1.
Short title
This Act may be cited as the Lifespan Respite Care Act of 2005.
2.
Lifespan respite care
The Public Health Service Act (42 U.S.C. 201 et seq.) is amended by adding at the end the following: <enum>XXIX</enum><header>Lifespan respite care</header> <section id="HD54D00DC50904BB898E7760008507493"><enum>2901.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="H1D1FBA40A3A945719E998939E9903245"><enum>(1)</enum><header>Adult with a special need</header><text>The term <term>adult with a special need</term> means a person 18 years of age or older who requires care or supervision to—</text> <subparagraph id="H96362E702FB64A63B8DC581DB641C57D"><enum>(A)</enum><text>meet the person’s basic needs; or</text></subparagraph> <subparagraph id="H0533428577894A1A8786E16DF57F0037"><enum>(B)</enum><text>prevent physical self-injury or injury to others.</text></subparagraph></paragraph> <paragraph id="HB74F87B81A174C2180747BBB7B9E3E33"><enum>(2)</enum><header>Child with a special need</header><text>The term <term>child with a special need</term> means a person less than 18 years of age who requires care or supervision beyond that required of children generally to—</text> <subparagraph id="H572402D0C76C489F8773895D5DFAA786"><enum>(A)</enum><text>meet the child’s basic needs; or</text></subparagraph> <subparagraph id="H479A8D6E613C4191009F8FE9CE3B5B62"><enum>(B)</enum><text>prevent physical self-injury or injury to others.</text></subparagraph></paragraph> <paragraph id="HDCCA4B3B0AC94B8C8986D1FA47B4B7F"><enum>(3)</enum><header>Eligible recipient</header><text>The term <term>eligible recipient</term> means—</text> <subparagraph id="H95BDC86879504DBBBC5FE075DD661697"><enum>(A)</enum><text>a State agency;</text></subparagraph> <subparagraph id="H5FD39F52BAE14848B9F1CDACC6170900"><enum>(B)</enum><text>any other public entity that is capable of operating on a statewide basis;</text></subparagraph> <subparagraph id="H2224527421734EA9983B7D497B5C0659"><enum>(C)</enum><text>a private, nonprofit organization that is capable of operating on a statewide basis;</text></subparagraph> <subparagraph id="H6D4AECE3DB6C43BFAA4E553F78343F3E"><enum>(D)</enum><text>a political subdivision of a State that has a population of not less than 3,000,000 individuals; or</text></subparagraph> <subparagraph id="HBE4F4A2EAE2644D7AE42645658F95D8F"><enum>(E)</enum><text>any recognized State respite coordinating agency that has—</text> <clause id="H6CC11DF5CBF64E89A1E0DD9EA3F94FFA"><enum>(i)</enum><text>a demonstrated ability to work with other State and community-based agencies;</text></clause> <clause id="H736344C9E7C14A78A799A16D7724F110"><enum>(ii)</enum><text>an understanding of respite care and family caregiver issues; and</text></clause> <clause id="H493BB81E77464096BAC7FC76BD5FF7C7"><enum>(iii)</enum><text>the capacity to ensure meaningful involvement of family members, family caregivers, and care recipients.</text></clause></subparagraph></paragraph> <paragraph id="H82803939AF164577802D1C84C49DE5B3"><enum>(4)</enum><header>Family caregiver</header><text>The term <term>family caregiver</term> means an unpaid family member, a foster parent, or another unpaid adult, who provides in-home monitoring, management, supervision, or treatment of a child or adult with a special need.</text></paragraph> <paragraph id="H9495F29B67B64011AEC57498BFD4A242"><enum>(5)</enum><header>Lifespan respite care</header><text>The term <term>lifespan respite care</term> means a coordinated system of accessible, community-based respite care services for family caregivers of children or adults with special needs.</text></paragraph> <paragraph id="HFC8D5106D56245309532482D6330148E"><enum>(6)</enum><header>Respite care</header><text display-inline="yes-display-inline">The term <term>respite care</term> means planned or emergency care provided to a child or adult with a special need in order to provide temporary relief to the family caregiver of that child or adult.</text></paragraph></section> <section id="H78AB3AC58A094AFF99C8627EC7D2B737"><enum>2902.