<official-title>To authorize the Secretary of the Interior to allow the Columbia Gas Transmission Corporation to increase the diameter of a natural gas pipeline located in the Delaware Water Gap National Recreation Area.</official-title>

<section id="HF1638726A60C495796527EF1962FEDEE" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Delaware Water Gap National Recreation Area Natural Gas Pipeline Enlargement Act</short-title></quote>.</text></section> 
<section id="H96E7E61510BB4485A9009685C84EEE62"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H971E986924D644D084387B24836ED63D"><enum>(1)</enum><header>Corporation</header><text>The term <term>Corporation</term> means the Columbia Gas Transmission Corporation.</text></paragraph> 
<paragraph id="H613CB66A8EE8409C009163B2FEF9D984"><enum>(2)</enum><header>Pipeline</header><text>The term <term>pipeline</term> means that portion of the pipeline of the Corporation numbered 1278 that is—</text> 
<subparagraph id="H097AE1D0F60A43169245D019775154F5"><enum>(A)</enum><text>located in the Recreation Area; and</text></subparagraph> 
<subparagraph id="H5318CE6B2AD04E33AC00202D3DE8824B"><enum>(B)</enum><text>situated on 2 tracts designated by the Corporation as ROW No. 16405 and No. 16413.</text></subparagraph></paragraph> 
<paragraph id="H9B52C32E9C604747B2816F7D3E6E99B1"><enum>(3)</enum><header>Recreation area</header><text>The term <term>Recreation Area</term> means the Delaware Water Gap National Recreation Area in the Commonwealth of Pennsylvania.</text></paragraph> 
<paragraph id="H42C3ACDFE77B40A081DC12C7B8664076"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="HCE82EF7A8E8E416988C2E1B713998B14"><enum>(5)</enum><header>Superintendent</header><text>The term <quote>Superintendent</quote> means the Superintendent of the Recreation Area.</text></paragraph></section> 
<section id="HB917B21486E044B2BD4D69CF00485146"><enum>3.</enum><header>Easement for expanded natural gas pipeline</header> 
<subsection id="H624791373C26469082AAD904AAF9176"><enum>(a)</enum><header>In general</header><text>The Secretary may enter into an agreement with the Corporation to grant to the Corporation, an easement to enlarge the diameter of the pipeline from 14 inches to not more than 20 inches.</text></subsection> 
<subsection id="HD545C8B58B6D4BBFBAE5A8BCC32C7BD"><enum>(b)</enum><header>Terms and conditions</header><text>The easement authorized under subsection (a) shall—</text> 
<paragraph id="H1E301D84A3BB412C8D3B00527634E1CC"><enum>(1)</enum><text>be consistent with—</text> 
<subparagraph id="HB70644DFB4FC4A36BE3FDDD75BEF00A3"><enum>(A)</enum><text>the recreational values of the Recreation Area; and</text></subparagraph> 
<subparagraph id="H35C2B6E440B04D2DA4FC2C8585BA1715"><enum>(B)</enum><text>protection of the resources of the Recreation Area;</text></subparagraph></paragraph> 
<paragraph id="H17C5DC8C164846B3A671FFD4F1590600"><enum>(2)</enum><text>include provisions for the protection of resources in the Recreation Area that ensure that only the minimum and necessary amount of disturbance, as determined by the Secretary, shall occur during the construction or maintenance of the enlarged pipeline;</text></paragraph> 
<paragraph id="H8BA7B37A6F4C4A5883339B29E6E81547"><enum>(3)</enum><text>be consistent with the laws (including regulations) and policies applicable to units of the National Park System; and</text></paragraph> 
<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="H516CDCC03676454C952E71E1BCB6BB5D"><enum><added-phrase reported-display-style="italic" committee-id="HII00">(4)</added-phrase></enum><text><added-phrase reported-display-style="italic" committee-id="HII00">be subject to any other terms and conditions that the Secretary determines to be necessary.</added-phrase></text></paragraph></subsection> 
<subsection id="H14C8C6BC8E7C4871B55285B967F4EEE0"><enum>(c)</enum><header>Permits</header> 
<paragraph id="H888527805A1D4930A4A294110967ABBB"><enum>(1)</enum><header>In general</header><text>The Superintendent may issue a permit to the Corporation for the use of the Recreation Area in accordance with subsection (b) for the temporary construction and staging areas required for the construction of the enlarged pipeline.</text></paragraph> 
