<section id="H07E0D8E1FFCD43E1878100583BDF4F87" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Livestock Identification and Marketing Opportunities Act</short-title></quote>.</text></section> 
<section id="HA8D64866F7C24A2697F667F079AECA42"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H7CACA92BD458497DAA7BFCB2A100929F"><enum>(1)</enum><text display-inline="yes-display-inline">For purposes of animal health investigation and surveillance, there needs to be an identification system that can trace animals from the time of first movement of the animal from its original premise to the time of slaughter of the animal in less than 48 hours.</text></paragraph> 
<paragraph id="H62299BB9F69244E58FCA36D700C0DA90"><enum>(2)</enum><text display-inline="yes-display-inline">The beef industry estimates that the United States cattle industry lost approximately $3,000,000,000 in export value on beef, beef variety meats, hides, and tallow during the 12 months since a December 2003 diagnosis in the United States of bovine spongiform encephalopathy. A livestock identification system may have prevented some of this loss.</text></paragraph> 
<paragraph id="H4AF74BEED6BB4813BEAF24C105BB1198"><enum>(3)</enum><text>In order to be as efficient as possible, the livestock identification system needs to be automated and electronic with participants using compatible technologies.</text></paragraph> 
<paragraph id="HDBDFA8AFB85D4347A7DB1E58E99001F"><enum>(4)</enum><text display-inline="yes-display-inline">The livestock identification system needs to be flexible enough to adapt to changes in technology and to the demands of the industry and the markets.</text></paragraph> 
<paragraph id="H500151AF9CC145EF9F83645D4F239511"><enum>(5)</enum><text>The best technology available should be used for the livestock identification system while still allowing for registration into the system for livestock owners who are economically disadvantaged.</text></paragraph> 
<paragraph id="H457C640EEA144046BBE96CFD584F4BB9"><enum>(6)</enum><text display-inline="yes-display-inline">Confidentiality of information on animal movements, sales, and ownership is necessary to ensure that livestock owners have the confidence to comply with and fully participate in the livestock identification system.</text></paragraph> 
<paragraph id="H9E1B0CB41CDF4934A8EBA3770065DC47"><enum>(7)</enum><text>Besides animal disease surveillance, the livestock identification system should provide a commercial information exchange infrastructure that would allow for enhanced marketing opportunities.</text></paragraph></section> 
<section id="H127E24D10605456387DC145BC568104D"><enum>3.</enum><header>Livestock identification board</header> 
<subsection id="H58DA0559601040FBAF6C6C54F764774F"><enum>(a)</enum><header>Establishment</header><text>There is established a board to be known as the <quote>Livestock Identification Board</quote>.</text></subsection> 
<subsection id="HFC91CDE8AA914E00A593A9DD72264556"><enum>(b)</enum><header>Duties</header><text>The duties of the Board shall be to—</text> 
<paragraph id="H4B2E31E478F2407B91FA31745DF8D200"><enum>(1)</enum><text display-inline="yes-display-inline">establish and maintain an electronic livestock identification system that—</text> 
<subparagraph id="H9C928F486BAA41E7BCDF7B5FE659256"><enum>(A)</enum><text display-inline="yes-display-inline">is capable of tracing all livestock in the United States from the time of first movement of the livestock from its original premise to the time of slaughter of such livestock in less than 48 hours;</text></subparagraph> 
<subparagraph id="HF3ECEAA29B504E4EBC9DAC84A21D8E1"><enum>(B)</enum><text>tracks all relevant information about the livestock, including—</text> 
<clause id="H390B8993C1364049BCC1560500E3C341"><enum>(i)</enum><text>the livestock identification number or the group or lot identification number for the livestock, as applicable;</text> </clause> 
<clause id="H9E530B0EFAA447A900E01DEB83B19BE4"><enum>(ii)</enum><text>the date the livestock identification number or the group or lot identification number was assigned;</text></clause> 
