<subsection id="HF93C5E4A599D459E8885005EB7046436" display-inline="no-display-inline"><enum>(d)</enum><header>Regulations</header><text> Not later than 180 days after the date of the enactment of this Act, the Attorney General, the Secretary of Homeland Security, and Secretary of State shall promulgate regulations to implement the provisions contained in the Battered Immigrant Women Protection Act of 2000 (title V of VAWA–2000) and the amendments made by (and the provisions of) this Act.</text></subsection></section>

<subtitle id="H7B3AC68CA96C4D0F83355995481E724C"><enum>A</enum><header>Victims of Crime</header> 
<section id="H9146C3AF06F743268CE9E3036D1BD5A0" display-inline="no-display-inline"><enum>101.</enum><header>Conditions applicable to U and T visas</header> 
<subsection id="HC5B5166233BA4130AB15B0BF7859F97E"><enum>(a)</enum><header>Treatment of U derivatives</header><text>Clause (ii) of section 101(a)(15)(U)(ii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(U)(ii)</external-xref>), as added by section 1513(b) of VAWA–2000, is amended to read as follows:</text> 
<quoted-block style="OLC" id="H43DBCE9C00EA423885532886A959B618" display-inline="no-display-inline"> 
<clause id="H9F4CC4CEBD9E461A9134A74EE4B031DF" indent="up1"><enum>(ii)</enum><text>the spouse or child of an alien described in clause (i), or the parent of such an alien if the alien is a child, or the unmarried sibling of such a child if such sibling is under 18 years of age on the date on which such alien applied for status under such clause, if—</text> 
<subclause id="HD340A5A5DA7B4B0A8476D03780005941"><enum>(I)</enum><text>the Secretary of Homeland Security considers it necessary to avoid extreme hardship to such alien or such spouse, child, parent, or sibling; or</text></subclause> 
<subclause id="HC40DB00E79234EA892E31E2B76D3FE00"><enum>(II)</enum><text>a government official described in clause (i)(III) certifies that an investigation or prosecution described in such clause would be harmed without the assistance of such spouse, child, parent, or sibling; and</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDA136B99493E4A15AE709F76B59628D3" display-inline="no-display-inline"><enum>(b)</enum><header>Treatment of spouse and children of victims of trafficking</header><text>Clause (ii) of section 101(a)(15)(T) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(T)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="H8532AAC8D841431500C65561A2FAA500" display-inline="no-display-inline"> 
<clause id="HB5A387C6BED54138BFB984B4D494A4D9" indent="up1"><enum>(ii)</enum><text>if accompanying, or following to join, the alien described in clause (i)—</text> 
<subclause id="HE188014A4808436091BA8FB2981EB088"><enum>(I)</enum><text>in the case of an alien so described who is under 21 years of age, the spouse, children, unmarried siblings under 18 years of age on the date on which such alien applied for status under such clause, and parents of such alien; or</text></subclause> 
<subclause id="H84273B384E8647D7BAD771677962569C"><enum>(II)</enum><text>in the case of an alien described in clause (i) who is 21 years of age or older, the spouse and children of such alien;</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H510E3D2A28B74639996B96E84C782681"><enum>(c)</enum><header>Duration of U and T visas</header><text></text> 
<paragraph id="H688E384D90DA439492B6DF77000288E9"><enum>(1)</enum><header>U visas</header><text>Section 214(p) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(p)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block id="H916B45195D864296AFBAA9D3F5A63BAB" style="OLC"> 
<paragraph id="HA3AC81E932C54C458FEE44B404912F"><enum>(6)</enum><header>Duration of status</header><text>The authorized period of status of an alien as a nonimmigrant under section 101(a)(15)(U) shall be 4 years, but shall be extended—</text> 
<subparagraph id="HECBFC62D006944858C8D8FF8AF96358"><enum>(A)</enum><text>on a year-by-year basis upon certification from a Federal, State or local law enforcement official, prosecutor, judge, or other Federal, State or local authority investigating or prosecuting criminal activity described in section 101(a)(15)(U)(iii) that the alien’s continued presence in the United States is required to assist in the investigation or prosecution of such criminal activity; and</text></subparagraph> 
<subparagraph id="H211CCA901FD94EF38D903900226989CD"><enum>(B)</enum><text>if the alien files an application for adjustment of status under section 245(m), until final adjudication of such application.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H7EBF8187D14F44C495CF937CA6F1E3FD" display-inline="no-display-inline"><enum>(2)</enum><header>T visas</header><text display-inline="yes-display-inline">Section 214(o) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(o)</external-xref>), as redesignated by section 8(a)(3) of the Trafficking Victims Protection Reauthorization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/193">Public Law 108–193</external-xref>), is amended by adding at the end the following:</text> 
<quoted-block act-name="Immigration" id="HF6EC47AA991349589BD3B2DDD875F942"> 
<paragraph indent="up1" id="HD985B85AB60D405F86D6945E50FCC510"><enum>(7)</enum><text display-inline="yes-display-inline">The authorized period of status of an alien as a nonimmigrant status under section 101(a)(15)(T) shall be 4 years, but shall be extended—</text> 
<subparagraph id="H4A4A4D6EF7EE48C7BDB0C1B5000055E1"><enum>(A)</enum><text>on a year-by-year basis upon certification from a Federal, State or local law enforcement official, prosecutor, judge, or other Federal, State or local authority investigating or prosecuting criminal activity relating to human trafficking that the alien’s continued presence in the United States is required to assist in the investigation or prosecution of such criminal activity; and</text></subparagraph> 
<subparagraph id="HEBACABE1319246B2B853AA5B07F38C04"><enum>(B)</enum><text display-inline="yes-display-inline">if the alien files an application for adjustment of status under section 245(l), until final adjudication of such application.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HF41963E7333E413EBE74C24238B01890"><enum>(d)</enum><header>Permitting change of nonimmigrant status to U and T nonimmigrant status</header> 
<paragraph id="HFD4D1F3FD2F148FA8C59B7138DC7BF7B"><enum>(1)</enum><header>In general</header><text>Section 248 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1258">8 U.S.C. 1258</external-xref>) is amended—</text> 
<subparagraph id="HA9D568D776014D4CA16817C4B5E46DE7"><enum>(A)</enum><text>by striking <quote>The Attorney General</quote> and inserting <quote>(a) The Secretary of Homeland Security</quote>;</text></subparagraph> 
<subparagraph id="HBB00F2CD69AA46DAA96D41E9919F1B07"><enum>(B)</enum><text>by inserting <quote>(subject to subsection (b))</quote> after <quote>except</quote>; and</text></subparagraph> 
<subparagraph id="HD25AD1A29C814EDA855573B946C29430"><enum>(C)</enum><text>by adding at the end the following new subsection:</text> 
<quoted-block id="H1B1D3B79DC0A4F708F8565F6FF1368E8" style="OLC"> 
<subsection id="HDEB91B7179334F378D00247595E4FCD4"><enum>(b)</enum><text>The limitation based on inadmissibility under section 212(a)(9)(B) and the exceptions specified in numbered paragraphs of subsection (a) shall not apply to a change of nonimmigrant classification to that of a nonimmigrant under subparagraph (T) or (U) of section 101(a)(15), other than from such classification under subparagraph (C) or (D) of such section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H419567AC59B64F9C9BD809DB4263024F"><enum>(2)</enum><header>Conforming amendment</header><text>Section 214(l)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(l)(2)(A)</external-xref>) is amended by striking <quote>248(2)</quote> and inserting <quote>248(a)(2)</quote>. </text></paragraph></subsection> 
<subsection id="H2B91EFEBE5FA4C59A9C9EAB32BFC2718"><enum>(e)</enum><header>U visa crimes</header> 
<paragraph id="H479B7C51F41F4F57A200CFD88CB2DE1C"><enum>(1)</enum><header>In general</header><text>Section 101(a)(15)(U) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(U)</external-xref>) is amended—</text> 
<subparagraph id="HFC7DFE2B78134FE89894C7F3C98F988"><enum>(A)</enum><text>in clause (i)(I)—</text>

