<section id="HA63B045A242D469998E37872A58FC8C"><enum>101.</enum><header>Findings and declarations</header> 
<subsection id="H00EC0DEAB2994F889400E57FCA813983"><enum>(a)</enum><header>Undermining of democracy by campaign contributions from private sources</header><text>The Congress finds and declares that the current system of privately financed campaigns for election to the House of Representatives has the capacity, and is often perceived by the public, to undermine democracy in the United States by—</text> 
<paragraph id="H04629BDD3A644471B135D126E6BEA3C0"><enum>(1)</enum><text>violating the democratic principle of <quote>one person, one vote</quote> and diminishing the meaning of the right to vote by allowing monied interests to have a disproportionate and unfair influence within the political process;</text></paragraph> 
<paragraph id="HB44F1A18396D490F92CC00B46D944119"><enum>(2)</enum><text>diminishing or giving the appearance of diminishing a Member of the House of Representatives’s accountability to constituents by compelling legislators to be accountable to the major contributors who finance their election campaigns;</text></paragraph> 
<paragraph id="H5DBAE8FD0A4C4C5CB732BA7D5B010038"><enum>(3)</enum><text>creating a conflict of interest, perceived or real, by encouraging Members to take money from private interests that are directly affected by Federal legislation;</text></paragraph> 
<paragraph id="HFD2781E3CA444FBBA378C19E74138BA6"><enum>(4)</enum><text>imposing large, unwarranted costs on taxpayers through legislative and regulatory outcomes shaped by unequal access to lawmakers for campaign contributors;</text></paragraph> 
<paragraph id="HC001A898F19B4928B15CE58BDCA0C507"><enum>(5)</enum><text>driving up the cost of election campaigns, making it difficult for qualified candidates without personal fortunes or access to campaign contributions from monied individuals and interest groups to mount competitive House of Representatives election campaigns;</text></paragraph> 
<paragraph id="HAFF183213BFB42E69C8584F190EAB77C"><enum>(6)</enum><text>disadvantaging challengers, because large campaign contributors tend to give their money to incumbent Members, thus causing House of Representatives elections to be less competitive; and</text></paragraph> 
<paragraph id="HD8958BBE422B4061A32FE9F67E606933"><enum>(7)</enum><text>burdening incumbents with a preoccupation with fundraising and thus decreasing the time available to carry out their public responsibilities.</text></paragraph></subsection> 
<subsection id="H58F3EFB993344C77A157F0F0B40607A8"><enum>(b)</enum><header>Enhancement of democracy by providing Clean Money</header><text>Congress finds and declares that providing the option of the replacement of private campaign contributions with clean money financing for all primary, runoff, and general elections to the House of Representatives would enhance American democracy by—</text> 
<paragraph id="H7282DA6E73B84C38B26F3D21A605DB16"><enum>(1)</enum><text>helping to eliminate access to wealth as a determinant of a citizen’s influence within the political process and to restore meaning to the principle of <quote>one person, one vote</quote>;</text></paragraph> 
<paragraph id="HFE17AC2B52ED4F2CBEB238C307E0D81F"><enum>(2)</enum><text>increasing the public’s confidence in the accountability of Members to the constituents who elect them;</text></paragraph> 
<paragraph id="H364313B3D77640D9836293B1FB99B035"><enum>(3)</enum><text>eliminating the potentially inherent conflict of interest caused by the private financing of the election campaigns of public officials, thus restoring public confidence in the fairness of the electoral and legislative processes;</text></paragraph> 
<paragraph id="H4981BB96712749818650237848BCBCC6"><enum>(4)</enum><text>reversing the escalating cost of elections and saving taxpayers billions of dollars that are (or that are perceived to be) currently misspent due to legislative and regulatory agendas skewed by the influence of contributions;</text></paragraph> 
<paragraph id="HB2E5C17095B342A0BA61CAED018DA9BE"><enum>(5)</enum><text>creating a more level playing field for incumbents and challengers, creating genuine opportunities for all Americans to run for the House of Representatives, and encouraging more competitive elections; and</text></paragraph> 
<paragraph id="H518AB74F6AAD4AB9822327E6135FEFA4"><enum>(6)</enum><text>freeing Members from the constant preoccupation with raising money, and allowing them more time to carry out their public responsibilities.</text></paragraph></subsection></section> 
<section id="H5490BEEFD54B4BDC00A37B5EF94E14CF"><enum>102.</enum><header>Eligibility requirements and benefits of Clean Money financing of House election campaigns</header><text display-inline="no-display-inline">The <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/2/431">2 U.S.C. 431 et seq.</external-xref>) is amended by adding at the end the following:</text>

<title id="HBEFEEC47F54B4B559C342584D9EB000"><enum>V</enum><header>Clean Money financing of House election campaigns</header> 
<section id="H57DAA90275E34B869EC5F72C79BFBBDA"><enum>501.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> 
<paragraph id="H2837F6C1CB2E41C3A096EE7710D65F35"><enum>(1)</enum><header>Allowable contribution</header><text>The term <term>allowable contribution</term> means a qualifying contribution or seed money contribution.</text></paragraph> 
<paragraph id="H38C02E99432F4C68BF00281613E2E4E5"><enum>(2)</enum><header>Clean Money</header><text>The term <term>clean money</term> means funds that are made available by the Commission to a clean money candidate under this title.</text></paragraph> 
<paragraph id="HA44DA8DD767543BE95013069D01F21AF"><enum>(3)</enum><header>Clean Money candidate</header><text>The term <term>clean money candidate</term> means a candidate for Member of or Delegate or Resident Commissioner to the Congress who is certified under section 505 as being eligible to receive clean money.</text></paragraph> 
<paragraph id="HB4779555E40A43D79DFCA0089CD9957"><enum>(4)</enum><header>Clean Money qualifying period</header><text>The term <term>clean money qualifying period</term> means the period beginning on the date that is 180 days before the date of the primary election and ending on the date that is 30 days before the date of the general election. In the event of a special election, the clean money qualifying period shall begin on the earlier date of either the date that is 180 days before the date of the special election or on the date of announcement of such special election date if same as within 180 days of the date of the special election. It shall end on the date that is 30 days before the date of the special election.</text></paragraph> 
<paragraph id="H24F4C779C9994A52A7ED059D0034EFDA"><enum>(5)</enum><header>General election period</header><text>The term <term>general election period</term> means, with respect to a candidate, the period beginning on the day after the date of the primary or primary runoff election for the specific office that the candidate is seeking, whichever is later, and ending on the earlier of—</text> 
<subparagraph id="HB83DC6904D7747AFBC82E77EAFC57331"><enum>(A)</enum><text>the date of the general election; or</text></subparagraph> 
<subparagraph id="H64D95068FF554E6A89628170005D2B2E"><enum>(B)</enum><text>the date on which the candidate withdraws from the campaign or otherwise ceases actively to seek election.</text></subparagraph></paragraph> 
<paragraph id="H3CDFB59C7BD843B9B0B5A4A8CF6F6016"><enum>(6)</enum><header>General runoff election period</header><text>The term <term>general runoff election period</term> means, with respect to a candidate, the period beginning on the day following the date of the last general election for the specific office that the candidate is seeking and ending on the date of the runoff election for that office.</text></paragraph> 
<paragraph id="HF62F61FB7465471BA45583FAE0C9D0EB"><enum>(7)</enum><header>House of Representatives Election Fund</header><text>The term <term>House of Representatives Election Fund</term> means the fund established by section 507(a).</text></paragraph> 
<paragraph id="HDB1B2759122B4D93A0605B23FDE8641"><enum>(8)</enum><header>Immediate family</header><text>The term <term>immediate family</term> means—</text> 
<subparagraph id="H52156DD19CE646D18EAF63522CEF34D"><enum>(A)</enum><text>a candidate’s spouse;</text></subparagraph> 
<subparagraph id="HD0F0560C95B84026A07BFE957CC48726"><enum>(B)</enum><text>a child, stepchild, parent, grandparent, brother, half-brother, sister, or half-sister of the candidate or the candidate’s spouse; and</text></subparagraph> 