<clause id="H3A1DA0DB70074BA68EA7FA33DF01A461"><enum>(iii)</enum><text>the premise identification number;</text></clause> 
<clause id="HC9236E1D726B4D80B774A84EC551B9A3"><enum>(iv)</enum><text>the species of the livestock;</text></clause> 
<clause id="H74775E435B1342DDB4B4143292D2E929"><enum>(v)</enum><text>the date of birth of the livestock, to the extent possible;</text></clause> 
<clause id="H50C1202B90B840C1AE003514B3329815"><enum>(vi)</enum><text>the sex of the livestock;</text> </clause> 
<clause id="H0153D42D94BC49A0B888301738170035"><enum>(vii)</enum><text>any other information the Board considers appropriate for animal disease surveillance; and</text></clause> 
<clause id="HFE172CC8E48F4573BFD6003715483B00" commented="no"><enum>(viii)</enum><text>any other information that the person who owns or controls the livestock voluntarily submits to the Board;</text></clause></subparagraph></paragraph> 
<paragraph id="H92889FCA731549438651D534F937D69F"><enum>(2)</enum><text>maintain information obtained through the livestock identification system in a centralized data system; and</text></paragraph> 
<paragraph id="H2BD6C98DE5F84C5BBE88BCA33DB31F99"><enum>(3)</enum><text>determine the official identification technology to be used to track animals under the livestock identification system.</text></paragraph> </subsection> 
<subsection id="HFACFB7161FFC4A418CE9AF5C63002E" commented="no"><enum>(c)</enum><header>Powers</header><text>The Board may—</text> 
<paragraph id="H61C7432DC7BA433EBC00ADECCD77EABD" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">prescribe and collect fees to recover the costs of the livestock identification system; and</text></paragraph> 
<paragraph id="H7681C738E42A47E89F7643BB08BEB659" commented="no"><enum>(2)</enum><text>establish and maintain a grant program to assist persons with fulfilling the requirements of the livestock identification system.</text> </paragraph></subsection> 
<subsection id="H392111556EAC4F92BBD1955DDB462322"><enum>(d)</enum><header>Membership</header> 
<paragraph id="H4E3C393D21024A9CA24220B252667CAA"><enum>(1)</enum><header>Voting members</header><text>The Board shall be composed of 7 voting members appointed by the Secretary of Agriculture, in consultation with the Chair and ranking minority member of the relevant congressional committees, of whom—</text> 
<subparagraph id="HDAB325B680124C83915CD6272F496046"><enum>(A)</enum><text>1 member shall be a representative of cattle owners;</text></subparagraph> 
<subparagraph id="H2F96AB840C074D4A99D7DF65D3EF9008"><enum>(B)</enum><text>1 member shall be a representative of swine owners;</text></subparagraph> 
<subparagraph id="H09133592C8944C9BB2B400F21FD6EB7E"><enum>(C)</enum><text>1 member shall be a representative of sheep and goat owners;</text></subparagraph> 
<subparagraph id="H612D014D49274150BC0134F704D4DD26"><enum>(D)</enum><text>1 member shall be a representative of poultry owners;</text></subparagraph> 
<subparagraph id="HBE15ECF027CF4DC09FDB9DC04CF0A1D9"><enum>(E)</enum><text>1 member shall be a representative of livestock auction market operators;</text></subparagraph> 
<subparagraph id="H406AAAE050AE48FEA6A985E89C1A3F3"><enum>(F)</enum><text>1 member shall be a representative of meat processors; and</text></subparagraph> 
<subparagraph id="H3229F915E15C4D9A8CE6E93EEDCA748" commented="no"><enum>(G)</enum><text>1 member shall be a person actively engaged in the livestock industry.</text> </subparagraph> </paragraph> 
<paragraph id="H9E3923B40A3141DFA87DF524D4A8A5A0"><enum>(2)</enum><header>Non-voting members</header><text>The Board shall include 2 non-voting members appointed by the Secretary, in consultation with the Chair and ranking minority member of the relevant congressional committees, of whom—</text> 
<subparagraph id="H78C5E6F3A0A148E2A768AF1754BA2855"><enum>(A)</enum><text>1 member shall be a representative of the Department of Agriculture; and</text></subparagraph> 
