<section id="H89441B6345E249D2A35795CA246837BE" display-inline="no-display-inline"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HDB659D73D7594848A7C9DC4808A083D2"><enum>(1)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <quote>appropriate congressional committees</quote> means the Committee on International Relations of the House of Representatives and the Committee on Foreign Relations of the Senate.</text></paragraph> 
<paragraph id="HDE38240AF67340AB90D0A0F5E91F78DA"><enum>(2)</enum><header>Government of Sudan</header> 
<subparagraph id="HE3BCD283BBF647E98DD64445177FBD76"><enum>(A)</enum><header>In general</header><text>The term <quote>Government of Sudan</quote> means the National Congress Party, formerly known as the National Islamic Front, led-government in Khartoum, Sudan, or any successor government formed on or after the date of the enactment of this Act (including the coalition National Unity Government agreed upon in the Comprehensive Peace Agreement for Sudan), except that such term does not include the regional Government of Southern Sudan.</text></subparagraph> 
<subparagraph id="HC5D396DDDAB2416F91B028003822FFEE"><enum>(B)</enum><header>Officials of the government of sudan</header><text>The term <quote>Government of Sudan</quote>, when used with respect to an official of the Government of Sudan, does not include an individual—</text> 
<clause id="H4668F5E0DADB4F97BCFB67D30000DDD3"><enum>(I)</enum><text>who was not a member of such government prior to July 1, 2005; or</text></clause> 
<clause id="HE474746A958E441C9B49278192FE00D9"><enum>(ii)</enum><text>who is a member of the regional Government of Southern Sudan.</text></clause></subparagraph></paragraph> 
<paragraph id="HC9F38B856C23498B00D1F62B90168DE8"><enum>(3)</enum><header>Comprehensive peace agreement for sudan</header><text display-inline="yes-display-inline">The term <quote>Comprehensive Peace Agreement for Sudan</quote> means the peace agreement signed by the Government of Sudan and the Sudan People’s Liberation Movement/Army (SPLM/A) in Nairobi, Kenya, on January 9, 2005.</text></paragraph></section> 
<section id="HCF05988FD8304E01A05449B6AE52B9A7" display-inline="no-display-inline"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text> 
<paragraph id="HAD1EF91F93AD4980AB00CB96F2B5912B"><enum>(1)</enum><text>On July 22, 2004, the House of Representatives and the Senate declared that the atrocities occurring in the Darfur region of Sudan are genocide.</text></paragraph> 
<paragraph id="HA0AF727262544C0083C7C8C2AC33EC79"><enum>(2)</enum><text>On September 9, 2004, Secretary of State Colin L. Powell stated before the Committee on Foreign Relations of the Senate, <quote>genocide has been committed in Darfur,</quote> and <quote>the Government of Sudan and the [Janjaweed] bear responsibility—and genocide may still be occurring</quote>. </text></paragraph> 
<paragraph id="H1977A9967E1245C183278DEA58F42009"><enum>(3)</enum><text>On September 21, 2004, in an address before the United Nations General Assembly, President George W. Bush affirmed the Secretary of State’s finding and stated,<quote>[a]t this hour, the world is witnessing terrible suffering and horrible crimes in the Darfur region of Sudan, crimes my government has concluded are genocide</quote>.</text></paragraph> 
<paragraph id="H937A22C1F8FD4710AFBFE2B0215B92D1"><enum>(4)</enum><text>On July 30, 2004, the United Nations Security Council passed Security Council Resolution 1556, calling upon the Government of Sudan to disarm the Janjaweed militias and to apprehend and bring to justice Janjaweed leaders and their associates who have incited and carried out violations of human rights and international humanitarian law, and establishing a ban on the sale or supply of arms and related materiel of all types, including the provision of related technical training or assistance, to all nongovernmental entities and individuals, including the Janjaweed.</text></paragraph> 
<paragraph id="HAC07A6D444454CC68E38656DF122F45D"><enum>(5)</enum><text>On September 18, 2004, the United Nations Security Council passed Security Council Resolution 1564, determining that the Government of Sudan had failed to meet its obligations under Security Council Resolution 1556, calling for a military flight ban in and over the Darfur region, demanding the names of Janjaweed militiamen disarmed and arrested for verification, establishing an International Commission of Inquiry on Darfur to investigate violations of international humanitarian and human rights laws, and threatening sanctions should the Government of Sudan fail to fully comply with Security Council Resolutions 1556 and 1564, including such actions as to affect Sudan’s petroleum sector or individual members of the Government of Sudan.</text></paragraph> 