</enum><header>Lifespan respite care grants and cooperative agreements</header> <subsection id="H8D8DF1E858A24E26A5EBBFE1FABD5070"><enum>(a)</enum><header>Purposes</header><text>The purposes of this section are—</text> <paragraph id="H1639ABD2C7EA4E50BD74D5EA56005CF0"><enum>(1)</enum><text>to expand and enhance respite care services to family caregivers;</text></paragraph> <paragraph id="H73F991D3B16F42CD81C26F8F30895DA"><enum>(2)</enum><text>to improve the statewide dissemination and coordination of respite care; and</text></paragraph> <paragraph id="HE5C49271D1AE417B89D2B6BFA5E94DDC"><enum>(3)</enum><text>to provide, supplement, or improve access and quality of respite care services to family caregivers, thereby reducing family caregiver strain.</text></paragraph></subsection> <subsection id="H8D23D2603F4943E281ECBA06E76329E3"><enum>(b)</enum><header>Authorization</header><text>Subject to subsection (e), the Secretary is authorized to award grants or cooperative agreements to eligible recipients who submit an application pursuant to subsection (d).</text></subsection> <subsection id="H3E78527E2C3F44D39F097B7C125BCC7"><enum>(c)</enum><header>Federal lifespan approach</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary shall work in cooperation with the National Family Caregiver Support Program Officer of the Administration on Aging and other respite care program officers within the Department to ensure coordination of respite care services for family caregivers of children and adults with special needs.</text></subsection> <subsection id="HC6574D229991494681C3F2AAA99BCABF"><enum>(d)</enum><header>Application</header> <paragraph id="H7D58A57678BE4C51B4D026EE206C68C8"><enum>(1)</enum><header>Submission</header><text>Each eligible recipient desiring to receive a grant or cooperative agreement under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary shall require.</text></paragraph> <paragraph id="HCAD0C6BC7F224DAF86C59435E14FD1F3"><enum>(2)</enum><header>Contents</header><text>Each application submitted under this section shall include—</text> <subparagraph id="HE5D08D0872464AD7A17DADD2ECD49C27"><enum>(A)</enum><text>a description of the applicant’s—</text> <clause id="HB6F75F8C5AF242F68BDE01662F294556"><enum>(i)</enum><text>understanding of respite care and family caregiver issues;</text></clause> <clause id="H6FC0B12D885B4A8CB91600CAA2C89700"><enum>(ii)</enum><text>capacity to ensure meaningful involvement of family members, family caregivers, and care recipients; and</text></clause> <clause id="H7F38DB6786284C10997D00F3A215CA68"><enum>(iii)</enum><text>collaboration with other State and community-based public, nonprofit, or private agencies;</text></clause></subparagraph> <subparagraph id="H531DA95107814BE3855EB905FB811343"><enum>(B)</enum><text>with respect to the population of family caregivers to whom respite care information or services will be provided or for whom respite care workers and volunteers will be recruited and trained, a description of—</text> <clause id="H9D50911DD4DC43CA812986F0E7745541"><enum>(i)</enum><text>the population of family caregivers;</text></clause> <clause id="H332BB725319B4404846DC1662656DFCD"><enum>(ii)</enum><text>the extent and nature of the respite care needs of that population;</text></clause> <clause id="HD0C926F6172E4118A7C058A09C30EDB2"><enum>(iii)</enum><text>existing respite care services for that population, including numbers of family caregivers being served and extent of unmet need;</text></clause> <clause id="H11B39B30C0D0418DA5B77821B22221BD"><enum>(iv)</enum><text>existing methods or systems to coordinate respite care information and services to the population at the State and local level and extent of unmet need;</text></clause> <clause id="H951E4D9D5A684CFFA4B823ADEDA86903"><enum>(v)</enum><text>how respite care information dissemination and coordination, respite care services, respite care worker and volunteer recruitment and training programs, or training programs for family caregivers that assist such family caregivers in making informed decisions about respite care services will be provided using grant or cooperative agreement funds;</text></clause> <clause id="H06599D9A62F44B26BB34C5393FFDA3AE"><enum>(vi)</enum><text>a plan for collaboration and coordination of the proposed respite care activities with other related services or programs offered by public or private, nonprofit entities, including area agencies on aging;</text></clause> <clause id="H336A900E80624A599564F3F0AA4E7238"><enum>(vii)</enum><text>how