<section id="H38FCB3863206477BA9DD9EBDB1A666A7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Video Choice Act of 2005</short-title></quote>.</text></section> 
<section id="H92E8614B0FAD4FE4A65021BC2CEDC0AE"><enum>2.</enum><header>Establishment of Video Choice Regulatory Relief</header><text display-inline="no-display-inline">The Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) is amended by adding at the end the following new title:</text>

<title id="H1C21C6F711834436AA2152D88C3B4766"><enum>VIII</enum><header>Video Choice Regulatory Relief</header> 
<section id="H22B358D4E0D3454D9E886E6B2000F5B9"><enum>801.</enum><header>Definitions</header> 
<subsection id="HDBA688112A024F6A9CAFB3C1FDDAD77"><enum>(a)</enum><header>Competitive video services provider</header><text display-inline="yes-display-inline">For purposes of this title, the term <quote>competitive video services provider</quote> means any provider of video programming, interactive on-demand services, other programming services, or any other video services, who has, pursuant to any Federal, State, or local law, any right, permission, or authority to establish or use lines in or across public rights-of-way, which right, permission or authority does not rely on, and is independent of, any cable franchise obtained pursuant to section 621.</text> </subsection> 
<subsection id="H9E6425341E2643150061C2906DDB3B8B"><enum>(b)</enum><header>Other terms</header><text>For the purposes of this title, any term used in this title that is defined by section 602 has the meaning provided by that section.</text></subsection></section> 
<section id="HA7B23512D73149FD9E8EC6E800878822"><enum>802.</enum><header>Regulatory Relief</header> 
<subsection id="H138A6903FE05488CAB871EFB92F0F263"><enum>(a)</enum><header>Redundant franchises prohibited</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, no competitive video services provider may be required, whether pursuant to section 621 or to any other provision of Federal, State, or local law, to obtain a franchise, in order to provide any video programming, interactive on-demand services, other programming services, or any other video services in any geographic area if the provider has, pursuant to any Federal, State, or local law, any right, permission, or authority to establish lines in or across public rights-of-way in such geographic area, which right, permission or authority does not rely on, and is independent of, any cable franchise obtained pursuant to section 621.</text></subsection> 
<subsection id="HAFD1B16B4E2A4141A3003BA292A13120"><enum>(b)</enum><header>Fees</header> 
<paragraph id="HEF38C63454144CBDB97163F1CBB99ECC"><enum>(1)</enum><header>Fees permitted</header><text display-inline="yes-display-inline">Any competitive video services provider may be subject to the payment of fees to a local franchising authority, based on the gross revenues of the provider within the jurisdiction of such franchising authority, subject to the limitations of paragraph (2).</text></paragraph> 
<paragraph id="H9629E434A3C74234AF9869810400DFA7"><enum>(2)</enum><header>Limits on fees</header><text display-inline="yes-display-inline">In determining the fees that may be required under <internal-xref idref="HEF38C63454144CBDB97163F1CBB99ECC" legis-path="662.(b)(1)">paragraph (1)</internal-xref>—</text> 
<subparagraph id="H056C43FFD0AE44BA88E1F6386748F7BA"><enum>(A)</enum><text>the rate at which fees are imposed shall not exceed—</text> 
<clause id="HD10E3F0B169E4F328C54E7263156FAED"><enum>(i)</enum><text>the rate at which franchise fees are imposed on any cable operator providing cable service in the jurisdiction of the franchising authority, as determined in accordance with section 622 and any related regulations; or</text></clause> 
<clause id="HA46BF7E284544EC188BEAA56B8CD450"><enum>(ii)</enum><text>in any jurisdiction in which no cable operator provides service, no more than the rate at which franchise fees could be imposed rate on a cable operator in accordance with section 622 and any related regulations; and</text></clause></subparagraph> 
<subparagraph id="H7C580AA264ED457AB318AE99717D734"><enum>(B)</enum><text>the only revenues that shall be considered are those attributable to services that would be considered in calculating franchise fees if the provider were deemed a cable operator for purposes of section 622 and any related regulations.</text></subparagraph></paragraph> 
<paragraph id="H55455008790440DBACAB2BB55FC31F15"><enum>(3)</enum><header>Itemized billing permitted</header><text>The competitive video services provider may designate that portion of the end user’s bill attributable to the fee under this subsection as a separate item on the bill.</text></paragraph></subsection> 
<subsection id="H38C9DDF9684F4DC087079381CC145093"><enum>(c)</enum><header>Regulatory treatment</header> 
<paragraph id="H4640F92047A14441988828007BCEABB5"><enum>(1)</enum><header>Obligations and duties</header><text>Any competitive video services provider shall—</text> 
<subparagraph id="H88846E1E6AE047798DE9E8B0082DA2FB"><enum>(A)</enum><text>be subject to the retransmission consent provisions of section 325(b);</text></subparagraph> 