<paragraph id="HDA6B19EC4FF64F5DB0C35C0672D4B92C"><enum>(6)</enum><text>The Report of the International Commission of Inquiry on Darfur, submitted to the United Nations Secretary-General on January 25, 2005, established that the <quote>Government of the Sudan and the Janjaweed are responsible for serious violations of international human rights and humanitarian law amounting to crimes under international law,</quote> that <quote>these acts were conducted on a widespread and systematic basis, and therefore may amount to crimes against humanity,</quote> and that Sudanese officials and other individuals may have acted with <quote>genocidal intent</quote>.</text></paragraph> 
<paragraph id="HAA5507DA4F5946338F3B969C0082BB00"><enum>(7)</enum><text>The Report of the International Commission of Inquiry on Darfur further notes that, pursuant to its mandate and in the course of its work, the Commission had collected information relating to individual perpetrators of acts constituting <quote>violations of international human rights law and international humanitarian law, including crimes against humanity and war crimes</quote> and that a sealed file containing the names of those individual perpetrators had been delivered to the United Nations Secretary-General.</text></paragraph> 
<paragraph id="H3AB0E2389217492DA99BCDEF622D79E"><enum>(8)</enum><text>On March 24, 2005, the United Nations Security Council passed Security Council Resolution 1590, establishing the United Nations Mission in Sudan (UNMIS), consisting of up to 10,000 military personnel and 715 civilian police tasked with supporting implementation of the Comprehensive Peace Agreement for Sudan and <quote>closely and continuously liais[ing] and coordinat[ing] at all levels with the African Union Mission in Sudan (AMIS) with a view towards expeditiously reinforcing the effort to foster peace in Darfur</quote>.</text></paragraph> 
<paragraph id="HC312D51EFB46415582FB07C09EF9C01C"><enum>(9)</enum><text>On March 29, 2005, the United Nations Security Council passed Security Council Resolution 1591, extending the military embargo established by Security Council Resolution 1556 to all the parties to the N’djamena Ceasefire Agreement of April 8, 2004, and any other belligerents in the states of North Darfur, South Darfur, and West Darfur, calling for an asset freeze and travel ban against those individuals who impede the peace process, constitute a threat to stability in Darfur and the region, commit violations of international humanitarian or human rights law or other atrocities, are responsible for offensive military overflights, or violate the military embargo, and establishing a Committee of the Security Council and a Panel of Experts to assist in monitoring compliance with Security Council Resolutions 1556 and 1591.</text></paragraph> 
<paragraph id="H82A67A9CC06140858100C3353BFCCBD5"><enum>(10)</enum><text>On March 31, 2005, the United Nations Security Council passed Security Council Resolution 1593, referring the situation in Darfur since July 1, 2002, to the prosecutor of the International Criminal Court and calling on the Government of Sudan and all parties to the conflict to cooperate fully with the Court.</text></paragraph> 
<paragraph id="H56B33B439F5748C3836F00F8384FDD97"><enum>(11)</enum><text>In remarks before the G–8 Summit on June 30, 2005, President Bush reconfirmed that <quote>the violence in Darfur is clearly genocide</quote> and <quote>the human cost is beyond calculation</quote>.</text></paragraph> 
<paragraph id="HB2C771E030FA4D0BA76BF044F29A4BC"><enum>(12)</enum><text display-inline="yes-display-inline">On July 30, 2005, Dr. John Garang de Mabior, the newly appointed Vice President of Sudan and the leader of the Sudan People’s Liberation Movement/Army (SPLM/A) for the past 21 years, was killed in a tragic helicopter crash in southern Sudan, sparking riots in Khartoum and challenging the commitment of all Sudanese to the Comprehensive Peace Agreement for Sudan.</text></paragraph> 
<paragraph id="H887D2E640B3C4BC4BD5D38AED44C00F1"><enum>(13)</enum><text display-inline="yes-display-inline"> Since 1993, the Secretary of State has determined that the Republic of Sudan is a country which has repeatedly provided support for acts of international terrorism and, pursuant to section 6(j) of the Export Administration Act of 1979, section 40 of the Arms Export Control Act, and section 620A of the Foreign Assistance Act of 1961, designated Sudan as a State Sponsor of Terrorism, thereby restricting United States assistance, defense exports and sales, and financial and other transactions with the Government of Sudan. </text></paragraph></section> 