<subparagraph id="H3C034C66E6594D64A910EB243EF62860"><enum>(C)</enum><text>the spouse of any person described in subparagraph (B).</text></subparagraph></paragraph> 
<paragraph id="H0BAEC03E8BAC4CAAB08269DBC868DD4E"><enum>(9)</enum><header>Major party candidate</header><text>The term <term>major party candidate</term> means a candidate of a political party of which a candidate for Member of or Delegate or Resident Commissioner to the Congress, for President, or for Governor in the preceding 5 years received, as a candidate of that party, 25 percent or more of the total number of popular votes received in the State (or Congressional district, if applicable) by all candidates for the same office.</text></paragraph> 
<paragraph id="H34AA3C93A6DB439ABC98C01E454042E1"><enum>(10)</enum><header>Personal funds</header><text>The term <term>personal funds</term> means an amount that is derived from—</text> 
<subparagraph id="HD8124A88435249F7919E9FAFA0DF8533"><enum>(A)</enum><text>the personal funds of the candidate or a member of the candidate’s immediate family; and</text></subparagraph> 
<subparagraph id="H7B365718623549509E5C002650DA674C"><enum>(B)</enum><text>proceeds of indebtedness incurred by the candidate or a member of the candidate’s immediate family.</text></subparagraph></paragraph> 
<paragraph id="H5940A70479184201AAEB8BDB00687BBA"><enum>(11)</enum><header>Personal use</header> 
<subparagraph id="H8BC4AE96B8494996BEAF58E5111311CE"><enum>(A)</enum><header>In general</header><text>The term <term>personal use</term> means the use of funds to fulfill a commitment, obligation, or expense of a person that would exist irrespective of the candidate’s election campaign or individual’s duties as a holder of Federal office.</text></subparagraph> 
<subparagraph id="HB365DD9B22144C448CD142DC95235390"><enum>(B)</enum><header>Inclusions</header><text>The term <term>personal use</term> includes, but is not limited to—</text> 
<clause id="H3CD3FBAEA9C74A4C9CCEFD75D1054D99"><enum>(i)</enum><text>a home mortgage, rent, or utility payment;</text></clause> 
<clause id="HF1CFD5D0B14E4EDDB3385D4FB974257C"><enum>(ii)</enum><text>a clothing purchase;</text></clause> 
<clause id="H88A753E915CD4A069335D55F05305EF1"><enum>(iii)</enum><text>a noncampaign-related automobile expense;</text></clause> 
<clause id="H98A4A73D75E64AED885C9F7F1BC6F540"><enum>(iv)</enum><text>a country club membership;</text></clause> 
<clause id="HCAEB69E999A74D50B3CB75D3BB97B9A8"><enum>(v)</enum><text>a vacation or other noncampaign-related trip;</text></clause> 
<clause id="HBBF1EA491EA04572B4924DF5CFF33FB8"><enum>(vi)</enum><text>a household food item;</text></clause> 
<clause id="H4EFBDC8D1C944619832800D6AB9B1C49"><enum>(vii)</enum><text>a tuition payment;</text></clause> 
<clause id="H3F6C9BE3FC544C31AFC9D222BADAB1"><enum>(viii)</enum><text>admission to a sporting event, concert, theater, or other form of entertainment not associated with an election campaign; and</text></clause> 
<clause id="H6D1A2DD973884BB3BE7FCC52F1EA87EA"><enum>(ix)</enum><text>dues, fees, and other payments to a health club or recreational facility.</text></clause></subparagraph></paragraph> 
<paragraph id="H922B755BC9C94DB086694C7D40DCE863"><enum>(12)</enum><header>Primary election period</header><text>The term <term>primary election period</term> means the period beginning on the date that is 90 days before the date of the primary election and ending on the date of the primary election. In the event of a special primary election, if applicable, the term <term>primary election period</term> means the period beginning on the date that is the longer of 90 days before the date of such special primary election, or the date of establishment by the appropriate election authority of the special primary election date and ending on the date of the special primary election.</text></paragraph> 
<paragraph id="HDDED302A30B7447EA0EEA73B803D98C0"><enum>(13)</enum><header>Primary runoff election period</header><text>The term <term>primary runoff election period</term> means, with respect to a candidate, the period beginning on the day following the date of the last primary election for the specific office that the candidate is seeking and ending on the date of the runoff election for that office.</text></paragraph> 
<paragraph id="HB59D2E8967724EE5B87E2CBAE106E1A"><enum>(14)</enum><header>Private money candidate</header><text>The term <term>private money candidate</term> means a candidate for Member of or Delegate or Resident Commissioner to the Congress other than a clean money candidate.</text></paragraph> 
<paragraph id="H03E8E762E77A49A29EB55FC6B293EDC9"><enum>(15)</enum><header>Qualifying contribution</header><text>The term <term>qualifying contribution</term> means a contribution that—</text> 
<subparagraph id="H0AB07B7BD1824876A6884BA08E6928C6"><enum>(A)</enum><text>is in the amount of $5 exactly;</text></subparagraph> 
<subparagraph id="H30888FF8043A44C59D4D6DFAF0D80694"><enum>(B)</enum><text>is made by an individual who is a resident of the candidate’s State and is otherwise authorized to make a contribution under this Act;</text></subparagraph> 
<subparagraph id="HE9400238A471454FB09B66A7A91F0875"><enum>(C)</enum><text>is made during the clean money qualifying period; and</text></subparagraph> 
<subparagraph id="H400678F670C44018BAFF1818551D7C11"><enum>(D)</enum><text>meets the requirements of section 502(a)(2)(D).</text></subparagraph></paragraph>

<section id="H2F15285D0689466FA000DA894EE9D0F0"><enum>502.</enum><header>Eligibility for Clean Money</header> 
<subsection id="H15983D3210884962BAA981565B4BDC1E"><enum>(a)</enum><header>Primary election period and primary runoff election period</header> 
<paragraph id="HAF20D57043E8416385A38DE385ADB2C6"><enum>(1)</enum><header>In general</header><text>A candidate qualifies as a clean money candidate during the primary election period and primary runoff election period if the candidate files with the Commission a declaration, signed by the candidate and the treasurer of the candidate’s principal campaign committee, that the candidate—</text> 
<subparagraph id="H32747011305249AC00A4C92E4C99DB25"><enum>(A)</enum><text>has complied and will comply with all of the requirements of this title;</text></subparagraph> 
<subparagraph id="HBA792EDEAE16428E00C05109CCC8EBC"><enum>(B)</enum><text>will not run in the general election as a private money candidate; and</text></subparagraph> 
<subparagraph id="HDE34E591C05E45D181BC6FCCE8443448"><enum>(C)</enum><text>meets the qualifying contribution requirement of paragraph (2).</text></subparagraph></paragraph> 
<paragraph id="H399B118666FA4EF0A73549F2D63F1032"><enum>(2)</enum><header>Qualifying contribution requirement</header> 
<subparagraph id="HB4338CFEA5E743CEB7A511E27B63408"><enum>(A)</enum><header>Major party candidates and certain independent candidates</header><text>The requirement of this paragraph is met if, during the clean money qualifying period, a major party candidate (or an independent candidate who meets the minimum vote percentage required for a major party candidate under section 501(9)) receives 1,500 qualifying contributions.</text></subparagraph> 
<subparagraph id="H0639FD9458DB40CB9D545CEBBED372B8"><enum>(B)</enum><header>Other candidates</header><text>The requirement of this paragraph is met if, during the clean money qualifying period, a candidate who is not described in subparagraph (A) receives a number of qualifying contributions that is at least 150 percent of the number of qualifying contributions that a candidate described in subparagraph (A) in the same election is required to receive under subparagraph (A).</text></subparagraph> 
<subparagraph id="H8515C084C2FE42FD870086FE578D8E"><enum>(C)</enum><header>Receipt of qualifying contribution</header><text>A qualifying contribution shall—</text> 
<clause id="H8EAD6DA038D649CDA6FE0068E09E22"><enum>(i)</enum><text>be accompanied by the contributor’s name and home address;</text></clause> 
<clause id="H5F06500D187E4C43BFABAB00ABCEE9C8"><enum>(ii)</enum><text>be accompanied by a signed statement that the contributor understands the purpose of the qualifying contribution;</text></clause> 
<clause id="HB0C68B98B6B64261AB557133BDBD1E82"><enum>(iii)</enum><text>be made by a personal check or money order payable to the House of Representatives Election Fund or by cash; and</text></clause> 
<clause id="H88E1EB33A61F46F6803D48D4A282B045"><enum>(iv)</enum><text>be acknowledged by a receipt that is sent to the contributor with a copy kept by the candidate for the Commission and a copy kept by the candidate for the election authorities in the candidate’s State.</text></clause></subparagraph> 
