<official-title>To amend the Help America Vote Act of 2002 to improve the fairness and accuracy of voter registration in elections for Federal office, establish a uniform standard for the treatment of provisional ballots cast at an incorrect polling place, and for other purposes.</official-title>

<section id="H05430B5A121D46C3881E57AEAFD32BBB" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Secure America’s Vote Act of 2005</short-title></quote>. </text></section> 
<section id="HEBD2AC9BCCBD4D588CFBF59526F0C567"><enum>2.</enum><header>Improving Fairness and Accuracy of Voter Registration</header> 
<subsection id="HD6D42B1F5A764062BF2E1C4B9396E767"><enum>(a)</enum><header>Emphasizing Citizenship Requirement on Voter Registration Forms</header><text>Paragraph (4) of section 303(b) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(b)(4)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="H24DB2639E6ED41BAAFE254D6B1400A9" display-inline="no-display-inline"> 
<paragraph id="H3FF29DE08D23433D84A6E616C8557329"><enum>(4)</enum><header>Emphasizing citizenship requirement on voter registration forms</header><text>The Commission shall revise the mail voter registration form developed under section 9(a)(2) of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/1973gg–">42 U.S.C. 1973gg–(a)(2)</external-xref>) so that the form provides a more prominent emphasis of the requirement that an individual must be a citizen of the United States to register to vote in elections for Federal office.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H2AF390B77EC844499545F995338282A"><enum>(b)</enum><header>Prohibiting Rejection of Application For Errors Correctable by State</header><text>Section 303(a)(5)(A)(iii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(a)(5)(A)(iii)</external-xref>) is amended to read as follows:</text>

<clause id="HECCE5779C42844E38513259D96BE7E1"><enum>(iii)</enum><header>Prohibiting rejection of application for errors correctable by State</header><text>A State shall not reject an application for voter registration for Federal office solely on the grounds that the individual failed to provide the information required under clause (i) or made an error in providing such information, if with reasonable effort the State would be able to provide the correct information.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD850B42FEE8A49069E6CDB00753BBCA1"><enum>(c)</enum><header>Preventing Incorrect Removal of Eligible Voters From Voter Registration List</header> 
<paragraph id="H9DC7EF8BE0E14857918271E3BD71C4F"><enum>(1)</enum><header>Requiring databases to meet accuracy standards</header> 
<subparagraph id="H68163274365047498958D34CF000998"><enum>(A)</enum><header>In general</header><text>Section 303(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(a)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="HE41A6D7468BE49C18300AC79F6472235" display-inline="no-display-inline"> 
<paragraph id="HFBDDA0B533D543A49F2B62AFE1EB94B0"><enum>(6)</enum><header>Requiring databases used to remove voters to meet accuracy standards</header> 
<subparagraph id="HB246AA5F613942B9A0DEDD3E00F3CEF0"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of this subsection or any provision of the National Voter Registration Act of 1993, a State may not remove an individual from the official list of eligible voters for elections for Federal office in the State by reason of felony status or by reason of the death of the registrant unless the applicable database meets accuracy standards established by the Director of the National Institute of Standards and Technology in consultation with the Commission.</text></subparagraph> 
<subparagraph id="H1C3DB945591445B0BAB8A300F6CFACF"><enum>(B)</enum><header>Applicable database defined</header><text>In this paragraph, the term <term>applicable database</term> means—</text> 
<clause id="H72F7597E7B7940788B01008271596701"><enum>(i)</enum><text>in the case of an individual removable from the official list of eligible voters by reason of felony status, the database used by the State to determine the individual’s felony status; or</text></clause> 
