<official-title>To ensure that countries that have signed a Small Quantities Protocol also sign, ratify, and implement the Additional Protocol and provide access by IAEA inspectors to their nuclear-related facilities and to direct the United States Permanent Representative to the IAEA to make every effort to rescind and eliminate the Small Quantities Protocol and ensure compliance by all Member States of the IAEA with IAEA obligations and the purposes and principles of the Charter of the United Nations.</official-title>

<section id="H24841800B83146D1A5C2DB9FA772CB5" section-type="section-one"><enum>1.</enum><header>Small Quantities Protocol</header> 
<subsection id="H062D26E2F527453F9D6912E2777C13F8"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> 
<paragraph id="H70740E5D1C2D4162AD6483279017F46D"><enum>(1)</enum><text display-inline="yes-display-inline">There are 87 countries that are signatories to the Small Quantities Protocol as part of their existing safeguards and inspection agreement with the International Atomic Energy Agency (IAEA).</text></paragraph> 
<paragraph id="H6355875D95B84148A137A11D00C95B11"><enum>(2)</enum><text>The Small Quantities Protocol was originally intended to conserve limited safeguards resources by foregoing inspections in small countries in stable regions that had little or no nuclear materials and no nuclear facilities.</text></paragraph> 
<paragraph id="HD9B7F685CFB345FF91BB05EC00BC5FCB"><enum>(3)</enum><text>Unfortunately, at a time when terrorism and private nuclear <quote>black-market</quote> supplier networks exist and flourish by taking advantage of small countries with lax government regulations and oversight, the Small Quantities Protocol may become a hindrance to the timely detection by the IAEA of illicit nuclear proliferation activities. </text></paragraph> 
<paragraph id="H3014FCBCB6AA42BCA2A5115B08B5D68F" commented="no"><enum>(4)</enum><text>It has also become clear that some countries, such as Saudi Arabia, are not in secure and stable regions of the world and concerns have been raised about their possible interest in nuclear technology.</text></paragraph> 
<paragraph id="HE5804E87EAC24E0A890007002D008CCC" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">Saudi Arabia, a signatory to a Small Quantities Protocol as of June 16, 2005, is one of 27 non-nuclear members of the Treaty on the Non-Proliferation of Nuclear Weapons (21 UST 483) (commonly referred to as the <quote>Nuclear Nonproliferation Treaty</quote> or the <quote>NPT</quote>) but is only <quote>willing to provide</quote> the IAEA with additional information and access <quote>if all other parties</quote> are required to comply.</text></paragraph> 
<paragraph id="H4B5A5391ACC44475B15BC8F7E0EB0068" commented="no"><enum>(6)</enum><text>The Small Quantities Protocol allows countries to possess up to the following amounts of nuclear material without having to report such to the IAEA:</text> 
<subparagraph id="HFCEBC44E87A04599874100323B8ED479" commented="no"><enum>(A)</enum><text>Ten tons of natural uranium.</text></subparagraph> 
<subparagraph id="H0D19330CF265464BB3F1957516A96E46" commented="no"><enum>(B)</enum><text>Twenty tons of depleted uranium, depending on the degree of enrichment.</text></subparagraph> 
<subparagraph id="H030281A1B244479E83000000908570C4" commented="no"><enum>(C)</enum><text>One kilogram of plutonium.</text></subparagraph></paragraph> 
<paragraph id="H55C16EFC3C0A456BB795F0DAB0D15928"><enum>(7)</enum><text>Countries party to the Small Quantities Protocol can continue to secretly work on nuclear facilities for up to six months before such facilities are operational.</text></paragraph> 
<paragraph id="HA4DFC751542F46D6833370F3F9262811"><enum>(8)</enum><text>The Small Quantities Protocol therefore makes it difficult for the IAEA to evaluate the nuclear program of a Small Quantities Protocol country or to verify that such a country meets the conditions required to operate under the Small Quantities Protocol. </text></paragraph> 
<paragraph id="HAB057B98B4C94439006F8B80B874C02D"><enum>(9)</enum><text>According to an IAEA report circulated to the Member States on the Board of Governors of the IAEA, the Small Quantities Protocol <quote>has the effect of holding in abeyance the implementation of most of the safeguard’s measures</quote> as well as limiting <quote>obligations to provide certain information</quote> and the <quote>right to request access to relevant locations</quote>.</text></paragraph>
<paragraph id="H829777D5B09C4B57B59174487C687D25"><enum>(10)</enum><text display-inline="yes-display-inline">The Additional Protocol to the Safeguards Agreements between the IAEA and Member States of the IAEA empowers the IAEA to seek a broad range of information about all aspects of a country’s nuclear and nuclear-related activities. The Additional Protocol also provides broader right of access for IAEA inspectors to nuclear and nuclear-related facilities and contains measures to improve the effectiveness of safeguards for such activities.</text></paragraph> 
