<section id="H2212A4F92231492500FBCF88A1EAD0E4"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Sex Offender Registration and Notification Act</short-title></quote>.</text></section> 
<section id="HC20AD355917D433E953C1BA11D52BEE8"><enum>102.</enum><header>Declaration of purpose</header><text display-inline="no-display-inline">In response to the vicious attacks by violent sexual predators against the victims listed below, Congress in this Act establishes a comprehensive national system for the registration of sex offenders:</text> 
<paragraph id="HD6094DA755014CA08C3F5CF4C16321E"><enum>(1)</enum><text display-inline="yes-display-inline">Jacob Wetterling, who was 11 years old, was abducted in 1989 in Minnesota, and remains missing.</text></paragraph> 
<paragraph id="H28B65B1886E04097A138F3FEBDD85FB5"><enum>(2)</enum><text display-inline="yes-display-inline">Megan Nicole Kanka, who was 7 years old, was abducted, sexually assaulted and murdered in 1994, in New Jersey.</text></paragraph> 
<paragraph id="H74B55526E54A48769100D07B54F39EC"><enum>(3)</enum><text>Pam Lychner, who was 31 years old, was attacked by a career offender in Houston, Texas.</text></paragraph> 
<paragraph id="H11A9A8A8F93F4885AEDF7206E1BC00DF"><enum>(4)</enum><text>Jetseta Gage, who was 10 years old, was kidnapped, sexually assaulted, and murdered in 2005 in Cedar Rapids, Iowa.</text></paragraph> 
<paragraph id="H6C1E890D52E64D45A0BD4E4137EFF125"><enum>(5)</enum><text>Dru Sjodin, who was 22 years old, was sexually assaulted and murdered in 2003, in North Dakota.</text></paragraph> 
<paragraph id="H5578B99598E243A694E7FBE5586FCBF"><enum>(6)</enum><text>Jessica Lunsford, who was 9 years, was abducted, sexually assaulted, buried alive, and murdered in 2005, in Homosassa, Florida.</text></paragraph> 
<paragraph id="H00A954B45EB245218E932D8B26A814BB"><enum>(7)</enum><text>Sarah Lunde, who was 13 years old, was strangled and murdered in 2005, in Ruskin, Florida.</text></paragraph> 
<paragraph id="HEF31A22AAEBD4DB1A98CB3ED7C9CBB98"><enum>(8)</enum><text>Amie Zyla, who was 8 years old, was sexually assaulted in 1996 by a juvenile offender in Waukesha, Wisconsin, and has become an advocate for child victims and protection of children from juvenile sex offenders.</text></paragraph> 
<paragraph id="HC3B8D61FA60543C898152859507BDB81"><enum>(9)</enum><text>Christy Ann Fornoff, who was 13 years old, was abducted, sexually assaulted and murdered in 1984, in Tempe, Arizona.</text></paragraph> 
<paragraph id="H2777924802BD470E94F00001728377E5"><enum>(10)</enum><text>Alexandra Nicole Zapp, who was 30 years old, was brutally attacked and murdered in a public restroom by a repeat sex offender in 2002, in Bridgewater, Massachusetts.</text></paragraph></section> 
<subtitle id="HF44AB7BB8FEF4A51B3AA1527C579FBD0"><enum>A</enum><header>Jacob Wetterling Sex Offender Registration and Notification Program</header> 
<section id="H7392B8CB2B3D49B4AA41C01714603FBD"><enum>111.</enum><header>Relevant definitions, including Amie Zyla expansion of sex offender definition and expanded inclusion of child predators</header><text display-inline="no-display-inline">In this title the following definitions apply:</text> 
<paragraph id="H67667C0B6E1B4A66B0933E21F5C7FA01"><enum>(1)</enum><header>Sex offender registry</header><text>The term <quote>sex offender registry</quote> means a registry of sex offenders, and a notification program, maintained by a jurisdiction.</text></paragraph> 
<paragraph id="HC1CC47049421482C81B52CDB123C6238"><enum>(2)</enum><header>Jurisdiction</header><text>The term jurisdiction means any of the following:</text> 
<subparagraph id="H451671A851994C76AB69868874B60000" display-inline="no-display-inline"><enum>(A)</enum><text>A State.</text></subparagraph>

<paragraph id="H35C93CD25F6E4D90A38F891DA2B215D2" display-inline="no-display-inline"><enum>(6)</enum><header>Serious sex offense</header><text>The term <quote>serious sex offense</quote> means—</text> 
<subparagraph id="HA53161D409394DD6B91176DF200C75F"><enum>(A)</enum><text> a sex offense punishable under the law of a jurisdiction by imprisonment for more than one year;</text></subparagraph> 
<subparagraph id="H7A1591536A5247AFAD1B557BCFE8F690"><enum>(B)</enum><text>any Federal offense under chapter 109A, 110, 117, or <external-xref legal-doc="usc" parsable-cite="usc/18/1591">section 1591</external-xref> of title 18, United States Code;</text></subparagraph> 
<subparagraph id="H1BE4CD8646324E23B77F4B8DD5A2CC5"><enum>(C)</enum><text>an offense in a category specified by the Secretary of Defense under section 115(a)(8)(C) of title I of <external-xref legal-doc="public-law" parsable-cite="pl/105/119">Public Law 105–119</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/10/951">10 U.S.C. 951</external-xref> note);</text></subparagraph>