<paragraph id="HA0C95527B1494FCFBA00524900F40013"><enum>(2)</enum><header>Implementation</header><text>It is the intent of Congress that certifications should be made under clause (i)(III) of section 101(a)(15)(U) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(U)</external-xref>) where an alien provides information to a law enforcement official on criminal activity described in clause (iii) of such section and is willing to help in the investigation of such activity, regardless of whether a prosecution is made in such case or if prosecution is made for criminal activity not described in such clause.</text></paragraph></subsection> 
<subsection id="HB347D098393548DC91801206BEFCBEF"><enum>(f)</enum><header>Certification process for victims of trafficking</header> 
<paragraph id="H6558AE2E8F1E4355B9E3DF78B5DBBABC"><enum>(1)</enum><header>Victim assistance in investigation or prosecution</header><text>Section 107(b)(1)(E) of the Trafficking Victims Protection Act of 2000 (Division A of <external-xref legal-doc="public-law" parsable-cite="pl/106/386">Public Law 106–386</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/7105">22 U.S.C. 7105(b)(1)(E)</external-xref>) is amended—</text>

If such a petition contains a certification that a trafficking victim is a victim of a severe form of trafficking, the presence of the trafficking victim shall be permitted in accordance with this paragraph.</quote>. </text></paragraph></subsection> 
<subsection id="H48E317D044944C1AA6D7C671AC7C64F5"><enum>(g)</enum><header>Effective dates</header> 
<paragraph id="H3E00653533BA4F9F82A0A8F984F039A6"><enum>(1)</enum><header>In general</header><text>The amendments made by subsections (a), (b), (c)(1), (d), and (e) shall take effect on the date of the enactment of this Act.</text></paragraph> 
<paragraph id="HEE4BA28A7A8A4F10AB59FD8BDEA5AB7"><enum>(2)</enum><header>Transition for duration of T visas</header><text>In the case of an alien who is classified as a nonimmigrant under section 101(a)(15)(T) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(T)</external-xref>) before the the date of implementation of the amendment made by subsection (c)(2) and whose period of authorized stay was less than 4 years, the authorized period of status of the alien as such a nonimmigrant shall be extended to be 4 years and shall be further extended on a year-by-year basis as provided in section 214(o)(7) of such Act, as added by such amendment.</text></paragraph> 
<paragraph id="HB50592C5B87A4E338913D6A4DF236443"><enum>(3)</enum><header>Certification process</header> 
<subparagraph id="H7AA277B035EC433C98B9CCD6FBB032F" display-inline="yes-display-inline"><enum>(A)</enum><text>The amendments made by subsection (f)(1) shall be effective as if included in the enactment of VAWA–2000.</text></subparagraph> 
<subparagraph id="HE7E8584BE765465990E77264306C13A0" indent="up1"><enum>(B)</enum><text>The amendments made by subsection (f)(2) shall be effective as of the applicable date of transfer of authority from the Attorney General to the Secretary of Homeland Security under the Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>).</text></subparagraph> 
<subparagraph id="HDD89A55DF1944A6580F538A244F56BE5" indent="up1"><enum>(C)</enum><text>The amendment made by subsection (f)(3) shall be effective as if included in the enactment of the Trafficking Victims Protection Reauthorization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/193">Public Law 108–193</external-xref>). </text></subparagraph></paragraph></subsection></section> 
<section id="H2F9AD562A7BE41BFBEAF706334807518" display-inline="no-display-inline"><enum>102.</enum><header>Clarification of basis for relief under hardship waivers for conditional permanent residence</header> 
<subsection id="HC630B0A8BB194F60B064E0D7B2B8E77D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 216(c)(4) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1186a">8 U.S.C. 1186a(c)(4)</external-xref>) is amended by adding at the end the following: <quote>An application for relief under this paragraph may be based on one or more grounds specified in subparagraphs (A) through (D) and may be amended at any time to change the ground or grounds for such relief without the application being resubmitted.</quote>.</text></subsection> 
<subsection id="HC703E02F8FB641458CC5419CCF75028"><enum>(b)</enum><header>Conforming amendment</header><text>Section 237(a)(1)(H)(ii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(1)(H)(ii)</external-xref>) is amended by inserting before the period at the end the following: <quote>or qualifies for a waiver under section 216(c)(4)</quote>. </text></subsection> 
<subsection id="HE81F72AEC61E493FBAE114468207B2D"><enum>(c)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply to applications for relief pending or filed on or after April 10, 2003 .</text></subsection></section>

<clause id="H547AB9B048114EDD842997A2CD85E4DF"><enum>(ii)</enum><text>by inserting after <quote>domestic violence,</quote> the following: <quote>or who was a child of a lawful permanent resident resident who within the past 2 years (or, if later, two years after the date the child attains 18 years of age) died or otherwise terminated the parent-child relationship,</quote>.</text></clause></subparagraph> 
<subparagraph id="HB941E002C52E419F806C0093BFE84C5E"><enum>(B)</enum><header>Conforming treatment of deceased spouses</header><text>Section 204(a)(1)(B)(ii)(II)(aa)(CC) of such Act (8 U.S.C. 1154(a)(1)(B)(ii)(II)(aa)(CC)) is amended—</text> 
<clause id="H89B4C6B3EFE942E88EEAE5E69B099B00"><enum>(i)</enum><text>by redesignating subitems (aaa) and (bbb) as subitems (bbb) and (ccc), respectively; and</text></clause> 
<clause id="H66257CB309264ED6925EE0BC2B1329B8"><enum>(ii)</enum><text>by inserting before subitem (bbb), as so redesignated, the following: </text>