<subparagraph id="HEB689B5394DB4C3094D6F3F4780711C5"><enum>(B)</enum><text display-inline="yes-display-inline">carry, within each local franchise area, any public, educational, or governmental use channels that are carried by cable operators within such franchise area, and, in any franchise area not served by a cable operator, provide reasonable public, educational or governmental access facilities pursuant to section 611;</text></subparagraph> 
<subparagraph id="H890BFFDB776F44E0891740E404BB0003"><enum>(C)</enum><text>carry the signals of local commercial television stations as required by section 614;</text></subparagraph> 
<subparagraph id="H28ABC709AE5644AAA16738AC670728A"><enum>(D)</enum><text>carry the signals of local noncommercial educational television stations as required by section 615;</text></subparagraph> 
<subparagraph id="H8DBFC09A9241407BABBDF44500451F57"><enum>(E)</enum><text display-inline="yes-display-inline">not deny services to any group of potential residential subscribers because of the income of the residents of the local area in which such group resides; </text></subparagraph> 
<subparagraph id="HD2B79A22F13B4548B989F4A84933BCC"><enum>(F)</enum><text>be entitled to the benefits and protection of section 628;</text></subparagraph> 
<subparagraph id="H6689E02CC9344D37918FABB5212950EC"><enum>(G)</enum><text>protect the personally identifiable information of its subscribers in the same manner as is required of cable operators with respect to subscribers to cable services under section 631;</text></subparagraph> 
<subparagraph id="HDD6E3AA6604C483500C57400BC14ACD"><enum>(H)</enum><text>comply with any consumer protection and customer service requirements promulgated by the Commission pursuant to section 632;</text></subparagraph> 
<subparagraph id="H85621FB7EF3F4F18BE4B85DBBDC7EA83"><enum>(I)</enum><text display-inline="yes-display-inline">be entitled to the benefits and protection of section 633;</text></subparagraph> 
<subparagraph id="HC774DD01A9FA4A049FA3F8540764B4AB"><enum>(J)</enum><text>be subject to the requirements of section 641;</text></subparagraph> 
<subparagraph id="HC8503F06658B45A7923450BF7F2097C"><enum>(K)</enum><text display-inline="yes-display-inline">be subject to the prohibition on buy outs of or by the incumbent cable operator under section 652; and </text></subparagraph> 
<subparagraph id="HE5D24A1C0F53487689404D0041AEE2DC"><enum>(L)</enum><text>not be subject to any other provisions of title VI of this Act.</text></subparagraph></paragraph> 
<paragraph id="H6C1009BA20144B94924E0065DF013CDB"><enum>(2)</enum><header>Determinations of local signals</header><text>For purposes of complying with <internal-xref idref="H890BFFDB776F44E0891740E404BB0003" legis-path="662.(c)(1)(C)">paragraphs (1) (C)</internal-xref> and <internal-xref idref="H28ABC709AE5644AAA16738AC670728A" legis-path="662.(c)(1)(D)">(D)</internal-xref>, a competitive video service provider shall treat as local television stations with respect to a customer located within the jurisdiction of any franchising authority the same stations that are treated as local television stations for a cable system located within such jurisdiction.</text></paragraph></subsection> 
<subsection id="H6C251FDA078542FA946D3E6C96B7B58F"><enum>(d)</enum><header>Other regulation prohibited</header><text>Except to the extent expressly provided in this title, neither the Commission nor any State or political subdivision thereof may regulate the rates, charges, terms, or conditions for, entry into, exit from, deployment or provision of, or any other aspect of the services provided by a competitive video services provider.</text></subsection> 
<subsection id="H7BF175F83081472EBF79E511135900B9"><enum>(e)</enum><header>State and local government authority</header><text>Except as provided in <internal-xref idref="H138A6903FE05488CAB871EFB92F0F263" legis-path="662.(a)">subsection (a)</internal-xref>, nothing in this section affects the authority of a State or local government to manage the public rights-of-way.</text></subsection></section> </title><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H5882C4A3ECB54C9FB222AB252107E06F"><enum>3.</enum><header>Regulation of Common Carriers</header><text display-inline="no-display-inline">Section 651(a)(3) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/571">47 U.S.C. 571(a)(3)</external-xref>) is amended—</text> 
<paragraph id="HDAF92A2C494D4F7DA64E014479A600C1"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of subparagraph (A);</text></paragraph> 
<paragraph id="HE5D308CCE203459E956873E0875011AE"><enum>(2)</enum><text>by striking the period at the end of subparagraph (B) and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="H3678520E66C844E08084D2982188D1F6"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="H88FDC20CCCA5492D86B3F31700FD916B"><enum>(C)</enum><text display-inline="yes-display-inline">if such carrier is a competitive video services provider providing video programming pursuant to title VIII of this Act, such carrier shall not be subject to the requirements of this title except as provided in title VIII.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