<subparagraph id="HBAC964858E7F467AA600AD10A7BB9B79"><enum>(D)</enum><header>Deposit of qualifying contributions in House of Representatives Election Fund</header> 
<clause id="H341B3833050F4F9492F964C6F02DE24"><enum>(i)</enum><header>In general</header><text>Not later than the date that is 1 day after the date on which the candidate is certified under section 505, a candidate shall remit all qualifying contributions to the Commission for deposit in the House of Representatives Election Fund.</text></clause> 
<clause id="H29E88A24BCA340B798F4F907BC6B86B"><enum>(ii)</enum><header>Candidates that are not certified</header><text>Not later than the last day of the clean money qualifying period, a candidate who has received qualifying contributions and is not certified under section 505 shall remit all qualifying contributions to the Commission for deposit in the House of Representatives Election Fund.</text></clause></subparagraph></paragraph> 
<paragraph id="HE9A9C25784C74BC597DAC7C38BC95E13"><enum>(3)</enum><header>Time to file declaration</header><text>A declaration under paragraph (1) shall be filed by a candidate not later than the date that is 30 days before the date of the primary election. With respect to any special primary election, a declaration under paragraph (1) shall be filed by a candidate not later than the date that is 30 days before the special primary election.</text></paragraph></subsection> 
<subsection id="HC1593343D58844A7B1BB961B93597773"><enum>(b)</enum><header>General election period</header> 
<paragraph id="HBB797AB87C7041C09FFB8708FCF9B41"><enum>(1)</enum><header>In general</header><text>A candidate qualifies as a clean money candidate during the general election period if—</text> 
<subparagraph id="H89CA5AD7601D4659B471B87F6EDFB243"><enum>(A)</enum> 
<clause display-inline="yes-display-inline" id="H56527246861649FC835513637DC09008"><enum>(i)</enum><text>the candidate qualified as a clean money candidate during the primary election period (and primary runoff election period, if applicable); or</text></clause> 
<clause indent="up1" id="HF7AC321065494DE39CBAF10884395D0"><enum>(ii)</enum><text>the candidate files with the Commission a declaration, signed by the candidate and the treasurer of the candidate’s principal committee, that the candidate—</text> 
<subclause id="H0ADAC99F8A8E4BE090AC5ECEF1CEC8AD"><enum>(I)</enum><text>has complied and will comply with all the requirements of this title; and</text></subclause> 
<subclause id="H7F4382E8FDB540E9B900EA94C834FD3D"><enum>(II)</enum><text>meets the qualifying contribution requirement of subsection (a)(2);</text></subclause></clause></subparagraph> 
<subparagraph id="H0C3B82564E504E848D07B255CC00CE70"><enum>(B)</enum><text>the candidate files with the Commission a written agreement between the candidate and the candidate’s political party in which the political party agrees not to make any expenditures in connection with the general election of the candidate in excess of the limit in section 315(d)(3)(C); and</text></subparagraph> 
<subparagraph id="HF6560850B10D47B8A0ABADEB4C6056EE"><enum>(C)</enum><text>the candidate’s party nominated the candidate to be placed on the ballot for the general election or the candidate qualified to be placed on the ballot as an independent candidate, and the candidate is qualified under State law to be on the ballot.</text></subparagraph></paragraph> 
<paragraph id="H78E6814A228C4FCDA1BCE2BFD9CACDC4"><enum>(2)</enum><header>Time to file declaration or statement</header><text>A declaration or statement required to be filed under paragraph (1) shall be filed by a candidate not later than the date that is 30 days before the date of the general election. With respect to any special general election, a declaration or statement required to be filed under paragraph (1) shall be filed by a candidate not later than the date that is 30 days before the date of the special general election.</text></paragraph></subsection> 
<subsection id="HA15DD836D43B46C6AD00C8D52552AA06"><enum>(c)</enum><header>General runoff election period</header><text>A candidate qualifies as a clean money candidate during the general runoff election period if the candidate qualified as a clean money candidate during the general election period.</text></subsection></section> 
<section id="HF9B6C0A9B04F48DEB769EDC67F69AA30"><enum>503.</enum><header>Requirements applicable to Clean Money candidates</header> 
<subsection id="H774CE0CB7DF34FCCB46DC5968EA0DAE"><enum>(a)</enum><header>Contributions and expenditures</header> 
<paragraph id="H4410E84C178C4C4280AF16EE8E1B1FF7"><enum>(1)</enum><header>Prohibition of private contributions</header><text>Except as otherwise provided in this title, during the election cycle of a clean money candidate, the candidate shall not accept contributions other than clean money from any source.</text></paragraph> 
<paragraph id="HB73BFA00C848417DB000CC04425CD900"><enum>(2)</enum><header>Prohibition of expenditures from private sources</header><text>Except as otherwise provided in this title, during the election cycle of a clean money candidate, the candidate shall not make expenditures from any amounts other than clean money amounts.</text></paragraph></subsection> 
<subsection id="H7EC6AA06A9A14CCD8D61C68391A08B57"><enum>(b)</enum><header>Use of personal funds</header> 
<paragraph id="H6A8AE88B59CC49D6BD6B221DF56B4886"><enum>(1)</enum><header>In general</header><text>A clean money candidate shall not use personal funds to make an expenditure except as provided in paragraph (2).</text></paragraph> 
<paragraph id="H12EC2421D4BE44FF94D86ED65417C83C"><enum>(2)</enum><header>Exceptions</header><text>A seed money contribution or qualifying contribution from the candidate or a member of the candidate’s immediate family shall not be considered to be use of personal funds.</text></paragraph></subsection></section> 
<section id="H929F87C5333B4A38A0D5E4BC92D312D"><enum>504.</enum><header>Seed money</header> 
<subsection id="H448251FF1FE74D26BAA736C37BFD77FE"><enum>(a)</enum><header>Seed money limit</header><text>A clean money candidate may accept seed money contributions in an aggregate amount not exceeding $35,000.</text></subsection> 
<subsection id="H2411107CA66542DCB46D6600F06EF7A6"><enum>(b)</enum><header>Contribution limit</header><text>Except as provided in section 502(a)(2), a clean money candidate shall not accept a contribution from any person except a seed money contribution (as defined in section 501).</text></subsection> 
<subsection id="H1C77EEA9726149B3A86B976871C8B112"><enum>(c)</enum><header>Records</header><text>A clean money candidate shall maintain a record of the contributor’s name, street address, and amount of the contribution.</text></subsection> 
<subsection id="H4968BB5360074A2B993F8C7F2E3C3866"><enum>(d)</enum><header>Use of seed money</header> 
<paragraph id="H1984A6EA78F1487BA589A1613EDB023B"><enum>(1)</enum><header>In general</header><text>A clean money candidate may expend seed money for any election campaign-related costs, including costs to open an office, fund a grassroots campaign, or hold community meetings.</text></paragraph> 
<paragraph id="H85094B5BC87D4980B0873E8D86443297"><enum>(2)</enum><header>Prohibited uses</header><text>A clean money candidate shall not expend seed money for—</text> 
<subparagraph id="HEB33633243C04E41B647A0B45D9E6B08"><enum>(A)</enum><text>a television or radio broadcast; or</text></subparagraph> 
<subparagraph id="H00519413A80640F59BCC3E093FBE6287"><enum>(B)</enum><text>personal use.</text></subparagraph></paragraph></subsection> 
<subsection id="H1EC228CFDD2F4371AA8E96D9F194BCD4"><enum>(e)</enum><header>Report</header><text>Unless a seed money contribution or expenditure made with a seed money contribution has been reported previously under section 304, a clean money candidate shall file with the Commission a report disclosing all seed money contributions and expenditures not later than 48 hours after—</text> 
<paragraph id="HFFD02A60840D466C82DE08D159B96825"><enum>(1)</enum><text>the earliest date on which the Commission makes funds available to the candidate for an election period under paragraph (1) or (2) of section 506(b); or</text></paragraph> 
<paragraph id="HE5EFA61EBE45484A8F32ACFF211266"><enum>(2)</enum><text>the end of the clean money qualifying period,</text></paragraph><continuation-text continuation-text-level="subsection">whichever occurs first.</continuation-text></subsection> 
