<section id="HA1AFF9D4505C40B9BA33BA69DB5839D0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Carlie’s Law</short-title></quote>.</text></section> 
<section id="H759DD43A6D8544FFB567A209C6F3700"><enum>2.</enum><header>Coordination among Department of State, Department of Homeland Security, and Federal Bureau of Investigation to monitor overseas sex offenders upon return to the United States</header> 
<subsection id="H3E388BF347444B05B7E29FB02E1B36F8"><enum>(a)</enum><header>State Department to notify customs and border protection agents</header><text display-inline="yes-display-inline">Whenever it is made known to the Secretary of State that a citizen of the United States has been convicted outside the United States of a child predatory crime—</text> 
<paragraph id="HDF8AEEA6F506435D8DE900B247044BE0"><enum>(1)</enum><text>the Secretary of State shall promptly notify the Secretary of Homeland Security of the conviction of that individual; and</text></paragraph> 
<paragraph id="HA2519BEF006949BEB8DDB1D91669749C"><enum>(2)</enum><text>the Secretary of Homeland Security shall ensure that the information relating to the conviction is available to, and used by, agents of the Bureau of Customs and Border Protection.</text></paragraph></subsection> 
<subsection id="H3A9FB3692AD840FA81931B16542139DF"><enum>(b)</enum><header>Customs and border protection agents to notify FBI</header> <text>Whenever it is made known to an agent of the Bureau of Customs and Border Protection that a citizen of the United States, who has been convicted outside the United States of a child predatory crime, has entered the United States—</text> 
<paragraph id="H46749467DC1945E58400D28F5EA7CD"><enum>(1)</enum><text>the Secretary of Homeland Security shall promptly notify the Director of the Federal Bureau of Investigation of the entry of that citizen; and</text></paragraph> 
<paragraph id="H0A683AA6C9C24F3FB772A3D0791580D6"><enum>(2)</enum><text>the Director of the Federal Bureau of Investigation shall ensure that the information relating to the entry of that citizen is promptly entered into the National Sex Offender Registry.</text></paragraph></subsection> 
<subsection id="H639038157B264FEFBCA81B36B3AB96B1"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>child predatory crime</term> includes—</text> 
<paragraph id="H03863962E6604BFC86A5082ED1AFE551"><enum>(1)</enum><text>any crime under which a child is exploited for sexual purposes, such as molestation, rape, fondling, or trafficking; and</text></paragraph> 
<paragraph id="H647E3F46221F4E06B7FF46535BEC3233"><enum>(2)</enum><text>any felony in which a child is the victim.</text></paragraph></subsection></section> 
<section id="H90B16D1D91974575982264D9DCB62BA0"><enum>3.</enum><header>Expansion of National Sex Offender Registry to include individuals convicted of exploitation or trafficking</header><text display-inline="no-display-inline">Section 170101 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/14071">42 U.S.C. 14071</external-xref>) is amended in subsection (a)(3)(A)—</text> 
<paragraph id="H781B130111B042A3A87ED2FDCB6F7138"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of clause (viii);</text></paragraph> 
<paragraph id="HA64446A64C3A45188950E7E4E2FCEB5"><enum>(2)</enum><text>by redesignating clause (ix) as clause (xi);</text></paragraph> 
<paragraph id="H9029FFB148624FC5A689EDC1D0073AB"><enum>(3)</enum><text>by inserting after clause (viii) the following new clauses:</text> 
<quoted-block style="OLC" id="H484E2CE36FFF4C4AA505B07BC7325BA" display-inline="no-display-inline"> 
<clause id="HD1BB8295422A427FBBB98BB0E155FD55"><enum>(ix)</enum><text>exploitation of a minor;</text></clause> 
<clause id="H60D60EAD53B34B5B91816FB0426E778D"><enum>(x)</enum><text>trafficking in persons with respect to a minor; or</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H3CD82F728463481DA3FFF6B8A48E00C3"><enum>(4)</enum><text>in clause (xi), as so redesignated, by striking <quote>clauses (i) through (vii)</quote> and inserting <quote>clauses (i) through (x)</quote>.</text></paragraph></section> 
<section id="H8E06C7EFC37A4B16A3367F39A71C9E08"><enum>4.</enum><header>Criminal forfeiture of property of persons convicted of exploitation or trafficking</header> 
<subsection id="H05CE6B0EF3FA4634A247113B34A07E6C"><enum>(a)</enum><header>Property subject to criminal forfeiture</header><text>Any person convicted of a violation of a Federal law relating to exploitation or trafficking in persons shall forfeit to the United States, irrespective of any provision of State law—</text> 
<paragraph id="H96F8166BEA52407FBD900024FA92871"><enum>(1)</enum><text>any property constituting, or derived from, any proceeds the person obtained, directly or indirectly, as the result of such violation; and</text></paragraph> 
<paragraph id="H12039E5DF90F40E0804E65FFE658D217"><enum>(2)</enum><text>any of the person’s property used, or intended to be used, in any manner or part, to commit, or to facilitate the commission of, such violation.</text></paragraph></subsection> 