<paragraph id="H2CF584BFAF234F1EA3FA988DAFC097BD"><enum>(8)</enum><header>Student</header><text>The term <quote>student</quote> means an individual who enrolls or attends an educational institution, including (whether public or private) a secondary school, trade or professional school, and institution of higher education.</text></paragraph> 
<paragraph id="H8EDFC87B8C744079A24E744161E3C2EA"><enum>(9)</enum><header>Employee</header><text>The term <quote>employee</quote> includes an individual who is self-employed or works for any other entity, whether compensated or not.</text></paragraph> 
<paragraph id="H50920643850C4D43B88B65B9E5D757CA"><enum>(10)</enum><header>Resides</header><text>The term <quote>resides</quote> means, with respect to an individual, the location of the individual’s home or other place where the individual lives.</text></paragraph> 
<paragraph id="HB672E3E4EF3E4AD18300C73C49DEA8F6"><enum>(11)</enum><header>Minor</header><text>The term <quote>minor</quote> means an individual who has not attained the age of 18 years. </text></paragraph></section> 
<section id="HF148B3E407204590B6D02C4B8454EF68" display-inline="no-display-inline" section-type="subsequent-section"><enum>112.</enum><header>Registry requirements for jurisdictions</header><text display-inline="no-display-inline">Each jurisdiction shall maintain a jurisdiction-wide sex offender registry conforming to the requirements of this title. The Attorney General shall issue and interpret guidelines to implement the requirements and purposes of this title. </text></section> 
<section id="H91A6487E3AFF46F887194CDAF8027A5"><enum>113.</enum><header>Registry requirements for sex offenders</header> 
<subsection id="HE39EBF1D912F4BCA913FDC7C0040714B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A sex offender must register, and keep the registration current, in each jurisdiction where the offender resides, where the offender is an employee, and where the offender is a student.</text></subsection> 
<subsection id="H0D7E7CE470024CA8862637BC71EC58E"><enum>(b)</enum><header>Initial registration</header><text>The sex offender shall initially register—</text> 
<paragraph id="H1FECE2247717448DBB9392C32DE41409"><enum>(1)</enum><text> before completing a sentence of imprisonment with respect to the offense giving rise to the registration requirement; or</text></paragraph> 
<paragraph id="H72E6A7B0AF6244C088FF26C122E18EDE"><enum>(2)</enum><text>not later than 5 days after being sentenced for that offense, if the sex offender is not sentenced to a term of imprisonment.</text></paragraph></subsection> 
<subsection id="HECEB70DB57014AD4ADD53E241EA58644"><enum>(c)</enum><header>Keeping the registration current</header><text>A sex offender must inform each jurisdiction involved, not later than 5 days after each change of residence, employment, or student status.</text></subsection> 
<subsection id="HAC3DBA8272074BF19EA18FD687AF5FE"><enum>(d)</enum><header>Retroactive duty to register</header><text>The Attorney General shall prescribe a method for the registration of sex offenders convicted before the enactment of this Act.</text></subsection> 
<subsection id="H07622095FDA84BE8AAEC65A90064126F"><enum>(e)</enum><header>State penalty for failure to comply</header><text>Each jurisdiction shall provide a criminal penalty, that includes a maximum term of imprisonment that is greater than one year, for the failure of a sex offender to comply with the requirements of this title.</text></subsection></section> 
<section id="H7AB06B50E77241A684F4A6A12B7200EC"><enum>114.</enum><header>Information required in registration</header> 
<subsection id="H733AF9129D91438FB2A07C88CD552900"><enum>(a)</enum><header>Provided by the offender</header><text display-inline="yes-display-inline">The sex offender must provide the following information to the appropriate official for inclusion in the sex offender registry:</text> 
<paragraph id="H748323C7FCBC4A90AA00FD2BF8B61E62"><enum>(1)</enum><text>The name of the sex offender (including any alias used by the individual).</text></paragraph> 
<paragraph id="HAF70D8B4CB1D499B82A7C6A6C8000022"><enum>(2)</enum><text>The Social Security number of the sex offender.</text></paragraph> 
<paragraph id="HE45681E3FA40407E916E9195A1003FC2"><enum>(3)</enum><text>The address and location of the residence at which the sex offender resides or will reside.</text></paragraph> 
<paragraph id="H71E0EDB7998D44D4ACEF94E1136556C4"><enum>(4)</enum><text>The place where the sex offender is employed or will be employed.</text></paragraph> 
<paragraph id="HB4AF9470E3E042169043A5EE5437A12E"><enum>(5)</enum><text>The place where the sex offender is a student or will be a student.</text></paragraph> 
<paragraph id="H83BC00B6448B416F93CD0081782BA16B"><enum>(6)</enum><text>The license plate number of any vehicle owned or operated by the sex offender.</text></paragraph> 
<paragraph id="HE3FACF2951384F6FA8646B1B4704B9FE"><enum>(7)</enum><text>A photograph of the sex offender.</text></paragraph> 
<paragraph id="HF64EEA0F2C344D9C93B4D209D21C5B9"><enum>(8)</enum><text>A set of fingerprints and palm prints of the sex offender, if the appropriate official determines that the jurisdiction does not already have available an accurate set.</text></paragraph> 
<paragraph id="H2F014DE8731342DFB78948B6C1C5BE24"><enum>(9)</enum><text>A DNA sample of the sex offender, if the appropriate official determines that the jurisdiction does not already have available an appropriate DNA sample.</text></paragraph> 
<paragraph id="HE6A04283B06B493FBB781BC6FCADF1B"><enum>(10)</enum><text>Any other information required by the Attorney General.</text></paragraph></subsection> 
<subsection id="H596D7AC1FBD9415CBFE9D2CF9D88B63"><enum>(b)</enum><header>Provided by the jurisdiction</header><text>The jurisdiction in which the sex offender registers shall include the following information in the registry for that sex offender:</text> 
<paragraph id="H467578702EE44006BB82FC17564F5D8"><enum>(1)</enum><text>A statement of the facts of the offense giving rise to the requirement to register under this title.</text></paragraph> 
<paragraph id="H648C12E352CC475900ED2700CEBA4973"><enum>(2)</enum><text>The criminal history of the sex offender.</text></paragraph> 
<paragraph id="HCF18CE7ED15E404FBC9CF82E69F1B23"><enum>(3)</enum><text>Any other information required by the Attorney General.</text></paragraph></subsection></section> 
<section id="H72C341DDF06D4413B0BEA0FB67C104ED"><enum>115.</enum><header>Duration of registration requirement</header><text display-inline="no-display-inline">A sex offender shall keep the registration current—</text> 
<paragraph id="H9A8A2CA78289429BB1A9C9FC4265D377"><enum>(1)</enum><text>for the life of the sex offender, if the offense is a specified offense against a minor, a serious sex offense, or a second misdemeanor sex offense against a minor; and</text></paragraph> 
<paragraph id="H453637DD7D594C588C9E6F3269F853B4"><enum>(2)</enum><text display-inline="yes-display-inline">for a period of 20 years, in any other case. </text></paragraph></section> 
<section id="H99323B0005234A3D002DD67389B34CBC"><enum>116.</enum><header>In person verification</header><text display-inline="no-display-inline">A sex offender shall appear in person and verify the information in each registry in which that offender is required to be registered not less frequently than once every six months.</text></section> 
<section id="H6BC5428495EE4FA2B56268130119E562"><enum>117.</enum><header>Duty to notify sex offenders of registration requirements and to register</header><text display-inline="no-display-inline">An appropriate official shall, shortly before release from custody of the sex offender, or, if the sex offender is not in custody, immediately after the sentencing of the sex offender, for the offense giving rise to the duty to register—</text> 
<paragraph id="H8988AADFA06A486DA5A72DC5256BCFB5"><enum>(1)</enum><text>inform the sex offender of the duty to register and explain that duty;</text></paragraph> 
<paragraph id="H39465FCBE6EB4B32B6BA9FB4F72FF2DB"><enum>(2)</enum><text>require the sex offender to read and sign a form stating that the duty to register has been explained and that the sex offender understands the registration requirement; and</text></paragraph> 
<paragraph id="H6F3914CD14A04702AD85540007016E66"><enum>(3)</enum><text>ensure that the sex offender is registered.</text></paragraph></section> 
<section id="HC236A482C7D54F4C89C4CF83A016DCF"><enum>118.</enum><header>Jessica Lunsford Address Verification Program</header> 
<subsection id="H547258C9A85B4639B914D86C51CB0500"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established the Jessica Lunsford Address Verification Program (hereinafter in this section referred to as the <quote>Program</quote>).</text></subsection> 
<subsection id="H7BF2D07AE3FB4171B45924DF10DDE43F"><enum>(b)</enum><header>Verification</header><text>In the Program, an appropriate official shall verify the residence of each registered sex offender not less than monthly or, in the case of a sex offender required to register because of a misdemeanor sex offense against a minor, not less than quarterly.</text></subsection> 
<subsection id="H152D354C9E28402CA28EC58FA19EF7A4"><enum>(c)</enum><header>Use of mailed form authorized</header><text>Such verification may be achieved by mailing a nonforwardable verification form to the last known address of the sex offender. The date of the mailing may be selected at random. The sex offender must return the form, including a notarized signature, within a set period of time. A failure to return the form as required may be a failure to register for the purposes of this title.</text></subsection></section> 
<section id="HC515F2C7832646EBB9EBD90076EC486"><enum>119.</enum><header>National Sex Offender Registry</header><text display-inline="no-display-inline">The Attorney General shall maintain a national database at the Federal Bureau of Investigation for each sex offender and other person required to register in a jurisdiction’s sex offender registry. The database shall be known as the National Sex Offender Registry.</text></section> 
<section id="H1A6E9C082EB84CE48364D01ED7162884"><enum>120.</enum><header>Dru Sjodin National Sex Offender Public Website</header> 
<subsection id="HA8D8B58176B247EC91DA4983F1B7338E"><enum>(a)</enum><header>Establishment</header><text>There is established the Dru Sjodin National Sex Offender Public Website (hereinafter referred to as the <quote>Website</quote>).</text></subsection> 
<subsection id="H6541C50F629C4B40AEF783EC075ED6EF"><enum>(b)</enum><header>Information to be provided</header><text>The Attorney General shall maintain the Website as a site on the Internet which allows the public to obtain relevant information for each sex offender by a single query in a form established by the Attorney General.</text></subsection> 
<subsection id="H663D0D521025447AB9C67944FECC24BE"><enum>(c)</enum><header>Electronic forwarding</header><text display-inline="yes-display-inline">The Attorney General shall ensure (through the National Sex Offender Registry or otherwise) that updated information about a sex offender is immediately transmitted by electronic forwarding to all relevant jurisdictions, unless the Attroney General determines that each jurisdiction has so modified its sex offender registry and notification program that there is no longer a need for the Attorney General to do.</text></subsection></section> 
<section id="HE832810A965D44E90000F1A3EF411F70" display-inline="no-display-inline"><enum>121.</enum><header>Public access to sex offender information through the Internet</header><text display-inline="no-display-inline">Each jurisdiction shall make available on the Internet all information about each sex offender in the registry, except for the offender’s Social Security number, the identity of any victim, and any other information exempted from disclosure by the Attorney General. The jurisdiction shall provide this information in a manner that is readily accessible to the public.</text></section> 
<section id="H1318D09008A349BE8BC2F20691E81F3D"><enum>122.</enum><header>Megan Nicole Kanka and Alexandra Nicole Zapp Community Notification Program</header> 
<subsection id="H194078A795A846A58FD81DE81B5F583B"><enum>(a)</enum><header>Establishment of program</header><text display-inline="yes-display-inline">There is established the Megan Nicole Kanka and Alexandra Nicole Zapp Community Program (hereinafter in this section referred to as the <quote>Program</quote>).</text></subsection> 
<subsection id="HF3E4001FF8A648289E8258530662CACC"><enum>(b)</enum><header>Notification</header><text display-inline="yes-display-inline">In the Program, as soon as possible, and in any case not later than 5 days after a sex offender registers or updates a registration, an appropriate official in the jurisdiction shall provide the information in the registry (other than information exempted from disclosure by the Attorney General) about that offender to the following:</text> 
<paragraph id="H764A1EA97E904B35BD732EF944D34C4"><enum>(1)</enum><text>The Attorney General, who shall include that information in the National Sex Offender Registry.</text></paragraph> 
<paragraph id="H33EC0911B5AE4257ADEEAAB6FC636137"><enum>(2)</enum><text>Appropriate law enforcement agencies (including probation agencies, if appropriate), and each school and public housing agency, in each area in which the individual resides, is employed, or is a student.</text></paragraph> 
<paragraph id="HAC5E244231F3498298F94C8497738F45"><enum>(3)</enum><text>Each jurisdiction from or to which a change of residence, work, or student status occurs.</text></paragraph> 
<paragraph id="HAC2C8FD5DE7A4350965D84CE230091AD"><enum>(4)</enum><text>Any agency responsible for conducting employment-related background checks under section 3 of the National Child Protection Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/5119a">42 U.S.C. 5119a</external-xref>). </text></paragraph> 
<paragraph id="H40B8FBE49FDD43A788A62F923208E2E3"><enum>(5)</enum><text>Social service entities responsible for protecting minors in the child welfare system.</text></paragraph> 
<paragraph id="H8ADA9AA03F434E0BB815D123EF41362"><enum>(6)</enum><text>Volunteer organizations in which contact with minors or other vulnerable individuals might occur.</text></paragraph></subsection></section> 