<subparagraph id="H072752941CE040F88940007DC75BB1C2"><enum>(B)</enum><text>1 member shall be a representative of State or tribal veterinarians or State or tribal agriculture agencies.</text></subparagraph></paragraph> 
<paragraph id="H47D34EF062CD421AAAAD3B78F2507FB4"><enum>(3)</enum><header>Terms</header> 
<subparagraph id="H27AABB65AD1D4108AD45888E9657DAC5"><enum>(A)</enum><header>In general</header><text>Each member shall be appointed for a term of 3 years, except as provided by subparagraphs (B) and (C).</text></subparagraph> 
<subparagraph id="H7EA65F6260894A5ABB90EACE19925000"><enum>(B)</enum><header>Terms of initial appointees</header><text>As designated by the Secretary at the time of appointment, of the voting members first appointed—</text> 
<clause id="HB40202D0D8ED42BEB3E41DABC3863147"><enum>(i)</enum><text>the members appointed under subparagraphs (B), (D), and (E) of paragraph (1) shall be appointed for a term of 2 years; and</text></clause> 
<clause id="H9D3AA1E8D7734692999D4C210000432E"><enum>(ii)</enum><text>the members appointed under subparagraphs (C) and (G) of paragraph (1) shall be appointed for a term of 1 year.</text></clause> </subparagraph> 
<subparagraph id="H10E8AA31A4DA4C49A0D463DE1BAD248"><enum>(C)</enum><header>Vacancies</header><text display-inline="yes-display-inline">Any member appointed to fill a vacancy occurring before the expiration of the term for which the member’s predecessor was appointed shall be appointed only for the remainder of that term. A member may serve after the expiration of that member’s term until a successor has taken office. A vacancy in the Board shall be filled in the manner in which the original appointment was made.</text></subparagraph></paragraph> 
<paragraph id="H5EAE1888F6FC44B393BA9B200005EFD"><enum>(4)</enum><header>Chairperson</header><text>The Chairperson of the Board shall be elected by its members.</text></paragraph> 
<paragraph id="H2C667F0EB1D64029A4FF814CF5BA4D9C"><enum>(5)</enum><header>Appointment</header><text>The Secretary shall appoint all members of the Board not later than 45 days after the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="H6C8E76F8A0DC4C2E008B946B8F609CA5"><enum>(e)</enum><header>Meetings</header> 
<paragraph id="H41798AEE74214F5E8C04F9F5F005533"><enum>(1)</enum><header>Initial meeting</header><text>Not later than 60 days after the date of the enactment of this Act, the Board shall hold its initial meeting.</text></paragraph> 
<paragraph id="H6FAA46875F844A5F96AFC37B7533FFBA"><enum>(2)</enum><header>Subsequent meetings</header><text>The Board shall meet at the call of the Chairperson.</text></paragraph></subsection> 
<subsection id="H9DDF63A37FFB4925B26F433D7D8D9283"><enum>(f)</enum><header>Quorum</header><text>4 voting members of the Board shall constitute a quorum.</text></subsection> 
<subsection id="H35118B1BED074D13BFF38B8DDD2CF46"><enum>(g)</enum><header>Pay</header><text>Members of the Board shall serve without compensation.</text></subsection> 
<subsection id="HFDADD403206A46E5AF7721E38952ABE7"><enum>(h)</enum><header>Travel expenses</header><text display-inline="yes-display-inline">Each member of the Board shall receive travel expenses, including per diem in lieu of subsistence, in accordance with applicable provisions under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></subsection> 
<subsection id="HC7063FCC2199499584506D317FAAF05B"><enum>(i)</enum><header>Staff</header><text>The Board may appoint and fix the pay of personnel as the Board considers appropriate.</text></subsection> 
<subsection id="HF9FA2E17FEB948B6873489DDAB3E99C"><enum>(j)</enum><header>Contracts</header><text>The Board may contract with or compensate any persons for goods or services.</text></subsection> 
<subsection id="H90D3C1CDA77C465B888CF2F1E58E41B8"><enum>(k)</enum><header>Rules and regulations</header><text>The Board may issue such rules and regulations as may be necessary to carry out this Act.</text></subsection> 
<subsection id="HA6225925AC074159A776CEBFFB2DFA02"><enum>(l)</enum><header>Implementation</header> 
