<official-title>To amend title 5, United States Code, to provide to assistant United States attorneys the same retirement benefits as are afforded to Federal law enforcement officers.</official-title>

<section id="HBE4A641CD46141EEAF29C207852C3E68" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Assistant United States Attorney Retirement Benefit Equity Act of 2005</short-title></quote>.</text></section> 
<section id="H105032DEEE9244A781799629344B9358"><enum>2.</enum><header>Retirement treatment of assistant United States attorneys</header> 
<subsection id="HDEEE8667C3274FE0B01271B77FD4B881"><enum>(a)</enum><header>Civil service retirement system</header> 
<paragraph id="H71A50F4BCBE9437987CE4E78BB5516CF"><enum>(1)</enum><header>Assistant United States attorney defined</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8331">Section 8331</external-xref> of title 5, United States Code, is amended—</text> 
<subparagraph id="H43A84591237A4853AD197117EBC3EF39"><enum>(A)</enum><text>in paragraph (28), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="HAB95F0CAEF0546B9BE86C3568ED78264"><enum>(B)</enum><text>in the first paragraph (29), by striking the period and inserting a semicolon;</text></subparagraph> 
<subparagraph id="HA1F457F31B264674AFE8D3C309BF1964"><enum>(C)</enum><text>in the second paragraph (29)—</text> 
<clause id="HA30D34D136B944199162B2917DEE459"><enum>(i)</enum><text>by striking <quote>(29)</quote> and inserting <quote>(30)</quote>; and</text></clause> 
<clause id="HF51EAB58FDF34E1AAA45D88E1BDE9E76"><enum>(ii)</enum><text> by striking the period and inserting <quote>; and</quote>; and</text></clause></subparagraph>

<subparagraph id="HD9CC52CE03704A688E692DDFF63320FB"><enum>(A)</enum><text>an assistant United States attorney under <external-xref legal-doc="usc" parsable-cite="usc/28/542">section 542</external-xref> of title 28; and</text></subparagraph> 
<subparagraph id="H6670C088422E41418C7603ACD72519E"><enum>(B)</enum><text>any other attorney employed by the Department of Justice occupying a position designated by the Attorney General upon finding that the position—</text> 
<clause id="H75D885F712344344A35D61254E31E67E"><enum>(i)</enum><text>involves routine employee responsibilities that are substantially similar to those of assistant United States attorneys; and</text></clause> 
<clause id="HAB0307AA3A134D5790D4B112D02519BA"><enum>(ii)</enum><text>is critical to the Department’s successful accomplishment of an important mission.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H13768721EAA74EE8BA5BFB384E8BCDF3"><enum>(2)</enum><header>Retirement treatment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/83">Chapter 83</external-xref> of title 5, United States Code, is amended by adding after section 8351 the following:</text>

<section id="H14E36B98D3CC44C29EDC63F8BBF9D0F"><enum>8352.</enum><header>Assistant United States attorneys</header><text display-inline="no-display-inline">Except as provided under the Assistant United States Attorneys Retirement Benefit Equity Act of 2005 (including the provisions relating to the non-applicability of mandatory separation requirements under section 8335(b) and 8425(b) of this title), an assistant United States attorney shall be treated in the same manner and to the same extent as a law enforcement officer for purposes of this chapter.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H91FA325C377B4A780007C05CD2082DD3"><enum>(3)</enum><header>Technical and conforming amendments</header> 
<subparagraph id="HA03C88ACD77E4B9299E1F6CE808995A" display-inline="yes-display-inline"><enum>(A)</enum><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/83">chapter 83</external-xref> of title 5, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/5/8351">section 8351</external-xref> the following:</text>

<subparagraph id="HAEAF67D4ECB94DD4865B00C29ECAEDF" indent="up1"><enum>(B)</enum><text>Section 8335(a) of such title is amended by striking <quote>8331(29)(A)</quote> and inserting <quote>8331(30)(A)</quote>. </text></subparagraph></paragraph></subsection> 
<subsection id="H498758D535474627949F6C7C8EA75FBE"><enum>(b)</enum><header>Federal employees’ retirement system</header> 
<paragraph id="H2985280BCD034F4095DDDBA4BFCB9C3C"><enum>(1)</enum><header>Assistant United States attorney defined</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8401">Section 8401</external-xref> of title 5, United States Code, is amended—</text> 