<section id="H9B1D0479AF014A420075C1D776149EE9"><enum>123.</enum><header>Actions to be taken when sex offender fails to comply</header><text display-inline="no-display-inline">An appropriate official shall notify the Attorney General and appropriate State and local law enforcement agencies of any failure by a sex offender to comply with the requirements of a registry. The appropriate official, the Attorney General, and each such State and local law enforcment agency shall take any appropriate action to ensure compliance.</text></section> 
<section id="HE65CD1B08F8743259C007C20F7E15EAC"><enum>124.</enum><header>Immunity for good faith conduct</header><text display-inline="no-display-inline">Law enforcement agencies, employees of law enforcement agencies and independent contractors acting at the direction of such agencies, and officials of jurisdictions and other political subdivisions shall not be civilly or criminally liable for good faith conduct under this title.</text></section> 
<section id="H6FE0E1BCBEBF4E6B9420DFD5E4E2EDE"><enum>125.</enum><header>Development and availability of registry management software</header><text display-inline="no-display-inline"> The Attorney General shall develop and support software for use to establish, maintain, publish, and share sex offender registries.</text></section> 
<section id="HB0C701E0A0994079BA1441C071C8C105"><enum>126.</enum><header>Federal duty when State programs not minimally sufficient</header><text display-inline="no-display-inline">If the Attorney General determines that a jurisdiction does not have a minimally sufficient sex offender registration program, the Department of Justice shall, to the extent practicable, carry out the duties imposed on that jurisdiction by this title.</text></section> 
<section id="H2EFAC02B37834E67853C49AFAAB2C94D" display-inline="no-display-inline"><enum>127.</enum><header>Period for implementation by jurisdictions</header><text display-inline="no-display-inline">Each jurisdiction shall implement this title not later than 2 years after the date of the enactment of this Act. However, the Attorney General may authorize a one-year extension of the deadline.</text></section> 
<section id="HCFE275A3B9A149CC9994A960FCCC936"><enum>128.</enum><header>Failure to comply</header> 
<subsection id="HDCF1954F4F98438A8504323568FCB97"><enum>(a)</enum><header>In general</header><text>For any fiscal year after the end of the period for implementation, a jurisdiction that fails to implement this title shall not receive 10 percent of the funds that would otherwise be allocated for that fiscal year to the jurisdiction under each of the following programs: </text> 
<paragraph id="HF32DCC0E89654317B104A4B38EDF8E10"><enum>(1)</enum><header>Byrne</header><text>Subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3750">42 U.S.C. 3750 et seq.</external-xref>), whether characterized as the Edward Byrne Memorial State and Local Law Enforcement Assistance Programs, the Edward Byrne Memorial Justice Assistance Grant Program, or otherwise. </text></paragraph> 
<paragraph id="H408038EDBDE346D4A9FD0926D2CB421C"><enum>(2)</enum><header>LLEBG</header><text>The Local Government Law Enforcement Block Grants program. </text></paragraph></subsection> 
<subsection id="H638886B58BBE4297A0E80928211C0079"><enum>(b)</enum><header>Reallocation</header><text>Amounts not allocated under a program referred to in paragraph (1) to a jurisdiction for failure to fully implement this title shall be reallocated under that program to jurisdictions that have not failed to implement this title.</text></subsection></section> 
<section id="HA5FCC2E8B970404690B3478F038EB99"><enum>129.</enum><header>Sex Offender Management Assistance (SOMA) Program</header> 
<subsection id="H181FCB38D8D04E6398E13789C1B7A3BB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General shall establish and implement a Sex Offender Management Assistance program (in this title referred to as the <quote>SOMA program</quote>) under which the Attorney General may award a grant to a jurisdiction to offset the costs of implementing this title.</text></subsection> 
<subsection id="H22B56BF96EE84D96AC07A8B36EDCCDEE"><enum>(b)</enum><header>Application</header><text>The chief executive of a jurisdiction shall, on an annual basis, submit to the Attorney General an application in such form and containing such information as the Attorney General may require.</text></subsection> 
<subsection id="H93486D6B781D483D9BC8713FE457E32E"><enum>(c)</enum><header>Bonus payments for prompt compliance</header><text>A jurisdiction that, as determined by the Attorney General, has implemented this title not later than two years after the date of the enactment of this Act is eligible for a bonus payment. Such payment shall be made under the SOMA program for the first fiscal year beginning after that determination. The amount of the payment shall be—</text> 
<paragraph id="HB9F902CD1F3C491CA3644BB7B1605DD2"><enum>(1)</enum><text>10 percent of the total received by the jurisdiction under the SOMA program for the preceding fiscal year, if implementation is not later than one year after the date of enactment of this Act; and</text></paragraph> 
<paragraph id="H0BF49EF30BCA41C1BD1656721F9F9214"><enum>(2)</enum><text>5 percent of such total, if not later than two years after that date.</text></paragraph></subsection> 
<subsection id="H14CE68DC980D46B9BE518FA9E2E2AC6F"><enum>(d)</enum><header>Authorization of appropriations</header><text>In addition to any amounts otherwise authorized to be appropriated, there are authorized to be appropriated such sums as may be necessary to the Attorney General, to be available only for the SOMA program, for fiscal years 2006 through 2008.</text></subsection></section> 
<section id="H8B2EBF301E96418F99023476DCFB7794"><enum>130.</enum><header>Demonstration project for use of electronic monitoring devices</header> 
<subsection id="HDE3FE9BD5B574B83BD57ACAC8DCB9410"><enum>(a)</enum><header>Project required</header><text>The Attorney General shall carry out a demonstration project under which the Attorney General makes grants to jurisdictions to demonstrate the extent to which electronic monitoring devices can be used effectively in a sex offender management program.</text></subsection> 
<subsection id="H4944DCB0F68B4E76A6B6262967331295"><enum>(b)</enum><header>Use of funds</header><text>The jurisdiction may use grant amounts under this section directly, or through arrangements with public or private entities, to carry out programs under which the whereabouts of sex offenders are monitored by electronic monitoring devices.</text></subsection> 
<subsection id="H93DBC1AAEA9D407F953F2CDD3559D95"><enum>(c)</enum><header>Participants</header><text>Not more than 10 jurisdictions may participate in the demonstration project at any one time.</text></subsection> 
<subsection id="H6C65015B8E1B4627A85900C63EE7EE31"><enum>(d)</enum><header>Factors</header><text>In selecting jurisdictions to participate in the demonstration project, the Attorney General shall consider the following factors:</text> 
<paragraph id="HDC26179FE0344E2891A16E9CCA23732E"><enum>(1)</enum><text>The total number of sex offenders in the jurisdiction.</text></paragraph> 
<paragraph id="H77562EF0499F46C8ACD957741A987A9"><enum>(2)</enum><text>The percentage of those sex offenders who fail to comply with registration requirements.</text></paragraph> 
<paragraph id="H9FC50A0BF70C4E9EA7B2C08143418C3F"><enum>(3)</enum><text>The threat to public safety posed by those sex offenders who fail to comply with registration requirements.</text></paragraph> 
<paragraph id="H94836F40FC744AE39CEFFCF6B390B79E"><enum>(4)</enum><text>Any other factor the Attorney General considers appropriate.</text></paragraph></subsection> 
<subsection id="HAD1EE55514724FE28614008FA000862E"><enum>(e)</enum><header>Duration</header><text>The Attorney General shall carry out the demonstration project for fiscal years 2007, 2008, and 2009.</text></subsection> 
<subsection id="HF7A6BB80BBAE403D9D4D03B13CF686B1"><enum>(f)</enum><header>Reports</header><text>The Attorney General shall submit to Congress an annual report on the demonstration project. Each such report shall describe the activities carried out by each participant, assess the effectiveness of those activities, and contain any other information or recommendations that the Attorney General considers appropriate.</text></subsection> 
<subsection id="H17438A51D2854F3C9D7E430357FB5701"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary.</text></subsection></section> 
<section id="H91F13D6CAA324B1B806369961B99B8CF" display-inline="no-display-inline" section-type="subsequent-section"><enum>131.</enum><header>Bonus payments to States that implement electronic monitoring</header> 
<subsection id="H1BDDA03A4A64488B9512D7C83FB23FAB"><enum>(a)</enum><header>In general</header><text>A State that, within 3 years after the date of the enactment of this Act, has in effect laws and policies described in subsection (b) shall be eligible for a bonus payment described in subsection (c), to be paid by the Attorney General from any amounts available to the Attorney General for such purpose.</text></subsection> 
<subsection id="H488E7256B3934D95815ED6646261539D"><enum>(b)</enum><header>Electronic monitoring laws and policies</header> 
<paragraph id="H3C79A40E8D8F4E4D8E91CEEB98C43477"><enum>(1)</enum><header>In general</header><text>Laws and policies referred to in subsection (a) are laws and policies that ensure that electronic monitoring is required of a person if that person is released after being convicted of a State sex offense in which an individual who has not attained the age of 18 years is the victim.</text></paragraph> 
<paragraph id="H4E194F4F25C349138178739692EB1170"><enum>(2)</enum><header>Monitoring required</header><text display-inline="yes-display-inline">The monitoring required under paragraph (1) is a system that actively monitors and identifies the person’s location and timely reports or records the person’s presence near or within a crime scene or in a prohibited area or the person’s departure from specified geographic limitations.</text></paragraph> 
<paragraph id="HF875FC64EA9247ACAE17A3E845D276B9"><enum>(3)</enum><header>Duration</header><text>The electronic monitoring required by paragraph (1) shall be required of the person—</text> 
<subparagraph id="HC4FCE06E42C6406D98EE5EE5F4B570CC"><enum>(A)</enum><text>for the life of the person, if—</text> 
<clause id="HE51D3CDB3387418497A2E32084029237"><enum>(i)</enum><text>an individual who has not attained the age of 12 years is the victim; or</text></clause> 
<clause id="HE2E70B8D8F314AF99200031DB339BD67"><enum>(ii)</enum><text>the person has a prior sex conviction (as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/3559">section 3559(e)</external-xref> of title 18, United States Code); and </text></clause></subparagraph> 
<subparagraph id="H66712086C3DB4BF983E2884209009900"><enum>(B)</enum><text>for the period during which the person is on probation, parole, or supervised release for the offense, in any other case.</text></subparagraph></paragraph> 
<paragraph id="HB18A173C4E7E49F7892E00CC22C33AA" display-inline="no-display-inline"><enum>(4)</enum><header>State required to monitor all sex offenders residing in State</header><text display-inline="yes-display-inline">In addition, laws and policies referred to in subsection (a) also includee laws and policies that ensure that the State frequently monitors each person residing in the State for whom electronic monitoring is required, whether such monitoring is required under this section or under <external-xref legal-doc="usc" parsable-cite="usc/18/3563">section 3563(a)(9)</external-xref> of title 18, United States Code.</text></paragraph></subsection> 
<subsection id="HF8344A0E522A43EBA8505D692DB0286D"><enum>(c)</enum><header>Bonus payments</header><text display-inline="yes-display-inline">The bonus payment referred to in subsection (a) is a payment equal to 10 percent of the funds that would otherwise be allocated for that fiscal year to the jurisdiction under each of the following programs: </text> 
<paragraph id="H39E559B1AC0F488FB9972C00BED16F85"><enum>(1)</enum><header>Byrne</header><text>Subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3750">42 U.S.C. 3750 et seq.</external-xref>), whether characterized as the Edward Byrne Memorial State and Local Law Enforcement Assistance Programs, the Edward Byrne Memorial Justice Assistance Grant Program, or otherwise. </text></paragraph> 
<paragraph id="H3D8BCC2B48EC411CB2A13C02F3184500"><enum>(2)</enum><header>LLEBG</header><text>The Local Government Law Enforcement Block Grants program.</text></paragraph></subsection> 
<subsection id="H2288CA1DEE684263ACD74F895DB46A3" display-inline="no-display-inline"><enum>(d)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <quote>State sex offense</quote> means any criminal offense in a range of offenses specified by State law which is comparable to or which exceeds the range of offenses encompassed by the following:</text> 
<paragraph id="H8202FF665E004F22B56C97BCED84E99F"><enum>(1)</enum><text>A specified offense against a minor.</text></paragraph> 
<paragraph id="H9A1034EE8C514188884D7F020041A5E3"><enum>(2)</enum><text>A serious sex offense.</text></paragraph></subsection></section> 
<section id="H372FBD8C140F4311877E94C0715BC98B"><enum>132.</enum><header>National Center for Missing and Exploited Children access to Interstate Identification Index</header> 
<subsection id="H6FD087C58B7D478CBDB23576DDE1B219"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Attorney General shall ensure that the National Center for Missing and Exploited Children has access to the Interstate Identification Index, to be used by the Center only within the scope of its duties and responsibilities under Federal law. The access provided under this section shall be authorized only to personnel of the Center that have met all the requirements for access, including training, certification, and background screening.</text></subsection> 
<subsection id="H33AC0F8871F54062A9E66DD54B31B733"><enum>(b)</enum><header>Immunity</header><text display-inline="yes-display-inline">Personnel of the Center shall not be civilly or criminally liable for any use or misuse of information in the Interstate Identification Index if in good faith.</text></subsection></section> 
<section id="H98C12FB1FB834C0FB088D105A1B6714E"><enum>133.</enum><header>Limited immunity for National Center for Missing and Exploited Children with respect to CyberTipline</header><text display-inline="no-display-inline">Section 227 of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13032">42 U.S.C. 13032</external-xref>) is amended by adding at the end the following new subsection:</text>