<section id="H861CD192B6104B0E9D3D836C3B1E8235" display-inline="no-display-inline"><enum>4.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> 
<paragraph id="H4F96D4755E65473990B27BBC8688E096"><enum>(1)</enum><text>the genocide unfolding in the Darfur region of Sudan is characterized by acts of terrorism and atrocities directed against civilians, including mass murder, rape, and sexual violence committed by the Janjaweed and associated militias with the complicity and support of the National Congress Party-led faction of the Government of Sudan;</text></paragraph> 
<paragraph id="HC3837D5EF35C491E8E396336FB0012E"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary of State should designate the Janjaweed militia as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act; </text></paragraph> 
<paragraph id="HECB85FB1BF234CFDADC0A9E1008C5804"><enum>(3)</enum><text display-inline="yes-display-inline">all parties to the conflict in the Darfur region have continued to violate the N’djamena Ceasefire Agreement of April 8, 2004, and the Abuja Protocols of November 9, 2004, and violence against civilians, humanitarian aid workers, and personnel of the African Union Mission in Sudan (AMIS) is increasing;</text></paragraph> 
<paragraph id="H989598EDDF2A4070B8BE9773D9254562"><enum>(4)</enum><text>the African Union should rapidly expand the size and amend the mandate of the African Union Mission in Sudan to authorize such action as may be necessary to protect civilians and humanitarian operations, and deter violence in the Darfur region without delay;</text></paragraph> 
<paragraph id="HED98815870E7439295F39E4E64192550"><enum>(5)</enum><text>the international community, including the United Nations, the North Atlantic Treaty Organization (NATO), the European Union, and the United States, should immediately act to mobilize sufficient political, military, and financial resources to support the expansion of the African Union Mission in Sudan so that it achieves the size, strength, and capacity necessary for protecting civilians and humanitarian operations, and ending the continued violence in the Darfur region;</text></paragraph> 
<paragraph id="HB626C1B1FB3343C8B8D3D500BA58003E"><enum>(6)</enum><text display-inline="yes-display-inline">if an expanded and reinforced African Union Mission in Sudan fails to stop genocide in the Darfur region, the international community should take additional, dispositive measures to prevent and suppress acts of genocide in the Darfur region;</text></paragraph> 
<paragraph id="HC0759BE08AC44134B0BBFC1CC1D0ED5D"><enum>(7)</enum><text>acting under Article 5 of the Charter of the United Nations, the United Nations Security Council should call for suspension of the Government of Sudan’s rights and privileges of membership by the General Assembly until such time as the Government of Sudan has honored pledges to cease attacks upon civilians, demobilize and demilitarize the Janjaweed and associated militias, and grant free and unfettered access for deliveries of humanitarian assistance in the Darfur region;</text></paragraph> 
<paragraph id="HA53ACDAEAF2143C6A48BF81D501F37E3"><enum>(8)</enum><text>the President should use all necessary and appropriate diplomatic means to ensure the full discharge of the responsibilities of the Committee of the United Nations Security Council and the Panel of Experts established pursuant to section 3(a) of Security Council Resolution 1591 (March 29, 2005);</text></paragraph> 
<paragraph id="H6E3AF0C389A644DE9C007E02828B0723"><enum>(9)</enum><text display-inline="yes-display-inline">the United States should not provide assistance to the Government of Sudan, other than assistance necessary for the implementation of the Comprehensive Peace Agreement for Sudan, the support of the regional Government of Southern Sudan and marginalized areas in northern Sudan (including the Nuba Mountains, Southern Blue Nile, Abyei, Eastern Sudan (Beja), Darfur, and Nubia), as well as marginalized peoples in and around Khartoum, or for humanitarian purposes in Sudan, until such time as the Government of Sudan has honored pledges to cease attacks upon civilians, demobilize and demilitarize the Janjaweed and associated militias, grant free and unfettered access for deliveries of humanitarian assistance in the Darfur region, and allow for the safe and voluntary return of refugees and internally displaced persons;</text></paragraph> 