the population, including family caregivers, care recipients, and relevant public or private agencies, will participate in the planning and implementation of the proposed respite care activities;</text></clause> <clause id="H3CB835A060F94B40003C69F3149F34CF"><enum>(viii)</enum><text>how the proposed respite care activities will make use, to the maximum extent feasible, of other Federal, State, and local funds, programs, contributions, other forms of reimbursements, personnel, and facilities;</text></clause> <clause id="H7A740DB57E764B25818D4527E1536B87"><enum>(ix)</enum><text>respite care services available to family caregivers in the applicant’s State or locality, including unmet needs and how the applicant’s plan for use of funds will improve the coordination and distribution of respite care services for family caregivers of children and adults with special needs;</text></clause> <clause id="H06545FB028C7458AA5D07BEC5F87EA46"><enum>(x)</enum><text>the criteria used to identify family caregivers eligible for respite care services;</text></clause> <clause id="H7038A7941C3B4641875078A989D0261B"><enum>(xi)</enum><text>how the quality and safety of any respite care services provided will be monitored, including methods to ensure that respite care workers and volunteers are appropriately screened and possess the necessary skills to care for the needs of the care recipient in the absence of the family caregiver; and</text></clause> <clause id="HA439D47CC0734636A2694D3E82B1E600"><enum>(xii)</enum><text>the results expected from proposed respite care activities and the procedures to be used for evaluating those results; and</text></clause></subparagraph> <subparagraph id="HABBFF18C553D4D7FAF40CF3D86E6EC23"><enum>(C)</enum><text>assurances that, where appropriate, the applicant shall have a system for maintaining the confidentiality of care recipient and family caregiver records.</text></subparagraph></paragraph></subsection> <subsection id="H0427F96A3FD04FD3A548B753D1A194FA"><enum>(e)</enum><header>Priority</header><text display-inline="yes-display-inline">When awarding grants or cooperative agreements under this section, the Secretary shall give priority to—</text> <paragraph id="H60A3D9C6738C425DA311704F3F003244"><enum>(1)</enum><text>applicants that show the greatest likelihood of implementing or enhancing lifespan respite care statewide; and</text></paragraph> <paragraph id="H84CDA8DE38B34B6ABA638509ABEE35DF"><enum>(2)</enum><text>applicants from States that are not otherwise receiving a grant under this title. </text></paragraph></subsection> <subsection id="H99DE6F8E9A7D42FD81F29DE9BB6679AA"><enum>(f)</enum><header>Use of grant or cooperative agreement funds</header> <paragraph id="H6EA7F2B420DA4B83A43DF9D35D3229FF"><enum>(1)</enum><header>In general</header> <subparagraph id="H2A29F5D1B18B492A8295BFBAA3AC0078"><enum>(A)</enum><header>Mandatory uses of funds</header><text display-inline="yes-display-inline">Each eligible recipient that is awarded a grant or cooperative agreement under this section shall use the funds, unless such a program is in existence—</text> <clause id="H6A0A90AFC75E4F4DA62C167BEB000059"><enum>(i)</enum><text display-inline="yes-display-inline">to develop lifespan respite care at the State and local levels;</text></clause> <clause id="H3939746D59AC4A67A1C0A1A8023B9527"><enum>(ii)</enum><text>to provide respite care services for family caregivers caring for children or adults; </text></clause> <clause id="H84EEC8CA8C2447C8BBAD3F8DB9F6AA90"><enum>(iii)</enum><text>to train and recruit respite care workers and volunteers; </text></clause> <clause id="H0762E2CBE9634CE6A6C382D2F13D870"><enum>(iv)</enum><text>to provide information to caregivers about available respite and support services; and </text></clause> <clause id="HB12A7EB0223D4213AF6E528700307EB0"><enum>(v)</enum><text>to assist caregivers in gaining access to such services.