<section id="HA026900B6C544F1884E22EFF8B552DE"><enum>101.</enum><header>Renewable content of motor vehicle fuel</header> 
<subsection id="HF6D81E4384614C959F940094011FFBA8"><enum>(a)</enum><header>In general</header><text>Section 211 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545</external-xref>) is amended—</text> 
<paragraph id="HC6AD516966DD45919BCFBEEA82EF79C6"><enum>(1)</enum><text>by redesignating subsection (o) as subsection (q); and</text></paragraph> 
<paragraph id="HA527DF497A574CF08926C3F46329FC6F"><enum>(2)</enum><text>by inserting after subsection (n) the following:</text>

<subsection id="H01EAB9F629EF4B24985F7DC06549F776"><enum>(o)</enum><header>Renewable fuel program</header> 
<paragraph id="HD3FAFFE7E4AB417CA4076B00B4C0F115"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="H6D15D0256C4341658F56F2945E15C12C"><enum>(A)</enum><header>Ethanol</header> 
<clause id="HEB46AFAE40434997A30000F9FC06E746"><enum>(i)</enum><header>Cellulosic biomass ethanol</header><text>The term <quote>cellulosic biomass ethanol</quote> means ethanol derived from any lignocellulosic or hemicellulosic matter that is available on a renewable or recurring basis. The term includes the material specified in clauses (i) through (vi) of section 9001(3)(B) of the Farm Security and Rural Investment Act of 2002 (7 U.S.C. (8101(3)(B)).</text></clause> 
<clause id="H401651B3F1A04AB393D92F40F3FAB216"><enum>(ii)</enum><header>Waste derived ethanol</header><text>The term <quote>waste derived ethanol</quote> means ethanol derived from—</text> 
<subclause id="HDE33810B134E41CE8F6D878546F8CDFC"><enum>(I)</enum><text display-inline="yes-display-inline">material specified in clauses (vii) and (viii) of section 9001(3)(B) of the Farm Security and Rural Investment Act of 2002 (7 U.S.C. (8101(3)(B)); or</text></subclause> 
<subclause id="H84651ECEB1EE42ED9C6964B98F5DE44D"><enum>(II)</enum><text>municipal solid waste.</text></subclause></clause></subparagraph> 
<subparagraph id="HAF8D84DC396649A3BFA4CD779193F3D1"><enum>(B)</enum><header>Renewable fuel</header> 
<clause id="H5E740EAE508E47F7AD3BB989FCEA6544"><enum>(i)</enum><header>In general</header><text>The term <quote>renewable fuel</quote> means motor vehicle fuel that—</text> 
<subclause id="H688B78485F6C4F15A4B9B8EC3F750761"><enum>(I)</enum> 
<item id="H821419B81AD54009AEFD5FD666AFB0BC" display-inline="yes-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline">is produced from grain, starch, oilseeds, wood fiber, or other biomass; or</text></item> 
<item id="H90518849FD604B04ABA8002000D28F75" indent="up1"><enum>(bb)</enum><text> is natural gas produced from a biogas source, including a landfill, sewage waste treatment plant, feedlot, paper mill, or other place where decaying organic material is found; and</text></item></subclause> 
<subclause id="H5D15DDD516AB41B1B880EC1F4961B3E7"><enum>(II)</enum><text display-inline="yes-display-inline">is used to replace or reduce the quantity of fossil fuel present in a fuel mixture used to operate a motor vehicle.</text></subclause></clause> 
<clause id="H76B9AE0A82534A2582C0DF36A85F5CE3"><enum>(ii)</enum><header>Inclusion</header><text>The term `renewable fuel' includes—</text> 
<subclause id="H4FED6F53B40B4DDCB4F400EFFB32E8D7"><enum>(I)</enum><text>cellulosic biomass ethanol;</text></subclause> 
<subclause id="H7C25F0F9CB344886980181AB5200EB6D"><enum>(II)</enum><text> waste derived ethanol;</text></subclause> 
<subclause id="HFFC584503BE342868B21F10213CE7F41"><enum>(III)</enum><text>biodiesel (as defined in section 312(f) of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/13220">42 U.S.C. 13220(f)</external-xref>); and</text></subclause> 
<subclause id="H8B120D6F688A485DA1EC56D314B11D6"><enum>(IV)</enum><text>any blending components derived from renewable fuel, except that only the renewable fuel portion of any such blending component shall be considered part of the applicable volume under the renewable fuel program established by this subsection.</text></subclause></clause></subparagraph> 
<subparagraph id="H6614CBF348884D2AA726683704606770"><enum>(C)</enum><header>Small refinery</header><text display-inline="yes-display-inline">The term `small refinery' means a refinery for which average aggregate daily crude oil throughput for the calendar year (as determined by dividing the aggregate throughput for the calendar year by the number of days in the calendar year) does not exceed 75,000 barrels.</text></subparagraph></paragraph> 
<paragraph id="HBC712A537CE8482E8EB90762C9DED286"><enum>(2)</enum><header>Renewable fuel program</header> 
<subparagraph id="HCB3EDA969F634531BC006410EE3FE238"><enum>(A)</enum><header>In general</header> 
<clause id="H3CB8C64F7B3D41B1AA1FA350E3898866"><enum>(i)</enum><header>Regulations</header><text>Not later than 1 year after the date of enactment of this subsection, the Administrator shall promulgate regulations ensuring that motor vehicle fuel sold or dispensed to consumers in the contiguous United States, on an annual average basis, contains the applicable volume of renewable fuel specified in subparagraph (B).</text></clause> 
<clause id="H665575F9E125422CA2A1909C015106DA"><enum>(ii)</enum><header>Compliance</header><text>Regardless of the date of promulgation, the regulations shall contain compliance provisions for refiners, blenders, and importers, as appropriate, to ensure that the requirements of this subsection are met, but shall not restrict where renewable fuel can be used, or impose any per-gallon obligation for the use of renewable fuel.</text></clause> 