<paragraph id="HA9485931CABF4DC293AFE1AF69F4C4B"><enum>(1)</enum><header>In general</header><text>The Board shall implement the livestock identification system established pursuant to this section not later than December 31, 2008.</text></paragraph> 
<paragraph id="H666930EB779741AEBC6F4E77EFBFCC01" commented="no"><enum>(2)</enum><header>Report</header><text>Not later than one year after the date of the enactment of this Act, and quarterly thereafter until December 31, 2010, the Board shall submit to the Secretary of Agriculture and the relevant congressional committees a report on the status of the implementation of the livestock identification system, including—</text> 
<subparagraph id="HD08F71F1E6A541F0A02D72DCBE8CE5C" commented="no"><enum>(A)</enum><text>for each species subject to the system, the number of animals or groups of animals tracked by the system; and</text></subparagraph> 
<subparagraph id="HDD0E114FAC8C44ABB400215C9E2B442E" commented="no"><enum>(B)</enum><text>the percentage of each animal species subject to the livestock identification system that are tracked by the system, which shall be determined by dividing the number submitted under subparagraph (A) for a species by the total number of animals of such species in the United States.</text> </subparagraph></paragraph></subsection> </section> 
<section id="H150BCC5E9342446AA35CD5C7215731F7"><enum>4.</enum><header>Premise identifications</header><text display-inline="no-display-inline">Not later than nine months after the date of the enactment of this Act, the Secretary of Agriculture shall establish a premise identification system for all premises in the United States. The premise identification data shall be made available to the Board and shall include—</text> 
<paragraph id="H1E14B0510B1E4323AF87AC424832659"><enum>(1)</enum><text>a premise identification number;</text></paragraph> 
<paragraph id="HC051F865A85942F8949F868B260078D0"><enum>(2)</enum><text>the name of the entity that owns or controls the premise;</text></paragraph> 
<paragraph id="H9926EE77C0424C3BACCF2000A4D42E00"><enum>(3)</enum><text>contact information for the premise, including a person, address, and phone number;</text></paragraph> 
<paragraph id="H56EF4F0B8FF6419190B0BB481042BAA"><enum>(4)</enum><text>the type of operation at the premise; and</text></paragraph> 
<paragraph id="HD9209205D9A54534B582578001C5C8F6"><enum>(5)</enum><text>the date the premise number was assigned.</text></paragraph></section> 
<section id="HFA02DC65757B46CDA39FD8738166ABC6" commented="no"><enum>5.</enum><header>Enforcement; first entry into commerce</header><text display-inline="no-display-inline">Subject to section 6(b), the Secretary of Agriculture shall verify that each animal, or group of animals, where applicable, subject to the livestock identification system established pursuant to section 3 is properly identified upon first entry of the animal into commerce. Any animal or group of animals that the Secretary determines is not properly identified shall be identified using the official identification technology before entering commerce.</text></section> 
<section id="H707992D53A4F45ED8B91E08CCFEE6567" commented="no"><enum>6.</enum><header>Voluntary participation for other animal species</header> 
<subsection id="H2FBE4C9399834F89A34CA51BE0A3C83F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The owner of an animal or group of animals, where applicable, that is not subject to the livestock identification system established pursuant to section 3 may voluntarily subject such animal or group of animals to tracking by such livestock identification system.</text></subsection> 
<subsection id="HCDA92D3C08064016A44741AFC0C521CC"><enum>(b)</enum><header>Enforcement exemption</header><text>The voluntary tracking of such animal or group of animals shall not make the animal or group of animals subject to the enforcement actions of the Secretary under section 5.</text></subsection></section> 
<section id="HD570BCE0857D4889897EDDBDDBEEF085"><enum>7.</enum><header>Release of livestock identification numbering information</header> 