<paragraph id="H8803A3AF83FC496AB9003119775D544F"><enum>(3)</enum><header>Effective dates</header> 
<subparagraph id="H6B0C86E22B154CF4A5DDA9A4CA409D42"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the amendment made by paragraphs (1) and (2) shall take effect on the date of the enactment of this Act.</text></subparagraph> 
<subparagraph id="H8E24B81BAF8E445CBCD34D25675DF0F3" commented="no"><enum>(B)</enum><header>Transition in case of citizen parents who died before enactment</header><text>In applying the amendments made by paragraphs (1) and (2)(A) in the case of an alien whose citizen parent or lawful permanent resident parent died or whose parent-child relationship with such parent terminated during the period beginning on October 28, 1998, and ending on the date of the enactment of this Act, the following rules apply:</text> 
<clause id="H15055B127A4447F0A2AFA491E24E5A2"><enum>(i)</enum><text>The reference to <quote>within the past 2 years</quote> in section 204(a)(1)(A)(iv) or 204(a)(1)(B)(iii), respectively, of the Immigration and Nationality Act in the matter inserted by such paragraph is deemed to be a reference to such period.</text></clause> 
<clause id="H9C706C02659849F9B76DF78E198D6106"><enum>(ii)</enum><text>The petition must be filed under such section within 2 years after the date of the enactment of this Act (or, if later, 2 years after the alien’s 18th birthday).</text></clause> 
<clause id="HC18D7B9B3BC04D8B00667C2D00C7DBD4"><enum>(iii)</enum><text display-inline="yes-display-inline">The determination of eligibility for benefits as a child under such section (including under section 204(a)(1)(D) of the Immigration and Nationality Act by reason of a petition authorized under such section) shall be determined as of the date of the death of the citizen parent or lawful permanent resident parent or the termination of the parent-child relationship.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H114E6F20664B4729BB2811F8F5B36267"><enum>(b)</enum><header>Protecting victims of child abuse from aging out</header><text></text> 
<paragraph id="HB259B540782C4BCDB099222037048304"><enum>(1)</enum><header>Clarification regarding continuation of immediate relative status for children of citizens</header><text>Section 204(a)(1)(D)(i)(I) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(D)(i)(I)</external-xref>) is amended—</text> 
<subparagraph id="H17FE3A76B7424545ABA706AC57BFF154"><enum>(A)</enum><text>by striking <quote>clause (iv) of section 204(a)(1)(A)</quote> and inserting <quote>subparagraph (A)(iv)</quote>; and</text></subparagraph> 
<subparagraph id="HDD8E6EDBE65D4D82BFF9EEED6CF1FB12"><enum>(B)</enum><text>by striking <quote>a petitioner for preference status under paragraph (1), (2), or (3) of section 203(a), whichever paragraph is applicable</quote> and inserting <quote>to continue to be treated as an immediate relative under section 201(b)(2)(A)(i), or a petitioner for preference status under section 203(a)(3) if subsequently married,</quote>.</text></subparagraph></paragraph> 
<paragraph id="HC018DD50542D47B09200BDBA91A26214"><enum>(2)</enum><header>Clarification regarding application to children of lawful permanent residents</header><text>Section 204(a)(1)(D) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(D)</external-xref>) is amended——</text> 
<subparagraph id="HEAD1B2B703A84B45A1CF7E069D66C4E4"><enum>(A)</enum><text>in clause (i)(I)—</text> 
<clause id="H2EC278D9CC4A46FC9EF3B6F6761FA68"><enum>(i)</enum><text> by inserting after the first sentence the following new sentence: <quote>Any child who attains 21 years of age who has filed a petition under subparagraph (B)(iii) that was filed or approved before the date on which the child attained 21 year of age shall be considered (if the child has not been admitted or approved for lawful permanent residence by the date the child attained 21 years of age) a petitioner for preference status under section 203(a)(2)(A), with the same priority date assigned to the self-petition filed under such subparagraph.</quote>; and</text></clause> 
<clause id="HA3AD7B8FFD7C477382638875CA1500E"><enum>(ii)</enum><text>in the last sentence, by inserting <quote>in either such case</quote> after <quote>shall be required to be filed</quote>;</text></clause></subparagraph> 
<subparagraph id="H3580F80306034B50ABAF4CBCAF27B0D2"><enum>(B)</enum><text>in clause (i)(III), by striking <quote>paragraph (1), (2), or (3) of section 203(a)</quote> and inserting <quote>section 203(a)(2)(A)</quote>; and</text></subparagraph>

<subsection id="H3BB3E9626A354803AB018169E7B0AADA"><enum>(c)</enum><header>Clarification of no separate adjustment application for derivative children</header> 
<paragraph id="H411470C0645C41B2B722107BEC16579"><enum>(1)</enum><header>In general</header><text>Section 245(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255(a)</external-xref>) is amended by adding at the end the following: <quote>In the case of a petition under clause (ii), (iii), or (iv) of section 204(a)(1)(A) that includes an individual as a derivative child of a principal alien, no adjustment application other than the adjustment application of the principal alien shall be required for adjustment of status of the individual under this subsection or subsection (c).</quote>.</text> </paragraph> 
<paragraph id="HC224C24964104461009151AB2C006BB7"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall take effect on the date of the enactment of this Act and shall apply to applications filed before, on, or after such date.</text></paragraph></subsection> 
<subsection id="H1E4BDFC042004F79835283F3B8B1C698"><enum>(d)</enum><header> Late petition permitted for adults abused as children</header><text display-inline="yes-display-inline"></text> 
<paragraph id="HDECE1D6F7F464270B2ADBDD1C39612A5"><enum>(1)</enum><header>In general</header><text>Section 204(a)(1)(D) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(D)</external-xref>), as amended by subsection (b)(1), is amended by adding at the end the following new clause: </text> 
<quoted-block style="OLC" id="H8CC59749DE0F46DEB91D5DE37272E34B" display-inline="no-display-inline"> 
<clause id="H3598A023801E494400EA3EE89842B73" indent="up3"><enum>(v)</enum><text display-inline="yes-display-inline">In the case of an alien who qualified to petition under subparagraph (A)(iv) or (B)(iii) as of the date the individual attained 21 years of age, the alien may file a petition under such respective subparagraph notwithstanding that the alien has attained such age or been married so long as the petition is filed before the date the individual attains 30 years of age. In the case of such a petition, the alien shall remain eligible for adjustment of status as a child notwithstanding that the alien has attained 21 years of age or has married, or both.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H7978049601644E02AB09E10621CC1D64" display-inline="no-display-inline"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall take effect on the date of the enactment of this Act and shall apply to individuals who attain 21 years of age on or after the date of the enactment of VAWA–2000. </text></paragraph></subsection></section> 
<section id="H2C053A86CFF640EEB70313FA8F0A3EE" display-inline="no-display-inline" section-type="subsequent-section"><enum>113.</enum><header>Self-petitioning parents</header> 
<subsection id="HF2F712FBB6F543A4AE20BC719F6ED2A5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 204(a)(1)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(A)</external-xref>) is amended by adding at the end the following new clause: </text>