<subsection id="H72FC827A1470479EB88C757CA12851E2"><enum>(f)</enum><header>Time to accept seed money contributions</header><text>A clean money candidate may accept seed money contributions for an election from the day after the date of the previous general election for the office to which the candidate is seeking election through the earliest date on which the Commission makes funds available to the candidate for an election period under paragraph (1) or (2) of section 506(b).</text></subsection> 
<subsection id="H39B119E56466462F8D4C678EA4FD00F"><enum>(g)</enum><header>Deposit of unspent seed money contributions</header><text>A clean money candidate shall remit any unspent seed money to the Commission, for deposit in the House of Representatives Election Fund, not later than the earliest date on which the Commission makes funds available to the candidate for an election period under paragraph (1) or (2) of section 506(b).</text></subsection> 
<subsection id="H53343AEDE5DC41CE9608B055C93C1EF"><enum>(h)</enum><header>Not considered an expenditure</header><text>An expenditure made with seed money shall not be treated as an expenditure for purposes of section 506(f)(2).</text></subsection></section> 
<section id="H193AF7D494494594BEBF5F3C55FBFA13"><enum>505.</enum><header>Certification by Commission</header> 
<subsection id="H962D0AC97F19414FBDBBEADF2F277FEA"><enum>(a)</enum><header>In general</header><text>Not later than 5 days after a candidate files a declaration under section 502, the Commission shall—</text> 
<paragraph id="H3DDD67E99F624357A335852DB63F1E3F"><enum>(1)</enum><text>determine whether the candidate meets the eligibility requirements of section 502; and</text></paragraph> 
<paragraph id="H756658AD9CE84A2D90D42B08C1476447"><enum>(2)</enum><text>certify whether or not the candidate is a clean money candidate.</text></paragraph></subsection> 
<subsection id="HB544720ACFD4425E95B4BAC929EB374"><enum>(b)</enum><header>Revocation of certification</header><text>The Commission may revoke a certification under subsection (a) if a candidate fails to comply with this title.</text></subsection> 
<subsection id="H2B7B3E9560A84E78AD33D345BCF6FB9F"><enum>(c)</enum><header>Repayment of benefits</header><text>If certification is revoked under subsection (b), the candidate shall repay to the House of Representatives Election Fund an amount equal to the value of benefits received under this title.</text></subsection></section> 
<section id="H87A31A481BE6407CB18B11A3E75EDE19"><enum>506.</enum><header>Benefits for Clean Money candidates</header> 
<subsection id="HA1FE6FCE5C0E4FD18940E89150E20027"><enum>(a)</enum><header>In general</header><text>A clean money candidate shall be entitled to—</text> 
<paragraph id="HCF7269BEA9134A85A9AC35CA97BB8500"><enum>(1)</enum><text>a clean money amount for each election period to make or obligate to make expenditures during the election period for which the clean money is provided, as provided in subsection (c);</text></paragraph> 
<paragraph id="HAE0742DE2CA3469DA10064695DF87F1B"><enum>(2)</enum><text>media benefits under section 315 of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/315">47 U.S.C. 315</external-xref>); and</text></paragraph> 
<paragraph id="HE0E1195B38A14B43A6CD84514CAEDD0"><enum>(3)</enum><text>an aggregate amount of increase in the clean money amount in response to certain independent expenditures and expenditures of a private money candidate under subsection (d) that, in the aggregate, are in excess of 125 percent of the clean money amount of the clean money candidate.</text></paragraph></subsection> 
<subsection id="H94B53AAC2BB446CD88441D00C6C675F"><enum>(b)</enum><header>Payment of Clean Money amount</header> 
<paragraph id="H6C48522E75064C1B99BFD3A1C500EE2C"><enum>(1)</enum><header>Primary election</header><text>The Commission shall make funds available to a clean money candidate on the later of—</text> 
<subparagraph id="HF8F2C4FA59DD489997266311BA669BD5"><enum>(A)</enum><text>the date on which the candidate is certified as a clean money candidate under section 505; or</text></subparagraph> 
<subparagraph id="H38F97065BF214D1D8DDC8BCCA7B19986"><enum>(B)</enum><text>the date on which the primary election period begins.</text></subparagraph></paragraph> 
<paragraph id="HA1C3B9B584C94D8800D3223E38030484"><enum>(2)</enum><header>General election</header><text>The Commission shall make funds available to a clean money candidate not later than 48 hours after—</text> 
<subparagraph id="H53088E8E72EC49A69000B237124E3888"><enum>(A)</enum><text>certification of the primary election or primary runoff election result; or</text></subparagraph> 
<subparagraph id="H16F4777E2DFF4C4E8464B748E4F07D76"><enum>(B)</enum><text>the date on which the candidate is certified as a clean money candidate under section 505 for the general election,</text></subparagraph><continuation-text continuation-text-level="paragraph">whichever occurs first.</continuation-text></paragraph> 
<paragraph id="H260EEBABD88D4D3E9CBB14D4EC6E221"><enum>(3)</enum><header>Runoff election</header><text>The Commission shall make funds available to a clean money candidate not later than 48 hours after the certification of the primary or general election result (as applicable).</text></paragraph></subsection> 
<subsection id="H92734A37219141C1ABBD43E6DBBEABC"><enum>(c)</enum><header>Money amounts</header> 
<paragraph id="H707929D975334717B7A666F109BF136B"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the clean money amount paid to a clean money candidate with respect to an election shall be equal to the applicable percentage of 80 percent of the base amount for the election cycle involved, except that in no event may the amount determined under this subsection for a clean money candidate for an election cycle be less than the amount determined under this subsection for the candidate for the previous election cycle.</text></paragraph> 
<paragraph id="H794E6DB07C044477AC15F0D3ABA7BB62"><enum>(2)</enum><header>Reduction for uncontested elections</header><text>If a clean money candidate has no opposition in an election for which a payment is made under this section, the clean money amount paid shall be 40 percent of the amount otherwise determined under paragraph (1).</text></paragraph> 
<paragraph id="HCF2894261AAB4ADEB4D05205D39C8B20"><enum>(3)</enum><header>Definitions</header> 
<subparagraph id="H2EF9FCC29CD2408BAB937F8D5406D070"><enum>(A)</enum><header>Applicable percentage</header><text>In this subsection, the <quote>applicable percentage</quote> is as follows:</text> 
<clause id="H6CDD8548BA93425288388142266547B"><enum>(i)</enum><text>25 percent, in the case of a candidate in a primary election who is not a major party candidate.</text></clause> 
<clause id="H2979881E9E3B4E7495E3D2153F073229"><enum>(ii)</enum><text>40 percent, in the case of a major party candidate in a primary election.</text></clause> 
<clause id="HC37E7FBB217B4DB79500EF4C3CA5FC93"><enum>(iii)</enum><text>60 percent, in the case of any candidate in a general election.</text></clause></subparagraph> 
<subparagraph id="HD483E01EE1964C57A582DC3E7458EDA2"><enum>(B)</enum><header>Base amount</header><text>In this subsection, the term <term>base amount</term> means (with respect to an election cycle) the national average of all amounts expended by winning candidates during the 3 most recent general elections for Member of, or Delegate or Resident Commissioner to, the Congress preceding the election cycle involved.</text></subparagraph></paragraph></subsection> 
<subsection id="H29B7D6A8243E4504BFFFD600E8A63D97"><enum>(d)</enum><header>Matching funds in response to independent expenditures and expenditures of private money candidates</header> 
<paragraph id="H5F3C6156BA174EBA8D5DF35B3F7D98CA"><enum>(1)</enum><header>In general</header><text>If the Commission—</text> 
<subparagraph id="H5D98A10DAD544D4CAD18AD1740C70960"><enum>(A)</enum><text>receives notification under—</text> 
<clause id="HB9D903A9E50F4A138580467493EB3602"><enum>(i)</enum><text>subparagraphs (A) or (B) of section 304(c)(2) that a person has made or obligated to make an independent expenditure in an aggregate amount of $1,000 or more in an election period or that a person has made or obligated to make an independent expenditure in an aggregate amount of $500 or more during the 20 days preceding the date of an election in support of another candidate or against a clean money candidate; or</text></clause> 