<clause id="H0BA0DFCB28564F3A92F047BC8138539B"><enum>(iii)</enum><header>No regulations</header><text>If the Administrator does not promulgate the regulations, the applicable percentage referred to in paragraph (3), on a volume percentage of gasoline basis, shall be 3.2 in 2006. </text></clause></subparagraph> 
<subparagraph id="HB5353A066D95452CA700FEFBF1B1EA5F"><enum>(B)</enum><header>Applicable volume</header> 
<clause id="HF21E47B5606A4C84A96F002729D3B3A7"><enum>(i)</enum><text display-inline="yes-display-inline">For the purpose of subparagraph (A), the applicable volume for any of calendar years 2006 through 2012 shall be determined in accordance with the following table:</text>

<clause id="H69DF8D3A4AAA4825807E2831734637C"><enum>(ii)</enum><header>Calendar years 2013 and thereafter</header><text display-inline="yes-display-inline">For the purpose of subparagraph (A), the applicable volume for calendar year 2013 and each calendar year thereafter shall be determined by the Administrator, in coordination with the Secretary of Energy and the Secretary of Agriculture. In determining the applicable volume for a calendar year, the Administrator shall take into consideration the following reviews: </text> 
<subclause id="H0084CE09A5BF4091952EEAF96347D228"><enum>(I)</enum><text display-inline="yes-display-inline">The Administrator shall review the implementation of the program since calendar year 2006 and the impact of the use of renewable fuels on the environment, air quality, energy security, and job creation.</text></subclause> 
<subclause id="HA6EFDA7C364047A3A5ACBAC2B823D272"><enum>(II)</enum><text display-inline="yes-display-inline">The Secretary of Agriculture shall review the rate of production of cellulosic ethanol and waste derived ethanol (other than municipal solid waste) since calendar year 2006, the anticipated future production of such cellulosic ethanol and waste derived ethanol, and the impact of the use of renewable fuels on rural economic development.</text></subclause></clause> 
<clause id="H1D93605FCE8C4703A5CF2F80DFB208C2"><enum>(iii)</enum><header>Limitation</header><text>An increase in the applicable volume for a calendar year under clause (ii) shall be not less than the product obtained by multiplying—</text> 
<subclause id="H35833AE4DD0F407184008940C2CF26E6"><enum>(I)</enum><text>the number of gallons of gasoline that the Administrator estimates will be sold or introduced into commerce during the calendar year; and</text></subclause> 
<subclause id="H5FA58DF938954726A121E54B4EEE372C"><enum>(II)</enum><text>the quotient obtained by dividing—</text> 
<item id="H2838E534AD2948C9B83DB1D6E406A974"><enum>(aa)</enum><text>8,000,000,000; by</text></item> 
<item id="H9406E5B95FB240AF8C6EC21B3F81D298"><enum>(bb)</enum><text display-inline="yes-display-inline">the number of gallons of gasoline sold or introduced into commerce during calendar year 2012.</text></item></subclause></clause></subparagraph></paragraph> 
<paragraph id="HDA8784D1748B469DA46FC00CD5F7C8F"><enum>(3)</enum><header>Applicable percentages</header> 
<subparagraph id="H7E153DF71C9D4DD9B3409FDCCC595E1"><enum>(A)</enum><header>Provision of estimate of volumes of gasoline sales</header><text>Not later than October 31 of each of calendar years 2006 through 2011, the Administrator of the Energy Information Administration shall provide to the Administrator of the Environmental Protection Agency an estimate of the volumes of gasoline that will be sold or introduced into commerce in the United States during the following calendar year.</text></subparagraph> 
<subparagraph id="H8CEDF659F15147D5947CC7CBE884658D"><enum>(B)</enum><header>Determination of applicable percentages</header> 
<clause id="H2E3C8CCF3DCC47DF894400757C70B909"><enum>(i)</enum><header>In general</header><text>Not later than November 30 of each of calendar years 2006 through 2011, based on the estimate provided under subparagraph (A), the Administrator shall determine and publish in the Federal Register, with respect to the following calendar year, the renewable fuel obligation that ensures that the requirements under paragraph (2) are met.</text></clause> 
<clause id="HD2FD9A654C204BDB8463B512F596FC78"><enum>(ii)</enum><header>Required elements</header><text>The renewable fuel obligation determined for a calendar year under clause (i) shall—</text> 
<subclause id="H5B4ADBC4CC754A6BB6F7EAE549FCB80"><enum>(I)</enum><text>be applicable to refiners, blenders, and importers, as appropriate;</text></subclause> 
<subclause id="H876C04A6D3B249158C3B47EA22A24F7E"><enum>(II)</enum><text>be expressed in terms of a volume percentage of gasoline sold or introduced into commerce; and</text></subclause> 
<subclause id="HF81A9AE017134554921DAEB606F049E"><enum>(III)</enum><text>subject to subparagraph (C)(i), consist of a single applicable percentage that applies to all categories of persons specified in subclause (I).</text></subclause></clause></subparagraph> 
<subparagraph id="HB31393B20E4F476C897144D2C31335C1"><enum>(C)</enum><header>Adjustments</header><text>In determining the applicable percentage for a calendar year, the Administrator shall make adjustments—</text> 
<clause id="H31DA5F06D8354EBDB5B605259B254BDC"><enum>(i)</enum><text> to prevent the imposition of redundant obligations to any person specified in subparagraph (B)(ii)(I); and</text></clause> 
<clause id="HBC5F045587774AF1A4F400B427AE2169"><enum>(ii)</enum><text>to account for the use of renewable fuel during the previous calendar year by small refineries that are exempt under paragraph (11).</text></clause></subparagraph></paragraph> 
<paragraph id="HA29FD99753FB460DA1C7F9527327E6F2"><enum>(4)</enum><header>Equivalency</header><text display-inline="yes-display-inline">For the purpose of paragraph (2), 1 gallon of either cellulosic biomass ethanol or waste derived ethanol shall be considered to be the equivalent of 2.5 gallons of renewable fuel.</text></paragraph> 