<clause id="H059679FCEFC04925A157A190AE93BB6" indent="up3"><enum>(vii)</enum><text display-inline="yes-display-inline">An alien who—</text> 
<subclause id="HB9EEB28F7E4B4B3E81C693F33BF870C1"><enum>(I)</enum><text display-inline="yes-display-inline">is the parent of a citizen of the United States or was a parent of a citizen of the United States who within the past 2 years lost or renounced citizenship status related to battering or extreme cruelty by the United States citizen son or daughter or who within the past two years died;</text></subclause> 
<subclause id="HE21763D64D364ED3BC6242AE3DCB1646"><enum>(II)</enum><text> is a person of good moral character;</text></subclause> 
<subclause id="HFF4A4A421E7D4E81B6E64DEDB12F94E"><enum>(III)</enum><text>is eligible to be classified as an immediate relative under section 201(b)(2)(A)(i); and</text></subclause> 
<subclause id="H45F9A4AF9A274C8CB71C59E1E91DC2F4"><enum>(IV)</enum><text>resides, or has resided in the past, with the citizen daughter or son; </text></subclause><continuation-text continuation-text-level="clause">may file a petition with the Secretary of Homeland Security under this subparagraph for classification of the alien under such section if the alien demonstrates that the alien has been battered by or has been the subject of extreme cruelty perpetrated by the alien’s citizen son or daughter.</continuation-text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB29ADEF110E44438B4B073B2B88BEE62"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act.</text></subsection></section> 
<section id="H8CBB588EC9AD4BE09BB6916F6FDAFF2F" display-inline="no-display-inline" section-type="subsequent-section"><enum>114.</enum><header>Promoting consistency in VAWA adjudications</header> 
<subsection id="HE6DA01E42C5040E79840AF45C2C36041"><enum>(a)</enum><header>In general</header><text>Section 204(a)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)</external-xref>) is amended—</text> 
<paragraph id="H939C35E399914061BB32EFCF847578AE"><enum>(1)</enum><text>in subparagraph (A)(iii)(II)(aa)(CC)(bbb), by striking <quote>an incident of domestic violence</quote> and inserting <quote>battering or extreme cruelty by the United States citizen spouse</quote>;</text></paragraph> 
<paragraph id="HFB50B3DD72554A6B8210557DB58791C4"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (A)(iv), by striking <quote>an incident of domestic violence</quote> and inserting <quote>battering or extreme cruelty by such parent</quote>;</text></paragraph> 
<paragraph id="HB66E17E8A2A945B9A7F9009C5534BEB"><enum>(3)</enum><text>in subparagraph (B)(ii)(II)(aa)(CC)(aaa), by striking <quote>due to an incident of domestic violence</quote> and inserting <quote>related to battering or extreme cruelty by the lawful permanent resident spouse</quote>; and</text></paragraph> 
<paragraph id="H1497A204458B454182C1E35608DCF1AF"><enum>(4)</enum><text display-inline="yes-display-inline">in subparagraph (B)(iii), by striking <quote>due to an incident of domestic violence</quote> and inserting <quote>related to battering or extreme cruelty by such parent</quote>.</text></paragraph></subsection> 
<subsection id="H1AC86946C59D41E1BCC0002F75505800"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect as if included in the enactment of VAWA–2000.</text></subsection></section> 
<section id="HBC39223F62B046F393F373E5D0EF807D"><enum>115.</enum><header>Relief for certain victims pending actions on petitions and applications for relief</header> 
<subsection id="HBD72749529BB4293AFC92C8492C74CB"><enum>(a)</enum><header>VAWA petitioners and applicants for U and T nonimmigrant classification</header> 
<paragraph id="H9ABAD0FBED0C4A4FA744FB3408958ED"><enum>(1)</enum><header>In general</header><text> Section 204(a)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