<clause id="H2A7C9598B2714C06A658F5372031419D"><enum>(ii)</enum><text>section 304(i)(1) that a private money candidate has made or obligated to make expenditures in an aggregate amount in excess of 100 percent of the amount of clean money provided to a clean money candidate who is an opponent of the private money candidate in the same election; and</text></clause></subparagraph> 
<subparagraph id="H3CB008006C78462598BC8E9DF5AC2135"><enum>(B)</enum><text>determines that the aggregate amount of expenditures reported under subparagraph (A) in an election period is in excess of 125 percent of the amount of clean money provided to a clean money candidate who is an opponent of the private money candidate in the same election or against whom the independent expenditure is made,</text></subparagraph><continuation-text continuation-text-level="paragraph">the Commission shall make available to the clean money candidate, not later than 24 hours after receiving a notification under subparagraph (A), an aggregate amount of increase in clean money in an amount equal to the aggregate amount of expenditures that is in excess of 125 percent of the amount of clean money provided to the clean money candidate as determined under subparagraph (B).</continuation-text></paragraph> 
<paragraph id="HA757488DD82144B5A24BD32968AB7335"><enum>(2)</enum><header>Clean Money candidates opposed by more than 1 private money candidate</header><text>For purposes of paragraph (1), if a clean money candidate is opposed by more than 1 private money candidate in the same election, the Commission shall take into account only the amount of expenditures of the private money candidate that expends, in the aggregate, the greatest amount (as determined each time notification is received under section 304(i)(1)).</text></paragraph> 
<paragraph id="HEBF3E44A63EB49AB891CDF0029BDD17C"><enum>(3)</enum><header>Clean Money candidates opposed by Clean Money candidates</header><text>If a clean money candidate is opposed by a clean money candidate, the increase in clean money amounts under paragraph (1) shall be made available to the clean money candidate if independent expenditures are made against the clean money candidate or in behalf of the opposing clean money candidate in the same manner as the increase would be made available for a clean money candidate who is opposed by a private money candidate.</text></paragraph></subsection> 
<subsection id="HC040730B51724C8A91963DE04EF98D00"><enum>(e)</enum><header>Limits on matching funds</header><text>The aggregate amount of clean money that a clean money candidate receives to match independent expenditures and the expenditures of private money candidates under subsection (d) shall not exceed 200 percent of the clean money amount that the clean money candidate receives under subsection (c).</text></subsection> 
<subsection id="HAB1E1AA5ED7042A60067ACD2217B0740"><enum>(f)</enum><header>Expenditures made with Clean Money amounts</header> 
<paragraph id="HB241BBAAC8FB485A978E56B154907B1B"><enum>(1)</enum><header>In general</header><text>The clean money amount received by a clean money candidate shall be used only for the purpose of making or obligating to make expenditures during the election period for which the clean money is provided.</text></paragraph> 
<paragraph id="HB05774F4B42A43E79568D6282B1F09E9"><enum>(2)</enum><header>Expenditures in excess of Clean Money amount</header><text>A clean money candidate shall not make expenditures or incur obligations in excess of the clean money amount.</text></paragraph> 
<paragraph id="HA43D0F1B67FE471BA754AF22193E7622"><enum>(3)</enum><header>Prohibited uses</header><text>The clean money amount received by a clean money candidate shall not be—</text> 
<subparagraph id="H5A171D031B2D48D997E36C004F43101F"><enum>(A)</enum><text>converted to a personal use; or</text></subparagraph> 
<subparagraph id="H1FE91B1004DA4A20A85E025625D0EFEA"><enum>(B)</enum><text>used in violation of law.</text></subparagraph></paragraph> 
<paragraph id="HAC63AA56177F4C5CA415E5AFB42176F4"><enum>(4)</enum><header>Repayment; civil penalties</header> 
<subparagraph id="H61B8DECB25DC4B1398CF00E529001FE5"><enum>(A)</enum><text>If the Commission determines that any benefit made available to a clean money candidate under this title was not used as provided for in this title, or that a clean money candidate has violated any of the spending limits or dates for remission of funds contained in this Act, the Commission shall so notify the candidate and the candidate shall pay to the House of Representatives’ Election Fund an amount equal to the amount of benefits so used, or the amount spent in excess of the limits or the amount not timely remitted, as appropriate.</text></subparagraph> 
<subparagraph id="H4F02A7B28B934FFD9E3B772DF5F774B8"><enum>(B)</enum><text>Any action by the Commission in accordance with this section shall not preclude enforcement proceedings by the Commission in accordance with section 309(a), including a referral by the Commission to the Attorney General in the case of an apparent knowing and willful violation of this title.</text></subparagraph></paragraph></subsection> 
<subsection id="H4D17AE5C00FC4793B001FE9FE9E500D5"><enum>(g)</enum><header>Remitting of Clean Money amounts</header><text>Not later than the date that is 14 days after the last day of the applicable election period, a clean money candidate shall remit any unspent clean money amount to the Commission for deposit in the House of Representatives Election Fund.</text></subsection></section> 
<section id="H1B78DE8FB6C946440092D8569D21D618"><enum>507.</enum><header>Administration of Clean Money</header> 
<subsection id="HEFA0AA7021CB46088FE48CDCD3443ED7"><enum>(a)</enum><header>House of Representatives Election Fund</header> 
<paragraph id="H1E3D8DE1B8934E30B3D7B9FB9D001400"><enum>(1)</enum><header>Establishment</header><text>There is established in the Treasury a fund to be known as the <quote>House of Representatives Election Fund</quote>.</text></paragraph> 
<paragraph id="H53B6D33F17F74203BBEB924ED8EE7F7"><enum>(2)</enum><header>Deposits</header><text>The Commission shall deposit unspent seed money contributions, qualifying contributions, penalty amounts received under this title, and amounts appropriated for clean money financing in the House of Representatives Election Fund.</text></paragraph> 
<paragraph id="HD3CFBC3FFC1C409E8D8142C9869B6946"><enum>(3)</enum><header>Funds</header><text>The Commission shall withdraw the clean money amount for a clean money candidate from the House of Representatives Election Fund.</text></paragraph></subsection> 
<subsection id="H3A00AF7EE779493B8B63941D5EE58925"><enum>(b)</enum><header>Regulations</header><text>The Commission shall promulgate regulations to—</text> 
<paragraph id="H28E5C0ED7E3848A7AF613E3BDF72E5"><enum>(1)</enum><text>effectively and efficiently monitor and enforce the limits on use of private money by clean money candidates;</text></paragraph> 
<paragraph id="H3B8F3DECBBA3447BAD85D1A2001DDB7"><enum>(2)</enum><text>effectively and efficiently monitor use of publicly financed amounts under this title; and</text></paragraph> 
<paragraph id="H5A32DCDCD89B40429300E493A4546EE"><enum>(3)</enum><text>enable clean money candidates to monitor expenditures and comply with the requirements of this title.</text></paragraph></subsection></section> 
<section id="HE3FFF649643748AAB60009EC5072C5D"><enum>508.</enum><header>Expenditures made from funds other than Clean Money</header><text display-inline="no-display-inline">If a clean money candidate makes an expenditure using funds other than funds provided under this title, the Commission shall assess a civil penalty against the candidate in an amount that is not more than 10 times the amount of the expenditure.</text></section> 
<section id="H5163846E87F8470C9E74FEF75FD506"><enum>509.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the House of Representatives Election Fund such sums as are necessary to carry out this title.</text></section></title><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H6D357940D6FE4E65A33F1345716B84F4"><enum>103.</enum><header>Reporting requirements for expenditures of private money candidates</header><text display-inline="no-display-inline">Section 304 of the <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/2/434">2 U.S.C. 434</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Federal Election Campaign Act of 1971" id="H76F2A6BFD1BB47EEA9721942DB2160D7"> 
<subsection id="HDA8A45CBC705406481B844ECB66300B3"><enum>(i)</enum><header>Private money candidates</header> 
