<official-title>To amend the Social Security Act to waive the 24-month waiting period for Medicare coverage of certain disabled individuals who have no health insurance coverage.</official-title>

<section section-type="section-one" id="HCE30D3D16B564F47A2B105BA0021F264" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Immediate Access to Medicare for the Disabled Act of 2005</short-title></quote>.</text></section> 
<section id="H1FF2C0155F614AAD914E008251F771F6"><enum>2.</enum><header>Waiver of 24-MONTH waiting period for Medicare coverage of certain disabled individuals who have no health insurance coverage</header> 
<subsection id="H63717B1A031F47DFA0A0FFD9C9E38B0"><enum>(a)</enum><header>In general</header><text>Section 226 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/426">42 U.S.C. 426</external-xref>) is amended—</text> 
<paragraph id="H7E1C16E991364ACB996CAB692D40B1CB"><enum>(1)</enum><text>by redesignating subsection (j) as subsection (k); and</text></paragraph> 
<paragraph id="HF691EBCCFB3E4813931896BF924D1000"><enum>(2)</enum><text>by inserting after subsection (i) the following new subsection:</text>

<subsection id="H81665C58596B40A38783C1FF67CA3D3"><enum>(j)</enum> 
<paragraph display-inline="yes-display-inline" id="HB0E5172DA1684F4391A789FF2CCA4868"><enum>(1)</enum><text>With respect to an individual described in paragraph (2) who would be entitled to benefits under subsection (b) but for the 24-month waiting period under subsection (b)(2), the following special rules apply:</text> 
<subparagraph id="HE681B63CA7EA420B8248B843A4A7F31B" indent="up1"><enum>(A)</enum><text>Subsection (b) shall be applied as if there were no requirement for any entitlement to benefits, or status, for a period longer than one month.</text></subparagraph> 
<subparagraph id="H2C0A8825689B418F8990FB3EEA3EFABF" indent="up1"><enum>(B)</enum><text>The entitlement under such subsection shall begin with the first month (rather than twenty-fifth month) of entitlement or status.</text></subparagraph> 
<subparagraph id="H5A64DB66765B4C2795A26D76FD1F0061" indent="up1"><enum>(C)</enum><text>Subsection (f) shall not be applied.</text></subparagraph></paragraph> 
<paragraph id="HD9A9EF877DAD4188A71FCBCA4B05CD79" indent="up1"><enum>(2)</enum><text>The special rules set forth in paragraph (1) apply to an individual who demonstrates to the Secretary that, during the 60-day period preceding the date on which such individual files an application for benefits under subsection (b)(2)(C), such individual has no health insurance coverage.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H07D3C4282AB545EABD507C3D2CE31B4D"><enum>(b)</enum><header>Conforming amendment</header><text>Section 1837 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395p">42 U.S.C. 1395p</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="HDBF2EFF9AB2143D4AC1CB4384D058B00"><enum>(k)</enum><text>In applying this section in the case of an individual who is entitled to benefits under part A pursuant to the operation of section 226(j), the following special rules apply:</text> 
<paragraph id="H2BBFD71F526B40368800C1D9CE447CA8"><enum>(1)</enum><text>The initial enrollment period under subsection (d) shall begin on the first day of the first month in which the individual satisfies the requirement of section 1836(1).</text></paragraph> 
<paragraph id="H6978F10D4CF74823002B9BC38FC01964"><enum>(2)</enum><text>In applying subsection (g)(1), the initial enrollment period shall begin on the first day of the first month of entitlement to disability insurance benefits referred to in such subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF382C9C329D54DBDB395760046CE6349"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to benefits for months beginning after the date of the enactment of this Act.</text></subsection></section>