<subparagraph id="H3F1B807B3CF142FE83E1D8C32D892093"><enum>(A)</enum><text>in paragraph (34), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="HF76443B10ABD459694C15FC1374B4363"><enum>(B)</enum><text>in paragraph (35), by striking the period and inserting <quote>; and</quote> ; and</text></subparagraph> 
<subparagraph id="H4F7B0E1C7E644F20826DD6F800C0373C"><enum>(C)</enum><text>by adding at the end the following:</text>

<subparagraph id="HB20661887AA64DB7A58700DB1000D200"><enum>(B)</enum><text>any other attorney employed by the Department of Justice occupying a position designated by the Attorney General upon finding that the position—</text> 
<clause id="HB69518DC7DD74E4EB7F75163586F2CD4"><enum>(i)</enum><text>involves routine employee responsibilities that are substantially similar to those of assistant United States attorneys; and</text></clause> 
<clause id="H53A3A8809DBA4252994B9FC4DE4CCE9E"><enum>(ii)</enum><text>is critical to the Department’s successful accomplishment of an important mission.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H0E1D8E2D538C4843A79BC85E5344EC7E"><enum>(2)</enum><header>Retirement treatment</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8402">Section 8402</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>

<subsection id="H33107FA325634270B850702BFDAC4ECB"><enum>(h)</enum><text>Except as provided under the Assistant United States Attorneys Retirement Benefit Equity Act of 2005 (including the provisions relating to the non-applicability of mandatory separation requirements under <external-xref legal-doc="usc" parsable-cite="usc/5/8335">section 8335(b)</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/5/8425">8425(b)</external-xref> of this title), an assistant United States attorney shall be treated in the same manner and to the same extent as a law enforcement officer for purposes of this chapter.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H1DA2220FE5294BA7953C8CFEE0BA9CD0"><enum>(c)</enum><header>Mandatory separation</header><text>Sections <external-xref legal-doc="usc" parsable-cite="usc/5/8335">8335(b)</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/5/8425">8425(b)</external-xref> of title 5, United States Code, are amended by adding at the end the following: <quote>The preceding provisions of this subsection shall not apply in the case of an assistant United States attorney as defined under section 8331(31) or 8401(36).</quote>.</text></subsection> 
<subsection id="HD55DD4AFEEFC43C7A2759FE2647BFD1F"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the first day of the first applicable pay period beginning on or after 120 days after the date of enactment of this Act.</text></subsection></section> 
<section id="HF4FE619FA11C46CCA9DBD294663152D0"><enum>3.</enum><header>Provisions relating to incumbents</header> 
<subsection id="H929A66D15F4048CAB22B32E174EAD474"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> 
<paragraph id="HE7958362F1D645E98D9FCDDA51035279"><enum>(1)</enum><text>the term <quote>assistant United States attorney</quote> means—</text> 
<subparagraph id="H523CE292DF10451DB966A8D6A9538442"><enum>(A)</enum><text>an assistant United States attorney under <external-xref legal-doc="usc" parsable-cite="usc/28/542">section 542</external-xref> of title 28, United States Code; and</text></subparagraph> 
<subparagraph id="HBC99A0BB8B884CA4AA9C5F9F3E6B9851"><enum>(B)</enum><text>any other attorney employed by the Department of Justice occupying a position designated by the Attorney General upon finding that the position—</text> 
<clause id="H9E57212224B14C9B8C5580F7279E8B83"><enum>(i)</enum><text>involves routine employee responsibilities that are substantially similar to those of assistant United States attorneys; and</text></clause> 
<clause id="H661F6F0449A84539B8D4BC3D1CD86FA7"><enum>(ii)</enum><text>is critical to the Department’s successful accomplishment of an important mission; and</text></clause></subparagraph></paragraph> 
<paragraph id="H73431424BF964BACBC820446DFCADB00"><enum>(2)</enum><text>the term <quote>incumbent</quote> means an individual who is serving as an assistant United States attorney on the effective date of this section.</text></paragraph></subsection> 