<paragraph id="H613007E0EA80443D921DC83058806D84"><enum>(2)</enum><header>Prior to issuance</header><text>The easement authorized under subsection (a) and the permit authorized under paragraph (1) shall require that before the Superintendent issues a permit for any clearing or construction, the Corporation shall—</text> 
<subparagraph id="H42E2E8478DD549B5A26F7B42EE04E7A6"><enum>(A)</enum><text>consult with the Superintendent;</text></subparagraph> 
<subparagraph id="HF0276FF73E4243D685EEDEC7939C0119"><enum>(B)</enum><text>identify natural and cultural resources of the Recreation Area that may be damaged or lost because of the clearing or construction; and</text></subparagraph> 
<subparagraph id="H4D31AC6B87334B2692043997B461C6B8"><enum>(C)</enum><text>submit to the Superintendent for approval a restoration and mitigation plan that—</text> 
<clause id="H76C8AC6DD09148488BAF4B6546003D16"><enum>(i)</enum><text>describes how the land subject to the easement will be maintained; and</text></clause> 
<clause id="H24C29C06877D43DAAB305D258E56FF17"><enum>(ii)</enum><text>includes a schedule for, and description of, the specific activities to be carried out by the Corporation to mitigate the damages or losses to, or restore, the natural and cultural resources of the Recreation Area identified under subparagraph (B).</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HFFAB62122626483E83004CDF491F129"><enum>(d)</enum><header>Pipeline replacement requirements</header><text>The enlargement of the pipeline authorized under subsection (a) shall be considered to meet the pipeline replacement requirements required by the Research and Special Programs Administration of the Department of Transportation (CPF No. 1–2002–1004–H).</text></subsection> 
<subsection id="HE4BBB7B7CC484D18B400B3BBB35E2C2B"><enum>(e)</enum><header>FERC consultation</header><text>The Corporation shall comply with all other requirements for certification by the Federal Energy Regulatory Commission that are necessary to permit the increase in pipeline size.</text></subsection> 
<subsection id="H005292FAA1C94C14000027DF51D1EF6"><enum>(f)</enum><header>Limitation</header><text>The Secretary shall not grant any additional increases in the diameter of, or easements for, the pipeline within the boundary of the Recreation Area after the date of enactment of this Act.</text></subsection> 
<subsection id="HCC1074A6A7DA48CAB43D78843B7CAC84"><enum>(g)</enum><header>Effect on right-of-Way easement</header><text>Nothing in this Act increases the 50-foot right-of-way easement for the pipeline.</text></subsection> 
<subsection id="H41F88B92CA0C44CABFBB05AD3D2121DB"><enum>(h)</enum><header>Penalties</header><text>On request of the Secretary, the Attorney General may bring a civil action against the Corporation in United States district court to recover damages and response costs under <external-xref legal-doc="public-law" parsable-cite="pl/101/337">Public Law 101–337</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/19jj">16 U.S.C. 19jj et seq.</external-xref>) or any other applicable law if—</text> 
<paragraph id="H2FD5D990072D4CFBA9CC447974273037"><enum>(1)</enum><text>the Corporation—</text> 
<subparagraph id="H28E2894B918B4C70AE22C4C3E438C8FB"><enum>(A)</enum><text>violates a provision of—</text> 
<clause id="HAA9303A0330744308E25BA435CC26FFB"><enum>(i)</enum><text>an easement authorized under subsection (a); or</text></clause> 
<clause id="H73E0358C80FA4A259E77CADB93E3F04"><enum>(ii)</enum><text>a permit issued under subsection (c); or</text></clause></subparagraph> 
<subparagraph id="H7189DAC33A59415E8F9134834307746C"><enum>(B)</enum><text>fails to submit or timely implement a restoration and mitigation plan approved under subsection (c)(3); and</text></subparagraph></paragraph> 
<paragraph id="HF4E62D21664F4367B8BC1870EA318785"><enum>(2)</enum><text>the violation or failure destroys, results in the loss of, or injures any park system resource (as defined in section 1 of <external-xref legal-doc="public-law" parsable-cite="pl/101/337">Public Law 101–337</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/19jj">16 U.S.C. 19jj</external-xref>)).</text></paragraph></subsection></section>