<clause id="HD264C092D0E6441D00E04B35AC0067AF"><enum>(ii)</enum><text>in the case of an individual removable from the official list of eligible voters by reason of death, the database used by the State to determine which individuals have died.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H1D85236AA42246FCB6613B81F2F2675D"><enum>(B)</enum><header>Conforming amendment</header><text>Section 303(a)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(a)(2)(A)</external-xref>) is amended by striking <quote>The appropriate</quote> and inserting <quote>Except as provided in paragraph (6), the appropriate</quote>. </text> </subparagraph> 
<subparagraph id="H1C9D7B4C841449EF8300D500CEE4F47E"><enum>(C)</enum><header>Deadline for establishment of standards</header><text>The Director of the National Institute of Standards and Technology shall establish the accuracy standards described in section 303(a)(6) of the Help America Vote Act of 2002 (as added by subparagraph (A)) not later than January 1, 2006.</text></subparagraph></paragraph> 
<paragraph id="HFCE338678C7A4EAA8E2ED4D034A13500"><enum>(2)</enum><header>Publication of list of individuals removed from computerized list</header><text>Section 303(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(a)</external-xref>), as amended by paragraph (1), is further amended by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="HD6F90B4E631B4F8DB9BDC1261770BE97" display-inline="no-display-inline"> 
<paragraph id="H7979E83E9BB948199D3040E64C8F289"><enum>(7)</enum><header>Public notice of individuals removed from computerized list</header><text>Not later than 45 days before the date of any Federal election held in the State, each State shall notify the public, by posting on the Internet on the public web site of the chief State election official and through such other methods as the State considers appropriate, of—</text> 
<subparagraph id="HE49F0437C87A42469129B566B8B651FB" commented="no"><enum>(A)</enum><text>all names which have been removed from the computerized list established and maintained under this section since the later of the most recent election for Federal office held in the State or the day of the most recent previous public notice provided under this section;</text></subparagraph> 
<subparagraph id="HF1885ED9FD724BD2933690FCC9D24B9" commented="no"><enum>(B)</enum><text>the criteria, processes, and procedures used to determine which names were removed; and</text></subparagraph> 
<subparagraph id="H885DA496515C4CA4A2A98C00C7D1883E"><enum>(C)</enum><text>information on the steps an individual may take to appeal the removal of the individual’s name from the list and reinstate the individual to the list prior to the election.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H8CF6011234544941B23CA77F1360F9BD"><enum>(3)</enum><header>Conforming amendment relating to applicability of definition of chief State election official</header><text>Section 253(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15403">42 U.S.C. 15403(e)</external-xref>) is amended by striking <quote>this subtitle</quote> and inserting <quote>this Act</quote>. </text></paragraph> 
<paragraph id="H5C84466A785B4F24932B04A0693D0083"><enum>(4)</enum><header>Effective date</header><text>Section 303(d)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(d)(1)</external-xref>) is amended—</text> 
<subparagraph id="HAE74CE7B852E48358E87BA86ABD42C5B"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>subparagraph (B)</quote> and inserting <quote>subparagraphs (B) and (C)</quote>; and</text></subparagraph> 
<subparagraph id="H48E363A4FAD2459980EFCEC2D757037B"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H75DBF8D383264C03A100E636CFB9DCFD"> 
<subparagraph id="H6E24C9AF1A154AEE804FEE90F7DD3906"><enum>(C)</enum><header>Exception for certain requirements</header><text>Each State shall be required to comply with the requirements of paragraph (6) of subsection (a) (relating to accuracy standards for databases used for voter removal) and paragraph (7) of subsection (a) (relating to public notice of individuals removed from the computerized list) not later than January 1, 2006.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> </subsection></section> 
<section id="HD2FD05E632DF402BB00000D0F4ED75DC"><enum>3.</enum><header>Uniform Standard For Treatment of Provisional Ballots Cast at Incorrect Polling Places</header> <text display-inline="no-display-inline">Section 302(a)(4) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15482">42 U.S.C. 15482(a)(4)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="traditional" display-inline="no-display-inline" id="H02ABA8E05E1044548DDEFEDB9950000"> 