<paragraph id="H6081BC979E3E4A93894D6147BF25AA07"><enum>(5)</enum><header>Credit program</header> 
<subparagraph id="H03C0970C6EB64BCBA3BAEE0524538041"><enum>(A)</enum><header>Regulations</header><text>The regulations promulgated to carry out this subsection shall provide for—</text> 
<clause id="H737D7A2E59E347EDA6F6FFDFC38869DD"><enum>(i)</enum><text>the generation of an appropriate amount of credits by any person that refines, blends, or imports gasoline that contains a quantity of renewable fuel that is greater than the quantity required under paragraph (2);</text></clause> 
<clause id="H8B97043D34884C38ADD6BBF157380428"><enum>(ii)</enum><text>the generation of an appropriate amount of credits for biodiesel fuel; and</text></clause> 
<clause id="H26FD2BCEF4A549EA9998602408478BE7"><enum>(iii)</enum><text>if a small refinery notifies the Administrator that the small refinery waives the exemption provided by this subsection, the generation of credits by the small refinery beginning in the year following the notification.</text></clause></subparagraph> 
<subparagraph id="H3F71AD658CE34F888BDAFDEC90D54F72"><enum>(B)</enum><header>Use of credits.</header><text display-inline="yes-display-inline">A person that generates credits under subparagraph (A) may use the credits, or transfer all or a portion of the credits to another person, for the purpose of complying with paragraph (2).</text></subparagraph> 
<subparagraph id="H5E41A35899B24DE2BC4B809F1E43C54D"><enum>(C)</enum><header>Life of credits</header><text>A credit generated under this paragraph shall be valid to demonstrate compliance for the calendar year in which the credit was generated.</text></subparagraph> 
<subparagraph id="H54080FC715E44D4EAA007100DFB1B870"><enum>(D)</enum><header>Inability to purchase sufficient credits</header><text display-inline="yes-display-inline">The regulations promulgated to carry out this subsection shall include provisions permitting any person that is unable to generate or purchase sufficient credits to meet the requirement under paragraph (2) to carry forward a renewables deficit if, for the calendar year following the year in which the renewables deficit is created—</text> 
<clause id="HB54060F17A9D4A96816EEBBD63601C63"><enum>(i)</enum><text display-inline="yes-display-inline">the person achieves compliance with the renewables requirement under paragraph (2); and</text></clause> 
<clause id="H6B74A4AEB4AF495AAF5B82648E41C585"><enum>(ii)</enum><text display-inline="yes-display-inline">generates or purchases additional renewables credits to offset the renewables deficit of the preceding year.</text></clause></subparagraph></paragraph> 
<paragraph id="HF9A70BE5BEFC40E1823D9465C899E623"><enum>(6)</enum><header>Seasonal variations in renewable fuel use</header> 
<subparagraph id="H270A7781B3FF40F187E61384CCEB7FAA"><enum>(A)</enum><header>Study</header><text>For each of calendar years 2006 through 2012, the Administrator of the Energy Information Administration, in consultation with the Secretary of Agriculture, shall conduct a study of renewable fuels blending to determine whether there are excessive seasonal variations in the use of renewable fuels.</text></subparagraph> 
<subparagraph id="HAAC3DCFC52B0474BA700F7B581162BD"><enum>(B)</enum><header>Regulation of excessive seasonal variation</header><text>If, for any calendar year, the Administrator of the Energy Information Administration, based on the study under subparagraph (A), makes the determinations specified in subparagraph (C), the Administrator shall promulgate regulations to ensure that 35 percent or more of the quantity of renewable fuels necessary to meet the requirements under paragraph (2) is used during each of the periods specified in subparagraph (D) of each subsequent calendar year.</text></subparagraph> 
<subparagraph id="H7A5FE2FB07C54F7886FAF611C779D57B"><enum>(C)</enum><header>Determinations</header><text display-inline="yes-display-inline">The determinations referred to in subparagraph (B) are that—</text> 
<clause id="H2E2A4749A0804EF19CD7A254E040F656"><enum>(i)</enum><text display-inline="yes-display-inline">less than 35 percent of the quantity of renewable fuels necessary to meet the requirements under paragraph (2) has been used during 1 of the periods specified in subparagraph (D) of the calendar year;</text></clause> 
<clause id="HB23ED183D6A842FBA7090400916B8117"><enum>(ii)</enum><text>a pattern of excessive seasonal variation described in clause (i) will continue in subsequent calendar years; and</text></clause> 
<clause id="H0B1E650C1C9B4314B7235BC4572724FF"><enum>(iii)</enum><text>promulgating regulations or other requirements to impose a 35 percent or more seasonal use of renewable fuels will not prevent or interfere with the attainment of national ambient air quality standards or significantly increase the price of motor fuels to the consumer.</text></clause></subparagraph> 
<subparagraph id="HC0B9E8123E7A43CCA5BF13A11DC804DF"><enum>(D)</enum><header>Periods</header><text display-inline="yes-display-inline">The 2 periods referred to in this paragraph are—</text> 
<clause id="H6226A419A470456E81BB055DE855DF41"><enum>(i)</enum><text>April through September; and</text></clause> 
<clause id="HC62CED3104FD48A2A638009943CF8464"><enum>(ii)</enum><text>January through March and October through December.</text></clause></subparagraph> 
<subparagraph id="H60B0530CCB144D3CB7547C1B7DBA11C2"><enum>(E)</enum><header>Exclusions</header><text display-inline="yes-display-inline">Renewable fuels blended or consumed in 2006 in a State that has received a waiver under section 209(b) shall not be included in the study under subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="H4EAF9185E83C464A8F17CB74CBE3E620"><enum>(7)</enum><header>Waivers</header> 