<subsection id="H79AC50A45D1D49F1B7DE00ECDA41351B"><enum>(a)</enum><header>Freedom of information act</header><text>Information obtained through the livestock identification system established pursuant to section 3 or the premise identification system established pursuant to section 4 is exempt from disclosure under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code.</text></subsection> 
<subsection id="H247081F0DAD546F1A9E2DA01C7F7D376"><enum>(b)</enum><header>Character of livestock identification system information</header><text>Except as provided in subsections (c) and (d), information obtained through the livestock identification system or the premise identification system—</text> 
<paragraph id="HC1FC88FA5ABB4243ABCD7692E76DAEB"><enum>(1)</enum><text>may not be released;</text></paragraph> 
<paragraph id="H5DE71A94EE144EEFA3B56D7D421CC2DE"><enum>(2)</enum><text>shall not be considered information in the public domain; and</text></paragraph> 
<paragraph id="H34A33E008B1548D9916EAE17ED83BD1"><enum>(3)</enum><text>shall be considered commercial information that is privileged and confidential.</text></paragraph></subsection> 
<subsection id="H546E250A9F1148AB9ED2D5A9CE5FB93" commented="no"><enum>(c)</enum><header>Limited release of information authorized</header><text display-inline="yes-display-inline">Notwithstanding subsection (b), the Board may release information obtained through the livestock identification system or the premise identification system (other than information voluntarily submitted pursuant to section 3(b)(1)(B)(viii)) regarding particular livestock if—</text> 
<paragraph id="H939BE99EB05247ADA75900F99CFDF896" commented="no"><enum>(1)</enum><text>a disease or pest poses a significant threat to the livestock that the information involves;</text> </paragraph> 
<paragraph id="H3535D3C604D24B209F18A7E08FC6D56" commented="no"><enum>(2)</enum><text>the release of the information is related to actions the Board may take under this Act; and</text></paragraph> 
<paragraph id="HAA9AB975D2FC4C268EF9990228EBC88C" commented="no"><enum>(3)</enum><text>the person obtaining the information needs the information for reasons consistent with the public health and public safety purposes of the livestock identification system, as determined by the Secretary of Agriculture.</text></paragraph></subsection> 
<subsection id="H549FF6F8BDB1490C99681377528EF4DF"><enum>(d)</enum><header>Limited release of information required</header> 
<paragraph id="HC92F1BBABC404B0DB5C6722C8F1E284F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding subsection (b), the Board shall promptly release information obtained through the livestock identification system or the premise identification system (other than information voluntarily submitted pursuant to section 3(b)(1)(B)(viii)) regarding particular livestock—</text> 
<subparagraph id="HCB7CEA55915E4A409C45CEEF6FBD2600"><enum>(A)</enum><text>to the person who owns or controls the livestock, if the person requests such information;</text></subparagraph> 
<subparagraph id="H446AC592C1464DB3AF14A900E2DFE923"><enum>(B)</enum><text>to the Secretary of Agriculture for the purpose of animal disease surveillance;</text></subparagraph> 
<subparagraph id="H9C77C53BADD5463E8E5D441DCCFBA6E5"><enum>(C)</enum><text>to a State or tribal veterinarian or a State or tribal agriculture agency for the purpose of animal disease surveillance;</text></subparagraph> 
<subparagraph id="H8C7C85B8B97D43A98315EA6D6E927E1E"><enum>(D)</enum><text>to the Attorney General for the purpose of investigation or prosecution of a criminal act;</text></subparagraph> 
<subparagraph id="HC30F0050B43C4432A29807C040F5FFFF"><enum>(E)</enum><text>to the Secretary of Homeland Security for the purpose of national security;</text></subparagraph> 
<subparagraph id="HE04FAC50DD3140229B3CEEF36BBFE96"><enum>(F)</enum><text>to the Secretary of Health and Human Services for the purpose of protection of public health; and</text></subparagraph> 
