<official-title>To amend the Higher Education Act of 1965 to establish a demonstration program to support college and university communities that wish to expand their book store services and savings for students through the creation of course material rental programs.</official-title>

<section id="H7369105CFC7A42519474CE474C221886" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header> 
<subsection id="H20CACA92D3D54A75B135DCEF571DE3FA"><enum></enum><text>This Act may be cited as the <quote><short-title>Affordable Books for College Act</short-title></quote>.</text></subsection></section> 
<section id="H931C819222A1407DAB25D7ADCA23D4F5"><enum>2.</enum><header>Establishment of bookstore course material rental program</header><text display-inline="no-display-inline">Title VII of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1133">20 U.S.C. 1133 et seq.</external-xref>) is amended by adding at the end the following:</text>

<part id="H524B10DF54C74B78A9BAF9FA00922EA5"><enum>E</enum><header>College bookstore rental expansion program</header> 
<section id="HE38DBD0B2C6C44B2AA3D6524AE8620AA"><enum>771.</enum><header>Loans authorized</header> 
<subsection id="H117BFCF3137744078E6790A1B64818A5"><enum>(a)</enum><header>In general</header> 
<paragraph id="HA529EDAF44174B4B929F29487C359C33"><enum>(1)</enum><header>Authorization</header><text display-inline="yes-display-inline">From the amounts appropriated pursuant to <internal-xref idref="H06E402CAE5EF429BA6D901C9338E5532" legis-path="771. (g)">subsection (h)</internal-xref>, the Secretary shall make loans on a competitive basis to not more than 50 eligible entities to support programs that expand the services of bookstores to provide the option for students to rent course materials in order to achieve savings for students.</text></paragraph> 
<paragraph id="HC304C98E1FFA4E78BE74F5BB5888DE6D"><enum>(2)</enum><header>Grant program</header><text>The Secretary shall award grants to eligible entities to enable such entities to conduct, prior to submitting an application under subsection (c), a feasibility study to determine whether a program described in paragraph (1) would be effective at the school served by the entity. The maximum amount of a grant made pursuant to this subsection shall be $25,000.</text></paragraph> 
<paragraph id="H328FB806BFE84AE7BD11DC9CFA4DCDA"><enum>(3)</enum><header>Models for best practices</header><text>Not less often than once every 2 years, the Secretary shall compile and make publicly available a document that contains potential models and best practices for the use of entities carrying out college textbook rental programs.</text></paragraph></subsection> 
<subsection id="H4C308C753396498087F97D15FE136EAC"><enum>(b)</enum><header>Allocation of funds</header> 
<paragraph id="H8CB18EE950CF4A7D8998D1AEF0E04437"><enum>(1)</enum><header>Public comment period</header><text display-inline="yes-display-inline">In promulgating regulations to carry out the provision relating to the application procedures under subsection (c), the Secretary shall provide for a public comment period for outside groups to review and comment on such procedures before they are finalized by the Secretary.</text></paragraph> 
<paragraph id="H16269143DAB5464CB4DDF2E179A1CCBE"><enum>(2)</enum><header>Maximum amount</header><text>The maximum amount of a loan made pursuant to this section shall be $2,500,000. The maximum amount for all loans made pursuant to this section shall be $50,000,000.</text></paragraph></subsection> 
<subsection id="HB8447F791312467CADD9E2005B8900D"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity that desires to obtain a loan under this part shall submit an application to the Secretary at such time, in such form, and containing or accompanied by such information, agreements, and assurances as the Secretary may reasonably require.</text></subsection> 
<subsection id="H2460327D4D31415ABF1E009C5D50B4BE"><enum>(d)</enum><header>Use of funds</header><text>The funds made available by a loan under this part may be used for—</text> 
<paragraph id="HF9739AECAD884D6CBA84479FCEBE307"><enum>(1)</enum><text>purchase of course materials that the entity will make available by rent to students;</text></paragraph> 
<paragraph id="H2767DB4B959D4D13BCA1135DAC958ED8"><enum>(2)</enum><text>any equipment or software necessary for the conduct of a rental program;</text></paragraph> 
<paragraph id="H33F81F82A0C543368EF7FFC9ADC4BA38"><enum>(3)</enum><text>hiring staff needed for the conduct of a rental program, with priority given to hiring enrolled undergraduate students; and</text></paragraph> 
<paragraph id="H8223354096A74E04972F84FC90A73719"><enum>(4)</enum><text>building or acquiring extra storage space dedicated to course materials for rent.</text></paragraph></subsection> 
<subsection id="H627200C427CE4EE19B28A88EBB3F16E0"><enum>(e)</enum><header>Amount and terms of loans</header><text>The Secretary shall prescribe the terms and conditions of the loans under this part, except that the interest rate shall be equal to the rate applicable to funds borrowed by the Secretary from the Treasury to carry out the demonstration program under this part.</text></subsection> 
<subsection id="H4F9F7E9B37A944E2AD03443634E1CCF0"><enum>(f)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">To be eligible to receive a loan under this section, an entity shall be—</text> 
<paragraph id="H1F750EE968714B829B3CD0F2256E82AB"><enum>(1)(A)</enum><text>an institution of higher education; or</text></paragraph> 
<paragraph id="H600D84CB06164A9594725DB16400F6B5"><enum>(B)</enum><text>a campus or local nonprofit or for-profit bookstore, a bookstore cooperative, or an auxiliary service unit; and</text></paragraph> 
<paragraph id="H43E054450DE8419FB4E5BF41FB992E67"><enum>(2)</enum><text>if the entity is an entity described in paragraph (1)(B), recognized by an institution of higher education as effectively delivering course materials to undergraduate college students.</text></paragraph></subsection> 
<subsection id="H1CB71893BB60487300849CFB60C92400"><enum>(g)</enum><header>Study</header><text>Not later than September 30, 2010, the Secretary shall conduct a study on the savings achieved by students who participate in college textbook rental programs.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H06E402CAE5EF429BA6D901C9338E5532"><enum>(h)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this part such sums as may be necessary for fiscal year 2006 and each of the 5 succeeding fiscal years.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section>