<paragraph id="HE7D99ADDE94443D0A8428631FAA06448"><enum>(10)</enum><text>the President should seek to assist members of the Sudanese diaspora in the United States by establishing a student loan forgiveness program for those individuals who commit to return to southern Sudan for a period of not less than five years for the purpose of contributing professional skills needed for the reconstruction of southern Sudan; </text></paragraph> 
<paragraph id="H228AB25F35F245E0BAE986EAD6CB30B2"><enum>(11)</enum><text>the President should appoint a Presidential Envoy for Sudan with appropriate resources and a clear mandate to provide stewardship of efforts to implement the Comprehensive Peace Agreement for Sudan, seek ways to bring stability and peace to the Darfur region, address instability elsewhere in Sudan and northern Uganda, and pursue a truly comprehensive peace throughout the region;</text></paragraph> 
<paragraph id="H99B88FCCA65548279787E1ABF96F6C00"><enum>(12)</enum><text display-inline="yes-display-inline">to achieve the goals specified in paragraph (10) and to further promote human rights and civil liberties, build democracy, and strengthen civil society, the Presidential Envoy for Sudan should be empowered to promote and encourage the exchange of individuals pursuant to educational and cultural programs, including programs funded by the Government of the United States;</text></paragraph> 
<paragraph id="H8FB054FD640C4B69AA3F94620000B2BB"><enum>(13)</enum><text>the international community should strongly condemn attacks against humanitarian workers and demand that all armed groups in the Darfur region, including the forces of the Government of Sudan, the Janjaweed, associated militias, the Sudan Liberation Movement/Army (SLM/A), the Justice and Equality Movement (JEM), and all other armed groups refrain from such attacks; </text></paragraph> 
<paragraph id="H90D682D420234DA39DD7B9E869A44A2"><enum>(14)</enum><text>the United States should fully support the Comprehensive Peace Agreement for Sudan and urge rapid implementation of its terms; and</text></paragraph> 
<paragraph id="HE2896484DC0C4F6E8630AF7792914EB5"><enum>(15)</enum><text>the new leadership of the Sudan People’s Liberation Movement (SPLM) should—</text> 
<subparagraph id="H3BA7FF0B61BF4A96A039A29B418ED641"><enum>(A)</enum><text>seek to transform the SPLM into an inclusive, transparent, and democratic body;</text></subparagraph> 
<subparagraph id="HB14B84E7DAF142C3906DEA6496ED118C"><enum>(B)</enum><text>reaffirm the commitment of the SPLM to bringing peace not only to southern Sudan, but also to the Darfur region, eastern Sudan, and northern Uganda; and</text></subparagraph> 
<subparagraph id="HD77D5B433B8D47ED8D97E198E01D3F8E"><enum>(C)</enum><text>remain united in the face of efforts to undermine the SPLM.</text></subparagraph></paragraph></section> 
<section id="H0E2CC95648374EF7BBC5EE52434FD3A4" display-inline="no-display-inline"><enum>5.</enum><header>Sanctions in support of peace in Darfur</header> 
<subsection id="H670392481A27476CA27BEC575770F25D"><enum>(a)</enum><header>Blocking of assets and restriction on visas</header><text>Section 6 of the Comprehensive Peace in Sudan Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/497">Public Law 108–497</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended—</text> 
<paragraph id="HC161513E64B649E38DCECA5566D88424"><enum>(1)</enum><text>in the heading of subsection (b), by inserting <quote><header-in-text level="subsection" style="OLC">of appropriate senior officials of the Sudanese Government</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">assets</header-in-text></quote>;</text></paragraph> 
<paragraph id="HEF0BF253F2684D91958D3D002C6EB3A"><enum>(2)</enum><text>by redesignating subsections (c) through (e) as subsections (d) through (f), respectively; and</text></paragraph> 
<paragraph id="HDDB83F1C5E7A409CAFE7D852C78CE06"><enum>(3)</enum><text>by inserting after subsection (b) the following new subsection:</text> 
<quoted-block style="OLC" id="H0A186F920DEF45FE839547FF5DA2A467" display-inline="no-display-inline">
<subsection id="H10066D88232B4413AE15CF5FDBF1E8CD"><enum>(c)</enum><header>Blocking of assets and restriction on visas of certain individuals identified by the President</header> 
<paragraph id="H0F6FCDA258E4496FB5CCE76C982E4B11"><enum>(1)</enum><header>Blocking of assets</header><text display-inline="yes-display-inline">Beginning on the date that is 30 days after the date of the enactment of the <short-title>Darfur Peace and Accountability Act of 2006</short-title>, and in the interest of contributing to peace in Sudan, the President shall, consistent with the authorities granted in the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>), block the assets of any individual who the President determines is complicit in, or responsible for, acts of genocide, war crimes, or crimes against humanity in Darfur, including the family members or any associates of such individual to whom assets or property of such individual was transferred on or after July 1, 2002.</text></paragraph> 