<subparagraph id="HCF54DFBDC7144D2100D956393CC35307"><enum>(A)</enum><header>In general</header><text>The Administrator, in consultation with the Secretary of Agriculture and the Secretary of Energy, may waive the requirements under paragraph (2), in whole or in part, on a petition by 1 or more States by reducing the national quantity of renewable fuel required under this subsection—</text> 
<clause id="H0CF0EDC5F6C348148E54D7D8A3BE3500"><enum>(i)</enum><text>based on a determination by the Administrator, after public notice and opportunity for comment, that implementation of the requirement would severely harm the economy or environment of a State, a region, or the United States; or</text></clause> 
<clause id="H8C029033F62A4A08BCD2950500D4C146"><enum>(ii)</enum><text>based on a determination by the Administrator and the Secretary of Agriculture, after public notice and opportunity for comment, that there is an inadequate domestic supply to meet the requirement.</text></clause></subparagraph> 
<subparagraph id="H3BD4E9C4FE634CBFBB95AB765CEDECB7"><enum>(B)</enum><header>Petitions for waivers.</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which a petition is received by the Administrator under subparagraph (A), the Administrator, in consultation with the Secretary of Agriculture and the Secretary of Energy, shall approve or disapprove the petition.</text></subparagraph> 
<subparagraph id="HB4AFBADB0917486B931E3D0045DAFCA8"><enum>(C)</enum><header>Termination of waivers</header><text>A waiver granted under subparagraph (A) shall terminate on the date that is 1 year after the date on which the waiver was granted, but may be renewed by the Administrator, after consultation with the Secretary of Agriculture and the Secretary of Energy.</text></subparagraph></paragraph> 
<paragraph id="H3AAEEC18B93E4FCF8396E448FC6DA223"><enum>(8)</enum><header>Small refineries</header> 
<subparagraph id="HEF535576F6FB4583BFACBB175B00C40"><enum>(A)</enum><header>In general</header><text>Paragraph (2) shall not apply to small refineries until the first calendar year beginning more than 5 years after the first year set forth in the table in paragraph (2)(B)(i).</text></subparagraph> 
<subparagraph id="HC7BB03ACCEA94C93B7CAD8C004CAC00"><enum>(B)</enum><header>Study</header><text>Not later than December 31, 2008, the Secretary of Energy shall complete for the Administrator a study to determine whether the requirements under paragraph (2) would impose a disproportionate economic hardship on small refineries.</text></subparagraph> 
<subparagraph id="H8AEA4FA868E04F34B47E0093206EC049"><enum>(C)</enum><header>Small refineries and economic hardship</header><text display-inline="yes-display-inline">For any small refinery that the Secretary of Energy determines would experience a disproportionate economic hardship, the Administrator shall extend the small refinery exemption for the small refinery for not less than 2 additional years.</text></subparagraph> 
<subparagraph id="HF5C121E4A31A4821AAD13CC837CEBF2"><enum>(D)</enum><header>Economic hardship</header> 
<clause id="H31BC425AFC1149EBB86B62C5E615A557"><enum>(i)</enum><header>Extension of exemption</header><text>A small refinery may at any time petition the Administrator for an extension of the exemption from the requirements under paragraph (2) for the reason of disproportionate economic hardship.</text></clause> 
<clause id="H1BF91DAA01F647E68D54673495B5F002"><enum>(ii)</enum><header>Evaluation</header><text>In evaluating a hardship petition, the Administrator, in consultation with the Secretary of Energy, shall consider the findings of the study in addition to other economic factors.</text></clause> 
<clause id="HF44D9D99238645CD8ED944793824EC00"><enum>(iii)</enum><header>Deadline for action on petitions</header><text>The Administrator shall act on any petition submitted by a small refinery for a hardship exemption not later than 90 days after the receipt of the petition.</text></clause></subparagraph> 
<subparagraph id="H5430A8ABD716471B8BF34FA0E4B490AC"><enum>(E)</enum><header>Credit program</header><text display-inline="yes-display-inline">Paragraph (6)(A)(iii) shall apply to each small refinery that waives an exemption under this paragraph.</text></subparagraph> 
<subparagraph id="H801F813904624076B24EDFBE36B65CF9"><enum>(F)</enum><header>Opt-in for small refiners</header><text display-inline="yes-display-inline">A small refinery shall be subject to paragraph (2) if the small refinery notifies the Administrator that the small refinery waives the exemption under subparagraph (C).</text></subparagraph></paragraph></subsection> 
<subsection id="H2BC79DE30BA94CD98BA03E7540827D70"><enum>(p)</enum><header>Renewable fuel safe harbor</header> 
<paragraph id="HA2B9842566474C1DB0AC172E3C79F685"><enum>(1)</enum><header>Safe harbor</header><text>Notwithstanding any other provision of Federal or State law, a renewable fuel (as defined in subsection (o)(1)) that is used or intended to be used as a motor vehicle fuel and any motor vehicle fuel containing renewable fuel (as so defined) shall not be considered or determined to be defective in design or manufacture by reason of the fact that the fuel is, or contains, renewable fuel, if—</text> 
<subparagraph id="HDBF86E8818C5461A8F03829DB8B69847"><enum>(A)</enum><text>the fuel does not violate a control or prohibition imposed by the Administrator under this section; and</text></subparagraph> 
<subparagraph id="H0BA1F62DB8B64061A19DA54876DA144F"><enum>(B)</enum><text>the manufacturer of the fuel is in compliance with all requests for information under subsection (b).</text></subparagraph></paragraph> 