<subsection id="H75CFB80A9E114FD7BDFAE04225309C41"><enum>(b)</enum><header>Court order</header><text>The court, in imposing sentence on such person, shall order, in addition to any other sentence imposed for that offense, that the person forfeit to the United States all property described in subsection (a). In lieu of a fine otherwise authorized for that offense, a defendant who derives profits or other proceeds from an offense may be fined not more than twice the gross profits or other proceeds.</text></subsection> 
<subsection id="H43646444796B47C096749B568974FE8F"><enum>(c)</enum><header>Incorporation of criminal forfeiture provisions of Controlled Substances Act</header><text>The following provisions of section 413 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/853">21 U.S.C. 853</external-xref>) apply to a conviction referred to in subsection (a): Subsections (b) through (i) and subsections (k) through (p).</text></subsection> 
<subsection id="H3C441A86B21E41B2A09C7738C8A98269"><enum>(d)</enum><header>Comparable State forfeiture laws</header><text>Each State shall have in effect laws and policies comparable to the laws and policies in this section. A State that, as determined by the Attorney General, fails to have in effect such laws and policies shall not receive any grant amounts or other assistance under any program of the Department of Justice.</text></subsection></section> 
<section id="H56113BFE38AF463E82AE1486EA0966F7"><enum>5.</enum><header>Electronic surveillance of individuals convicted of a criminal offense against a minor age 12 or under</header> 
<subsection id="H4E944919A2D749FE96EE56D0B1FBAA19"><enum>(a)</enum><header>Surveillance required</header><text>Any person convicted of a criminal offense against a victim who is a minor (as defined in section 170101 of the Violent Crime Control and Law Enforcement Act of 1994) shall, if the minor was age 12 or under, be subject to electronic surveillance for the life of the person, except as provided in this section.</text></subsection> 
<subsection id="HB7E76C372BF34E4483F2F4D8AE9240FF"><enum>(b)</enum><header>Exceptions</header> 
<paragraph id="H7A43367E2AEA42C1821CFCF1B296D2BF"><enum>(1)</enum><header>During period of imprisonment</header><text>A person shall not be subject to electronic surveillance under subsection (a) during a period of imprisonment.</text></paragraph> 
<paragraph id="HB7C77B1DCDBE4EC588F3EEFA14DAA9C0"><enum>(2)</enum><header>After determined to be no longer a threat to community</header><text>After a person has completed any period of imprisonment, probation, parole, or supervised release, and has completed any mandatory counseling, an appropriate official shall periodically assess, in an appropriate proceeding, whether the person no longer presents a threat to the community. If the official so determines, and that determination becomes final, the person shall not be subject to electronic surveillance under subsection (a) thereafter.</text></paragraph></subsection> 
<subsection id="H12C31A0CD672410FBEE87CAD968DE3FD"><enum>(c)</enum><header>Officials responsible</header><text>The United States Marshals Service and the Bureau of Prisons shall be responsible for carrying out the electronic surveillance required by this section.</text></subsection> 
<subsection id="HB179E9E2252B4E97A3EB8353B984A2C6"><enum>(d)</enum><header>Type of surveillance</header><text>Surveillance required by this section shall be carried out using devices approved by the United States Marshals Service.</text></subsection> 
<subsection id="H9F1734AF2B5143E48D518FA911808813"><enum>(e)</enum><header>Comparable State electronic surveillance laws</header><text>Each State shall have in effect laws and policies comparable to the laws and policies in this section. A State that, as determined by the Attorney General, fails to have in effect such laws and policies shall not receive any grant amounts or other assistance under any program of the Department of Justice.</text></subsection></section> 
<section id="H9A21361055744E5FBC567BAB39E9C7D"><enum>6.</enum><header>Reclassification of trafficking in persons as crime of violence under Federal Sentencing Guidelines</header><text display-inline="no-display-inline">Pursuant to its authority under <external-xref legal-doc="usc" parsable-cite="usc/28/994">section 994(p)</external-xref> of title 28, United States Code, the United States Sentencing Commission shall amend the Federal Sentencing Guidelines to provide for trafficking in persons to be treated as a crime of violence.</text></section> 
<section id="H80EECD9BBD5949DF8517A83500E3142B"><enum>7.</enum><header>Revocation of probation or supervised release</header> 
<subsection id="HF93541B0243E49F7879DFC355CEB8BB1"><enum>(a)</enum><header>Probation</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3565">Section 3565(b)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H94F334C99F384E9288343F8924DB6E6F"><enum>(1)</enum><text>in paragraph (3) by striking <quote>or</quote> at the end; and</text></paragraph> 
<paragraph id="HAC1425A0CB83499881044256CFC5C584"><enum>(2)</enum><text>by inserting after paragraph (4) the following new paragraphs:</text> 
<quoted-block style="USC" id="H9AD26E553E2C4CE7B91B725FDF358E83" display-inline="no-display-inline"> 
