<section section-type="section-one" id="H5B85167560C14CBCA82914007184E51C" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Judicial District of the Virgin Islands Act of 2005</short-title></quote>.</text></section> 
<section id="HE322A6AACC75449190B3BCB557C9C925"><enum>2.</enum><header>Establishment of District Court of the Virgin Islands as an article III court</header> 
<subsection id="H761F885093094D4182BDB69ED69C4C04"><enum>(a)</enum><header>Establishment</header> 
<paragraph id="HCCB41FE7E734497D918F95DB8F62EFE3"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/5">Chapter 5</external-xref> of title 28, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/28/126">section 126</external-xref> the following new section:</text>

<section id="H97F8DA6C71094FAA86A837AEA3781600"><enum>126A.</enum><header>Virgin Islands</header><text display-inline="no-display-inline">The Virgin Islands constitutes one judicial district comprising two divisions.</text> 
<paragraph id="H0468D9F24DFE4F128EF088F4C6588421"><enum>(1)</enum><text>The Saint Croix Division comprises the Island of Saint Croix and adjacent islands and cays.</text></paragraph> 
<paragraph id="H5C2592609C4D449AB87EA26B2E84F654"><enum></enum><text>Court for the Saint Croix Division shall be held at Christiansted.</text></paragraph> 
<paragraph id="HB9D9E99F9EE441E9AD7DCB8920A1164"><enum>(2)</enum><text>The Saint Thomas and Saint John Division comprises the Islands of Saint Thomas and Saint John and adjacent islands and cays.</text></paragraph> 
<paragraph id="H6FD27CA49FF24B12B865899801012954"><enum></enum><text>Court for the Saint Thomas and Saint John Division shall be held at Charlotte-Amalie.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HEA2DCF3E449144768865E788B452E49"><enum>(2)</enum><header>Conforming amendment</header><text>The table of contents for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/5">chapter 5</external-xref> of title 28, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/28/126">section 126</external-xref> the following:</text>

<paragraph id="H6092E5342EC34C22B35FAFF1E8222D15"><enum>(1)</enum><header>Repeals</header><text>Sections 25, 26, and 27 of the Revised Organic Act of the Virgin Islands (<external-xref legal-doc="usc" parsable-cite="usc/48/1615">48 U.S.C. 1615</external-xref>, 1616, and 1617) are repealed.</text></paragraph> 
<paragraph id="H0B974662BB6B4B2EBA03FE007FFE2E9B"><enum>(2)</enum><header>Bill of rights</header><text>Section 3 of the Revised Organic Act of the Virgin Islands (<external-xref legal-doc="usc" parsable-cite="usc/48/1561">48 U.S.C. 1561</external-xref>) is amended in the 23d undesignated paragraph—</text> 
<subparagraph id="HD79F21E48CE84F08BD99A20307D815DC"><enum>(A)</enum><text>by inserting <quote>article III;</quote> after <quote>section 9, clauses 2 and 3;</quote>; and</text></subparagraph> 
<subparagraph id="H94AC650A02104A39B33E88EA4FAF98C2"><enum>(B)</enum><text>by striking <quote>: <italic>Provided, however</italic></quote> and all that follows through the end of the paragraph and inserting the following: <quote>; except that all offenses under the laws of the Virgin Islands which are prosecuted in the courts established by local law shall continue to be prosecuted by information, except those that are required by local law to be prosecuted by indictment by grand jury.</quote>.</text></subparagraph></paragraph> 
<paragraph id="HC82F9F53EA294F7EABFCF967319B2386"><enum>(3)</enum><header>Jurisdiction of local courts</header><text>Section 21 of the Revised Organic Act of the Virgin Islands (<external-xref legal-doc="usc" parsable-cite="usc/48/1611">48 U.S.C. 1611</external-xref>) is amended to read as follows:</text>

<section id="HF984ABEF35D64D5FA9DEF1C8DB4C621F"><enum>21.</enum><header>Jurisdiction of courts of the Virgin Islands</header> 
<subsection id="H7068B604C38641B386E6EE298556A64B"><enum>(a)</enum><header>Jurisdiction of the courts of the Virgin Islands</header><text>The judicial power of the Virgin Islands shall be vested in such appellate court and lower local courts as may have been or may hereafter be established by local law. The courts of the Virgin Islands established by local law shall have jurisdiction over all causes of action in the Virgin Islands over which any court established by the Constitution and laws of the United States does not have exclusive jurisdiction.</text></subsection> 
<subsection id="H939FA2F80F3C44E09FEA292703A8C673"><enum>(b)</enum><header>Practice and procedure</header><text>The rules governing the practice and procedure of the courts established by local law and those prescribing the qualifications and duties of the judges and officers thereof, oaths and bonds, and the times and places of holding court shall be governed by local law or the rules promulgated by those courts.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H9834A69399A44C8990CA076BE387AD65"><enum>(4)</enum><header>Jurisdiction over criminal matters and income tax</header><text>Section 22 of the Revised Organic Act of the Virgin Islands (<external-xref legal-doc="usc" parsable-cite="usc/48/1612">48 U.S.C. 1612</external-xref>) is amended to read as follows:</text>

