enum>(iii)</enum><text>continuously monitors, evaluates, and reports to the Secretary on performance; and</text></clause> 
<clause id="HF8FBD41A3C694F9983F17904AC44B840"><enum>(iv)</enum><text>imposes such restrictions on the use on high occupancy vehicle lanes by vehicles that do not satisfy established occupancy requirements as are necessary to ensure that the performance of individual high occupancy vehicle lanes, and the entire high occupancy vehicle lane system, will not become seriously degraded.</text></clause></subparagraph></paragraph> 
<paragraph id="HFF42542A79AC47019DFC9CA76D3F4C49"><enum>(5)</enum><header>Advanced lean burn technology vehicles</header><text>Before September 30, 2009, the State agency may allow vehicles certified as advanced lean burn technology vehicles under subsection (e), and labeled in accordance with subsection (e), to use the HOV facility if the agency—</text> 
<subparagraph id="HE145BE17A7414E67AADC668C8563715B"><enum>(A)</enum><text>establishes a program that addresses how those qualifying advanced lean burn technology vehicles are selected and certified;</text></subparagraph> 
<subparagraph id="H03CB394341304AE69C16CDF7CC3FF397"><enum>(B)</enum><text>establishes requirements for labeling qualifying advanced lean burn technology vehicles (including procedures for enforcing those requirements);</text></subparagraph> 
<subparagraph id="H86516190E5B54779BA8DC776DB2F02D9"><enum>(C)</enum><text>continuously monitors, evaluates, and reports to the Secretary on performance; and</text></subparagraph> 
<subparagraph id="H9EA9473FF97341D2A744703C376F0100"><enum>(D)</enum><text>imposes such restrictions on the use on high occupancy vehicle lanes by vehicles that do not satisfy established occupancy requirements as are necessary to ensure that the performance of individual high occupancy vehicle lanes, and the entire high occupancy vehicle lane system, will not become seriously degraded.</text></subparagraph></paragraph></subsection> 
<subsection id="H456F5A0F09B5451E8C32A4DE5399D23"><enum>(c)</enum><header>Requirements applicable to tolls</header> 
<paragraph id="H90E9320E6E1848EA91D8E8790172723E"><enum>(1)</enum><header>In general</header><text>Tolls may be charged under subsections (b)(3) and (b)(4) notwithstanding section 301 and, except as provided in paragraphs (2) and (3), subject to the requirements of section 129.</text></paragraph> 
<paragraph id="H198B953C5786452D92B4662F02DCC2ED"><enum>(2)</enum><header>HOV facilities on the interstate system</header><text>Notwithstanding section 129, tolls may be charged under subsections (b)(3) and (b)(4) on a HOV facility on the Interstate System.</text></paragraph> 
<paragraph id="H9FDEEAEB51704147883032FBC6C9D598"><enum>(3)</enum><header>Excess toll revenues</header><text>If a State agency makes a certification under the last sentence of section 129(a)(3) with respect to toll revenues collected under subsections (b)(3) and (b)(4), the State, in the use of tolls revenues under that sentence, shall give priority consideration to projects for developing alternatives to single occupancy vehicle travel and projects for improving highway safety.</text></paragraph></subsection> 
<subsection id="HB4DE42CA259A4BC2A9CE29BCA1BC3EB9"><enum>(d)</enum><header>HOV facility management, operation, monitoring, and enforcement</header> 
<paragraph id="H5E0D7AD7AE4A499EA7101B007900F5C9"><enum>(1)</enum><header>In general</header><text>A State agency that allows vehicles to use a HOV facility under subsection (b)(4) in a fiscal year shall certify to the Secretary that the agency will carry out the following responsibilities with respect to the facility in the fiscal year:</text> 
<subparagraph id="H35D70F0B41004D46005FFA60AA352908"><enum>(A)</enum><text>Establishing, managing, and supporting a performance monitoring, evaluation, and reporting program for the facility that provides for continuous monitoring, assessment, and reporting on the impacts that such vehicles may have on the operation of the facility and adjacent highways.</text></subparagraph> 
<subparagraph id="H8C20C0F841AE421DB9196D77D74693FF"><enum>(B)</enum><text>Establishing, managing, and supporting an enforcement program that ensures that the facility is being operated in accordance with the requirements of this section.</text></subparagraph> 
<subparagraph id="HB42B5DDBA79D4B6B0083FF27007C48E5"><enum>(C)</enum><text>Limiting or discontinuing the use of the facility by such vehicles if the presence of such vehicles has degraded the operation of the facility.</text></subparagraph></paragraph> 
<paragraph id="H3FBA0B04DDE847FE9C8585F01630E568"><enum>(2)</enum><header>Degraded facility</header> 
<subparagraph id="H85AD2A5947B14052A4247103EA946DC"><enum>(A)</enum><header>In general</header><text>For purposes of paragraph (1), the operation of a HOV facility shall be considered to be degraded if vehicles operating on the facility are failing to maintain a minimum average operating speed 90 percent of the time over a consecutive 6-month period during morning or evening weekday peak hour periods (or both).</text></subparagraph> 