<subparagraph id="HD0E468A6B3BF4A22840592162E159D3F"><enum>(G)</enum><text>to the government of a foreign country, if release of the information is necessary to trace livestock threatened by disease or pest, as determined by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="HB733272124704BBAB1CE3C008470B71D" commented="no"><enum>(2)</enum><header>Information voluntarily submitted</header><text>Notwithstanding subsection (b), on the request of a person who owns or controls livestock, the Board shall release information voluntarily submitted to the Board pursuant to section 3(b)(1)(B)(viii) regarding such livestock to such person or to another person.</text> </paragraph></subsection> 
<subsection id="H07B9B4E624F04C68AEA66B20CF12B234"><enum>(e)</enum><header>Conflict of law</header><text>If the information disclosure limitations or requirements of this section conflict with information disclosure limitations or requirements of a State law and such conflict involves interstate or international commerce, this section shall take precedence over the State law.</text> </subsection></section> 
<section id="H75F29566BD2F443485A74E6B00E8CCE5"><enum>8.</enum><header>Report on impact of livestock identification system</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Agriculture shall submit to the Committees on Appropriations of the House of Representatives and the Senate, the Committee on Agriculture of the House of Representatives, and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report on a livestock identification system, including—</text> 
<paragraph id="HF7DC506A166A4A4E86DF223F2E34D4F0"><enum>(1)</enum><text>the lessons learned and the effectiveness of the animal identification system pilot programs funded in fiscal year 2005;</text></paragraph> 
<paragraph id="H7E889A03953246C2BCCD659000AD2D00"><enum>(2)</enum><text>an analysis of the economic impact of a livestock identification system on the livestock industry; and</text></paragraph> 
<paragraph id="HC798246BE9EB478DBBFE658EA66C93DD"><enum>(3)</enum><text>the expected cost of implementing a livestock identification system.</text></paragraph></section> 
<section id="H64B1A64A952346BCAC5F002B7CA5199"><enum>9.</enum><header>Conforming amendments</header><text display-inline="no-display-inline">Subsection (f) of section 282 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1638a">7 U.S.C. 1638a</external-xref>) is amended—</text> 
<paragraph id="HC41477BF25B4452B85A2F4C4A53059B"><enum>(1)</enum><text>by striking <quote><header-in-text level="subsection" style="OLC">Certification of origin.—</header-in-text></quote> and all that follows through <quote>To certify the country of origin</quote> and inserting <quote><header-in-text level="subsection" style="OLC">Certification of origin; existing certification programs.—</header-in-text>To certify the country of origin</quote>; and</text></paragraph>

<section id="H45E1167423CF4FDE8F73E08051003BF7"><enum>10.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HF904A830ABCD495F9139A6AB17F50090"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>Board</quote> means the Livestock Identification Board established under section 3(a).</text></paragraph> 
<paragraph id="H30B8BDDD9F8B47278335D4AA009352FB"><enum>(2)</enum><text>The term <quote>livestock</quote> means cattle, swine, sheep, goats, and poultry.</text></paragraph> 
<paragraph id="H7FAFA0151B334A7000D2DF01F206A8C4"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>premise</quote> means a location that holds, manages, or boards animals.</text></paragraph> 
<paragraph id="H796CD2895BFE4060B0063D696F9F7287"><enum>(4)</enum><text>The term <quote>relevant congressional committees</quote> means the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate.</text></paragraph> 
<paragraph id="H14C4EE14FDF4439F8373EBB23100B8AB"><enum>(5)</enum><text>The term <quote>Secretary</quote> means the Secretary of Agriculture.</text></paragraph></section> 
<section id="HF4787F6923584FECA123A7BF4D44A332"><enum>11.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this Act $33,000,000 for each of fiscal years 2006 through 2008.</text></section>