<paragraph id="H1686FE565A0F485C82674C5B2E00B3C8"><enum>(11)</enum><text display-inline="yes-display-inline">The Additional Protocol is therefore an important means of addressing some of the concerns outlined above, particularly concerning rights of access to certain information.</text></paragraph></subsection> 
<subsection id="H52519F34C2A94E4D8BFD2D8C5EE851D1"><enum>(b)</enum><header>Statement of Congress</header><text display-inline="yes-display-inline">Congress declares that, in light of the findings described in subsection (a), the United States should use all diplomatic, political, and economic means necessary to persuade all countries currently with a Small Quantities Protocol to renounce their Small Quantities Protocol and to sign, ratify, and implement the Additional Protocol at the earliest possible date.</text> </subsection> 
<subsection id="HC46AF5C93CA246689DF47E6ECC204BE5"><enum>(c)</enum><header>United States policy</header> 
<paragraph id="H27DCC2379B26447A88000093BFE5B44C"><enum>(1)</enum><header>Requirements</header> 
<subparagraph id="HE2214E6C6271455F00AB94CE5AAECA1"><enum>(A)</enum><header>In general</header><text>The President shall use all available political, economic, and diplomatic tools to ensure that each United States ally or recipient of United States assistance that has signed a Small Quantities Protocol with the IAEA, also signs, ratifies, and implements the Additional Protocol and provides immediate access for IAEA inspectors to its nuclear-related facilities.</text></subparagraph> 
<subparagraph id="H344D931F7FD845E88E993F1962DE61E5"><enum>(B)</enum><header>Definition</header><text>In this paragraph, the term <quote>United States assistance</quote> means assistance under any provision of law with respect to which amounts are appropriated under the foreign operations, export financing, and related programs appropriations Act for a fiscal year. </text></subparagraph></paragraph> 
<paragraph id="H769B243E9C074FC3AEE69D9170003527" commented="no"><enum>(2)</enum><header>Limitation on assistance</header><text display-inline="yes-display-inline">If a country has signed a Small Quantities Protocol with the IAEA but does not satisfy the requirements specified in paragraph (1), the President shall prohibit the provision or transfer of each of the following to the country:</text> 
<subparagraph id="H82362B7C68BD41C3B7C6F618B98CE1E"><enum>(A)</enum><text>Assistance under part II of the Foreign Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2301">22 U.S.C. 2301 et seq.</external-xref>), other than assistance under chapter 6 of part II of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2348">22 U.S.C. 2348 et seq.</external-xref>).</text></subparagraph> 
<subparagraph id="H84353DFC16604BE8B74C939168C5241C"><enum>(B)</enum><text>Assistance under section 23 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2763">22 U.S.C. 2763</external-xref>).</text></subparagraph> 
<subparagraph id="HE43ED7B30D4B4479B4A6A0FF2B174F7B"><enum>(C)</enum><text>Defense articles, defense services, or design and construction services under the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751 et seq.</external-xref>), including defense articles and defense services licensed or approved for export under section 38 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778</external-xref>).</text></subparagraph> 
<subparagraph id="HB0E93C5B601D498B92661BF9A0090FC"><enum>(D)</enum><text>Dual use goods or technology. In this subparagraph, the term <quote>dual use goods or technology</quote> means goods or technology that are specifically designed or developed for civil purposes but which also may be used or deployed in a military or proliferation mode. Such term does not include purely commercial items.</text></subparagraph></paragraph> 
<paragraph id="HCEDFDA2D1D2D4A71ABBFF922A5403210" commented="no"><enum>(3)</enum><header>Waiver</header><text display-inline="yes-display-inline">The President may waive the limitation on assistance to a country described in paragraph (2) for not more than one fiscal year if, at least 30 days before such waiver is to take effect, the President certifies to the Committee on International Relations of the House of Representatives and the Committee on Foreign Relations of the Senate that—</text> 
<subparagraph id="HBB37BD7588EA4DEC9BAA7804521B7EC"><enum>(A)</enum><text display-inline="yes-display-inline">such waiver is vital to the national security of the United States; and</text></subparagraph> 
<subparagraph id="H534503350EBD46048BA298A12E48AC00"><enum>(B)</enum><text display-inline="yes-display-inline">such country has undertaken substantial measures to comply with the requirements of paragraph (1).</text></subparagraph></paragraph></subsection> 