<subclause id="HEEE901A622B34984B46BDD5FDE7627D" indent="up1"><enum>(I)</enum><text>if the petition sets forth a prima facie case for approval, the alien shall not be removed, detained, or deported, and such a petition shall be processed without regard to whether a proceeding to remove or deport such alien is brought or pending; and</text> </subclause> 
<subclause id="H57E6FD82B5B84A9EB4DF012D77528150" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">if the petition is approved, the alien is eligible for work authorization and shall be provided an <quote>employment authorized</quote> endorsement or other appropriate work permit incidental to such approval.</text></subclause></clause> 
<clause id="H28FDB164370341E0927D27C3684F9E22" indent="up1"><enum>(ii)</enum><text>In the case of an alien in the United States for whom an application for nonimmigrant status (whether as a principal or derivative child) under subparagraph (T) of section 101(a)(15) has been filed—</text> 
<subclause id="HF8537DC0EA4A4E1C007B5F301F111799"><enum>(I)</enum><text>if there is a bona fide determination that the application is approvable or the application is approved, the alien shall not be removed, detained, or deported; and</text></subclause> 
<subclause id="H8CA8FDD78D97472691DCD5EB2815ED7F"><enum>(II)</enum><text>if the application is approved, the alien is eligible for work authorization and shall be provided an <quote>employment authorized</quote> endorsement or other appropriate work permit incidental to such approval.</text></subclause></clause> 
<clause id="H039DF99046E14A908ED46C5693022E01" indent="up1"><enum>(iii)</enum><text>In the case of an alien in the United States for whom an application for nonimmigrant status (whether as a principal or derivative child) under subparagraph (U) of section 101(a)(15) has been filed, if interim relief is granted on the application or the application is approved—</text> 
<subclause id="H3294CC598595410CA3B67D6FAF312DF8"><enum>(I)</enum><text>the alien shall not be removed, detained, or deported; and</text></subclause> 
<subclause id="H7F4612A99EDE435FB938007CDA1342FB"><enum>(II)</enum><text>the alien is eligible for work authorization and shall be provided an <quote>employment authorized</quote> endorsement or other appropriate work permit incidental to such relief or approval.</text></subclause></clause> </subparagraph> <after-quoted-block>.</after-quoted-block></quoted-block> </paragraph> 
<paragraph id="H63A667A3B3A247E2861524BC00EB91B2"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall take effect on the date of the enactment of this Act and shall apply to petitions and applications filed before, on, or after such date.</text></paragraph></subsection> 
<subsection id="HDF36EE89AF27402BB92DEBD88BC186BB"><enum>(b)</enum><header>Applicants for cancellation of removal or suspension of deportation</header> 
<paragraph id="H0D7BC70394EB41349823A5B008C75D0"><enum>(1)</enum><header>In general</header><text>Section 240A(b)(2) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1229b">8 U.S.C. 1229b(b)(2)</external-xref>) is amended by adding at the end the following new subparagraph: :</text> 
<quoted-block style="OLC" id="HB9118AA3EDA24A59A30038094ED4DFA" display-inline="no-display-inline"> 
<subparagraph id="H66FE7FF18ECF4C5F8D004FBE2C304B70"><enum>(E)</enum><header>Relief while application pending</header><text display-inline="yes-display-inline">In the case of an alien who has applied for relief under this paragraph and whose application sets forth a prima facie case for such relief or who has filed an application for relief under section 244(a)(3) (as in effect on March 31, 1997) that sets forth a prima facie case for such relief—</text> 
<clause id="HA3A1CE80175443EDA3499BC627D8F43E"><enum>(i)</enum><text>the alien shall not be removed, detained, or deported unless the application is denied and all opportunities for appeal of the denial have been exhausted; and</text></clause> 
<clause id="HB5FC48A0F86B4DF7BC9E00CB002E5E5D"><enum>(ii)</enum><text>such an application shall be processed without regard to whether a proceeding to remove or deport such alien is brought or pending.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H7E8F9A24D60249C400B8A6542579F0E5"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall take effect on the date of the enactment of this Act and shall apply to applications filed before, on, or after such date.</text></paragraph></subsection></section> 
<section id="H5EBF06C07F3743C8AE0088C30073104C"><enum>116.</enum><header>Access to VAWA protection regardless of manner of entry</header> 
<subsection id="H87247668E211477E99CE8F6397198279"><enum>(a)</enum><header>Fiancees</header> 
<paragraph id="H830EFB539471481DB4382FDDC4366223"><enum>(1)</enum><header>In general</header><text>Section 214(d) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(d)</external-xref>) is amended by inserting before the period at the end the following: <quote>, unless the alien is not eligible under section 204(c) to have a petition approved and is eligible for status as a VAWA petitioner, for status as a nonimmigrant under subparagraph (T) or (U) of section 101(a)(15)(T), or for relief under section 240A(b)(2) or under section 244(a)(3) (as in effect on March 31, 1997)</quote>.</text></paragraph> 
<paragraph id="H30E155C1FF464288A040E07628FD50F1"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall take effect on the date of the enactment of this Act and shall apply to aliens admitted before, on, or after such date.</text></paragraph></subsection> 
<subsection id="H11D601649C9E4C488002996700026D02"><enum>(b)</enum><header>Spouses who are conditional permanent residents</header> 
<paragraph id="H77A2A3FA82DB4E7C93C5133CC2AFF311"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 245(d) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255(d)</external-xref>) is amended—</text> 
<subparagraph id="H176DB7B66CF945BB85E5D8B0F8F3F92"><enum>(A)</enum><text>by inserting <quote>(1)</quote> after <quote>(d)</quote>; and</text></subparagraph> 
<subparagraph id="HDFE8C84702B448F3A3A3001E005EE314"><enum>(B)</enum><text>by adding at the end the following new paragraph: </text> 
<quoted-block style="OLC" id="H2B88659D391A4A86A0D120DD08E86500" display-inline="no-display-inline"> 
<paragraph id="H42F808A776E24944BA6717CA8F97F810" indent="up1"><enum>(2)</enum><text>Paragraph (1) shall not apply to an alien who seeks adjustment of status on the basis of an approved petition for classification as a VAWA petitioner.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H2F72A674D1E247D887576D35EF73549D"><enum>(2)</enum><header>Conforming clarification in cancellation of removal</header><text>Section 240A(b)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229b">8 U.S.C. 1229b(b)(2)(A)</external-xref>) is amended, in the matter before clause (i), by inserting <quote>, regardless of whether the alien has been admitted for permanent residence on a conditional basis under section 216,</quote> before <quote>if the alien demonstrates</quote>.</text></paragraph> 
<paragraph id="H612E65DCEC204C5C9196B0133CEA2B07"><enum>(3)</enum><header>Suspension of deportation</header><text display-inline="yes-display-inline">An alien may qualify for relief under section 244(a)(3) of the Immigration and Nationality Act (as in effect on March 31, 1997), regardless of whether the alien has been admitted for permanent residence on a conditional basis under section 216 of such Act.</text></paragraph> 
<paragraph id="H0284269AB7BA47F79E9E6DC4F25627A8"><enum>(4)</enum><header>Effective date</header><text>The amendments made by this subsection, and the provisions of paragraph (3), shall take effect on the date of the enactment of this Act and shall apply to applications for adjustment of status, for cancellation of removal, or for suspension of deportation filed before, on, or after such date.</text></paragraph></subsection> 
<subsection id="HA6049974B9394F3FB3CEFB181E907FEE"><enum>(c)</enum><header>Spouses and children of asylum applicants under adjustment provisions</header> 
<paragraph id="HED715BBE1857464DA41845A1036950DA"><enum>(1)</enum><header>In general</header><text>Section 209(b)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1159">8 U.S.C. 1159(b)(3)</external-xref>) is amended—</text>

<subparagraph id="H2A8AA152624443DF91AC8210E5910088" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">was the spouse of a refugee within the meaning of section 101(a)(42)(A) at the time the asylum application was granted and who was battered or was the subject of extreme cruelty perpetrated by such refugee or whose child was battered or subjected to extreme cruelty by such refugee (without the active participation of such spouse in the battery or cruelty), or</text></subparagraph> 
<subparagraph id="HB6006374BBC842C4882BB3A6644CCD7E" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">was the child of a refugee within the meaning of section 101(a)(42)(A) at the time of the filing of the asylum application and who was battered or was the subject of extreme cruelty perpetrated by such refugee,</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HB548BA5468324C9C83A6283276F42417"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1) shall take effect on the date of the enactment of this Act and—</text> 
<subparagraph id="H7417E353A7FE476B87CF93E900DE6F43"><enum>(A)</enum><text>section 209(b)(3)(B) of the Immigration and Nationality Act, as added by paragraph (1)(B), shall apply to asylum applications granted before, on, or after such date; and</text></subparagraph> 
<subparagraph id="H60A95FFBAC154D97BF229095C45BC3EB"><enum>(B)</enum><text>section 209(b)(3)(C) of such Act, as so added, shall apply with respect to asylum applications filed before, on, or after such date.</text></subparagraph></paragraph></subsection> 
<subsection id="H3D9C9394244C470A9BDD34F0361CDF75"><enum>(d)</enum><header>Visa waiver entrants</header> 
<paragraph id="H83EA9E5197CE4C61B19BA9E0F0386E22"><enum>(1)</enum><header>In general</header><text>Section 217(b)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187(b)(2)</external-xref>) is amended by inserting after <quote>asylum,</quote> the following: <quote>as a VAWA petitioner, or for relief under subparagraph (T) or (U) of section 101(a)(15), under section 240A(b)(2), or under section 244(a)(3) (as in effect on March 31, 1997),</quote>.</text></paragraph> 
<paragraph id="HC23047A771654365BA0177312F1D033B"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall take effect on the date of the enactment of this Act and shall apply to waivers provided under section 217(b)(2) of the Immigration and Nationality Act before, on, or after such date as if it had been included in such waivers.</text></paragraph></subsection> 
<subsection id="H7DEE00BBEDC7419B93E5A35608D5BBB7"><enum>(e)</enum><header>Exception from foreign residence requirement for educational visitors</header> 
<paragraph id="H7A0E8BA98BCA47829CBFD0FE551B11CA"><enum>(1)</enum><header>In general</header><text>Section 212(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(e)</external-xref>) is amended, in the matter before the first proviso, by inserting <quote>unless the alien is a VAWA petitioner or a nonimmigrant under subparagraph (T) or (U) of section 101(a)(15)</quote> after <quote>following departure from the United States</quote>.</text></paragraph>