</text></clause></subparagraph> <subparagraph id="H208E9CF25FF74A11BB63D0E909AC05BB"><enum>(B)</enum><header>Discretionary uses of funds</header><text>Each eligible recipient that is awarded a grant or cooperative agreement under this section may use the funds for—</text> <clause id="H6216B12C9F9942628200268000C0FF54"><enum>(i)</enum><text display-inline="yes-display-inline">training programs for family caregivers to assist such family caregivers in making informed decisions about respite care services; </text></clause> <clause id="H7C6FF8D8BD904629B40046955110FF63"><enum>(ii)</enum><text>other services essential to the provision of respite care as the Secretary may specify; or </text></clause> <clause id="HD906E6C4265741E19CE4001B9FA6BCA0"><enum>(iii)</enum><text display-inline="yes-display-inline">training and education for new caregivers.</text></clause></subparagraph></paragraph> <paragraph id="HC7D4B72D136940F0A990C2F8ED88B200"><enum>(2)</enum><header>Subcontracts</header><text>Each eligible recipient that is awarded a grant or cooperative agreement under this section may use the funds to subcontract with a public or nonprofit agency to carry out the activities described in paragraph (1).</text></paragraph></subsection> <subsection id="HB1E3FD7D6632466EA11B127200E05CF3"><enum>(g)</enum><header>Term of grants or cooperative agreements</header> <paragraph id="H376666EA07114A5294D88FCD2EE0B6BF"><enum>(1)</enum><header>In general</header><text>The Secretary shall award grants or cooperative agreements under this section for terms that do not exceed 5 years.</text></paragraph> <paragraph id="HFE54D0DF05FB449CA041DFAF11F317C"><enum>(2)</enum><header>Renewal</header><text>The Secretary may renew a grant or cooperative agreement under this section at the end of the term of the grant or cooperative agreement determined under paragraph (1).</text></paragraph></subsection> <subsection id="H8A8380ED142F44B4B8D4AD5E8E75C12D"><enum>(h)</enum><header>Supplement, not supplant</header><text>Funds made available under this section shall be used to supplement and not supplant other Federal, State, and local funds available for respite care services.</text></subsection></section> <section id="HCF2452145F8349EF9FD3299410A65BA9"><enum>2903.</enum><header>National Lifespan respite resource center</header> <subsection id="HDA96B097CE994458A05D62C536D25803"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall award a grant or cooperative agreement to a public or private nonprofit entity to establish a National Resource Center on Lifespan Respite Care (referred to in this section as the <quote>center</quote>).</text></subsection> <subsection id="H19B19C4490E04B2B9F679B244401E91B"><enum>(b)</enum><header>Purposes of the center</header><text>The center shall—</text> <paragraph id="HD5CE63F35D1C459EBA3255CE66EB78CA"><enum>(1)</enum><text>maintain a national database on lifespan respite care;</text></paragraph> <paragraph id="H52CF40EFC90347199858ECC1C2BC4CC"><enum>(2)</enum><text>provide training and technical assistance to State, community, and nonprofit respite care programs; and</text></paragraph> <paragraph id="HA8A3C2A43FBD440785B9DBF201CA73FC"><enum>(3)</enum><text>provide information, referral, and educational programs to the public on lifespan respite care.</text></paragraph></subsection></section> <section id="H0B0D73FCFC66485AB491BB075213A3DC"><enum>2904.</enum><header>Report</header><text display-inline="no-display-inline">Not later than January 1, 2007, the Secretary shall report to the Congress on the activities undertaken under this title. Such report shall evaluate—</text> <paragraph id="HE0507E016EDA4B0CA7003F18746957FE"><enum>(1)</enum><text>the number of States that have lifespan respite care programs;</text></paragraph> <paragraph id="H32ABFE11D87B4E3DBC24F3356DC612DD"><enum>(2)</enum><text>the demographics of the caregivers receiving respite care services through grants or cooperative agreements under this title; and</text></paragraph> <paragraph id="H1FA275F068654CE281447F0095F5C7DE"><enum>(3)</enum><text>the effectiveness of entities receiving grants or cooperative agreements under this title.</text></paragraph></section> <section id="HB036E721ED7E4A7CBA7B6BFA8FADBD50"><enum>2905.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this title—</text> <paragraph id="H28ABD856D25048399EB477153DF7611"><enum>(1)</enum><text display-inline="yes-display-inline">$90,500,000 for fiscal year 2006; and </text></paragraph> <paragraph id="H2F575154DEAE42128C048BCCB3E6621E"><enum>(2)</enum><text>such sums as are necessary for fiscal years 2007 through 2010.</text></paragraph></section>.