<subsection id="H6CDFB896DC3548E390ADEB67B2006094"><enum>(d)</enum><header>Actions at IAEA</header><text display-inline="yes-display-inline">The President shall direct the United States Permanent Representative to the IAEA to use the voice, vote, and influence of the United States at the IAEA to make every effort to ensure that the IAEA changes the policy regarding the Small Quantities Protocol in order to—</text> 
<paragraph id="H0027CD1482C248A5A855D100AEC28D76"><enum>(1)</enum><text display-inline="yes-display-inline">rescind and eliminate the Small Quantities Protocol;</text></paragraph> 
<paragraph id="HAACA36993D254CF0AD6D4CD5DF4642FB"><enum>(2)</enum><text>require that any IAEA Member State that has previously signed a Small Quantities Protocol to sign, ratify, and implement the Additional Protocol, provide immediate access for IAEA inspectors to its nuclear-related facilities, and agree to the strongest inspections regime of its nuclear efforts; and</text></paragraph> 
<paragraph id="HE4025E1652E34C6DBDE9AD40FA90BD10"><enum>(3)</enum><text>require that any IAEA Member State that does not comply with paragraph (2) to be ineligible to receive nuclear material, technology, equipment, or assistance from any IAEA Member State and subject to the penalties described in subsection (e).</text></paragraph></subsection> 
<subsection id="H3E299C7EAEA14380A013D9B8B9EF1F72"><enum>(e)</enum><header>Penalties</header> 
<paragraph id="H2AF4FFB867C744F2B9FA42B4A7F07B5C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall direct the United States Permanent Representative to the IAEA to use the voice, vote, and influence of the United States at the IAEA to ensure that a Member State of the IAEA that is under investigation for a breach of or noncompliance with its IAEA obligations or the purposes and principles of the Charter of the United Nations has its privileges suspended, including—</text> 
<subparagraph id="H2C84D54D318E47509CD7DB932872130" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">limiting its ability to vote on its case;</text></subparagraph> 
<subparagraph id="H0BFC0748BE7247859CE852E150D9A362" commented="no"><enum>(B)</enum><text>being prevented from receiving any technical assistance; and</text></subparagraph> 
<subparagraph id="H7F005766A0544B9EA63CC7978E6F70FF" commented="no"><enum>(C)</enum><text>being prevented from hosting meetings.</text></subparagraph></paragraph> 
<paragraph id="HB636E6A5099A4C8EA45F72A62801DD7"><enum>(2)</enum><header>Termination of penalties</header><text>The penalties specified under paragraph (1) shall be terminated when such investigation is concluded and such Member State is no longer in such breach or noncompliance.</text></paragraph></subsection> 
<subsection id="H5EC73249A31B4A75BA2095DC85AF66B0"><enum>(f)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act and every 180 days thereafter, the President shall submit to the Committee on International Relations of the House of Representatives and the Committee on Foreign Relations of the Senate a report that includes the following information:</text> 
<paragraph id="HEBC5421D495B48B6A26800037F08C383"><enum>(1)</enum><text display-inline="yes-display-inline">A description of progress made towards achieving the requirements described in subsection (c) and the policy changes described in subsection (d).</text></paragraph> 
<paragraph id="H5A53527447CC48AF857977A78B3CEC8"><enum>(2)</enum><text>A description of any penalties under subsection (e) that have been imposed and a list of those countries that have been subject to such penalties.</text></paragraph> 
<paragraph id="H0970EB1776974767B19C069CAB919849"><enum>(3)</enum><text display-inline="yes-display-inline">A list of countries that have a Small Quantities Protocol with the IAEA, including—</text> 
<subparagraph id="HDC575D57B35D4C6E896DDD36993F60A6"><enum>(A)</enum><text>their level of cooperation with safeguards inspections of their nuclear facilities;</text></subparagraph> 
<subparagraph id="HC150312286D24B8A8364E9BD5E9CF093"><enum>(B)</enum><text>whether they have signed, ratified, and implemented the Additional Protocol;</text></subparagraph> 
<subparagraph id="HB91ADC7797C14430B852773F82885EC3"><enum>(C)</enum><text>the type and amount of assistance received from the IAEA; and</text></subparagraph> 
<subparagraph id="H5B389041D9F04C4F98F6D627B500227B"><enum>(D)</enum><text>the type and amount of assistance received from each IAEA Member State.</text></subparagraph></paragraph> 
<paragraph id="H1BA91FCEBFB9403286527042FFA9EA2"><enum>(4)</enum><text>A description of United States strategy to ensure compliance by United States allies and recipients of United States assistance with the requirements described in subsection (c) and the policy changes described in subsection (d).</text></paragraph></subsection> </section>