<subsection id="HDB42F2D31A3F42E8857174C7D0864814"><enum>(a)</enum><header>Application of motions to reopen for all VAWA petitioners</header><text>Section 240(c)(7)(C)(iv) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1230">8 U.S.C. 1230(c)(7)(C)(iv)</external-xref>), as redesignated by section 101(d)(1) of the REAL ID Act of 2005 (Division B of <external-xref legal-doc="public-law" parsable-cite="pl/109/13">Public Law 109–13</external-xref>), is amended —</text>

<subsection id="H012BA2F220F54EA39602AD9D4CB212D"><enum>(g)</enum><header>Effective date</header><text>Except as otherwise provided in this section, the amendments made by this section shall take effect on the date of the enactment of this Act.</text></subsection></section>

<subsection id="HD82A105E7F6E4F61944956026586CECC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 240A(b)(4) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229b">8 U.S.C. 1229b(b)(4)</external-xref>) is amended—</text> 
<paragraph id="H73181CB24A684D75ABDA6ED14245A685"><enum>(1)</enum><text display-inline="yes-display-inline">in the heading, by inserting <quote><header-in-text level="paragraph" style="OLC">Battered aliens and</header-in-text></quote> before <quote><header-in-text level="paragraph" style="OLC">Children of battered aliens</header-in-text></quote>;</text></paragraph> 
<paragraph id="H90D90D0D24A14720B246E3EA03791EC1"><enum>(2)</enum><text>in subparagraph (A)—</text>

<subsection id="HEEE45A728CEA42148E4E6644C5F3E306"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 240B(d) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1229c">8 U.S.C. 1229c(d)</external-xref>) is amended—</text> 
<paragraph id="H2EA9150FE8814EA190AA7BA5FE32E473"><enum>(1)</enum><text>by striking <quote>If</quote> and inserting <quote>(1) Subject to paragraph (2), if</quote>; and</text></paragraph> 
<paragraph id="HF2368CA321224224B85CE29311DC9025"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>

<subsection id="HE2B724F9393C45E69961AEB0D4B1007C"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply as if included in the enactment of the Immigration Reform and Immigrant Responsibility Act of 1996 (division C of <external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>) and shall apply to failures to depart voluntarily occurring before, on, or after the date of the enactment of this Act.</text></subsection></section> 
<section id="H1791D64FC33B418796A682E96334A595"><enum>120.</enum><header>Clarification of access to naturalization for victims of domestic violence</header> 
<subsection id="H561C4A51BF474A759BD228D33E607487"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 319(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1430">8 U.S.C. 1430(a)</external-xref>) is amended by inserting after <quote>extreme cruelty by a United States citizen spouse or parent</quote> the following: <quote>, regardless of whether the lawful permanent resident status was obtained on the basis of such battery or cruelty</quote>.</text></subsection> 
<subsection id="HBF2417D017334C25A4A0DD35DDBE236"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act and shall apply to applications for naturalization filed before, on, or after the date of the enactment of this Act.</text></subsection></section> 
<section id="H9562B68B1074402E8EB5B7F84C127B38"><enum>121.</enum><header>Consolidating adjudication of VAWA cases in VAWA unit</header> 
<subsection id="H41176966B3E5442ABA89FC74E72FE9A1"><enum>(a)</enum><header>In general</header><text>Subtitle F of title IV of the Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>) is amended by adding at the end the following new section:</text>

<section id="HB454A508CF3C4707B7BA42B03DF793ED"><enum>479. </enum><header>Consolidated adjudication of VAWA cases in VAWA unit</header> 
<subsection id="HEE88BEEACCD5442198F8A87836ADFB7C"><enum>(a)</enum><header>Sole jurisdiction</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall designate the VAWA unit as the administrative unit within the Department of Homeland Security with sole jurisdiction over the adjudication of the following:</text>

<paragraph id="H3B926C0CDC2940CEA74EEBC7A33CC7BE"><enum>(4)</enum><text>in the case of an alien described in section 101(a)(27)(J) of the Immigration and Nationality Act who has been abused, neglected, or abandoned, contact the alleged abuser (or family member of the alleged abuser) at any stage of applying for special immigrant juvenile status, including after a request for the consent of the Secretary of Homeland Security under clause (iii)(I) of such section.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>