<paragraph id="H6EACF86F55654621A5AC2D005E6088F1"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraphs (2) and (3), the National Center for Missing and Exploited Children, including any of its directors, officers, employees, or agents, is not liable in any civil or criminal action for damages directly related to the performance of its CyberTipline responsibilities and functions as defined by this section.</text></paragraph> 
<paragraph id="H1FF62975AC3149389554715F4E5EF463"><enum>(2)</enum><header>Intentional, reckless, or other misconduct</header><text>Paragraph (1) does not apply in an action in which a party proves that the National Center for Missing and Exploited Children, or its officer, employee, or agent as the case may be, engaged in intentional misconduct or acted, or failed to act, with actual malice, with reckless disregard to a substantial risk of causing injury without legal justification, or for a purpose unrelated to the performance of responsibilities or functions under this section.</text></paragraph> 
<paragraph id="HDD784F98FA0C4808809B06A99C4139CE"><enum>(3)</enum><header>Ordinary business activities</header><text>Paragraph (1) does not apply to an act or omission related to an ordinary business activity, such as an activity involving general administration or operations, the use of motor vehicles, or personnel management.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></subtitle>

<paragraph id="H15BED8E50B7E475BA07E30A1A50000BF"><enum>(2)</enum><text>thereafter travels in interstate or foreign commerce, or enters or leaves Indian country; </text></paragraph><continuation-text continuation-text-level="subsection">and knowingly fails to register as required shall be fined under this title and imprisoned not less than 5 years nor more than 20 years.</continuation-text></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H589BE55284374388B1953551B4496581"><enum>(1)</enum><text> in subsection (d), in the sentence beginning with <quote>The court shall order, as an explicit condition of supervised release for a person described in section 4042(c)(4)</quote>, by striking <quote>described in section 4042(c)(4)</quote> and all that follows through the end of the sentence and inserting <quote>required to register under the <short-title>Sex Offender Registration and Notification Act</short-title> that the person comply with the requirements of that Act.</quote></text></paragraph> 
<paragraph id="H8BE47FF24C964841A02E2DB144938144"><enum>(2)</enum><text>in subsection (k)—</text>

<subsection id="H91AA1E7602AC4CE88CF85BCC4C9EA75D"><enum>(f)</enum><header>Duties of Bureau of Prisons</header><text>Paragraph (3) of <external-xref legal-doc="usc" parsable-cite="usc/18/4042">section 4042(c)</external-xref> of title 18, United States Code, is amended to read as follows:</text>

<subsection id="H48A0FB112FD342448DD3FE849E90F72F"><enum>(g)</enum><header>Conforming amendment of cross reference</header><text>Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/18/4042">section 4042(c)</external-xref> of title 18, United States Code, is amended by striking <quote>(4)</quote> and inserting <quote>(3)</quote>. </text></subsection>

<subsection id="H64A06F66E10D4D188141B360D82F0029"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General shall use the authority provided in <external-xref legal-doc="usc" parsable-cite="usc/28/566">section 566(e)(1)(B)</external-xref> of title 28, United States Code, to assist States and other jurisdictions in locating and apprehending sex offenders who violate sex offender registration requirements. </text></subsection> 
<subsection id="H5D17FF6E1631423B9F5FEA1197BD78D"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated such sums as may be necessary for fiscal years 2006 through 2008 to implement this section.</text></subsection></section>