<section id="H645E79B29E2E498DA138E980C219F4A0"><enum>22.</enum><header>Jurisdiction over income tax</header><text display-inline="no-display-inline">The United States District Court for the District of the Virgin Islands shall have exclusive jurisdiction over all criminal and civil proceedings in the Virgin Islands with respect to the income tax laws applicable to the Virgin Islands, regardless of the degree of the offense or of the amount involved, except the ancillary laws relating to the income tax enacted by the legislature of the Virgin Islands. Any act or failure to act with respect to the income tax laws applicable to the Virgin Islands which would constitute a criminal offense described in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/75">chapter 75</external-xref> of the Internal Revenue Code of 1986 shall constitute an offense against the government of the Virgin Islands and may be prosecuted in the name of the government of the Virgin Islands by appropriate officers thereof in the United States District Court for the District of the Virgin Islands without the request or consent of the United States attorney for the Virgin Islands.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HD9A4738225774FA4A6C3B7B5C2C700BB"><enum>(5)</enum><header>Relations between United States courts and local courts</header><text>Section 23 of the Revised Organic Act of the Virgin Islands (<external-xref legal-doc="usc" parsable-cite="usc/48/1613">48 U.S.C. 1613</external-xref>) is amended to read as follows:</text>

<section id="H24D5B2CD20424B129989BEB58DF0D93"><enum>23.</enum><header>Relations between courts of the United States and local courts</header> 
<subsection id="HEC85506FC1FB4A468EC656812CC399F"><enum>(a)</enum><header>In general</header><text>The relations between the courts established by the Constitution or laws of the United States (including the United States District Court for the District of the Virgin Islands) and the courts established by local law with respect to appeals, certiorari, removal of causes, the issuance of writs of habeas corpus, and other matters or proceedings shall be governed by the laws of the United States pertaining to the relations between the courts of the United States, including the Supreme Court of the United States, and the courts of the several States in such matters and proceedings, except that for the first 15 years following the establishment of the appellate court authorized by section 21(a) of this Act, the United States Court of Appeals for the Third Circuit shall have jurisdiction to review by writ of certiorari all final decisions of the highest court of the Virgin Islands from which a decision could be had.</text></subsection> 
<subsection id="HDD6AEDEC89DF4A22931C4DD6756CF91"><enum>(b)</enum><header>Reports to congress</header><text>The Judicial Council of the Third Circuit shall submit reports to the Committee on Energy and Natural Resources of the Senate and the Committee on Resources of the House of Representatives at intervals of 5 years following the establishment of the appellate court authorized by section 21(a) of this Act as to whether that court has developed sufficient institutional traditions to justify direct review by the Supreme Court of the United States from all final decisions of the highest court of the Virgin Islands.</text></subsection> 
<subsection id="H67639AB8D2284CF3B4F300FE72BDEA5D"><enum>(c)</enum><header>Rules</header><text>The United States Court of Appeals for the Third Circuit shall have jurisdiction to promulgate rules necessary to carry out the provisions of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H92825306ACA64EAD849EDC3D009B9520"><enum>(6)</enum><header>Appellate jurisdiction of district court</header><text>Section 23A of the Revised Organic Act of the Virgin Islands (<external-xref legal-doc="usc" parsable-cite="usc/48/1613a">48 U.S.C. 1613a</external-xref>) is amended by striking <quote>District Court of the Virgin Islands</quote> each place it appears and inserting <quote>United States District Court for the District of the Virgin Islands</quote>.</text></paragraph> 
<paragraph id="HEE8A807181AC44D395C9FC3828009FD3"><enum>(7)</enum><header>Assignment of additional judges to the court</header><text>Section 24 of the Revised Organic Act of the Virgin Islands (<external-xref legal-doc="usc" parsable-cite="usc/48/1614">48 U.S.C. 1614</external-xref>) is amended to read as follows:</text>