<paragraph id="H494467D22A3340E398E8248B3100A962"><enum>(2)</enum><header>When safe harbor not applicable</header><text>In any case in which paragraph (1) does not apply to a quantity of fuel, the existence of a design defect or manufacturing defect with respect to the fuel shall be determined under otherwise applicable law.</text></paragraph> 
<paragraph id="H562405C039B940FFA2FE00A76511474D"><enum>(3)</enum><header>Exception to safe harbor</header><text>Paragraph (1) does not apply to ethers.</text></paragraph> 
<paragraph id="H296F57D9C35C4913A9E394221C9DFCBE"><enum>(4)</enum><header>Effective date</header><text>Paragraph (1) applies with respect to any claim filed on or after the date of the enactment of the <short-title>Renewable Fuels Act of 2005</short-title>.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<section id="HB436A10AF05B4204B601AA757082926C"><enum>102.</enum><header>Federal agency ethanol-blended gasoline, and biodiesel, purchasing requirement</header><text display-inline="no-display-inline">Title III of the Energy Policy Act of 1992 is amended by striking section 306 (<external-xref legal-doc="usc" parsable-cite="usc/42/13215">42 U.S.C. 13215</external-xref>) and inserting the following:</text>

<section id="H3403F1657BCC411AA37CDAB1F3CCE91D"><enum>306.</enum><header>Federal agency ethanol-blended gasoline and biodiesel purchasing requirement</header> 
<subsection id="H16203DAEA2044B968D0424002E92BB62"><enum>(a)</enum><header>Ethanol-blended gasoline</header><text>The head of each Federal agency shall ensure that, in areas in which ethanol-blended gasoline is reasonably available at a generally competitive price, the Federal agency purchases ethanol-blended gasoline containing at least 10 percent ethanol rather than nonethanol-blended gasoline, for use in vehicles used by the agency that use gasoline.</text></subsection> 
<subsection id="HBFD7ED90D28147A28C1CCDFBED04FA3F"><enum>(b)</enum><header>Biodiesel</header> 
<paragraph id="H575B7F211000420DB2D929F023F68DAD"><enum>(1)</enum><header>Definition of biodiesel</header><text>In this subsection, the term <quote>biodiesel</quote> has the meaning given the term in section 312(f).</text></paragraph> 
<paragraph id="H766FA12DE8764A2985097045FD545347"><enum>(2)</enum><header>Requirement</header><text>The head of each Federal agency shall ensure that the Federal agency purchases, for use in fueling fleet vehicles that use diesel fuel used by the Federal agency at the location at which fleet vehicles of the Federal agency are centrally fueled, in areas in which the biodiesel-blended diesel fuel described in subparagraphs (A) and (B) is available at a generally competitive price—</text> 
<subparagraph id="HC56DE64A65A14A0C976392BE202951C3"><enum>(A)</enum><text>as of the date that is 5 years after the date of enactment of this paragraph, biodiesel-blended diesel fuel that contains at least 2 percent biodiesel, rather than nonbiodiesel-blended diesel fuel; and</text></subparagraph> 
<subparagraph id="H4C4197FAB9314F7794A800726760F146"><enum>(B)</enum><text>as of the date that is 10 years after the date of enactment of this paragraph, biodiesel-blended diesel fuel that contains at least 20 percent biodiesel, rather than nonbiodiesel-blended diesel fuel.</text></subparagraph></paragraph> 
<paragraph id="HA1ADB071AB724323BBBE0C2D79ECFA"><enum>(3)</enum><header>Requirement of federal law</header><text>The provisions of this subsection shall not be considered a requirement of Federal law for the purposes of section 312.</text></paragraph></subsection> 
<subsection id="HEFEB88C900CE4B49A51CFD75EDFB3C83"><enum>(c)</enum><header>Exemption</header><text>This section does not apply to fuel used in vehicles excluded from the definition of <quote>fleet</quote> by subparagraphs (A) through (H) of section 301(9).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HC859E280B4764705BE98307DCE921DF2"><enum>103.</enum><header>Monthly survey of renewable fuels demand in motor vehicle fuels market</header> 
<subsection id="H9632C54075DE4CF892C8C8DB4212C267"><enum>(a)</enum><header>Survey required</header><text display-inline="yes-display-inline">The Secretary of Agriculture, with the assistance of the Administrator of the Energy Information Administration, shall conduct and publish the results of a monthly survey of renewable fuels demand in the motor vehicle fuels market in the United States monthly, and in a manner designed to protect the confidentiality of individual responses.</text></subsection> 
<subsection id="H3A99B6DE72F7472CA6A2D70577555516"><enum>(b)</enum><header>Content of survey</header><text>In conducting the monthly survey required by subsection (a), the Secretary of Agriculture shall collect information, both on a national and regional basis, regarding—</text> 
<paragraph id="H711AAC771B6D4C178E684CF09FF8B6F5"><enum>(1)</enum><text>the quantity of renewable fuels produced;</text></paragraph> 
<paragraph id="H0D5A68E71D9C4D89BD006129724E0013"><enum>(2)</enum><text>the quantity of renewable fuels blended;</text></paragraph> 
<paragraph id="H716C03F25F5D49E7BC66CDA662459CF5"><enum>(3)</enum><text>the quantity of renewable fuels imported; </text></paragraph> 
<paragraph id="HA95FFCAAF4824B828310F2C86CF996BD"><enum>(4)</enum><text>the quantity of renewable fuels demanded; and</text></paragraph> 
<paragraph id="H82552B70353A4450B647795F50AC2D44"><enum>(5)</enum><text>the market price of renewable fuels.</text></paragraph></subsection> 