<subsection id="HAC81C34B793840238B2F1D719F3C42F6"><enum>(b)</enum><header>Designated attorneys</header><text>If the Attorney General makes any designation of an attorney to meet the definition under subsection (a)(1)(B) for purposes of being an incumbent under this section—</text> 
<paragraph id="H03401FC8C37C44B78B205E3640D0CADD"><enum>(1)</enum><text>such designation shall be made before the effective date of this section; and</text></paragraph> 
<paragraph id="HB3013E1D4C1E455B83815899AE3CD967"><enum>(2)</enum><text>the Attorney General shall submit to the Office of Personnel Management before that effective date—</text> 
<subparagraph id="H74045C08533E436A92EF6526A796C416"><enum>(A)</enum><text>the name of the individual designated; and</text></subparagraph> 
<subparagraph id="HB21D4069938F45D78CCEACC92B5C1B7"><enum>(B)</enum><text>the period of service performed by that individual as an assistant United States attorney before that effective date.</text></subparagraph></paragraph></subsection> 
<subsection id="HB7D37F4469604A96AC012671197B7CD"><enum>(c)</enum><header>Notice requirement</header><text>Not later than 9 months after the date of enactment of this Act, the Department of Justice shall take measures reasonably designed to provide notice to incumbents on—</text> 
<paragraph id="HBCBFF602DF274BDD8D0012A0A7DF7713"><enum>(1)</enum><text>their election rights under this Act; and</text></paragraph> 
<paragraph id="H77A5E4B3E2A241B4BFA939784383C4E7"><enum>(2)</enum><text>the effects of making or not making a timely election under this Act.</text></paragraph></subsection> 
<subsection id="H705C17345E0E42F198D13E227500C231"><enum>(d)</enum><header>Election available to incumbents</header> 
<paragraph id="HFAA0CA5963D1432AAAE750E3CC5F0067"><enum>(1)</enum><header>In general</header><text>An incumbent may elect, for all purposes, to be treated—</text> 
<subparagraph id="HE8E7A7E7965E489E93C3F3D6C05A11B"><enum>(A)</enum><text>in accordance with the amendments made by this Act; or</text></subparagraph> 
<subparagraph id="HCCB4AB2D421D4913B7EE604F045CC90"><enum>(B)</enum><text>as if this Act had never been enacted.</text></subparagraph></paragraph> 
<paragraph id="H1ABCD126F9874706B8FFE9CDF600E5F7"><enum>(2)</enum><header>Failure to elect</header><text>Failure to make a timely election under this subsection shall be treated in the same way as an election under paragraph (1)(A), made on the last day allowable under paragraph (3).</text></paragraph> 
<paragraph id="H06C1EF3F66B84E178690C3BB2CD18CEF"><enum>(3)</enum><header>Time limitation</header><text>An election under this subsection shall not be effective unless the election is made not later than the earlier of—</text> 
<subparagraph id="H26F1271FFA8548DE00B3407666BD45E6"><enum>(A)</enum><text>120 days after the date on which the notice under subsection (c) is provided; or</text></subparagraph> 
<subparagraph id="H7039790A67B24289A600B4AD569F3649"><enum>(B)</enum><text>the date on which the incumbent involved separates from service.</text></subparagraph></paragraph></subsection> 
<subsection id="H48321EF3F25D4224BFA6C406A2D216B3"><enum>(e)</enum><header>Limited retroactive effect</header> 
<paragraph id="H4D84368A108F49FD9E04667B1B831858"><enum>(1)</enum><header>Effect on retirement</header><text>In the case of an incumbent who elects (or is deemed to have elected) the option under subsection (d)(1)(A), all service performed by that individual as an assistant United States attorney and, with respect to (B) below, including any service performed by such individual pursuant to an appointment under sections 515, 541, 543, and 546 of title 28, United States Code, shall—</text> 
<subparagraph id="H2E59C7A5B3844847A5DDF1F7A69977F8"><enum>(A)</enum><text>to the extent performed on or after the effective date of that election, be treated in accordance with applicable provisions of subchapter III of chapter 83 or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, as amended by this Act; and</text></subparagraph> 
<subparagraph id="H7A1EC3258156472C96B0D4FC4665BCD6"><enum>(B)</enum><text>to the extent performed before the effective date of that election, be treated in accordance with applicable provisions of subchapter III of chapter 83 or chapter 84 of such title, as if the amendments made by this Act had then been in effect.</text></subparagraph></paragraph> 