<paragraph id="HBAF9AB82679F4BA8B3EAC0AFD30055D4"><enum>(2)</enum><header>Restriction on visas</header><text display-inline="yes-display-inline">Beginning on the date that is 30 days after the date of the enactment of the <short-title>Darfur Peace and Accountability Act of 2006</short-title>, and in the interest of contributing to peace in Sudan, the President shall deny visas and entry to any individual who the President determines is complicit in, or responsible for, acts of genocide, war crimes, or crimes against humanity in Darfur, including the family members or any associates of such individual to whom assets or property of such individual was transferred on or after July 1, 2002.</text></paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HCD41EB949EF149099EAA7370D4C13B87"><enum>(b)</enum><header>Waiver</header><text display-inline="yes-display-inline">Section 6(d) of the Comprehensive Peace in Sudan Act of 2004 (as redesignated by subsection (a)) is amended by adding at the end the following new sentence: <quote>The President may waive the application of paragraph (1) or (2) of subsection (c) with respect to an individual if the President determines that such a waiver is in the national interests of the United States and, prior to exercising the waiver, transmits to the appropriate congressional committees a notification which includes the name of the individual and the reasons for the waiver.</quote>.</text></subsection> 
<subsection id="HA6A6F9C29DF64F800065770657041156"><enum>(c)</enum><header>Sanctions against certain janjaweed commanders and coordinators</header><text display-inline="yes-display-inline">The President should immediately consider imposing the sanctions described in section 6(c) of the Comprehensive Peace in Sudan Act of 2004 (as added by subsection (a)) against the Janjaweed commanders and coordinators identified by the former United States Ambassador-at-Large for War Crimes before the Subcommittee on Africa of the House International Relations Committee on June 24, 2004. </text></subsection></section> 
<section id="H8FEF5DF4D7BE4F65B0A404E76AA4EAE" display-inline="no-display-inline"><enum>6.</enum><header>Additional authorities to deter and suppress genocide in Darfur</header> 
<subsection id="HCDD1A6ECD5174D6681342801F6196618"><enum>(a)</enum><header>United States assistance to support AMIS</header><text display-inline="yes-display-inline">Section 7 of the Comprehensive Peace in Sudan Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/497">Public Law 108–497</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended—</text> 
<paragraph id="HD17CA6BC06174E0E9ED69F1BA42B6DDB"><enum>(1)</enum><text>by striking <quote>Notwithstanding</quote> and inserting <quote>(a) <header-in-text level="subsection" style="OLC">General assistance</header-in-text>.—Notwithstanding</quote>; and</text></paragraph> 
<paragraph id="H8CB996BFAD134F38AFCFFEB28700AE06"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="H0491187F1D2A4B848383C559349E2310" display-inline="no-display-inline">
<subsection id="H54FFD72B9F0D42ED9CB48D9446107941"><enum>(b)</enum><header>Assistance to support AMIS</header><text>Notwithstanding any other provision of law, the President is authorized to provide assistance, on such terms and conditions as the President may determine and in consultation with the appropriate congressional committees, to reinforce the deployment and operations of an expanded African Union Mission in Sudan (AMIS) with the mandate, size, strength, and capacity to protect civilians and humanitarian operations, stabilize the Darfur region of Sudan and dissuade and deter air attacks directed against civilians and humanitarian workers, including but not limited to providing assistance in the areas of logistics, transport, communications, materiel support, technical assistance, training, command and control, aerial surveillance, and intelligence.</text></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H82C79DB8DEC04BC1A803249C87149CFD"><enum>(b)</enum><header>NATO assistance to support AMIS</header><text>The President should instruct the United States Permanent Representative to the North Atlantic Treaty Organization (NATO) to use the voice, vote, and influence of the United States at NATO to advocate NATO reinforcement of the African Union Mission in Sudan (AMIS), upon the request of the African Union, including but not limited to the provision of assets to dissuade and deter offensive air strikes directed against civilians and humanitarian workers in the Darfur region of Sudan and other logistical, transportation, communications, training, technical assistance, command and control, aerial surveillance, and intelligence support.</text></subsection> 