<paragraph id="H306D3D5D4AA54806BE1B03B0817724C6"><enum>(5)</enum><text>commits a felony crime of violence; or</text></paragraph> 
<paragraph id="HA7C41C27F8EE4B17909B00A09990CA7B"><enum>(6)</enum><text>commits a crime of violence against, or an offense that consists of or is intended to facilitate unlawful sexual contact (as defined in section 2246) with, a person who has not attained the age of 16 years;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HDF3E332CE1974817A3A1E2F29CA6337E"><enum>(b)</enum><header>Supervised release</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3583">Section 3583(g)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="HCC1EA49B649A4EAD93A2411E2016178F"><enum>(1)</enum><text>in paragraph (3) by striking <quote>or</quote> at the end; and</text></paragraph> 
<paragraph id="HE40C1D4CFF9741CCBA82E202549F97D7"><enum>(2)</enum><text>by inserting after paragraph (4) the following new paragraphs:</text> 
<quoted-block style="USC" id="H7E5983F0CE0D44D2913421BF40790073" display-inline="no-display-inline"> 
<paragraph id="H03FFCED5B769412EB72837556170E95B"><enum>(5)</enum><text>commits a felony crime of violence; or</text></paragraph> 
<paragraph id="HDDC2BF88B58045B6B758E757933B39EF"><enum>(6)</enum><text>commits a crime of violence against, or an offense that consists of or is intended to facilitate unlawful sexual contact (as defined in section 2246) with, a person who has not attained the age of 16 years;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HA8D4802C91E9408A88751E9E669C0017"><enum>8.</enum><header>Standardization of information in National Sex Offender Registry</header> 
<subsection id="H64338AF1C0A64D84BD9F3F477E401DE7"><enum>(a)</enum><header>Standardization required</header><text display-inline="yes-display-inline">The Attorney General shall prescribe regulations that specify the fields of information used in the National Sex Offender Registry. The Attorney General shall ensure that each State or other entity that provides information to the National Sex Offender Registry provides, to the maximum extent practicable, all the information specified in the regulations.</text></subsection> 
<subsection id="H5D8F4F9A5E064814867345959948C856"><enum>(b)</enum><header>Report</header><text>Not later than 120 days after the date of the enactment of this Act, the Attorney General shall submit to Congress a report on the regulations required by subsection (a).</text></subsection></section> 
<section id="H42797403C205439BA88C23E91E56FA1D"><enum>9.</enum><header>Forfeiture of property by persons convicted of trafficking in persons</header> 
<subsection id="H5AD852EE3A074D65A9A1636D7DF5C1EB"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/117">Chapter 117</external-xref> of title 18, United States Code, is amended by adding at the end the following new section:</text> 
<quoted-block style="USC" id="HC9CFEFC8423C405C8277D97F5A5C99" display-inline="no-display-inline"> 
<section id="H9534E30B66F04E77B46C737DE901E53F"><enum>2428.</enum><header>Forfeiture</header> 
<subsection id="H42C046FEE11B492CA398A907DC4D8176"><enum>(a)</enum><header>Forfeiture required</header><text>The court, in imposing sentence on any person convicted of a violation of this chapter, shall order, in addition to any other sentence imposed and irrespective of any provision of State law, that such person shall forfeit to the United States—</text> 
<paragraph id="H29DCC5DDA53148DEAADAF00010FFED90"><enum>(1)</enum><text>such person’s interest in any property, real or personal, that was used or intended to be used to commit or to facilitate the commission of such violation; and</text></paragraph> 
<paragraph id="HF1AFA19203F749D28315FE5EBA9505D3"><enum>(2)</enum><text>any property, real or personal, constituting or derived from, any proceeds that such person obtained, directly or indirectly, as a result of such violation.</text></paragraph></subsection> 
<subsection id="H0C888DE9D66C482383AB9179DF23E8DC"><enum>(b)</enum><header>Property subject to forfeiture</header> 
<paragraph id="H304B3BB4EADE4A3A8667C4509440B5A8"><enum>(1)</enum><header>In general</header><text>The following shall be subject to forfeiture to the United States and no property right shall exist in them:</text> 
<subparagraph id="H3DD5B8760D39427AAAB64E45A7B9DEFC"><enum>(A)</enum><text>Any property, real or personal, used or intended to be used to commit or to facilitate the commission of any violation of this chapter.</text></subparagraph> 
<subparagraph id="HCA6D4F15CA8844A6B20018B40834BD1"><enum>(B)</enum><text>Any property, real or personal, which constitutes or is derived from proceeds traceable to any violation of this chapter.</text></subparagraph></paragraph> 
<paragraph id="HFD5BB39434C348CBA456BBEBF8EA8427"><enum>(2)</enum><header>Relationship to chapter 46</header><text>The provisions of chapter 46 of this title relating to civil forfeitures shall extend to any seizure or civil forfeiture under this subsection.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD91BA1045F33426AAC7B704285D7C500"><enum>(b)</enum><header>Technical amendment</header><text>The chapter analysis at the beginning of such chapter is amended by adding at the end the following new item:</text>