<subsection id="HE7FB5CDDD0F944E4A020034DFA53CA8"><enum>(a)</enum><text display-inline="yes-display-inline">Whoever, knowingly uses a controlled substance to substantially impair the ability of a person to appraise or control conduct, in order to commit a sex offense, other than an offense where such use is an element of the offense, shall, in addition to the punishment provided for the sex offense, be imprisoned for any term of years not less than 10, or for life. </text></subsection> 
<subsection id="HE961DE553C134320AF768E0832FC617F"><enum>(b)</enum><text>As used in this section, the term <quote>sex offense</quote> means an offense under this chapter other than an offense under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<title id="H0F5CDB6EC5C24DFDB3857BAAE9410556"><enum>II</enum><header>DNA Fingerprinting</header> 
<section id="H97A7A8DA59124D0EB0583D31449460C9"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>DNA Fingerprinting Act of 2005</short-title></quote>.</text></section> 
<section id="HA4E7E9E28504468B00D300FC05DBFEF5"><enum>202.</enum><header>Expanding use of DNA to identify and prosecute sex offenders</header> 
<subsection id="H2E7B75ECD84340119E2608005856BDB1"><enum>(a)</enum><header>Expansion of National DNA index system</header><text>Section 210304 of the DNA Identification Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/14132">42 U.S.C. 14132</external-xref>) is amended—</text> 
<paragraph id="H87D873E1C681436499EDBF03B3407294"><enum>(1)</enum><text>in subsection (a)(1)(C), by striking <quote>, provided</quote> and all that follows through <quote>System</quote>; and</text></paragraph>

<paragraph id="H78FDB5380BB34CAF80E07715418CDB2D"><enum>(1)</enum><header>In general</header><text>Section 3 of the DNA Analysis Backlog Elimination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/14135a">42 U.S.C. 14135a</external-xref>) is amended</text> 
<subparagraph id="H2552DA77E2474E7797B1003600FDF5BB"><enum>(A)</enum><text>in subsection (a)—</text> 
<clause id="HBDC639C86449436186D200D597DFDE3D"><enum>(i)</enum><text>in paragraph (1), by striking <quote>The Director</quote> and inserting the following:</text>

