<section id="H76D03A5440294F51B1A269C8FA085915" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Notch Baby Health Care Relief Act of 2005</short-title></quote>.</text></section> 
<section id="HEF6B2796EF124430BE02B77482E4007F" section-type="subsequent-section"><enum>2.</enum><header>Premiums paid by certain senior citizens for Medicare Part B</header> 
<subsection id="HD0B98858E631403788FD3D76D62CA823"><enum>(a)</enum><header>In general</header><text>Subpart C of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to refundable credits) is amended by redesignating section 36 as section 37 and by inserting after section 35 the following new section:</text>

<section id="H4A0C6E52C2B94ECF9FA9F6385EFA15E5"><enum>36.</enum><header>Premiums paid by certain senior citizens for Medicare Part B</header> 
<subsection id="HAE75E7AD3420401DB8109F7946F2CC1D"><enum>(a)</enum><header>Allowance of credit</header><text>In the case of an eligible individual, there shall be allowed as a credit against the tax imposed by this subtitle for the taxable year an amount equal to the aggregate premiums paid under section 1840 of the <act-name parsable-cite="SSA">Social Security Act</act-name> by the taxpayer during the taxable year for enrollment of the eligible individual under part B of title XVIII of such Act.</text></subsection> 
<subsection id="H7326BF710DA946A1BC0096D8861857F3"><enum>(b)</enum><header>Eligible individual</header><text>For purposes of subsection (a), the term <term>eligible individual</term> means—</text> 
<paragraph id="H791FA7E4F64E4FBC9BF8FDA8CD427615"><enum>(1)</enum><text>an individual born after 1916 and before 1927 who had wages or self-employment income credited for one or more years prior to 1979 and who was not eligible for an old-age or disability insurance benefit, and did not die, prior to January 1979,</text></paragraph> 
<paragraph id="H781A792524F24ABAB9517EC132DF00AF"><enum>(2)</enum><text>the spouse (as determined under section 7703) of an individual described in paragraph (1), and</text></paragraph> 
<paragraph id="H04DE1DE4B732415CAD08EE1B7297EAAE"><enum>(3)</enum><text>the widow or widower, as the case may be, of an individual described in paragraph (1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF79ADD1347ED4C97B8A3E6E5B2BBBA2B"><enum>(b)</enum><header>Technical amendments</header> 
<paragraph id="H9C8B55B5F7A64FD68C1C8E7D0700F405"><enum>(1)</enum><text>Paragraph (2) of <external-xref legal-doc="usc" parsable-cite="usc/31/1324">section 1324(b)</external-xref> of title 31, United States Code, is amended by striking <quote>or enacted</quote> and inserting <quote>enacted</quote> and by inserting before the period <quote>, or from section 36 of such Code</quote>.</text></paragraph> 
<paragraph id="H69964781B2E944E5A4B243C50058F6BB"><enum>(2)</enum><text>The table of sections for subpart C of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by striking the last item and inserting the following new items:</text>

<subsection id="H4B0AE56D257A469986EADE3FBC6FA120"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to premiums paid after the date of enactment of this Act.</text></subsection></section>