<paragraph id="H0EB40514A4384F29A8B99339EC184C05"><enum>(4)(A)</enum><text>An individual’s provisional ballot shall be counted as a vote in an election for Federal office if the appropriate State or local election official to whom the ballot or voter information is transmitted under paragraph (3) determines that the individual is eligible under State law to vote in that election—</text> 
<subparagraph id="H9DD1015A7B604124A6C4693D5CC33E51"><enum>(i)</enum><text>at the polling place at which the individual cast the provisional ballot; or</text></subparagraph> 
<subparagraph id="HFFCDB69C0046428AA701CDC87E50018C"><enum>(ii)</enum><text display-inline="yes-display-inline">at any other polling place at which votes are cast, in the same election for the same Federal office, which is located—</text> 
<clause id="HC35F33FF9E5B4A7D8494F2AC00756D58"><enum>(I)</enum><text>in the case of elections held prior to 2008, in the registrar’s jurisdiction (or, at the option of the State, in the State), or</text></clause> 
<clause id="H36D0882054B64018A72DDAAA43B54FC"><enum>(II)</enum><text>in the case of elections held during 2008 or any subsequent year, in the State.</text></clause></subparagraph></paragraph> 
<paragraph id="H501D9C9F77FD425EB82F03B35679BA53"><enum>(B)</enum><text>The appropriate State or local election official shall ensure that, at each polling place for an election for Federal office, a list is available which shows—</text> 
<subparagraph id="HC7308F450C114A69B0D9877AB59931B"><enum>(i)</enum><text>all individuals registered to vote in that election at all polling places located in the registrar’s jurisdiction; and</text></subparagraph> 
<subparagraph id="H8F09BBF4598143EFA5DFF05C0448CB37"><enum>(ii)</enum><text>for each such individual, the polling place at which the individual is registered.</text></subparagraph></paragraph> 
<paragraph id="HD15D64A27313434F948398BEB8975697"><enum>(C)</enum><text>In this paragraph, the term <term>registrar’s jurisdiction</term> has the meaning given such term in section 8(j) of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/1973gg-6">42 U.S.C. 1973gg–6(j)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H1005A0B1CED143DE9008BBF08BE11D"><enum>4.</enum><header>Additional Security Requirements for Voting Systems</header> <text display-inline="no-display-inline">Section 301(a) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C. 15481(a)</external-xref>) is amended by adding at the end the following new paragraphs:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HA134517DF2D844FBB5A8C7EA0073D458"> 
<paragraph id="H6241527E840446188B134DFB438E549E"><enum>(7)</enum><header>Security standards for voting systems used in Federal elections</header> 
<subparagraph id="HB7A0466F76924E1EA31C1CBCC41200F9"><enum>(A)</enum><header>In general</header><text>No voting system may be used in an election for Federal office in a State unless the manufacturer of the system, the manufacturer of the software used in connection with the system for the election (hereafter in this paragraph referred to as the <quote>election software</quote>), and the chief State election official of the State meet the applicable requirements described in subparagraph (B).</text></subparagraph> 
<subparagraph id="H23EDC51489564CAF94AE63E6FC006929"><enum>(B)</enum><header>Requirements described</header><text>The requirements described in this subparagraph with respect to a voting system used in a State are as follows:</text> 
<clause id="H73316401CA9B4099A6E6B707E67DBCE0"><enum>(i)</enum><text>The chief State election official shall ensure that all custodians of the election software digitally sign the software (in accordance with standards established by the National Institute of Standards and Technology), shall provide the Commission with information on the steps taken to ensure that these custodians meet this requirement, and shall make the information provided to the Commission available to the public by posting the information on the Internet on the public web site of the chief State election official.</text></clause> 
