<section id="HE50A7A70A6CE4A51AE6ED6DCDA59AEE4" section-type="section-one"><enum>1.</enum><header>Preferential treatment for certain apparel articles under the Caribbean Basin Economic Recovery Act</header> 
<subsection id="H22E49ED040C14F4BA44D79AE0A7D19E"><enum>(a)</enum><header>Amendment</header><text>Section 213(b)(2)(A)(v) of the Caribbean Basin Economic Recovery Act is amended by adding at the end the following new subclause:</text> 
<quoted-block style="OLC" id="H7D84C32F4461443A8647CCA18C297D03" display-inline="no-display-inline"> 
<clause id="HD2564C5DEF104150ADACC5CB6E27ABB6"><enum>(III)</enum><text>Apparel articles that are both cut (or knit to shape) and sewn or otherwise assembled in one or more CBTPA beneficiary countries from single knit 24 gauge jersey fabric with a jacquard attachment in chief weight of polyester staple, mixed with cotton and not more than 5 percent elastomeric weighing from 6.0 to 6.2 square meters per kilogram with a yarn size of 54.14 metric (32/1 English), with an elastomeric core, dyed and properly classified under subheading 6006.32.00 of the Harmonized Tariff Schedule of the United States.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4DFB01919CD4496195F13FC8D58D9BA"><enum>(b)</enum><header>Effective date</header> 
<paragraph id="H1FCEAEF7A0D34E21A20270B3A217978B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">This amendment made by subsection (a) applies to goods entered, or withdrawn from warehouse for consumption, on or after January 3, 2005.</text></paragraph> 
<paragraph id="H060E3FC1BB21497797B9D6E3AC9D28B"><enum>(2)</enum><header>Retroactive application</header><text display-inline="yes-display-inline">Notwithstanding section 514 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1514">19 U.S.C. 1514</external-xref>) or any other provision of law, upon proper request filed with the Bureau of Customs and Border Protection of the Department of Homeland Security before the 90th day after the date of the enactment of this Act, any entry, or withdrawal from warehouse for consumption, of any good—</text> 
<subparagraph id="H38407F537E964B0897AB95FAE04E0040"><enum>(A)</enum><text display-inline="yes-display-inline">that was made on or after January 3, 2005, and before the date of the enactment of this Act, and</text></subparagraph> 
<subparagraph id="H382B754CD56F4B95A50861423F80C5F6"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to which there would have been no duty or a lower rate of duty if the amendment made by subsection (a) applied to such entry or withdrawal,</text> </subparagraph><continuation-text continuation-text-level="paragraph">shall be liquidated or reliquidated as if such amendment applied to such entry or withdrawal. </continuation-text></paragraph></subsection></section>