<section id="HF27F9AE11E1F461BA34F9DB86C34174"><enum>24.</enum><header>Assignment of additional judges to the court</header><text display-inline="no-display-inline">Whenever it appears to be necessary for the proper dispatch of the business of the United States District Court for the District of the Virgin Islands—</text> 
<paragraph id="H5FF44123146E44AC862D4DE8BA533355"><enum>(1)</enum><text>the chief judge of the Third Judicial Circuit of the United States may assign—</text> 
<subparagraph id="H014B04DDE8D540B5A962CF8DF6852591"><enum>(A)</enum><text>a judge of a court of record of the Virgin Islands established by local law,</text></subparagraph> 
<subparagraph id="H3BB111A23BDC436B9E90CE300721D81"><enum>(B)</enum><text>a circuit or district judge of the Third Judicial Circuit, or</text></subparagraph> 
<subparagraph id="HFD019E7CC1F54FF3BCD1DE18B533C319"><enum>(C)</enum><text>a recalled senior judge of the District Court of the Virgin Islands, or</text></subparagraph></paragraph> 
<paragraph id="H55ABC523632142B8BC084FEAC9F44264"><enum>(2)</enum><text>the Chief Justice of the United States may assign any other United States circuit or district judge, with the consent of that judge and the chief judge of the circuit from which the judge is assigned,</text><continuation-text continuation-text-level="section">to serve temporarily as a judge of the United States District Court for the District of the Virgin Islands. After the establishment of the appellate court authorized by section 21(a) of this Act, no judge described in paragraph (1)(A) may be assigned to the district court under this section.</continuation-text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H8288DFE55CB34B40B024F1008E40E3B9"><enum>(c)</enum><header>Pleadings and proceedings in English</header><text>All pleadings and proceedings in the United States District Court for the District of the Virgin Islands shall be conducted in the English language.</text></subsection> 
<subsection id="HB12F4BA432C443B4B6A6A74C2D83924E"><enum>(d)</enum><header>Savings provisions</header> 
<paragraph id="H7148F48B7A0146970099693FB4B4F9CD"><enum>(1)</enum><header>Pending cases</header><text>With respect to any complaint or proceeding pending in the District Court of the Virgin Islands on the day before the effective date of this Act, such complaint or proceeding may, on and after such effective date, be pursued to final determination in the United States District Court for the District of the Virgin Islands, the United States Court of Appeals for the Third Circuit, and the United States Supreme Court.</text></paragraph> 
<paragraph id="H6DE8B8A6BE144B3484635B2D4C15E5DD"><enum>(2)</enum><header>Existing officers of the court</header><text>Any individual who, on the effective date of this Act, is serving as the United States Attorney for the Virgin Islands, or the United States marshal for the Virgin Islands, may continue in such office until a successor is appointed pursuant to the provisions of title 28, United States Code.</text></paragraph></subsection></section> 
<section id="H2ECDED38ADB949E4879142A25C1B7183"><enum>3.</enum><header>Technical and conforming amendments</header> 
<subsection id="H6F37954348174618ACEBFEBC78D903B"><enum>(a)</enum><header>Judicial comparisons</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/333">Section 333</external-xref> of title 28, United States Code, is amended by striking <quote>, the District Court of the Virgin Islands,</quote>. </text></subsection> 
<subsection id="H0D6ED3719D3A40AEB2B0DCB300B6277C"><enum>(b)</enum><header>Retirement and survivors’ annuities</header> 
<paragraph id="H7A5E24FF2C804F46B9FB92CB0139A7D5"><enum>(1)</enum><header>Retirement</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/373">Section 373</external-xref> of title 28, United States Code, is amended in subsections (a) and (e) by striking <quote>, the District Court of the Northern Mariana Islands, or the District Court of the Virgin Islands</quote> and inserting <quote>or the District Court of the Northern Mariana Islands</quote>.</text></paragraph> 
<paragraph id="H0CEFE7FD3609495BB7BB5CB72C74CEFC"><enum>(2)</enum><header>Survivors’ annuities</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/376">Section 376(a)</external-xref> of title 28, United States Code, is amended in paragraphs (1)(B) and (2)(B) by inserting <quote>(as in effect before the effective date of the <short-title>Judicial District of the Virgin Islands Act of 2005</short-title>)</quote> after <quote>the District Court of the Virgin Islands</quote>.</text></paragraph> 
<paragraph id="H7BD617205C3B45609E2C289520DBAFC4"><enum>(3)</enum><header>Calculation of service as a judge</header><text>In the case of a judge of a district court retiring under <external-xref legal-doc="usc" parsable-cite="usc/28/371">section 371</external-xref> of title 28, United States Code, after the effective date of this Act, service by the judge as a judge of the District Court of the Virgin Islands before the effective date of this Act shall be included in calculating service under section 371(c) of such title.</text></paragraph> 
<paragraph id="H4416B0C86F4F4A6AA877478588B42BE6"><enum>(4)</enum><header>Rights of existing retirees not affected</header><text>Nothing in this Act shall be construed to affect the rights of any judge who has retired as a judge of the District Court of the Virgin Islands before the effective date of this Act.</text></paragraph></subsection> 
<subsection id="H1C84A3ECE10F4FD0A1F600292DD6592"><enum>(c)</enum><header>Courts defined</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/610">Section 610</external-xref> of title 28, United States Code, is amended by striking <quote>the United States District Court for the District, the Canal Zone,</quote> and by striking <quote>the District Court of the Virgin Islands,</quote>.</text></subsection> 
<subsection id="H5009957C2DFE4F21959CC41434DEB847"><enum>(d)</enum><header>Magistrate judges</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/631">Section 631(a)</external-xref> of title 28, United States Code, is amended—</text>

<section id="H27325B0E685E47A3AE9082A3FFD83796"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect at the end of the 90-day period beginning on the date of the enactment of this Act.</text></section>