<clause id="HE5F2D38C6ABA4043BE0072ADA669DB42"><enum>(ii)</enum><text>The manufacturer of the system and the manufacturer of the election software shall each provide the Commission and the chief State election official with updated information regarding the identification of each individual who participated in the writing of the software, including specific information regarding whether the individual has ever been convicted of a felony or of any crime involving election fraud.</text></clause> 
<clause id="H3A04653925D1478096360167E2E62FD8"><enum>(iii)</enum><text>The manufacturer of the system and the manufacturer of the election software (as the case may be) shall provide the source code, object code, and executable representation of the software to the Commission and the chief State election official, and shall notify the chief State election official immediately if the manufacturer alters such codes.</text></clause> 
<clause id="HDA5E070CC775485EA8A3D792685D8CBB"><enum>(iv)</enum><text>The manufacturer of the system and the manufacturer of the election software shall meet standards established by the Commission to prevent the existence or appearance of any conflict of interest with respect to candidates for public office and political parties, including standards to ensure that each such manufacturer and its officers and directors do not hold positions of authority in any political party or in any partisan political campaign.</text></clause></subparagraph> 
<subparagraph id="H9D47E5E7AE3248498CF6A561FDF7CD8B"><enum>(C)</enum><header>Public availability of certain information</header><text>Upon request by any member of the public, the Commission or each chief State election official shall make available on a timely basis any information provided to or maintained by the Commission or the official under subparagraph (B)(iii).</text></subparagraph></paragraph> 
<paragraph id="HC0C58B120D0642BDB7756699358E6BA5"><enum>(8)</enum><header>Prohibition of use of wireless communications devices in voting systems</header><text>No voting system shall contain, use, or be accessible by any wireless, power-line, or concealed communication device.</text></paragraph> 
<paragraph id="HD539B16E9E474EC58D01D01E2D9F7909"><enum>(9)</enum><header>Prohibiting connection of system or transmission of system information over the internet</header><text>No component of any voting system upon which votes are cast shall be connected to the Internet.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H6B7C2A589CAC4D819100BBF9B2DECC5"><enum>5.</enum><header>Publication of State Election Laws</header> 
<subsection id="HE56601B955404982AAE16D6C214D7677"><enum>(a)</enum><header>Requiring States to Make Election Laws Available to Public</header><text>Section 302(b) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15482">42 U.S.C. 15482</external-xref>) is amended—</text> 
<paragraph id="HD0B666042DCE4A1382096483FCDAE99"><enum>(1)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></paragraph> 
<paragraph id="HB9C47C878EE7428EB216B729521CDBC6"><enum>(2)</enum><text>by inserting after paragraph (1) the following new paragraph:</text> 
<quoted-block style="OLC" id="H2C8D49CD92E4406DBAB8BC93DA237695" display-inline="no-display-inline"> 
<paragraph id="H8876439E488745588CC0CB777EAF2B50"><enum>(2)</enum><header>Publication of State election laws</header> 
<subparagraph id="H80FB03E0EAB94C6E9297D6E23D380817"><enum>(A)</enum><header>Regular republication during election years</header><text>The chief State election official of each State shall publish all State laws, regulations, procedures, and practices relating to Federal elections on January 1 of each year in which there is a regularly scheduled election for a Federal office (beginning with 2006).</text></subparagraph> 
<subparagraph id="H298ACEA51E8B4594B91649AFA23789F2"><enum>(B)</enum><header>Maintenance on the Internet</header><text>Each State shall be required to post on the Internet on the public web site of the chief State election official all of the material referred to in paragraph (1), and to update the contents of such site to reflect revisions to such material not later than 24 hours after a revision is made.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H0CED135C6D0346E500D036BE2B1772E5"><enum>(b)</enum><header>Conforming Amendments</header><text>Section 302 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15482">42 U.S.C. 15482</external-xref>) is amended—</text> 