<paragraph id="HEBE5E4C075484B3AA156E65FA76A328"><enum>(2)</enum><header>Conforming amendment</header><text>Subsections (b) and (c)(1)(A) of <external-xref legal-doc="usc" parsable-cite="usc/18/3142">section 3142</external-xref> of title 18, United States Code, are each amended by inserting <quote>and subject to the condition that the person cooperate in the collection of a DNA sample from the person if the collection of such a sample is authorized pursuant to section 3 of the DNA Analysis Backlog Elimination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/14135a">42 U.S.C. 14135a</external-xref>)</quote> after <quote>period of release</quote>.</text></paragraph></subsection> 
<subsection id="H14096FDBB9384177B3CE00003172D999"><enum>(c)</enum><header>Tolling of statute of limitations in sexual abuse cases</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3297">Section 3297</external-xref> of title 18, United States Code, is amended by striking <quote>except for a felony offense under chapter 109A,</quote>.</text></subsection></section> 
<section id="HC739A0EDF26041B185450110F655BB50"><enum>203.</enum><header>Stopping Violent Predators Against Children</header><text display-inline="no-display-inline">In carrying out Acts of Congress relating to DNA databases, the Attorney General shall give appropriate consideration to the need for the collection and testing of DNA to stop violent predators against children.</text></section> 
<section id="HA7AF949B26F84ACFA7274FAB15DEAA" section-type="subsequent-section"><enum>204.</enum><header>Model code on investigating missing persons and deaths</header> 
<subsection id="HAAC42B11E8634DF793CD3368FF8DB33F"><enum>(a)</enum><header>Model Code required</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Attorney General shall publish a model code setting forth procedures to be followed by law enforcement officers when investigating a missing person or a death. The procedures shall include the use of DNA analysis to help locate missing persons and to help identify human remains.</text></subsection> 
<subsection id="HEFB4440C1D6F445098CDA000FD13BC04"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that each State should, not later than 1 year after the date on which the Attorney General publishes the model code, enact laws implementing the model code.</text></subsection> 
<subsection id="HB6088F1199624CF89FA8D8E1982BD7ED"><enum>(c)</enum><header>GAO study</header><text>Not later than 2 years after the date on which the Attorney General publishes the model code, the Comptroller General shall submit to Congress a report on the extent to which States have implemented the model code. The report shall, for each State—</text> 
<paragraph id="HAAF3BE0201DE4D07A1B6A08186A0E574"><enum>(1)</enum><text>describe the extent to which the State has implemented the model code; and</text></paragraph> 
<paragraph id="H2C748A75F81D41C7AFCFDFD45360DEC0"><enum>(2)</enum><text>to the extent the State has not implemented the model code, describe the reasons why the State has not done so.</text></paragraph></subsection></section></title> 
<title id="HD94D943CEA7A4BD7983803340964F9D2"><enum>III</enum><header>Prevention and Deterrence of Crimes Against Children Act of 2005</header> 
<section id="HE100963CBD474CBC813DB7D3EF18E5B2" section-type="subsequent-section"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Prevention and Deterrence of Crimes Against Children Act of 2005</short-title></quote>.</text></section> 
<section id="H51127AA0228B4F80BF852C71A39BF3AB"><enum>302.</enum><header>Assured punishment for violent crimes against children</header> 
<subsection id="HF1171A021FBB4EEBA6D0706923444675"><enum>(a)</enum><header>Special sentencing rule</header><text>Subsection (d) of <external-xref legal-doc="usc" parsable-cite="usc/18/3559">section 3559</external-xref> of title 18, United States Code, is amended to read as follows:</text> 
<quoted-block style="USC" id="HB45B258010FB4AC28C7119B06B84ED7D" display-inline="no-display-inline"> 
<subsection id="H584E92699AD44854B6D6EC1D61E2BFCA"><enum>(d)</enum><header>Mandatory minimum terms of imprisonment for violent crimes against children</header><text>A person who is convicted of a felony crime of violence against the person of an individual who has not attained the age of 18 years shall, unless a greater mandatory minimum sentence of imprisonment is otherwise provided by law and regardless of any maximum term of imprisonment otherwise provided for the offense—</text> 
<paragraph id="H430F1A29A73F479A827863F559AC45AF"><enum>(1)</enum><text>if the crime of violence results in the death of a person who has not attained the age of 18 years, be sentenced to death or life in prison;</text></paragraph> 
<paragraph id="HD9FDCC3EE1134A94B071DAB6F9EB236C"><enum>(2)</enum><text>if the crime of violence is kidnapping, aggravated sexual abuse, sexual abuse, or maiming, or results in serious bodily injury (as defined in section 2119(2)) be imprisoned for life or any term of years not less than 30;</text></paragraph> 
<paragraph id="H7782F48BD602481D86033C8DC2E5C660"><enum>(3)</enum><text>if the crime of violence results in bodily injury (as defined in section 1365) or is an offense under paragraphs (1), (2), or (5) of section 2244(a), be imprisoned for life or for any term of years not less than 20;</text></paragraph> 
<paragraph id="HD696D546F93A472484A4055D4074C6E" display-inline="no-display-inline"><enum>(4)</enum><text>if a dangerous weapon was used during and in relation to the crime of violence, be imprisoned for life or for any term of years not less than 15; and</text></paragraph> 
<paragraph id="HA6BCA13926C0428EA9303B00777ED3C9"><enum>(5)</enum><text>in any other case, be imprisoned for life or for any term of years not less than 10.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HEE49C416FE2E482EAED66824EC28D570" display-inline="no-display-inline" section-type="subsequent-section"><enum>303.</enum><header>Ensuring fair and expeditious Federal collateral review of convictions for killing a child</header> 
<subsection id="H6B65BD9965654A79000003EE2784C038"><enum>(a)</enum><header>Limits on cases</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/2254">Section 2254</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text> 
<quoted-block id="H3009AFAA490A426D99DEF5DE7792CC4"> 
<subsection id="H5E4C7A8EB2294F23AA6C5BCE98A8FE87"><enum>(j)</enum> 
<paragraph id="HC1041C6867AC406EA5E71FA2164F41D7" display-inline="yes-display-inline"><enum>(1)</enum><text>A court, justice, or judge shall not have jurisdiction to consider any claim relating to the judgment or sentence in an application described under paragraph (2), unless the applicant shows that the claim qualifies for consideration on the grounds described in subsection (e)(2). Any such application that is presented to a court, justice, or judge other than a district court shall be transferred to the appropriate district court for consideration or dismissal in conformity with this subsection, except that a court of appeals panel must authorize any second or successive application in conformity with section 2244 before any consideration by the district court.</text></paragraph> 
<paragraph id="H602760271A0445CBA73F2F2D00A0BE54" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">This subsection applies to an application for a writ of habeas corpus on behalf of a person in custody pursuant to the judgment of a State court for a crime that involved the killing of a individual who has not attained the age of 18 years.</text></paragraph> 
<paragraph id="H92DBB17BD6114E8DAB639CDF20DE4192" indent="up1"><enum>(3)</enum><text>For an application described in paragraph (2), the following requirements shall apply in the district court:</text> 
<subparagraph id="H8AB19C4B7D9E441AA6C7E56117B2B6CA"><enum>(A)</enum><text>Any motion by either party for an evidentiary hearing shall be filed and served not later than 90 days after the State files its answer or, if no timely answer is filed, the date on which such answer is due.</text></subparagraph> 
<subparagraph id="H7EB635F2D66044D3BEF80613648D21CD"><enum>(B)</enum><text>Any motion for an evidentiary hearing shall be granted or denied not later than 30 days after the date on which the party opposing such motion files a pleading in opposition to such motion or, if no timely pleading in opposition is filed, the date on which such pleading in opposition is due.</text></subparagraph> 
<subparagraph id="H953F10E51EFC454DA31743DB56D8C775"><enum>(C)</enum><text>Any evidentiary hearing shall be—</text> 
<clause id="HF4A332FC27334F01ACB35B2DF060981F"><enum>(i)</enum><text>convened not less than 60 days after the order granting such hearing; and</text></clause> 
<clause id="H3425F3215C1C4EFEB039685EB4B17700"><enum>(ii)</enum><text>completed not more than 150 days after the order granting such hearing.</text></clause></subparagraph> 
<subparagraph id="H12B8BE2F11F84AFCA3453372FD84D6A9"><enum>(D)</enum><text>A district court shall enter a final order, granting or denying the application for a writ of habeas corpus, not later than 15 months after the date on which the State files its answer or, if no timely answer is filed, the date on which such answer is due, or not later than 60 days after the case is submitted for decision, whichever is earlier.</text></subparagraph> 
<subparagraph id="H8F3B2AEAA56349CFAF771EE9EA3070A8"><enum>(E)</enum><text>If the district court fails to comply with the requirements of this paragraph, the State may petition the court of appeals for a writ of mandamus to enforce the requirements. The court of appeals shall grant or deny the petition for a writ of mandamus not later than 30 days after such petition is filed with the court.</text></subparagraph></paragraph> 
<paragraph id="H4F2A369F0FDF400FBB582800DF8DBEA6" indent="up1"><enum>(4)</enum><text>For an application described in paragraph (2), the following requirements shall apply in the court of appeals:</text> 
<subparagraph id="HBA16A32045474365915E42896B223E2C"><enum>(A)</enum><text>A timely filed notice of appeal from an order issuing a writ of habeas corpus shall operate as a stay of that order pending final disposition of the appeal.</text></subparagraph> 
<subparagraph id="H62538D96EE6E434992F79982CCF9BD1"><enum>(B)</enum><text>The court of appeals shall decide the appeal from an order granting or denying a writ of habeas corpus—</text> 
<clause id="H726DFDCD487D45C0B2F7C4E48E29B105"><enum>(i)</enum><text>not later than 120 days after the date on which the brief of the appellee is filed or, if no timely brief is filed, the date on which such brief is due; or</text></clause> 
<clause id="H06B5CB87508149488BABB2A5F986A8B3"><enum>(ii)</enum><text>if a cross-appeal is filed, not later than 120 days after the date on which the appellant files a brief in response to the issues presented by the cross-appeal or, if no timely brief is filed, the date on which such brief is due.</text></clause></subparagraph> 
<subparagraph id="H4480E205A04C49D98E66E992C599E51F"><enum>(C)</enum> 
<clause display-inline="yes-display-inline" id="H48905B76B58248C0916D60D3CCA9C31"><enum>(i)</enum><text>Following a decision by a panel of the court of appeals under subparagraph (B), a petition for panel rehearing is not allowed, but rehearing by the court of appeals en banc may be requested. The court of appeals shall decide whether to grant a petition for rehearing en banc not later than 30 days after the date on which the petition is filed, unless a response is required, in which case the court shall decide whether to grant the petition not later than 30 days after the date on which the response is filed or, if no timely response is filed, the date on which the response is due.</text></clause> 
<clause indent="up1" id="H625FA463B46A462DA700B9CEECC6DCD6"><enum>(ii)</enum><text>If rehearing en banc is granted, the court of appeals shall make a final determination of the appeal not later than 120 days after the date on which the order granting rehearing en banc is entered.</text></clause></subparagraph> 
<subparagraph id="H0FD42FC430444035B27CB78B00847135"><enum>(D)</enum><text>If the court of appeals fails to comply with the requirements of this paragraph, the State may petition the Supreme Court or a justice thereof for a writ of mandamus to enforce the requirements.</text></subparagraph></paragraph> 
<paragraph id="H8A02377CE62846239D488F10EED8E72" indent="up1"><enum>(5)</enum> 
<subparagraph id="H4FAA21C12F1A49B9BF53D6946069C743" display-inline="yes-display-inline"><enum>(A)</enum><text>The time limitations under paragraphs (3) and (4) shall apply to an initial application described in paragraph (2), any second or successive application described in paragraph (2), and any redetermination of an application described in paragraph (2) or related appeal following a remand by the court of appeals or the Supreme Court for further proceedings.</text></subparagraph> 
<subparagraph id="H3A40E3CA3074411C9F608D24653DF5FB" indent="up1"><enum>(B)</enum><text>In proceedings following remand in the district court, time limits running from the time the State files its answer under paragraph (3) shall run from the date the remand is ordered if further briefing is not required in the district court. If there is further briefing following remand in the district court, such time limits shall run from the date on which a responsive brief is filed or, if no timely responsive brief is filed, the date on which such brief is due.</text></subparagraph> 
<subparagraph id="HFBFF17CD4DB84D70B2BF35E7DA22CFCE" indent="up1"><enum>(C)</enum><text>In proceedings following remand in the court of appeals, the time limit specified in paragraph (4)(B) shall run from the date the remand is ordered if further briefing is not required in the court of appeals. If there is further briefing in the court of appeals, the time limit specified in paragraph (4)(B) shall run from the date on which a responsive brief is filed or, if no timely responsive brief is filed, from the date on which such brief is due.</text></subparagraph></paragraph> 
<paragraph id="H9825C5C21F05401182827C1F5F1640D6" indent="up1"><enum>(6)</enum><text>The failure of a court to meet or comply with a time limitation under this subsection shall not be a ground for granting relief from a judgment of conviction or sentence, nor shall the time limitations under this subsection be construed to entitle a capital applicant to a stay of execution, to which the applicant would otherwise not be entitled, for the purpose of litigating any application or appeal.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H06520E6DD0C74BE69CB618FF9400F812"><enum>(b)</enum><header>Victims’ rights in habeas cases</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3771">Section 3771(b)</external-xref> of title 18, United States Code, is amended by adding at the end the following: <quote>The rights established for crime victims by this section shall also be extended in a Federal habeas corpus proceeding arising out of a State conviction to victims of the State offense at issue.</quote>.</text></subsection> 
<subsection id="H7CB95E5FECF144C1BEA8608896797913"><enum>(c)</enum><header>Application to pending cases</header> 
<paragraph id="H4A8FEC23C33A40C4965EE48244427657"><enum>(1)</enum><header>In general</header><text>The amendment made by this section apply to cases pending on the date of the enactment of this Act as well as to cases commenced on and after that date.</text></paragraph> 
<paragraph id="H1F48CCAC25A74C2995030022C01C3931"><enum>(2)</enum><header>Special rule for time limits</header><text>In a case pending on the date of the enactment of this Act, if the amendment made by subsection (a) provides that a time limit runs from an event or time that has occurred before that date, the time limit shall instead run from that date.</text></paragraph></subsection></section></title>

<subsection id="HE6733A0FBC63421580E242EBD50367AF"><enum>(b)</enum><header>Sexual exploitation and other abuse of children</header> 
<paragraph id="H52729B5D7EB745A1ACB8D2D96978578"><enum>(1)</enum><header>Sexual exploitation of children</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2251">Section 2251(e)</external-xref> of title 18, United States Code, is amended—</text>

<subparagraph id="H9D2A032E5E9E4152A4E93F32CB80D159"><enum>(C)</enum><text>by striking <quote>the sexual exploitation of children</quote> the first place it appears and inserting <quote>aggravated sexual abuse, sexual abuse, abusive sexual contact involving a minor or ward, or sex trafficking of children, or the production, possession, receipt, mailing, sale, distribution, shipment, or transportation of child pornography</quote>; </text></subparagraph> 
<subparagraph id="HD2DB741965654E92A0A694884600A4E"><enum>(D)</enum><text>by striking <quote>not less than 25 years nor more than 50 years, but if such person has 2 or more prior convictions under this chapter, chapter 71, chapter 109A, or chapter 117, or under <external-xref legal-doc="usc" parsable-cite="usc/10/920">section 920</external-xref> of title 10 (article 120 of the Uniform Code of Military Justice), or under the laws of any State relating to the sexual exploitation of children, such person shall be fined under this title and imprisoned not less than 35 years nor more than life.</quote> and inserting <quote>life.</quote>; and</text></subparagraph>