<subsection id="H7F1EEEFC91D94F3E9B45A54FDAEAEC43"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 101(b)(1)(E)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(b)(1)(E)(i)</external-xref>) is amended by inserting after <quote>at least two years</quote> the following: <quote>or if the child has been battered or subject to extreme cruelty by the adopting parent or by a family member of the adopting parent residing in the same household</quote>.</text></subsection> 
<subsection id="HF95E3D4CBC1E4F02A239F3904010F204"><enum>(b)</enum><header>Conforming naturalization amendment</header><text>Section 320(a)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1431">8 U.S.C. 1431(a)(3)</external-xref>) is amended by inserting before the period at the end the following: <quote>or the child is residing in the United States pursuant to a lawful admission for permanent residence and has been battered or subject to extreme cruelty by the citizen parent or by a family member of the citizen parent residing in the same household </quote></text></subsection> 
<subsection id="HC42F97CD99AB4557827184CE002093E8"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act and shall apply to applications pending or filed on or after such date.</text></subsection></section> 
<section id="H0788559CBAEC4768AF20DEA71CC755BD" display-inline="no-display-inline"><enum>132.</enum><header>Waiver of certain grounds of inadmissibility for VAWA petitioners</header> 
<subsection id="HFC7C50729C4C47B692F4EE2D25E2CDC2"><enum>(a)</enum><header>Waiver of unlawful presence</header><text>Paragraph (9)(B)(iii)(IV) of section 212(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)</external-xref>) is amended by striking <quote>who would be described in paragraph (6)(A)(ii)</quote> and all that follows and by inserting <quote>who demonstrates that the alien is described in subclauses (I) and (II) of paragraph (6)(A)(ii).</quote>.</text></subsection> 
<subsection id="H0DE4E3C11F7440BB9BF84EB4E059C37C"><enum>(b)</enum><header>Waiver of false claim of U.S. citizenship</header><text></text> 
<paragraph id="HF41DCC6A20BF49AC871676DAF0C33EE6"><enum>(1)</enum><header>In general</header><text>Section 212(i)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(i)(1)</external-xref>) is amended by inserting <quote>(and, in the case of a VAWA petitioner who demonstrates a connection between the false claim of United States citizenship and the petitioner being subjected to extreme cruelty or physical or mental abuse, clause (ii))</quote> after <quote>clause (i)</quote>.</text></paragraph> 
<paragraph id="H59B45E4A83AD475F8DD18DFC770064EE"><enum>(2)</enum><header>Conforming reference</header><text>Section 212(a)(6)(C)(iii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(6)(C)(iii)</external-xref>) is amended by striking <quote>clause (i)</quote>and inserting <quote>clauses (i) and (ii)</quote>.</text></paragraph></subsection>

<subsection id="H6E4E81E5F84749F7AA95F968DA124033"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 214(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)</external-xref>), as amended by sections 403(a) and 404(a) of the REAL ID Act of 2005 (Division B of <external-xref legal-doc="public-law" parsable-cite="pl/109/13">Public Law 109–13</external-xref>), is amended by adding at the end the following new paragraph: </text>

<paragraph id="HA23A1C0E3A0A41AC883CF4254E06CEBB" indent="up1"><enum>(15)</enum><text display-inline="yes-display-inline">In the case of an alien spouse admitted under section 101(a)(15)(H) who is accompanying or following to join a principal alien admitted under section 101(a)(15)(H)(i)(B), the Secretary of Homeland Security shall authorize the alien spouse to engage in employment in the United States and provide the spouse with an <quote>employment authorized</quote> endorsement or other appropriate work permit if the alien spouse demonstrates that during the marriage the alien spouse or a child of the alien spouse has been battered or has been the subject to extreme cruelty perpetrated by the spouse of the alien spouse.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB7C6013E85664F878461E8F500D11021"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act and shall apply to aliens who obtained the status of an alien spouse admitted under section 101(a)(15)(H) of the Immigration and Nationality Act before, on, or after such date.</text></subsection></section> 
<section id="H44040858C8FF4242A4ADA8C0E8528DF3" display-inline="no-display-inline"><enum>135.</enum><header>Grounds for hardship waiver for conditional permanent residence for intended spouses</header>

<section id="HD19D9A470D524C22841DDF27CC1E7183"><enum>139.</enum><header>Conforming relief in suspension of deportation parallel to the relief available in VAWA–2000 cancellation for bigamy</header><text display-inline="no-display-inline"> Section 244(a)(3) of the Immigration and Nationality Act (as in effect before the title III–A effective date in section 309 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996) shall be applied as if <quote>or by a United States citizen or lawful permanent resident whom the alien intended to marry, but whose marriage is not legitimate because of that United States citizen’s or permanent resident’s bigamy</quote> were inserted after <quote>by a spouse or parent who is a United States citizen or lawful permanent resident</quote>.</text></section>

<subsection id="HC65AC68F6E2A48DB9D56A3FA167E6DA8"><enum>(c)</enum><header>Exemption from 5-year ban for Federal means-tested public benefits</header><text>Section 403(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1613">8 U.S.C. 1613(b)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<subparagraph id="H957DC6CFA8DB4DA68945C269E22359FB"><enum>(B)</enum><text>is described in section 431(b) and also is described in section 431(c), other than paragraphs (1)(B), (2)(B), and (3)(B) of such section; or</text></subparagraph> 
<subparagraph id="H5896B4CADFAE4F0180EB148502A818C9"><enum>(C)</enum><text>is described in subparagraph (A) or (B) and was lawfully admitted as a permanent resident.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HBC60684D15124A64B918008B491EDF70"><enum>(d)</enum><header>Status as qualified alien for VAWA petitioners and nonimmigrant <quote>U</quote> and <quote>T</quote> visa applicants and visa holders</header><text>Section 431(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1641">8 U.S.C. 1641(b)</external-xref>) is amended—</text> 
<paragraph id="H7D00BDB40F6543D09DB3D3CA047CBEFE"><enum>(1)</enum><text>in paragraph (1)(B)—</text>

<paragraph id="HE42C06C3FDD54101006E2CFC56C3D948"><enum>(1)</enum><header>In general</header><text>Section 431(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1641">8 U.S.C. 1641(c)</external-xref>) is amended—</text> 
<subparagraph id="H22793C2508234E45A5A452E4D59CD240"><enum>(A)</enum><text>in paragraph (1)(A), by striking <quote>by a spouse or a parent, or by a member of the spouse or parent’s family residing in the same household as the alien and the spouse or parent consented to, or acquiesced in, such battery or cruelty</quote> and inserting <quote>by a spouse, parent, son, or daughter, or by any individual having a relationship with the alien covered by the civil or criminal domestic violence statutes of the State or Indian country where the alien resides, or the State or Indian country in which the alien, the alien’s child, or the alien child’s parents received a protection order, or by any individual against whom the alien could obtain a protection order,</quote>;</text></subparagraph>