<subsection id="H38D547D00BCC4075AF9C44A4DA008F58"><enum>(c)</enum><header>Role of office of energy policy and new uses</header><text display-inline="yes-display-inline">The Office of Energy Policy and New Uses of the Department of Agriculture shall assist the Secretary of Agriculture in evaluating the effectiveness of the renewable fuels mandate of the United States.</text></subsection> 
<subsection id="H1E3EA91714E74C87A5216FE7C815E134"><enum>(d)</enum><header>Renewable fuels defined</header><text>In this section, the term <quote>renewable fuel</quote> has the meaning given that term in section 211(o)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)</external-xref>). </text></subsection></section> 
<section id="HC6A80D5562134B0BAC92D6F5E4AE1113"><enum>104.</enum><header>Commodity credit corporation bioenergy program</header><text display-inline="no-display-inline"> In order to assist with the implementation of the national renewable fuels standard, funds made available under section 9010(c) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8108">7 U.S.C. 8108</external-xref>) for the bioenergy program of the Department of Agriculture for a fiscal year and unobligated by the end of that fiscal year shall remain available for obligation until expended.</text></section></title> 
<title id="HBF5D4AC021C3417A92B0E39C005525E"><enum>II</enum><header>Federal reformulated fuels</header> 
<section id="HDB6FB5754990491F8053E29B655BC000"><enum>201.</enum><header>Elimination of oxygen content requirement for reformulated gasoline</header> 
<subsection id="HA6C93A79C38A4B77A8B959FF14B396D4"><enum>(a)</enum><header>Elimination</header> 
<paragraph id="HC3EF6DBE2C004D7A96A71D42BB6D7D71"><enum>(1)</enum><header>In general</header><text>Section 211(k) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(k)</external-xref>) is amended—</text>

<subsection id="HF3AEE8E2880D48ABA4A8ABC95D7652"><enum>(b)</enum><header>Maintenance of toxic air pollutant emission reductions</header><text>Section 211(k)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(k)(1)</external-xref>) is amended—</text> 
<paragraph id="H6F25BAA1D33345018EBE5BC7007258C9"><enum>(1)</enum><text>by striking <quote>Within 1 year after the enactment of the Clean Air Act Amendments of 1990,</quote> and inserting the following:</text>

<paragraph id="H0A14BC01DCF145F28406B2FDAEC7EAF7"><enum>(2)</enum><text>by adding at the end the following:</text>

<subparagraph id="HF442CAD4411F456EB9DDE43175B31DE"><enum>(B)</enum><header>Maintenance of toxic air pollutant emissions reductions from reformulated gasoline</header> 
<clause id="HF438EA8665EF425C81D30992DA80C100"><enum>(i)</enum><header>Definition of padd</header><text>In this subparagraph, the term <quote>PADD</quote> means a Petroleum Administration for Defense District.</text></clause> 
<clause id="HBAE0DCCBC552411F85D7FA2CFEB6991C"><enum>(ii)</enum><header>Regulations regarding emissions of toxic air pollutants</header><text>Not later than 270 days after the date of enactment of this subparagraph, the Administrator shall establish, for each refinery or importer, standards for toxic air pollutants from use of the reformulated gasoline produced or distributed by the refinery or importer that maintain the reduction of the average annual aggregate emissions of toxic air pollutants for reformulated gasoline produced or distributed by the refinery or importer during calendar years 2001 and 2002, determined on the basis of data collected by the Administrator with respect to the refinery or importer.</text></clause> 
<clause id="H207B7C7BA6C84A6496F6F007D77FB7E"><enum>(iii)</enum><header>Standards applicable to specific refineries or importers</header> 
<subclause id="H46F02C3F03A443FCBAA88DA4F29E19F"><enum>(I)</enum><header>Applicability of standards</header><text>For any calendar year, the standards applicable to a refinery or importer under clause (ii) shall apply to the quantity of gasoline produced or distributed by the refinery or importer in the calendar year only to the extent that the quantity is less than or equal to the average annual quantity of reformulated gasoline produced or distributed by the refinery or importer during calendar years 2001 and 2002.</text></subclause> 
<subclause id="H502EBBF08BC14FB09F7C152B7C9D2E74"><enum>(II)</enum><header>Applicability of other standards</header><text>For any calendar year, the quantity of gasoline produced or distributed by a refinery or importer that is in excess of the quantity subject to subclause (I) shall be subject to standards for toxic air pollutants promulgated under subparagraph (A) and paragraph (3)(B).</text></subclause></clause> 
<clause id="H2FACEBE39CB24E7E88DFC5D3F5E46115"><enum>(iv)</enum><header>Credit program</header><text>The Administrator shall provide for the granting and use of credits for emissions of toxic air pollutants in the same manner as provided in paragraph (7).</text></clause> 
<clause id="H2A5401063A9145AFA7E4BF5D87CED097"><enum>(v)</enum><header>Regional protection of toxics reduction baselines</header> 
<subclause id="HAE2BB8CDB1B84A10AA951342DAFE9E00"><enum>(I)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this subparagraph, and not later than April 1 of each calendar year that begins after that date of enactment, the Administrator shall publish in the Federal Register a report that specifies, with respect to the previous calendar year—</text> 
<item id="H9E6EB98E39E14FB9A1C6F4AC8716633E"><enum>(aa)</enum><text>the quantity of reformulated gasoline produced that is in excess of the average annual quantity of reformulated gasoline produced in 2001 and 2002; and</text></item> 
<item id="H25132EC59A434B81B72E64870009E4D1"><enum>(bb)</enum><text>the reduction of the average annual aggregate emissions of toxic air pollutants in each PADD, based on retail survey data or data from other appropriate sources.</text></item></subclause> 