<paragraph id="H61FC40A611B24F06AA65EE4B6E180704"><enum>(1)</enum><header>Expenditures in excess of Clean Money amounts</header><text>Not later than 48 hours after making or obligating to make an expenditure, a private money candidate (as defined in section 501) that makes or obligates to make expenditures, in an aggregate amount in excess of 100 percent of the amount of clean money provided to a clean money candidate (as defined in section 501), during an election period (as defined by section 501) who is an opponent of the clean money candidate shall file with the Commission a report stating the amount of each expenditure (in increments of an aggregate amount of $100) made or obligated to be made.</text></paragraph> 
<paragraph id="HB330FCF2CCFC4A5693CB6B2404703CA1"><enum>(2)</enum><header>Place of filing; notification</header> 
<subparagraph id="HACE46AFBC4B249F587C69758A3D969C"><enum>(A)</enum><header>Place of filing</header><text>A report under this subsection shall be filed with the Commission.</text></subparagraph> 
<subparagraph id="H14206DD0B44F47228C3255E88CF6C8EB"><enum>(B)</enum><header>Notification of Clean Money candidates</header><text>Not later than 24 hours after receipt of a report under this subsection, the Commission shall notify each clean money candidate seeking nomination for election to, or election to, the office in question, of the receipt of the report.</text></subparagraph></paragraph> 
<paragraph id="H5FA373142B9640E8BA031130E506FE9"><enum>(3)</enum><header>Determinations by the Commission</header> 
<subparagraph id="H9BB97BCD13C343E0B11E56111744D763"><enum>(A)</enum><header>In general</header><text>The Commission may, on a request of a candidate or on its own initiative, make a determination that a private money candidate has made, or has obligated to make, expenditures in excess of the applicable amount in paragraph (1).</text></subparagraph> 
<subparagraph id="HE802DE1279FE4853B63DCA128180F524"><enum>(B)</enum><header>Notification</header><text>In the case of such a determination, the Commission shall notify each clean money candidate seeking nomination for election to, or election to, the office in question, of the making of the determination not later than 24 hours after making the determination.</text></subparagraph> 
<subparagraph id="H691354ED729342DFAC5B43AE2F23E61D"><enum>(C)</enum><header>Time to comply with request for determination</header><text>A determination made at the request of a candidate shall be made not later than 48 hours after the date of the request.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HDE1ACF67E4D54702A7F67B44B68F00C8"><enum>104.</enum><header>Transition rule for current election cycle</header> 
<subsection id="HA52C050EF2AE4D5B9DB415388F193E39"><enum>(a)</enum><header>In general</header><text>During the election cycle in effect on the date of enactment of this Act, a candidate may be certified as a clean money candidate (as defined in section 501 of the <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name>, as added by section 102), notwithstanding the acceptance of contributions or making of expenditures from private funds before the date of enactment that would, absent this section, disqualify the candidate as a clean money candidate.</text></subsection> 
<subsection id="HF4A7F7BB5FE14D07B64500E9566DCA7E"><enum>(b)</enum><header>Private funds</header><text>A candidate may be certified as a clean money candidate only if any private funds accepted and not expended before the date of enactment of this Act are—</text> 
<paragraph id="H91F3D8E11CBC4E7CA9EDACC306A72506"><enum>(1)</enum><text>returned to the contributor; or</text></paragraph> 
<paragraph id="H7F9E6AF5B5744F33BAB99881AD17BE2F"><enum>(2)</enum><text>submitted to the Federal Election Commission for deposit in the House of Representatives Election Fund (as defined in section 501 of the <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name>, as added by section 102).</text></paragraph></subsection></section></title> 
<title id="H4600AB037BF84E1589E2074BEC361077"><enum>II</enum><header>Independent expenditures; coordinated political party expenditures</header> 
<section id="HEB9AB4C2AB544CC5849E347086D257CA"><enum>201.</enum><header>Reporting requirements for independent expenditures</header><text display-inline="no-display-inline">Section 304(c) of the <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/2/434">2 U.S.C. 434(c)</external-xref>) is amended—</text>

<clause id="H2CD4160B433448C3A28CE000F5C1B86D"><enum>(i)</enum><header>In general</header><text>Not later than 48 hours after making an independent expenditure, more than 20 days before the date of an election, in support of an opponent of or in opposition to a clean money candidate (as defined in section 501), a person that makes independent expenditures in an aggregate amount in excess of $1,000 during an election period (as defined in section 501) shall file with the Commission a statement containing the information described in clause (ii).</text></clause> 
<clause id="H323B3A3237C74E3F98178F75636CEBC4"><enum>(ii)</enum><header>Contents of statement</header><text>A statement under subparagraph (A) shall include a certification, under penalty of perjury, that contains the information required by subsection (b)(6)(B)(iii).</text></clause> 
<clause id="H586B223F1D704144BAA2A288C3F49C2B"><enum>(iii)</enum><header>Additional statements</header><text>An additional statement shall be filed for each aggregate of independent expenditures that exceeds $1,000.</text></clause></subparagraph> 
<subparagraph id="HFABA69C57C1F4CBDA737569609731F1F"><enum>(B)</enum><header>Independent expenditures during the 20 days preceding an election</header><text>Not later than 24 hours after making or obligating to make an independent expenditure in support of an opponent of or in opposition to a clean money candidate in an aggregate amount in excess of $500, during the 20 days preceding the date of an election, a person that makes or obligates to make the independent expenditure shall file with the Commission a statement stating the amount of each independent expenditure made or obligated to be made.</text></subparagraph> 
<subparagraph id="H28DC6D6C2710465BB700C3807C79D3C1"><enum>(C)</enum><header>Place of filing; notification</header> 
<clause id="H728F581B28C445CE00469DA9A4D56008"><enum>(i)</enum><header>Place of filing</header><text>A report or statement under this paragraph shall be filed with the Commission.</text></clause> 
<clause id="HCB6C129FC7EC43499FD97E908039A2F6"><enum>(ii)</enum><header>Notification of Clean Money candidates</header><text>Not later than 24 hours, but excluding the time from 5:00 p.m. Friday through and until 9:00 a.m. the following Monday, and legal holidays after receipt of a statement under this paragraph, the Commission shall notify each clean money candidate seeking nomination for election to, or election to, the office in question of the receipt of a statement.</text></clause></subparagraph> 
<subparagraph id="H712077B20F8546638731C962E51376B4"><enum>(D)</enum><header>Determination by the Commission</header> 
<clause id="H5FDB350437CA474288209F05F9CBEACE"><enum>(i)</enum><header>In general</header><text>The Commission may, on request of a candidate or on its own initiative, make a determination that a person has made or obligated to make independent expenditures with respect to a candidate that in the aggregate exceed the applicable amount under subparagraph (A).</text></clause> 
<clause id="H99BC74F697B44238AA19FC4B4DD6D7E4"><enum>(ii)</enum><header>Notification</header><text>Not later than 24 hours after making a determination under clause (i), the Commission shall notify each clean money candidate in the election of the making of the determination.</text></clause> 
<clause id="HF2D914B07DE0497388CC5BE4DB6B2B4D"><enum>(iii)</enum><header>Time to comply with request for determination</header><text>A determination made at the request of a candidate shall be made not later than 48 hours after the date of the request.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HD160123A9F7247188451173E1ED9B6A2"><enum>202.</enum><header>Limit on expenditures by political party committees</header><text display-inline="no-display-inline">Section 315(d)(3) of the <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/2/441a">2 U.S.C. 441a(d)(3)</external-xref>) is amended—</text> 
<paragraph id="H4B6E1CD6B93444F98D69AB6F81A845A5"><enum>(1)</enum><text>in subparagraph (A)—</text>

<section id="HC1CB4D9ADB574F53B400F941341FDF97"><enum>203.</enum><header>Treatment of coordinated expenditures as contributions</header> 
<subsection id="HB2DC65FD5FF448E7BC25F9D814BEAB00"><enum>(a)</enum><header>In general</header><text>Section 301(8) of the <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/2/431">2 U.S.C. 431(8)</external-xref>) is amended—</text> 