<section id="HFB45DC3B28424838A8E0872FCB7BA732" section-type="subsequent-section" display-inline="no-display-inline"><enum>501.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Foster Child Protection and Child Sexual Predator Sentencing Act of 2005</short-title></quote>.</text></section> 
<section id="H21D0534630C546A287923E00958208DF" display-inline="no-display-inline" section-type="subsequent-section"><enum>502.</enum><header>Requirement to complete background checks before approval of any foster or adoptive placement and to check national crime information databases and state child abuse registries; suspension and subsequent elimination of opt-Out</header> 
<subsection id="H291742DBD36F4EEF84AF9C31003E2C08"><enum>(a)</enum><header>Requirement to complete background checks before approval of any foster or adoptive placement and to check national crime information databases and State child abuse registries; suspension of opt-out</header> 
<paragraph id="HA575591681AE4BF1B797C31EEA1E22AD"><enum>(1)</enum><header>Requirement to check national crime information databases and state child abuse registries</header><text>Section 471(a)(20) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(20)</external-xref>) is amended—</text> 
<subparagraph id="H82D658DAC4BC4FEA9D4500A77E853E4B"><enum>(A)</enum><text>in subparagraph (A)—</text> 
<clause id="H1536D3797E8B4827BA00A7B14D8E5E31"><enum>(i)</enum><text>in the matter preceding clause (i)—</text> 
<subclause id="HDF0F5B7040DD48CBA9DCA584B4DCFF8"><enum>(I)</enum><text>by inserting <quote>, including checks of national crime information databases (as defined in <external-xref legal-doc="usc" parsable-cite="usc/28/534">section 534(e)(3)(A)</external-xref> of title 28, United States Code),</quote> after <quote>criminal records checks</quote>; and </text></subclause> 
<subclause id="HACB0A715811648608EC364F0C587F3C"><enum>(II)</enum><text>by striking <quote>on whose behalf foster care maintenance payments or adoption assistance payments are to be made</quote> and inserting <quote>regardless of whether foster care maintenance payments or adoption assistance payments are to be made on behalf of the child</quote>; and</text></subclause></clause> 
<clause id="H4D7C22E32AC746CC9662393C03E53074"><enum>(ii)</enum><text>in each of clauses (i) and (ii), by inserting <quote>involving a child on whose behalf such payments are to be so made</quote> after <quote>in any case</quote>; and</text></clause></subparagraph> 
<subparagraph id="H636DC70C18234EDEBE4664DCB65F1459"><enum>(B)</enum><text>by adding at the end the following:</text>

<subparagraph id="HED950B3D4E89492E91C71786C17C7570" indent="up1"><enum>(C)</enum><text>provides that the State shall—</text> 
<clause id="H87D390E64918472397F8C2044094EA36"><enum>(i)</enum><text>check any child abuse and neglect registry maintained by the State for information on any prospective foster or adoptive parent and on any other adult living in the home of such a prospective parent, and request any other State in which any such prospective parent or other adult has resided in the preceding 5 years, to enable the State to check any child abuse and neglect registry maintained by such other State for such information, before the prospective foster or adoptive parent may be finally approved for placement of a child, regardless of whether foster care maintenance payments or adoption assistance payments are to be made on behalf of the child under the State plan under this part;</text></clause> 
<clause id="HAFAD204F2B354611B3839EA102D2C168"><enum>(ii)</enum><text>comply with any request described in clause (i) that is received from another State; and</text></clause> 
<clause id="H3FC19215EAAA476B9C1C85F4B9283EB"><enum>(iii)</enum><text>have in place safeguards to prevent the unauthorized disclosure of information in any child abuse and neglect registry maintained by the State, and to prevent any such information obtained pursuant to this subparagraph from being used for a purpose other than the conducting of background checks in foster or adoptive placement cases;</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HAADB90F623E24CD08809F6C15E4C285F"><enum>(2)</enum><header>Suspension of opt-out</header><text>Section 471(a)(20)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(20)(B)</external-xref>) is amended—</text> 
<subparagraph id="H5A5E3DD57394487AA3E825F1114DE22F"><enum>(A)</enum><text>by inserting <quote>, on or before September 30, 2005,</quote> after <quote>plan if</quote>; and</text></subparagraph> 
<subparagraph id="H45B8B180FDB3467A856000E2C088D8EB"><enum>(B)</enum><text>by inserting <quote>, on or before such date,</quote> after <quote>or if</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H436DD051A89D41CE9EC700B75EC9FB52"><enum>(b)</enum><header>Elimination of opt-Out</header><text>Section 471(a)(20) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(20)</external-xref>), as amended by subsection (a) of this section, is amended—</text> 
<paragraph id="HE606877BD88F494E814483CAF2B8DAC"><enum>(1)</enum><text>in subparagraph (A), in the matter preceding clause (i), by striking <quote>unless an election provided for in subparagraph (B) is made with respect to the State,</quote>; and</text> </paragraph> 
<paragraph id="H35BEE1511185445E9E0029026D3D005B"><enum>(2)</enum><text>by striking subparagraph (B) and redesignating subparagraph (C) as subparagraph (B).</text></paragraph></subsection> 
<subsection id="HFED7C995E4FA4FB59428A0F9F20014AF" display-inline="no-display-inline"><enum>(c)</enum><header>Effective date</header> 
<paragraph id="HE5FA6DCF9FFC421DBDE1CAD358628D"><enum>(1)</enum><header>In general</header><text>The amendments made by subsection (a) shall take effect on October 1, 2005, and shall apply with respect to payments under part E of title IV of the Social Security Act for calendar quarters beginning on or after such date, without regard to whether regulations to implement the amendments are promulgated by such date.</text></paragraph> 
<paragraph id="H04388575772F407B82ECD667855BA402"><enum>(2)</enum><header>Elimination of opt-out</header><text>The amendments made by subsection (b) shall take effect on October 1, 2007, and shall apply with respect to payments under part E of title IV of the Social Security Act for calendar quarters beginning on or after such date, without regard to whether regulations to implement the amendments are promulgated by such date.</text></paragraph> 
<paragraph id="H704C2CBED93543A2A24532EA1900803F"><enum>(3)</enum><header>Delay permitted if State legislation required</header><text>If the Secretary of Health and Human Services determines that State legislation (other than legislation appropriating funds) is required in order for a State plan under section 471 of the Social Security Act to meet the additional requirements imposed by the amendments made by a subsection of this section, the plan shall not be regarded as failing to meet any of the additional requirements before the first day of the first calendar quarter beginning after the first regular session of the State legislature that begins after the otherwise applicable effective date of the amendments. If the State has a 2-year legislative session, each year of the session is deemed to be a separate regular session of the State legislature.</text></paragraph></subsection></section> 
<section id="H654D06DE335445F59C68D8F7837C4E00" section-type="subsequent-section" display-inline="no-display-inline"><enum>503.</enum><header>Access to Federal crime information databases by child welfare agencies for certain purposes</header> 
<subsection id="HD0A48A8DAEF1472A95F0EE3200F055B2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General shall, upon request of the chief executive of a State, ensure that appropriate officers of child welfare agencies have the authority for <quote>read only</quote> online access to the databases of the national crime information databases (as defined in <external-xref legal-doc="usc" parsable-cite="usc/28/534">section 534</external-xref> of title 28, United States Code) to carry out criminal history records checks, subject to subsection (b).</text></subsection> 
<subsection id="HD3B1D8B6A63043899E286D6ECE77CEE"><enum>(b)</enum><header>Limitation</header><text>An officer may use the authority under subsection (a) only in furtherance of the purposes of the agency and only on an individual relevant to casework of the agency.</text></subsection> 
<subsection id="H16BD59ED6DDA43D2B52050276DC1EBC9"><enum>(c)</enum><header>Protection of information</header><text>An individual having information derived as a result of a check under subsection (a) may release that information only to appropriate officers of child welfare agencies or another person authorized by law to receive that information.</text></subsection> 
<subsection id="H5A1BCB1056004F18A127D81BE5A33CB"><enum>(d)</enum><header>Criminal penalties</header><text>An individual who knowingly exceeds the authority in subsection (a), or knowingly releases information in violation of subsection (c), shall be imprisoned not more than 10 years or fined under title 18, United States Code, or both.</text></subsection> 
<subsection id="H8F33BE7920414CB7BAEA03FB8BA4D561"><enum>(e)</enum><header>Child welfare agency defined</header><text>In this section, the term <quote>child welfare agency</quote> means—</text> 
<paragraph id="H448A77C753B54AD29145E8AD19EB022E"><enum>(1)</enum><text>the State or local agency responsible for administering the plan under part B or part E of title IV of the Social Security Act; and</text></paragraph> 
<paragraph id="H886723D602314E40B18005D12560D7E"><enum>(2)</enum><text>any other public agency, or any other private agency under contract with the State or local agency responsible for administering the plan under part B or part E of title IV of the Social Security Act, that is responsible for the placement of foster or adoptive children.</text></paragraph></subsection></section> 
<section id="H91589172CB3C49BF004CB9DDB41B6947" section-type="subsequent-section" display-inline="no-display-inline"><enum>504.</enum><header>Penalties for coercion and enticement by sex offenders</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2422">Section 2422(a)</external-xref> of title 18, United States Code, is amended by striking <quote>or imprisoned not more than 20 years, or both</quote> and inserting <quote>and imprisoned not less than 10 years nor more than 30 years</quote>.</text></section>