<subclause id="HF927832BAF6B4CF6AFCC44CE1C6326F0"><enum>(II)</enum><header>Effect of failure to maintain aggregate toxics reductions</header><text>If, in any calendar year, the reduction of the average annual aggregate emissions of toxic air pollutants in a PADD fails to meet or exceed the reduction of the average annual aggregate emissions of toxic air pollutants in the PADD in calendar years 2001 and 2002, the Administrator, not later than 90 days after the date of publication of the report for the calendar year under subclause (I), shall—</text> 
<item id="H9C42894A463C45EF8BCDCF8C018D5BD1"><enum>(aa)</enum><text>identify, to the maximum extent practicable, the reasons for the failure, including the sources, volumes, and characteristics of reformulated gasoline that contributed to the failure; and</text></item> 
<item id="HCBF778DD4BDA4273B381A59341E9A7CA"><enum>(bb)</enum><text>promulgate revisions to the regulations promulgated under clause (ii), to take effect not earlier than 180 days but not later than 270 days after the date of promulgation, to provide that, notwithstanding clause (iii)(II), all reformulated gasoline produced or distributed at each refinery or importer shall meet the standards applicable under clause (ii) not later than April 1 of the year following the report under this subclause and for subsequent years.</text></item></subclause></clause> 
<clause id="HC09FDE672DE445CEB0DF8552004E069F"><enum>(vi)</enum><header>Regulations to control hazardous air pollutants from motor vehicles and motor vehicle fuels</header><text>Not later than July 1, 2006, the Administrator shall promulgate final regulations to control hazardous air pollutants from motor vehicles and motor vehicle fuels, as provided for in <external-xref legal-doc="regulation" parsable-cite="cfr/40/80.1045">section 80.1045</external-xref> of title 40, Code of Federal Regulations (as in effect on the date of enactment of this subparagraph).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H3387C247C2134A7BBDC7E1E832B9698F"><enum>(c)</enum><header>Consolidation in reformulated gasoline regulations</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall revise the reformulated gasoline regulations under subpart D of part 80 of title 40, Code of Federal Regulations (or any successor regulations), to consolidate the regulations applicable to VOC-Control Regions 1 and 2 under section 80.41 of that title by eliminating the less stringent requirements applicable to gasoline designated for VOC-Control Region 2 and instead applying the more stringent requirements applicable to gasoline designated for VOC-Control Region 1.</text></subsection> 
<subsection id="H387564084E8344BE9FF2C0A1A3F5AE78"><enum>(d)</enum><header>Authority of Administrator</header><text>Nothing in this section affects or prejudices any legal claim or action with respect to regulations promulgated by the Administrator of the Environmental Protection Agency before the date of enactment of this Act regarding—</text> 
<paragraph id="H5108E473ADE4425B94E0C2C97522947"><enum>(1)</enum><text>emissions of toxic air pollutants from motor vehicles; or</text></paragraph> 
<paragraph id="H329A089820EB45B2AB44D9E127A839E0"><enum>(2)</enum><text>the adjustment of standards applicable to a specific refinery or importer made under the prior regulations.</text></paragraph></subsection> 
<subsection id="HB2D2A73331D1454E9E0500E9332F56C0"><enum>(e)</enum><header>Determination regarding a state petition</header><text>Section 211(k) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(k)</external-xref>) is amended by inserting after paragraph (10) the following:</text>

<paragraph id="H0E3A4D2F78E04568B7430713D073D74B"><enum>(11)</enum><text>Determination regarding a state petition—</text> 
<subparagraph id="HBEB0DD3F8C634FF494F9B5627A303F3"><enum>(A)</enum><text>In general- Notwithstanding any other provision of this section, not later than 30 days after the date of enactment of this paragraph, the Administrator shall determine the adequacy of any petition received from a Governor of a State to exempt gasoline sold in that State from the requirements under paragraph (2)(B).</text></subparagraph> 
<subparagraph id="H0DC3C643C525426295F5EA389900FBBB"><enum>(B)</enum><header>Approval</header><text>If a determination under subparagraph (A) is not made by the date that is 30 days after the date of enactment of this paragraph, the petition shall be considered to be approved.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H5F554B8C01CC419E9222A84CA79E0029"><enum>202.</enum><header>Public health and environmental impacts of fuels and fuel additives</header><text display-inline="no-display-inline">Section 211(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(b)</external-xref>) is amended—</text> 
<paragraph id="HA487B8D92832498BA68FB811EE14E769"><enum>(1)</enum><text>in paragraph (2)—</text> 
<subparagraph id="H1836B2BCA6FE43D8B55501293C96FB06"><enum>(A)</enum><text>by striking <quote>may also</quote> and inserting <quote>shall, on a regular basis,</quote>; and</text></subparagraph> 
<subparagraph id="HED1E1FF8996048C581E777E7E584FFC"><enum>(B)</enum><text>by striking subparagraph (A) and inserting the following:</text>

<subclause id="H82F3C224F6EA4144A895FEC75B85B2E4"><enum>(II)</enum><text>tertiary amyl methyl ether;</text></subclause> 
<subclause id="H22B65BEC2C494304AEC78ED4FAE273F6"><enum>(III)</enum><text>di-isopropyl ether;</text></subclause> 
<subclause id="HFC5908C58B1F4FEEA700965FACB7E275"><enum>(IV)</enum><text>tertiary butyl alcohol;</text></subclause> 
<subclause id="H5B6D6591735747B39F824067D520199D"><enum>(V)</enum><text>other ethers and heavy alcohols, as determined by the Administrator;</text></subclause> 