<subsection id="H111E20452DA447B2A908D900B8441B2B"><enum>(c)</enum><header>Denial of entry at United States ports to certain cargo ships or oil tankers</header> 
<paragraph id="H426C6962576146E1B2AE65AE0161F81F"><enum>(1)</enum><header>In general</header><text>The President should take all necessary and appropriate steps to deny the Government of Sudan access to oil revenues, including by prohibiting entry at United States ports to cargo ships or oil tankers engaged in business or trade activities in the oil sector of Sudan or involved in the shipment of goods for use by the armed forces of Sudan until such time as the Government of Sudan has honored its commitments to cease attacks on civilians, demobilize and demilitarize the Janjaweed and associated militias, grant free and unfettered access for deliveries of humanitarian assistance, and allow for the safe and voluntary return of refugees and internally displaced persons.</text></paragraph> 
<paragraph id="H488DBFC0D66B43A5B0B12B2527D14C05"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) shall not apply with respect to cargo ships or oil tankers involved in an internationally-recognized demobilization program or the shipment of non-lethal assistance necessary to carry out elements of the Comprehensive Peace Agreement for Sudan. </text></paragraph></subsection> 
<subsection id="HDD2BC2952B2142AD951118518D8D0030"><enum>(d)</enum><header>Prohibition on assistance to countries in violation of United Nations Security Council Resolutions 1556 and 1591</header> 
<paragraph id="HE9F94CE4E2FE4C0A803B514F090522A5"><enum>(1)</enum><header>Prohibition</header><text>Amounts made available to carry out the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151 et seq.</external-xref>) may not be used to provide assistance (other than humanitarian assistance) to the government of a country that is in violation of the embargo on military assistance with respect to Sudan imposed pursuant to United Nations Security Council Resolutions 1556 (July 30, 2004) and 1591 (March 29, 2005).</text></paragraph> 
<paragraph id="H8CED505418E64D7E9490A79308156752"><enum>(2)</enum><header>Waiver</header><text>The President may waive the application of paragraph (1) if the President determines and certifies to the appropriate congressional committees that it is in the national interests of the United States to do so.</text></paragraph></subsection></section> 
<section id="H1460F4EC89984A4D88A68304439CB0AE" display-inline="no-display-inline"><enum>7.</enum><header>Multilateral efforts</header><text display-inline="no-display-inline"> The President shall direct the United States Permanent Representative to the United Nations to use the voice and vote of the United States to urge the adoption of a resolution by the United Nations Security Council that—</text> 
<paragraph id="H307A592BE581419182DE9ED1352E6CAA"><enum>(1)</enum><text display-inline="yes-display-inline">supports the expansion of the African Union Mission in Sudan (AMIS) so that it achieves the mandate, size, strength, and capacity needed to protect civilians and humanitarian operations, and dissuade and deter fighting and violence in the Darfur region of Sudan, and urges Member States of the United Nations to accelerate political, material, financial, and other assistance to the African Union toward this end;</text></paragraph> 
<paragraph id="H04D18281A29E477783F5DBA869C115D"><enum>(2)</enum><text display-inline="yes-display-inline">reinforces efforts of the African Union to negotiate peace talks between the Government of Sudan, the Sudan Liberation Movement/Army (SLM/A), the Justice and Equality Movement (JEM), and associated armed groups in the Darfur region, calls on the Government of Sudan, the SLM/A, and the JEM to abide by their obligations under the N’Djamena Ceasefire Agreement of April 8, 2004 and subsequent agreements, urges all parties to engage in peace talks without preconditions and seek to resolve the conflict, and strongly condemns all attacks against humanitarian workers and African Union personnel in the Darfur region;</text></paragraph> 