<paragraph id="H57EB9979F0824B7DB97EFA7785F5CD65"><enum>(1)</enum><text>in subsection (b)(3) (as redesignated by subsection (a)(1)), by striking <quote>this section</quote> and inserting <quote>paragraph (1)</quote>; and</text></paragraph> 
<paragraph id="H21813AC8772D4B32BD6D7B34C6594B06"><enum>(2)</enum><text>in subsection (d), by striking <quote>Each State</quote> and inserting <quote>Except as provided in subsection (b)(2), each State</quote>.</text></paragraph></subsection></section> 
<section id="H26A7D35D665F49A387A9C185946BB7FA"><enum>6.</enum><header>Criminal Penalties for Voter Suppression</header><text display-inline="no-display-inline">Section 905 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15544">42 U.S.C. 15544</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HBB9B59E9282F4127BF0100C331B87F47"> 
<subsection id="H55486739DBAF44578BA04B261974BB5B"><enum>(c)</enum><header>Voter Suppression</header> 
<paragraph id="HBC814CFEE7424D22A5CE00D7793205A7"><enum>(1)</enum><header>In general</header><text>It is unlawful for any person—</text> 
<subparagraph id="HE7F4E7381B6F45EB8109C37E9737A2DA"><enum>(A)</enum><text>to assert to any State election official that an individual is not eligible to vote in an election for Federal office, unless the assertion is made in good faith on the basis of facts known to the person making the assertion; or</text></subparagraph> 
<subparagraph id="HB5EBA70C20A043D5B0FB32D4003FC428"><enum>(B)</enum><text>to knowingly provide any person with false information regarding an individual’s eligibility to vote in an election for Federal office or regarding the time, place, or manner of voting in such an election.</text></subparagraph></paragraph> 
<paragraph id="H0D67CA79752E4750B7BA22004E6FB9E7"><enum>(2)</enum><header>Penalty</header><text>A person who violates paragraph (1) shall be fined in accordance with title 18, United States Code, or imprisoned for not more than 1 year, or both, for each such violation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HAC86B8880D5443818083CE5DE0BDEC2C"><enum>7.</enum><header>Establishment of Best Practices For Treatment of Ballots of Absent Uniformed Services Voters and Overseas Voters</header> 
<subsection id="H32E4FAE3742B4CDE8F43FB7831CDCD67"><enum>(a)</enum><header>In General</header><text>Not later than January 1, 2006, the Election Assistance Commission, working in cooperation with the Secretary of Defense, the Secretary of State, and the Attorney General, shall establish best practice guidelines for the treatment of absentee ballots of absent uniformed services voters and overseas voters to ensure the timely delivery of ballots to such voters and the timely return of ballots from such voters.<italic></italic></text></subsection> 
<subsection id="HD3AA8CF81BF746C692495378355197E6"><enum>(b)</enum><header>Definitions</header><text>In this section, the terms <term>absent uniformed services voter</term> and <term>overseas voter</term> have the meaning given such terms in section 107 of the Uniformed and Overseas Citizens Absentee Voting Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1973ff-6">42 U.S.C. 1973ff–6</external-xref>).</text></subsection></section> 
<section id="H57FB0B887F5F4823B2E0F722E556E0A2"><enum>8.</enum><header>Simultaneous Transmission of Budget Requests of Election Assistance Commission to President and Congress</header> 
<subsection id="HDFEF65573BA44FF5BFC9B0708074E44B"><enum>(a)</enum><header>In General</header><text>Part 1 of subtitle A of title II of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15321">42 U.S.C. 15321 et seq.</external-xref>) is amended by inserting after section 209 the following new section:</text> 
<quoted-block id="H8FA342020EDD4ED9AECB00350089FA8C"> 
<section id="HBDC38BB017A3406AAB6DCDDFB117B6C"><enum>209A.</enum><header>Submission of budget requests</header><text display-inline="no-display-inline">Whenever the Commission submits any budget estimate or request to the President or the Director of the Office of Management and Budget, it shall concurrently transmit a copy of such estimate or request to the Congress.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3C7DB914FCB547158009F244F3012B92"><enum>(b)</enum><header>Clerical Amendment</header><text>The table of contents for part 1 of subtitle A of title II of such Act is amended by inserting after the item relating to section 209 the following new item:</text>