<paragraph id="HBAA9B251D02D48EBBEB7F779F0A29C56"><enum>(2)</enum><header>No other retroactive effect</header><text>Nothing in this Act (including the amendments made by this Act) shall affect any of the terms or conditions of an individual’s employment (apart from those governed by subchapter III of chapter 83 or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code) with respect to any period of service preceding the date on which such individual’s election under subsection (d) is made (or is deemed to have been made).</text></paragraph></subsection> 
<subsection id="H71B7DB84E8CB4EC2A152E888F034004C"><enum>(f)</enum><header>Individual contributions for prior service</header> 
<paragraph id="H29FDCD01BAE743468649922BFDBAE98"><enum>(1)</enum><header>In general</header><text>An individual who makes an election under subsection (d)(1)(A) shall, with respect to prior service performed by such individual, deposit, with interest, to the Civil Service Retirement and Disability Fund the difference between the individual contributions that were actually made for such service and the individual contributions that would have been made for such service if the amendments made by section 2 of this Act had then been in effect.</text></paragraph> 
<paragraph id="H6B6DC2E24BD84704A2DE62468E3D85E"><enum>(2)</enum><header>Effect of not contributing</header><text>If the deposit required under paragraph (1) is not paid, all prior service of the incumbent shall remain fully creditable as law enforcement officer service, but the resulting annuity shall be reduced in a manner similar to that described in <external-xref legal-doc="usc" parsable-cite="usc/5/8334">section 8334(d)(2)(B)</external-xref> of title 5, United States Code. This paragraph shall not apply in the case of a disability annuity.</text></paragraph> 
<paragraph id="HC79685653E344F9BB47436613316C007"><enum>(3)</enum><header>Prior service defined</header><text>For purposes of this section, the term <term>prior service</term> means, with respect to any individual who makes an election (or is deemed to have made an election) under subsection (d)(1)(A), all service performed as an assistant United States attorney, but not exceeding 20 years, performed by such individual before the date as of which applicable retirement deductions begin to be made in accordance with such election.</text></paragraph></subsection> 
<subsection id="H747256A461C64F19B8553D11FE8934C"><enum>(g)</enum><header>Regulations</header><text>Except as provided under section 4, the Office of Personnel Management shall prescribe regulations necessary to carry out this Act, including provisions under which any interest due on the amount described under subsection (e) shall be determined.</text></subsection> 
<subsection id="H88C0C7B31CC6492CBE6643A7DCF25C9D"><enum>(h)</enum><header>Effective date</header><text>This section shall take effect 120 days after the date of enactment of this Act.</text></subsection></section> 
<section id="H62E9FA99C64140309C1862AB8EFB6F75"><enum>4.</enum><header>Department of Justice administrative actions</header> 
<subsection id="HDBA827326B3E4A07B005E1002626821C"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>assistant United States attorney</term> has the meaning given such term under section 3(a)(1).</text></subsection> 
<subsection id="H10CB16DFF9FA465EBD00157CDFDDA9D9"><enum>(b)</enum><header>Regulations</header> 
<paragraph id="HA352F38BE6C74C068C7F78E67578F8FF"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after the date of enactment of this Act, the Attorney General, in consultation with the Office of Personnel Management, shall promulgate regulations for making designations of attorneys who are not assistant United States attorneys.</text></paragraph> 
<paragraph id="HAB9BA396DAFD4A18A195B7455E000918"><enum>(2)</enum><header>Contents</header><text>Any regulations promulgated under paragraph (1) shall ensure that attorneys designated as assistant United States attorneys who are not assistant United States attorneys have routine employee responsibilities that are substantially similar to those of assistant United States attorneys.</text></paragraph> 
<paragraph id="HBAD454A27C214EACA6DE5EB1A4D75BD4"><enum>(3)</enum><header>Designations</header><text>The designation of any attorney who is not an assistant United States attorney for purposes of this Act (including the amendments made by this Act) shall be at the discretion of the Attorney General.</text></paragraph></subsection></section>