<paragraph id="H9EF66BF61A614757859895B782556023"><enum>(3)</enum><text display-inline="yes-display-inline">imposes sanctions against the Government of Sudan, including sanctions against individual members of the Government of Sudan, and entities controlled or owned by officials of the Government of Sudan or the National Congress Party in Sudan until such time as the Government of Sudan has honored its commitments to cease attacks on civilians, demobilize and demilitarize the Janjaweed and associated militias, grant free and unfettered access for deliveries of humanitarian assistance, and allow for the safe and voluntary return of refugees and internally displaced persons;</text></paragraph> 
<paragraph id="HE3D74ED0411F4D439CB37BB5F216850"><enum>(4)</enum><text display-inline="yes-display-inline">extends the military embargo established by United Nations Security Council Resolutions 1556 (July 30, 2004) and 1591 (March 29, 2005) to include a total prohibition on the sale or supply of offensive military equipment to the Government of Sudan, except for use in an internationally-recognized demobilization program or for non-lethal assistance necessary to carry out elements of the Comprehensive Peace Agreement for Sudan; and</text></paragraph> 
<paragraph id="HCB3CE8087FF649039C77FFE6B047C600"><enum>(5)</enum><text display-inline="yes-display-inline">calls upon those Member States of the United Nations that continue to undermine efforts to foster peace in Sudan by providing military assistance and equipment to the Government of Sudan, the SLM/A, the JEM, and associated armed groups in the Darfur region in violation of the embargo on such assistance and equipment, as called for in United Nations Security Council Resolutions 1556 and 1591, to immediately cease and desist.</text></paragraph></section> 
<section id="H3486FCE529DE41AF8E4189A9EA297C2E"><enum>8.</enum><header>Continuation of restrictions</header> 
<subsection id="H5FB712D1C46E428DB55CAA61F41568F8"><enum>(a)</enum><header>Continuation of restrictions</header><text display-inline="yes-display-inline">Restrictions against the Government of Sudan that were imposed pursuant to Executive Order 13067 of November 3, 1997 (62 Federal Register 59989), title III and sections 508, 512, 527, and 569 of the Foreign Operations, Export Financing, and Related Programs Appropriations Act, 2006, or any other similar provision of law, shall remain in effect and shall not be lifted pursuant to such provisions of law until the President transmits to the appropriate congressional committees a certification that the Government of Sudan is acting in good faith to—</text> 
<paragraph id="H12EA153537EC4828A56CAADFABD102C0"><enum>(1)</enum><text>peacefully resolve the crisis in the Darfur region of Sudan; </text></paragraph> 
<paragraph id="HE745D42445A44CA3B6BAC159FBD6D5E9"><enum>(2)</enum><text>disarm, demobilize, and demilitarize the Janjaweed and all government-allied militias;</text></paragraph> 
<paragraph id="HDEA3185676284BA8A08C7D7800A08B4F"><enum>(3)</enum><text>adhere to United Nations Security Council Resolutions 1556 (2004), 1564 (2004), 1591 (2005), and 1593 (2005); </text></paragraph> 
<paragraph id="H1D0A2A3828DD4E8FA3C4C6A3E3A318CE"><enum>(4)</enum><text>negotiate a peaceful resolution to the crisis in eastern Sudan; </text></paragraph> 
<paragraph id="HF084FB0DEF864FA29D288CDFEF30E1BF"><enum>(5)</enum><text>fully cooperate with efforts to disarm, demobilize, and deny safe haven to members of the Lords Resistance Army; and </text></paragraph> 
<paragraph id="H62A8267EAB404D44A15CF7A610C6C2BD"><enum>(6)</enum><text>fully implement the Comprehensive Peace Agreement for Sudan without manipulation or delay, including by—</text> 
<subparagraph id="H59084970F6914D909B3E79D300168B32"><enum>(A)</enum><text>implementing the recommendations of the Abyei Commission Report;</text></subparagraph> 
<subparagraph id="H925AE8F335A14AE8A0412951F9D3E39"><enum>(B)</enum><text display-inline="yes-display-inline">establishing other appropriate commissions and implementing and adhering to the recommendations of such commissions consistent with the terms of the Comprehensive Peace Agreement for Sudan;</text></subparagraph> 
<subparagraph id="H24861D98079848DABF31CBC4DDA22FD8"><enum>(C)</enum><text>adhering to the terms of the Wealth Sharing Agreement; and </text></subparagraph> 
<subparagraph id="H9BB9973B30274BDEB56740B3D237E386"><enum>(D)</enum><text>withdrawing government forces from southern Sudan consistent with the terms of the Comprehensive Peace Agreement for Sudan.</text></subparagraph></paragraph></subsection> 
<subsection id="H39A0DC5939DC487A91BECD71DEC6E5F"><enum>(b)</enum><header>Waiver</header><text display-inline="yes-display-inline">The President may waive the application of subsection (a) if the President determines and certifies to the appropriate congressional committees that it is in the national interests of the United States to do so. </text></subsection></section> 