<subsection id="H10553318174D4ABBB6D7D02BB5CDBF30"><enum>(b)</enum><header>Supervised release</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3583">Section 3583(d)</external-xref> of title 18, United States Code, is amended by adding at the end the following: <quote>The court may order, as an explicit condition of supervised release for a person who is a felon or required to register under the Sex Offender Registration and Notification Act, that the person submit his person, and any property, house, residence, vehicle, papers, computer, other electronic communications or data storage devices or media, and effects to search at any time, with or without a warrant, by any law enforcement or probation officer with reasonable suspicion concerning a violation of a condition of supervised release or unlawful conduct by the person, and by any probation officer in the lawful discharge of the officer’s supervision functions.</quote></text></subsection></section> 
<section id="H9EACE654C7554252BB47B0FE2D8F43A5"><enum>508.</enum><header>Kidnapping penalties and jurisdiction</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1201">Section 1201</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H2ABA3FFE3DDF4FA399CFFC48C82C079C"><enum>(1)</enum><text>in subsection (a)(1), by striking <quote>if the person was alive when the transportation began</quote> and inserting <quote>, or the offender travels in interstate or foreign commerce or uses the mail or any means, facility, or instrumentality of interstate or foreign commerce in committing or in furtherance of the commission of the offense</quote>; and</text></paragraph>

<subparagraph id="H1142866C05104EEF9D5227D685D461DC"><enum>(D)</enum><text>in subsection (b), by striking <quote>4245 or 4246</quote> and inserting <quote>4245, 4246, or 4248</quote>; and</text></subparagraph>

<section id="H6DB2CCDC3D4C4395B69C1797FBEB18D"><enum>4248.</enum><header>Civil commitment of a sexually dangerous person</header> 
<subsection id="H3976776C6A4C4AAA8ED71D7DAEBB1BE3"><enum>(a)</enum><header>Institution of proceedings</header><text>In relation to a person who is in the custody of the Bureau of Prisons, or who has been committed to the custody of the Attorney General pursuant to section 4241(d), or against whom all criminal charges have been dismissed solely for reasons relating to the mental condition of the person, the Attorney General or any individual authorized by the Attorney General or the Director of the Bureau of Prisons may certify that the person is a sexually dangerous person, and transmit the certificate to the clerk of the court for the district in which the person is confined. The clerk shall send a copy of the certificate to the person, and to the attorney for the Government, and, if the person was committed pursuant to section 4241(d), to the clerk of the court that ordered the commitment. The court shall order a hearing to determine whether the person is a sexually dangerous person. A certificate filed under this subsection shall stay the release of the person pending completion of procedures contained in this section.</text></subsection> 
<subsection id="H484F551F99F9490F922426DE7E50E0F9"><enum>(b)</enum><header>Psychiatric or psychological examination and report</header><text>Prior to the date of the hearing, the court may order that a psychiatric or psychological examination of the defendant be conducted, and that a psychiatric or psychological report be filed with the court, pursuant to the provisions of section 4247(b) and (c).</text></subsection> 
<subsection id="H57395D9A11B34B7092CA7100B3EDA760"><enum>(c)</enum><header>Hearing</header><text>The hearing shall be conducted pursuant to the provisions of section 4247(d).</text></subsection> 
<subsection id="H39B1B4D2B0014F6EA268F4E168320625"><enum>(d)</enum><header>Determination and disposition</header><text>If, after the hearing, the court finds by clear and convincing evidence that the person is a sexually dangerous person, the court shall commit the person to the custody of the Attorney General. The Attorney General shall release the person to the appropriate official of the State in which the person is domiciled or was tried if such State will assume responsibility for his custody, care, and treatment. The Attorney General shall make all reasonable efforts to cause such a State to assume such responsibility. If, notwithstanding such efforts, neither such State will assume such responsibility, the Attorney General shall place the person for treatment in a suitable facility, until—</text> 
<paragraph id="H9375F65BAA2D407A9500F2A598DA0060"><enum>(1)</enum><text>such a State will assume such responsibility; or</text></paragraph> 
<paragraph id="HF7B1868ADB92429BBE00C147DD442273"><enum>(2)</enum><text>the person’s condition is such that he is no longer sexually dangerous to others, or will not be sexually dangerous to others if released under a prescribed regimen of medical, psychiatric, or psychological care or treatment;</text></paragraph><continuation-text continuation-text-level="subsection">whichever is earlier. The Attorney General shall make all reasonable efforts to have a State to assume such responsibility for the person’s custody, care, and treatment.</continuation-text></subsection> 
<subsection id="HFBE524D62AA64699BC96C4A9F54399AD"><enum>(e)</enum><header>Discharge</header><text>When the Director of the facility in which a person is placed pursuant to subsection (d) determines that the person’s condition is such that he is no longer sexually dangerous to others, or will not be sexually dangerous to others if released under a prescribed regimen of medical, psychiatric, or psychological care or treatment, he shall promptly file a certificate to that effect with the clerk of the court that ordered the commitment. The clerk shall send a copy of the certificate to the person’s counsel and to the attorney for the Government. The court shall order the discharge of the person or, on motion of the attorney for the Government or on its own motion, shall hold a hearing, conducted pursuant to the provisions of section 4247(d), to determine whether he should be released. If, after the hearing, the court finds by a preponderance of the evidence that the person’s condition is such that—</text> 
<paragraph id="H527971B8AD71470BA06037BAF16B14F"><enum>(1)</enum><text>he will not be sexually dangerous to others if released unconditionally, the court shall order that he be immediately discharged; or</text></paragraph> 
<paragraph id="HD6A2692F23C64B3AA1032D9BEF38E634"><enum>(2)</enum><text>he will not be sexually dangerous to others if released under a prescribed regimen of medical, psychiatric, or psychological care or treatment, the court shall—</text> 
<subparagraph id="H42979E7156E84B2300BD0000EBB0E611"><enum>(A)</enum><text>order that he be conditionally discharged under a prescribed regimen of medical, psychiatric, or psychological care or treatment that has been prepared for him, that has been certified to the court as appropriate by the Director of the facility in which he is committed, and that has been found by the court to be appropriate; and</text></subparagraph> 
<subparagraph id="H6B45C0CE1A654F79A746C94045FCC8D3"><enum>(B)</enum><text>order, as an explicit condition of release, that he comply with the prescribed regimen of medical, psychiatric, or psychological care or treatment.</text></subparagraph><continuation-text continuation-text-level="paragraph">The court at any time may, after a hearing employing the same criteria, modify or eliminate the regimen of medical, psychiatric, or psychological care or treatment.</continuation-text></paragraph></subsection> 
<subsection id="H5EF152412C664DAEB50705F361A3AFF5"><enum>(f)</enum><header>Revocation of conditional discharge</header><text>The director of a facility responsible for administering a regimen imposed on a person conditionally discharged under subsection (e) shall notify the Attorney General and the court having jurisdiction over the person of any failure of the person to comply with the regimen. Upon such notice, or upon other probable cause to believe that the person has failed to comply with the prescribed regimen of medical, psychiatric, or psychological care or treatment, the person may be arrested, and, upon arrest, shall be taken without unnecessary delay before the court having jurisdiction over him. The court shall, after a hearing, determine whether the person should be remanded to a suitable facility on the ground that he is sexually dangerous to others in light of his failure to comply with the prescribed regimen of medical, psychiatric, or psychological care or treatment.</text></subsection> 
<subsection id="H683D549AC555430C8BD3C3D7BEB189B"><enum>(g)</enum><header>Release to state of certain other persons</header><text>If the director of the facility in which a person is hospitalized or placed pursuant to this chapter certifies to the Attorney General that a person, against him all charges have been dismissed for reasons not related to the mental condition of the person, is a sexually dangerous person, the Attorney General shall release the person to the appropriate official of the State in which the person is domiciled or was tried for the purpose of institution of State proceedings for civil commitment. If neither such State will assume such responsibility, the Attorney General shall release the person upon receipt of notice from the State that it will not assume such responsibility, but not later than 10 days after certification by the director of the facility.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H5ED3275C30AF4C7CBFA45948794C1760"><enum>512.</enum><header>Mandatory penalties for sex-trafficking of children</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1591">Section 1591(b)</external-xref> of title 18, United States Code, is amended—</text>