<paragraph id="H7F92AC00401544088C1E3BB9EBF5D2C3"><enum>(2)</enum><header>Federal attribution of sponsor’s income and resources</header><text>Section 421(f)(1)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1631">8 U.S.C. 1631(f)(1)(A)</external-xref>) is amended—</text> 
<subparagraph id="H4B69AEFD283D4975B5DB6CD33563C732"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>by a spouse or parent, or by a member of the spouse or parent’s family residing in the same household as the alien and the spouse or parent consented or acquiesced to such battery or cruelty,</quote> and inserting <quote>by a spouse, parent, son, or daughter, or by any individual having a relationship with the alien covered by the civil or criminal domestic violence statutes of the State or Indian country where the alien resides, or the State or Indian country in which the alien, the alien’s child, or the alien child’s parents received a protection order, or by any individual against whom the alien could obtain a protection order,</quote>;</text></subparagraph> 
<subparagraph id="HFE15F81A5C7641AE98E01097551E0142"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (ii), by striking <quote>by a spouse or parent of the alien (without the active participation of the alien in the battery or cruelty), or by a member of the spouse or parent’s family residing in the same household as the alien and the spouse or parent consented or acquiesced to such battery or cruelty,</quote> and inserting <quote>by a spouse, parent, son, or daughter of the alien (without the active participation of the alien in the battery or cruelty) or by any individual having a relationship with the alien covered by the civil or criminal domestic violence statutes of the State or Indian country where the alien resides, or the State or Indian country in which the alien, the alien’s child, or the alien child’s parents received a protection order, or by any individual against whom the alien could obtain a protection order,</quote>;</text></subparagraph> 
<subparagraph id="H2F165EB7F14945ACB798E25DF065668F"><enum>(C)</enum><text>by striking <quote>or</quote> before <quote>(iii) the alien</quote>; and</text></subparagraph> 
<subparagraph id="HE8067C34E38E4065B180C1FEC4196E9E"><enum>(D)</enum><text>by inserting <quote>, or (iv) the alien is described in section 431(c)(4)</quote> before <quote>and the battery or cruelty</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H78B8976E0DF349DB9036050042455EDD"><enum>(f)</enum><header>Elimination of sponsor liability and responsibility or reimbursement with respect to benefits provided to battered aliens</header><text>Section 423(d) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 is amended by adding after paragraph (11) the following new paragraph:</text>

<subparagraph id="H4305CB195BBF4B8D9B872771B36E47D1"><enum>(B)</enum><text>is described in section 431(b) and also is described in section 431(c), other than paragraphs (1)(B), (2)(B), and (3)(B) of such section.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H172C7FA40F57405C9044C35D31970019"><enum>(h)</enum><header>Conforming amendment confirming IIRAIRA’s grant of public and assisted housing to all qualified aliens, including battered immigrants</header><text>Section 214 of the Housing and Community Development Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/1436a">42 U.S.C. 1436a</external-xref>) is amended—</text> 
<paragraph id="HDDF6ED977775401EBA7C8DCE0067163C"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H9D5F94F86B274BBC8216AAC2B364A9E0"><enum>(A)</enum><text>in paragraph (6), by striking <quote>or</quote> at the end;</text></subparagraph> 
<subparagraph id="H6E326D1F7B1F46EE8872F007959E57FB"><enum>(B)</enum><text>by redesignating paragraph (7) as paragraph (8); and</text></subparagraph>

<subsection id="HA8D86B701D76411CB1CCEFAC0078D62E"><enum>(i)</enum><header>Implementation</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security, Secretary of Agriculture, the Secretary of Health and Human Services, and the Secretary of Housing and Urban Development shall promulgate regulations for its officials to implement this section.</text></subsection> 
<subsection id="H67B97B9BA5754972AD3293FF053ECDDA"><enum>(j)</enum><header>Effective date</header><text>The amendments made by this section apply to applications for public benefits and public benefits provided on or after the date of the enactment of this Act.</text></subsection></section></subtitle> 
<subtitle id="HAAF5C85733FF443B986984C8BEE1A3"><enum>C</enum><header>Law Enforcement Training Grants</header> 
<section id="H3DFCBAFF1B7848A094D76CBD2DDDBCB" display-inline="no-display-inline"><enum>221.</enum><header>Grants for law enforcement training programs to identify and protect victims of trafficking</header> 
<subsection id="H8989FB1A28D746E482590071E990D39"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HA46161EB29DC4B5A855BA46279A37324"><enum>(1)</enum><header>Act of trafficking</header><text>The term <term>act of trafficking</term> means an act or practice described in paragraph (8) or (9) of section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>).</text></paragraph> 
<paragraph id="H8ED1367EBF1E4330BB196FDC8B6C53F3"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a State or a local government.</text></paragraph> 
<paragraph id="H10B9021125404B949B522D6E102524C4"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, the United States Virgin Islands, the Commonwealth of the Northern Mariana Islands, American Samoa, and any other territory or possession of the United States.</text></paragraph> 
<paragraph id="H8067002EC4E049B0A1F8D6E0F235F1C"><enum>(4)</enum><header>Victim of trafficking</header><text>The term <term>victim of trafficking</term> means an individual subjected to an act of trafficking.</text></paragraph></subsection> 
<subsection id="HD232653806A84034A72B6EF4073BBCF5"><enum>(b)</enum><header>Grants authorized</header><text>The Attorney General may award grants to eligible entities to provide training to State and local law enforcement personnel to identify and protect victims of trafficking.</text></subsection> 
<subsection id="H1269B0B28DD343A28F85A0D338730447"><enum>(c)</enum><header>Use of funds</header><text>A grant awarded under this section shall be used for any one or more of the following:</text> 
<paragraph id="HF9C672924BBC492AB2AC7984A6CD21F"><enum>(1)</enum><text>To train law enforcement personnel to identify and protect victims of trafficking, including training such personnel to utilize Federal, State, or local resources to assist victims of trafficking.</text></paragraph> 
<paragraph id="HEF4E04D93FA34688A470E61DCF829C27"><enum>(2)</enum><text>To train law enforcement or State or local prosecutors to identify, investigate, or prosecute acts of trafficking.</text></paragraph> 
<paragraph id="HF93D709061E74072A6C4EF223914798"><enum>(3)</enum><text>To train law enforcement or State or local prosecutors to utilize laws that prohibit acts of trafficking.</text></paragraph> 
<paragraph id="H053BDE9845F048989B78E59772AC2E97"><enum>(4)</enum><text>To assist in the development of State and local laws to prohibit acts of trafficking.</text></paragraph></subsection> 
<subsection id="H7DDC620C36A74C6BB43CE33EEB257E6E"><enum>(d)</enum><header>Restrictions</header> 
<paragraph id="H28654688A0F8416992ED867670C0B1C2"><enum>(1)</enum><header>Supplement not supplant</header><text>A grant awarded under this section shall be used to supplement and not supplant other Federal, State, and local public funds available to carry out the training described in subsection (c).</text></paragraph> 
<paragraph id="HAA44B079CE38447CA21000B9002EC439"><enum>(2)</enum><header>Administrative expenses</header><text>An eligible entity that receives a grant under this section may use not more than 5 percent of the total amount of such grant for administrative expenses.</text></paragraph> 
<paragraph id="H1497874861A3430088F9A46170B0009E"><enum>(3)</enum><header>Nonexclusivity</header><text>Nothing in this section may be construed to restrict the ability of an eligible entity to apply for or obtain funding from any other source to carry out the training described in subsection (c).</text></paragraph></subsection> 
<subsection id="H94FE2F607E9C45A1B7BE5686A681C49F"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated $10,000,000 for each of fiscal years 2006 through 2010 to carry out this section.</text></subsection></section></subtitle></title>