<subparagraph id="HEB85A511EDA8475BB599E0DF7BD0D3E3"><enum>(B)</enum><header>Minimum average operating speed defined</header><text>In subparagraph (A), the term <quote>minimum average operating speed</quote> means—</text> 
<clause id="H30AE210C38384FB6AC26CEF9D284ACB2"><enum>(i)</enum><text>45 miles per hour, in the case of a HOV facility with a speed limit of 50 miles per hour or greater; and</text></clause> 
<clause id="H5265BE7E3C334DF7BD2F00364CB89B28"><enum>(ii)</enum><text>not more than 10 miles per hour below the speed limit, in the case of a HOV facility with a speed limit of less than 50 miles per hour.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HE6B8DD8402444D6BB8FFA79213DE500"><enum>(e)</enum><header>Certification of low emission and energy-efficient vehicles and advanced lean burn technology vehicles</header><text>Not later than 6 months after the date of enactment of this section, the Administrator of the Environmental Protection Agency shall issue—</text> 
<paragraph id="H551E3E1446AB49ACB59062616CBCD554"><enum>(1)</enum><text>a final rule establishing requirements for certification of a vehicle for purposes of this section as—</text> 
<subparagraph id="HE59737B03B1A4BBC8B96A860CADCB0E6"><enum>(A)</enum><text>a low emission and energy-efficient vehicle; or</text></subparagraph> 
<subparagraph id="H237414E7E0CF4EAFBC305600952CF240"><enum>(B)</enum><text>an advanced lean burn technology vehicle; and</text></subparagraph></paragraph> 
<paragraph id="HA5D211FD183945F0B8CA90431CBAF4C"><enum>(2)</enum><text>requirements for the labeling of such vehicles.</text></paragraph></subsection> 
<subsection id="H396BB83041094677904918F667A36FF6"><enum>(f)</enum><header>Fuel efficiency guidance for hybrid vehicles</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this section, the Administrator of the Environmental Protection Agency shall issue guidance on methods for determining whether a vehicle meets the fuel efficiency standards required to qualify as a hybrid vehicle under subsection (g).</text></subsection> 
<subsection id="H81B84F5B2C344E8FA7AAF2E2E249FCA"><enum>(g)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text> 
<paragraph id="H352195011A3C452693151D5EB5FF400"><enum>(1)</enum><header>Advanced lean burn technology vehicle</header><text>The term <quote>advanced lean burn technology vehicle</quote> means a vehicle with an internal combustion engine that is designed to operate primarily using more air than is necessary for complete combustion of fuel, incorporates direct injection, achieves at least 125 percent of city fuel economy of a comparable vehicle, and has received a certificate that such vehicle meets or exceeds—</text> 
<subparagraph id="H1510C349C00C4DD1BF6646A020F67444"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of a vehicle having a gross vehicle weight rating of 6,000 pounds or less, the Bin 5 Tier II emission standard established in regulations prescribed by the Administrator of the Environmental Protection Agency under section 202(i) of the Clean Air Act (42 U.S.C 7521(i)); and</text></subparagraph> 
<subparagraph id="HE33BF56F35BC4A87A8A10453A23BFB19"><enum>(B)</enum><text>in the case of a vehicle having a gross vehicle weight rating of more than 6,000 pounds but not more than 8,500 pounds, the Bin 8 Tier II emission standard established in such regulations.</text></subparagraph></paragraph> 
<paragraph id="H6E7C8DDF5DB54E8489BEFC82B29E8B94"><enum>(2)</enum><header>Dedicated alternative fuel vehicle</header><text>The term <quote>dedicated alternative fuel vehicle</quote> means a vehicle that operates solely on—</text> 
<subparagraph id="H3ADD79865A0746D5AF027BF29BA940A8"><enum>(A)</enum><text>methanol, denatured ethanol, or other alcohols;</text></subparagraph> 
<subparagraph id="HD7864035BF4D439A84113E01056BE686"><enum>(B)</enum><text>a mixture containing at least 85 percent of methanol, denatured ethanol, and other alcohols by volume with gasoline or other fuels;</text></subparagraph> 
<subparagraph id="HE6855F39D756414A902CD68BFAFD1ED"><enum>(C)</enum><text>natural gas;</text></subparagraph> 
<subparagraph id="H6BD31E0ECDF94D9EA185B93E679D47C8"><enum>(D)</enum><text>liquefied petroleum gas;</text></subparagraph> 
<subparagraph id="HDB6825D0739144219DA933161EE96D51"><enum>(E)</enum><text>hydrogen;</text></subparagraph> 
<subparagraph id="HA2F97BC611054722886CB3509D74F140"><enum>(F)</enum><text>coal derived liquid fuels;</text></subparagraph> 
<subparagraph id="HE3A3C79C3CC14C90A582299B000343CE"><enum>(G)</enum><text>fuels (except alcohol) derived from biological materials;</text></subparagraph> 