<paragraph id="HB4178366829041D79382B3B17848C522"><enum>(1)</enum><text>in subparagraph (A)—</text>

<paragraph id="H57EDC4BD22934275A8616D9894A9D86C"><enum>(2)</enum><text>by adding at the end the following:</text>

<subparagraph id="H96EFFD9B27154B95ACC170E6F004FCA"><enum>(C)</enum><text>For the purposes of subparagraph (A)(iii), the term <term>payment made in coordination with a candidate</term> includes—</text> 
<clause id="H0795305315F048BA9EBAB1C75089C9B6"><enum>(i)</enum><text>a payment made by a person in cooperation, consultation, or concert with, at the request or suggestion of, or pursuant to any general or particular understanding with a candidate, the candidate’s authorized committee, or an agent acting on behalf of a candidate or authorized committee;</text></clause> 
<clause id="H85165D025F5B471EA9ABCDE5B0E2EBCC"><enum>(ii)</enum><text>a payment made by a person for the dissemination, distribution, or republication, in whole or in part, of any broadcast or any written, graphic, or other form of campaign material prepared by a candidate, a candidate’s authorized committee, or an agent of a candidate or authorized committee (not including a communication described in paragraph (9)(B)(i) or a communication that expressly advocates the candidate’s defeat);</text></clause> 
<clause id="H098BE5268016407EB4190795C438CED4"><enum>(iii)</enum><text>a payment made based on information about a candidate’s plans, projects, or needs provided to the person making the payment by the candidate or the candidate’s agent who provides the information with a view toward having the payment made;</text></clause> 
<clause id="HD06B4A4D9CA94171BCB8B35D8434ACEB"><enum>(iv)</enum><text>a payment made by a person if, in the same election cycle in which the payment is made, the person making the payment is serving or has served as a member, employee, fundraiser, or agent of the candidate’s authorized committee in an executive or policymaking position;</text></clause> 
<clause id="H192969E1E1BB4A4996024DAE4DAE1CB7"><enum>(v)</enum><text>a payment made by a person if the person making the payment has served in any formal policy or advisory position with the candidate’s campaign or has participated in strategic or policymaking discussions with the candidate’s campaign relating to the candidate’s pursuit of nomination for election, or election, to Federal office, in the same election cycle as the election cycle in which the payment is made; and</text></clause> 
<clause id="HD0AD06C657E8412BB9AB2B297BDEF1BD"><enum>(vi)</enum><text>a payment made by a person if the person making the payment retains the professional services of an individual or person who has provided or is providing campaign-related services in the same election cycle to a candidate in connection with the candidate’s pursuit of nomination for election, or election, to Federal office, including services relating to the candidate’s decision to seek Federal office, and the payment is for services of which the purpose is to influence that candidate’s election.</text></clause></subparagraph> 
<subparagraph id="H5C4E067DC569489AB4F1EEDFAA0800CC"><enum>(D)</enum><text>For purposes of subparagraph (C)(vi), the term <term>professional services</term> includes services in support of a candidate’s pursuit of nomination for election, or election, to Federal office such as polling, media advice, direct mail, fundraising, or campaign research.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H4A0ED38E366248839D6F94657FC9F000"><enum>(b)</enum><header>Exception for Clean Money candidates</header><text>Section 315(a)(7) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/441a">2 U.S.C. 441a(a)(7)</external-xref>) is amended by striking paragraph (B) and inserting the following:</text>

<subparagraph indent="up1" id="HAF8E2E1070AC4C8DA2DDEC8177166D7F"><enum>(B)</enum> 
<clause display-inline="yes-display-inline" id="H001BEA4DFA2E42AD84009456FF7EC5E"><enum>(i)</enum><text>except as provided in clause (ii), a payment made in coordination with a candidate (as described in section 301(8)(A)(iii)) shall be considered to be a contribution to the candidate, and, for the purposes of any provision of this Act that imposes a limitation on the making of expenditures by a candidate, shall be treated as an expenditure by the candidate for purposes of this paragraph, and</text></clause> 
<clause indent="up1" id="H69D806DE22C943A3BBF2BD49C3FAF52C"><enum>(ii)</enum><text>in the case of a clean money candidate (as defined in section 501), a payment made in coordination with a candidate by a committee of a political party shall not be treated as a contribution to the candidate for purposes of section 503(b)(1) or an expenditure made by the candidate for purposes of section 503(b)(2);</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title> 
<title id="HB41D23C964684A839BDB67B23675DFA9"><enum>III</enum><header>Voter information</header> 
<section id="HD232824DD0D948ACABDEFAF028E76DCC"><enum>301.</enum><header>Free broadcast time</header><text display-inline="no-display-inline">Section 315 of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/315">47 U.S.C. 315</external-xref>) is amended—</text> 
<paragraph id="H88DA8053C9704830BA18757327668E9D"><enum>(1)</enum><text>in subsection (a), in the third sentence, by striking <quote>within the meaning of this subsection</quote> and inserting <quote>within the meaning of this subsection or subsection (c)</quote>;</text></paragraph> 
<paragraph id="H1CBE2C943C3A4D1DA0D493DE29D29586"><enum>(2)</enum><text>by adding at the end the following:</text>

<paragraph id="H0D4DBE7C6C7C4B0FBDBDBDD6E1E6E17"><enum>(1)</enum><header>Amount of time</header><text>A clean money candidate shall be entitled to receive—</text> 
<subparagraph id="HC43C606FDDF142FCAC9D1735B9AA9132"><enum>(A)</enum><text>30 minutes of free broadcast time during each of the primary election period and the primary runoff election period; and</text></subparagraph> 
<subparagraph id="H69C220F48A044B31B35FFA2B32BD1674"><enum>(B)</enum><text>75 minutes of free broadcast time during the general election period and general runoff election period.</text></subparagraph></paragraph> 
<paragraph id="HE5DA56F3C4E546F4BE59EAA71C762509"><enum>(2)</enum><header>Time during which the broadcast is shown</header><text>The broadcast time under paragraph (1) shall be—</text> 
<subparagraph id="H7ACD0D63F38643BF96DFE24F97575F56"><enum>(A)</enum><text>with respect to a television broadcast, the time between 6:00 p.m. and 10:00 p.m. on any day that falls on Monday through Friday;</text></subparagraph> 
<subparagraph id="HB3C98218DB78426C0093ACE998F0258B"><enum>(B)</enum><text>with respect to a radio broadcast, the time between 7:00 a.m. and 9:30 a.m. or between 4:30 p.m. and 7:00 p.m. on any day that falls on Monday through Friday; or</text></subparagraph> 
<subparagraph id="H16A9F159832C49CBB1DF767B44A2EC26"><enum>(C)</enum><text>with respect to any broadcast, such other time to which the candidate and broadcaster may agree.</text></subparagraph></paragraph> 
<paragraph id="H5D0D863FAF4942ACA4005C7F97D03D05"><enum>(3)</enum><header>Maximum required of any station</header><text>The amount of free broadcast time that any 1 station is required to make available to any 1 clean money candidate during each of the primary election period, primary runoff election period, and general election period shall not exceed 15 minutes.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HE3BE33AD69B14C92A5B1E4B248AC4E8F"><enum>(3)</enum><text>in subsection (c)—</text> 
<subparagraph id="H201AB938EAE54B41A8CDDB4BD6FD531F"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of paragraph (1);</text></subparagraph>

<paragraph id="H4D96C48622244A7EAC76BE98DCDE749C"><enum>(4)</enum><header>Other House candidates</header><text>In the case of a candidate for election for Member of, or Delegate or Resident Commissioner to, the Congress who is not a clean money candidate, paragraph (1)(A) shall not apply.</text></paragraph> 
<paragraph id="H5516DB1AE6E94BB4B7823326217EA02C"><enum>(5)</enum><header>Rate cards</header><text>A licensee shall provide to a candidate for Member of or Delegate or Resident Commissioner to the Congress a rate card that discloses—</text> 
<subparagraph id="H3566964B172A400798CC77E9E720948F"><enum>(A)</enum><text>the rate charged under this subsection; and</text></subparagraph> 