<section id="H8E585A92221043E29957192332A31D68"><enum>9.</enum><header>Assistance efforts in Sudan</header> 
<subsection id="HC606C701B2A74DF6A1E3886CF35D01BD"><enum>(a)</enum><header>Additional authorities</header><text>Section 501(a) of the Assistance for International Malaria Control Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended—</text>

<subparagraph id="H0A61966099F94BC8AC29C52EFAE0B948"><enum>(A)</enum><header>In general</header><text>Assistance may not be obligated under this subsection until 15 days after the date on which the President has provided notice thereof to the congressional committees specified in section 634A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2394-1">22 U.S.C. 2394–1</external-xref>) in accordance with the procedures applicable to reprogramming notifications under such section.</text></subparagraph> 
<subparagraph id="HEF5284EC630441EA005CFCD57352C111"><enum>(B)</enum><header>Rule of construction</header><text>The notification requirement of subparagraph (A) shall not apply in the case of assistance subject to notification in accordance with section 634A of the Foreign Assistance Act of 1961 pursuant to any provision of an Act making appropriations for foreign operations, export financing, and related programs.</text></subparagraph></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<subsection id="HEF611D9917274B7994B986FC46AE00"><enum>(a)</enum><header>Report on African Union Mission in Sudan (AMIS) </header><text>Section 8 of the Sudan Peace Act (<external-xref legal-doc="public-law" parsable-cite="pl/107/245">Public Law 107–245</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended—</text> 
<paragraph id="HF64BC3A97EAA4F2DAEFD727E06612540"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph> 
<paragraph id="H583C7BC9DCE14AE480F938FC6C5E243C"><enum>(2)</enum><text>by inserting after subsection (b) the following new subsection: </text>

<paragraph id="H3974EBF0204B45B0A504D600AAB97665"><enum>(1)</enum><text>efforts to fully deploy the African Union Mission in Sudan (AMIS) with the size, strength, and capacity necessary to stabilize the Darfur region of Sudan and protect civilians and humanitarian operations;</text></paragraph> 
<paragraph id="H0B4997A2A3664055882CF3B003B42C"><enum>(2)</enum><text display-inline="yes-display-inline">the needs of AMIS to ensure success, including in the areas of housing, transport, communications, equipment, technical assistance, training, command and control, intelligence, and such assistance as is necessary to dissuade and deter attacks, including by air, directed against civilians and humanitarian operations;</text></paragraph> 
<paragraph id="H26A7FF05D0E4460DA8DC66A2D02D025"><enum>(3)</enum><text>the current level of United States assistance and other assistance provided to AMIS, and a request for additional United States assistance, if necessary;</text></paragraph> 
<paragraph id="H959984E364C8479CA153EF3543074E4B"><enum>(4)</enum><text>the status of North Atlantic Treaty Organization (NATO) plans and assistance to support AMIS; and</text></paragraph> 
<paragraph id="H70EA24E3B6364B73A3FEC6615EF019A7"><enum>(5)</enum><text>the performance of AMIS in carrying out its mission in the Darfur region.</text></paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H6CCDCA11A2B3457A8BA5ABC412304FE"><enum>(b)</enum><header>Report on sanctions in support of peace in Darfur</header><text>Section 8 of the Sudan Peace Act (<external-xref legal-doc="public-law" parsable-cite="pl/107/245">Public Law 107–245</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note), as amended by subsection (a), is further amended—</text> 
<paragraph id="HC29DD94D2112426DA3C11791F1521952"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (e); and</text></paragraph> 
<paragraph id="HA0F11627D1E84FAAA63925BD2CB080EE"><enum>(2)</enum><text>by inserting after subsection (c) the following new subsection: </text>

<paragraph id="H4359ADEAC80A4D0CA525D575F1375457"><enum>(1)</enum><text>a description of each sanction imposed under such provisions of law; and</text></paragraph> 
<paragraph id="H9D02A4594D0C478A9915D800E5119CE4"><enum>(2)</enum><text>the name of the individual or entity subject to the sanction, if applicable.</text></paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HD029776EAB964122B0A455E4C95169F4"><enum>11.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act (or any amendment made by this Act) or any other provision of law shall be construed to preempt any State law that prohibits investment of State funds, including State pension funds, in or relating to the Republic of the Sudan.</text></section>