<subparagraph id="HC2FFC0575B484A568D654E84E628B52D"><enum>(H)</enum><text>electricity (including electricity from solar energy); or</text></subparagraph> 
<subparagraph id="H1595FE8AEF9C4C20B0B85583B9AE9641"><enum>(I)</enum><text>any other fuel that the Secretary prescribes by regulation that is not substantially petroleum and that would yield substantial energy security and environmental benefits.</text></subparagraph></paragraph> 
<paragraph id="H42D5F44B332844E2A31BA58BFA42C54F"><enum>(3)</enum><header>HOV facility</header><text>The term <quote>HOV facility</quote> means a high occupancy vehicle facility.</text></paragraph> 
<paragraph id="H50AE4AB2D7E34211B22CEBBA5A8BBA"><enum>(4) </enum><header>Hybrid vehicle</header><text display-inline="yes-display-inline">The term <quote>hybrid vehicle</quote> means a vehicle that—</text> 
<subparagraph id="H5A051A408EB643B7A337BF5900C11B7F"><enum>(A)</enum><text display-inline="yes-display-inline">has propulsion energy drawn from onboard hybrid sources of stored energy, including—</text> 
<clause id="HAA296655254A488BB7A3A281F2C41B62"><enum>(i)</enum><text display-inline="yes-display-inline">an internal combustion or heat engine using consumable fuel; and</text></clause> 
<clause id="H8B452070C81F451BBD5D73D4427D9081"><enum>(ii)</enum><text display-inline="yes-display-inline">a rechargeable energy storage system; and</text></clause></subparagraph> 
<subparagraph id="HD4DFF479B20F4FD18B00FAACDE3256C9"><enum>(B)</enum><text display-inline="yes-display-inline">has been certified by the manufacturer, in accordance with guidance prescribed by the Administrator under subsection (f), to have achieved either—</text> 
<clause id="H6BB18D62FD084304B4A1B41642EBD9D"><enum>(i)</enum><text>a 10 percent or greater increase in city fuel economy relative to a comparable vehicle that is an internal combustion gasoline fueled vehicle (other than a vehicle that has propulsion energy from such onboard hybrid sources); or</text></clause> 
<clause id="H591CD76FF76A4D5CA82695AB708AB36"><enum>(ii)</enum><text>a 10 percent or greater increase in lifetime fuel savings relative to such comparable vehicle.</text></clause></subparagraph></paragraph> 
<paragraph id="H722A988477724D5DBB40006100E34E50"><enum>(5)</enum><header>Low emission and energy-efficient vehicle</header><text>The term <quote>low emission and energy-efficient vehicle</quote> means a vehicle that—</text> 
<subparagraph id="H60296F90D6134B0FA6CDEA70CCA5F1D"><enum>(A)</enum><text>has been certified by the Administrator of the Environmental Protection Agency as meeting the Tier II emission standard established in regulations prescribed by the Administrator under section 202(i) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7521">42 U.S.C. 7521(i)</external-xref>) for that make and model year vehicle; and</text></subparagraph> 
<subparagraph id="HC4C4C0B4EAB741678E560051B64CEE94"><enum>(B)</enum><text display-inline="yes-display-inline">is a hybrid vehicle or dedicated alternative fuel vehicle.</text></subparagraph></paragraph> 
<paragraph id="H499DEC6242E341FF866E1BB924EE9178"><enum>(6)</enum><header>Public transportation vehicle</header><text>The term <quote>public transportation vehicle</quote> means a vehicle that provides public transportation (as defined in <external-xref legal-doc="usc" parsable-cite="usc/49/5302">section 5302(a)</external-xref> of title 49).</text></paragraph> 
<paragraph id="H4F69E06635134608B4778BA8B69684F0"><enum>(7)</enum><header>State agency</header><text>The term <quote>State agency</quote>, as used with respect to a HOV facility, means an agency of a State or local government having jurisdiction over the operation of the facility and includes a State transportation department.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA3E6FB79A6BA48A1A4F48CD9B699E597"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="HE3AB6175C55049EB8667B5C7C77B19D7"><enum>(1)</enum><header>Program efficiencies</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/102">Section 102</external-xref> of title 23, United States Code, is amended by striking subsection (a) and redesignating subsections (b) and (c) as subsections (a) and (b), respectively.</text></paragraph> 
<paragraph id="H6F0C47D627FB4D369D928C5C7993A926"><enum>(2)</enum><header>Chapter analysis</header><text>The analysis for subchapter I of chapter 1 of such title is amended by adding at the end the following:</text>

<subsection id="H0A9571ACEF7E4C6BA9C3BC00F0D8CD97"><enum>(c)</enum><header>Technical amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/102">Section 102(b)</external-xref> of title 23, United States Code, (as redesignated by subsection (b)(1) of this section) is amended by striking <quote>10 years</quote> and all that follows through <quote>after</quote> and inserting <quote>10 years (or such longer period as the State requests and the Secretary determines to be reasonable) after</quote>.</text></subsection></section>