<subparagraph id="H3128BF72D39F4032AF6822013CCFDC1C"><enum>(B)</enum><text>the method that the licensee uses to determine the rate charged under this subsection.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H53FEF726B0394A9B9023712D9BD7E0D8"><enum>(b)</enum><header>Preemption</header><text>Section 315 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/47/315">47 U.S.C. 315</external-xref>), as amended by section 301, is amended by adding at the end the following:</text>

<paragraph id="HE2094C59609E4B57BD6400E0F0DD915"><enum>(2)</enum><header>Circumstances beyond control of licensee</header><text>If a program to be broadcast by a broadcasting station is preempted because of circumstances beyond the control of the broadcasting station, any candidate advertising spot scheduled to be broadcast during that program may also be preempted.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC0D7B8AF48B540D4A5D9518CD182A34F"><enum>(c)</enum><header>Revocation of license for failure to permit access</header><text>Section 312(a)(7) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/47/312">47 U.S.C. 312(a)(7)</external-xref>) is amended—</text> 
<paragraph id="H6EA6F8E6445B48C2BAEF763FFB5431B1"><enum>(1)</enum><text>by striking <quote>or repeated</quote>;</text></paragraph> 
<paragraph id="H7FBBF5AF5DE142869BE65918DC36A393"><enum>(2)</enum><text>by inserting <quote>or cable system</quote> after <quote>broadcasting station</quote>; and</text></paragraph> 
<paragraph id="HD21F438C83694C99A57F6F90479D9DC1"><enum>(3)</enum><text>by striking <quote>his candidacy</quote> and inserting <quote>the candidacy of the candidate, under the same terms, conditions, and business practices as apply to the most favored advertiser of the licensee</quote>.</text></paragraph></subsection></section> 
<section id="H8D43BF9D31D641CBB42F79F200909EAB"><enum>303.</enum><header>Limit on Congressional use of the franking privilege</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/39/3210">Section 3210(a)(6)</external-xref> of title 39, United States Code, is amended by striking subparagraph (A) and inserting the following:</text>

<subparagraph id="H1150969CED164C5BA6747E346002DAAA"><enum>(B)</enum><header>Selection of subjects</header><text>The subjects of audits and investigations under this paragraph shall be selected on the basis of impartial criteria established by a vote of at least 4 members of the Commission.</text></subparagraph> 
<subparagraph id="H6C96CE52BF904E3CA61E2F5E97BAEB2F"><enum>(C)</enum><header>Exclusion</header><text>This paragraph does not apply to an authorized committee of a candidate for President or Vice President subject to audit under chapter 95 or 96 of the Internal Revenue Code of 1986.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>

<clause id="H8B252D031314407AB9B284B070CC8FC2"><enum>(iv)</enum><text>the public interest would be best served by the issuance of an injunction;</text></clause></subparagraph><continuation-text continuation-text-level="paragraph">the Commission may initiate a civil action for a temporary restraining order or preliminary injunction pending the outcome of proceedings under paragraphs (1), (2), (3), and (4).</continuation-text>

<subparagraph id="H13C19B0D91A049D58E025B8508FEAE75"><enum>(B)</enum><header>Resolution before an election</header><text>If the Commission determines, on the basis of facts alleged in the complaint and other facts available to the Commission, that there is clear and convincing evidence that a violation of this Act has occurred, is occurring, or is about to occur and it appears that the requirements for relief stated in clauses (ii), (iii), and (iv) of paragraph (13)(A) are met, the Commission may—</text> 
<clause id="H29BF03BEC8DA4A2C91A537DA7AB77A8"><enum>(i)</enum><text>order expedited proceedings, shortening the time periods for proceedings under paragraphs (1), (2), (3), and (4) as necessary to allow the matter to be resolved in sufficient time before the election to avoid harm or prejudice to the interests of the parties; or</text></clause> 
<clause id="HB7547AFD667440E6B5DF360300EE2E84"><enum>(ii)</enum><text>if the Commission determines that there is insufficient time to conduct proceedings before the election, immediately seek relief under paragraph (13)(A).</text></clause></subparagraph> 
<subparagraph id="H0F36AEA7F8004BC88BF051007BBB89C4"><enum>(C)</enum><header>Meritless complaints</header><text>If the Commission determines, on the basis of facts alleged in the complaint and other facts available to the Commission, that the complaint is clearly without merit, the Commission may—</text> 
<clause id="H27AFCCDB4B42443BB4D02DDD6F6FCAE"><enum>(i)</enum><text>order expedited proceedings, shortening the time periods for proceedings under paragraphs (1), (2), (3), and (4) as necessary to allow the matter to be resolved in sufficient time before the election to avoid harm or prejudice to the interests of the parties; or</text></clause> 
<clause id="HC8849BC148BC49E18C22DA0112705649"><enum>(ii)</enum><text>if the Commission determines that there is insufficient time to conduct proceedings before the election, summarily dismiss the complaint.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H3AEAA4DFC631415CB4D9D095ED868676"><enum>407.</enum><header>Promoting expedited availability of FEC reports</header> 
<subsection id="HA90C4EA264A2458E8F706099A6F3E64E"><enum>(a)</enum><header>Mandatory electronic filing</header><text>Section 304(a)(11) of the <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/2/434">2 U.S.C. 434(a)(11)</external-xref>) is amended—</text> 
<paragraph id="H26A476B94BBF4B780017A97B94925DD2"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>under this Act—</quote> and all that follows and inserting <quote>under this Act shall be required to maintain and file such designation, statement, or report in electronic form accessible by computers.</quote>;</text></paragraph> 
<paragraph id="H6B456E94276F4782AAA7C266A9DE8F5C"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>48 hours</quote> and all that follows through <quote>filed electronically)</quote> and inserting <quote>24 hours</quote>; and</text></paragraph> 
<paragraph id="HA5BC8258C8234B8BA6C978C3958D516E"><enum>(3)</enum><text>by striking subparagraph (D).</text></paragraph></subsection> 
<subsection id="HCA52A6C3C3B442A880F2F65D047D44BE"><enum>(b)</enum><header>Requiring reports for all contributions made to any political committee within 90 days of election; requiring reports to be made within 24 hours</header><text>Section 304(a)(6) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/434">2 U.S.C. 434(a)(6)</external-xref>) is amended to read as follows:</text>

<subparagraph display-inline="yes-display-inline" id="HB64EBEF1BDC14CB8B04695E2871FF42"><enum>(A)</enum><text>Each political committee shall notify the Secretary or the Commission, and the Secretary of State, as appropriate, in writing, of any contribution received by the committee during the period which begins on the 90th day before an election and ends at the time the polls close for such election. This notification shall be made within 24 hours (or, if earlier, by midnight of the day on which the contribution is deposited) after the receipt of such contribution and shall include the name of the candidate involved (as appropriate) and the office sought by the candidate, the identification of the contributor, and the date of receipt and amount of the contribution.</text></subparagraph> 
<subparagraph indent="up1" id="HAA3ADC91EFB34330A39C9441562C2C80"><enum>(B)</enum><text>The notification required under this paragraph shall be in addition to all other reporting requirements under this Act.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<section id="H9FE42702672C44BFAEFB0722FFF7B45F"><enum>501.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or amendment made by this Act, or the application of a provision or amendment to any person or circumstance, is held to be unconstitutional, the remainder of this Act and amendments made by this Act, and the application of the provisions and amendment to any person or circumstance, shall not be affected by the holding.</text></section> 
<section id="HCD68A4A8D3E747E3BC9FD7C940B41540"><enum>502.</enum><header>Review of constitutional issues</header><text display-inline="no-display-inline">An appeal may be taken directly to the Supreme Court of the United States from any final judgment, decree, or order issued by any court ruling on the constitutionality of any provision of this Act or amendment made by this Act.</text></section> 
<section id="H1771035CAF28476DB3238BFED11EF2F2"><enum>503.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on January 1, 2006.</text></section></title>