<subclause id="HB8A8A2FFABBD4B839504B300B68D54B2"><enum>(VI)</enum><text>ethanol;</text></subclause> 
<subclause id="HF4F586BB163243ECB1213189C6D2744E"><enum>(VII)</enum><text>iso-octane; and</text></subclause> 
<subclause id="H3831E5ECB10A4B06A4C9B5870E397D0"><enum>(VIII)</enum><text>alkylates;</text></subclause></clause> 
<clause id="H251D255213A240FEA7B2D05FEBF76815"><enum>(ii)</enum><text>conduct a study on the effects on public health, air quality, and water resources of the adjustment for ethanol-blended reformulated gasoline to the VOC performance requirements otherwise applicable under sections 211(k)(1) and 211(k)(3); and</text></clause> 
<clause id="H2E81E138F728482CB3BF665BAD2D15F"><enum>(iii)</enum><text>submit to the Committee on Environment and Public Works of the Senate and the Committee on Energy and Commerce of the House of Representatives a report describing the results of these studies.</text></clause></subparagraph> 
<subparagraph id="HF8F52FE0F90049878EC31C5C4837FE38"><enum>(B)</enum><header>Contracts for study</header><text>In carrying out this paragraph, the Administrator may enter into one or more contracts with nongovernmental entities including but not limited to National Energy Laboratories and institutions of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H21BE0E1266534117A55222A71C8CBEBF"><enum>203.</enum><header>Analyses of motor vehicle fuel changes</header><text display-inline="no-display-inline">Section 211 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545</external-xref>) is amended by inserting after subsection (o) (as added by section 101(a)(2)) the following:</text>

<subparagraph id="H501AA33844C940EABCDA10FF9702E700"><enum>(A)</enum><header>Draft analysis</header><text>Not later than 4 years after the date of enactment of this subsection, the Administrator shall publish for public comment a draft analysis of the changes in emissions of air pollutants and air quality due to the use of motor vehicle fuel and fuel additives resulting from implementation of the amendments made by the Renewable Fuels Act of 2005.</text></subparagraph> 
<subparagraph id="HB3BDFD985F3A490BA1C6059EA0B35210"><enum>(B)</enum><header>Final analysis</header><text>After providing a reasonable opportunity for comment, but not later than 5 years after the date of enactment of this paragraph, the Administrator shall publish the analysis in final form.</text></subparagraph></paragraph> 
<paragraph id="H6BF4268B0D154208A7A5097695A4FDCE"><enum>(2)</enum><header>Emissions model</header><text>For the purposes of this subsection, as soon as the necessary data are available, the Administrator shall develop and finalize an emissions model that reasonably reflects the effects of gasoline characteristics or components on emissions from vehicles in the motor vehicle fleet during calendar year 2005.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HBE65109D70254B76A63B63ED1241891C"><enum>204.</enum><header>Additional opt-in areas under reformulated gasoline program</header><text display-inline="no-display-inline">Section 211(k)(6) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(k)(6)</external-xref>) is amended to read as follows:</text>

<clause id="HC30A2592910F4DC79E1F8220BECD0016"><enum>(ii)</enum><header>Period of applicability</header><text>Under clause (i), the prohibition specified in paragraph (5) shall apply in a State—</text> 
<subclause id="H449CD79D6E9145B28CFF708D4011BE21"><enum>(I)</enum><text>commencing as soon as practicable but not later than 2 years after the date of approval by the Administrator of the application of the Governor of the State; and</text></subclause> 
<subclause id="HE6A0F16120774B67B1453F70DED27761"><enum>(II)</enum><text>ending not earlier than 4 years after the commencement date determined under subclause (I).</text></subclause></clause> 
<clause id="HE266C2C9BEF14305A37277B3E14DDC20"><enum>(iii)</enum><header>Extension of commencement date based on insufficient capacity</header> 
<subclause id="H310B3B66F597412796457B95D35CD25F"><enum>(I)</enum><header>In general</header><text>If, after receipt of an application from a Governor of a State under clause (i), the Administrator determines, on the Administrator's own motion or on petition of any person, after consultation with the Secretary of Energy, that there is insufficient capacity to supply reformulated gasoline, the Administrator, by regulation—</text> 
<item id="H1386C047A7E5433090589EE3A3059768"><enum>(aa)</enum><text>shall extend the commencement date with respect to the State under clause (ii)(I) for not more than 1 year; and </text></item> 
<item id="H4BC6AB44E24D48359F81FE46166D56EC"><enum>(bb)</enum><text>may renew the extension under item (aa) for 2 additional periods, each of which shall not exceed 1 year. </text></item></subclause> 
<subclause id="H153F657791A84FAF9229ABC3962389E0"><enum>(II)</enum><header>Deadline for action on petitions</header><text>The Administrator shall act on any petition submitted under subclause (I) not later than 180 days after the date of receipt of the petition.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H4767DBCD2AC14156AFBF8189F04ED347"><enum>205.</enum><header>Federal enforcement of State fuels requirements</header><text display-inline="no-display-inline">Section 211(c)(4)(C) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(c)(4)(C)</external-xref>) is amended—</text> 
<paragraph id="HDA5E16CD27C946E78046DEF840C85B46"><enum>(1)</enum><text>by striking <quote>(C) A State</quote> and inserting the following:</text>

<subsection id="H65D81D31A7704ED2A1CAF29D3F43CC3F"><enum>(ii)</enum><header>Enforcement by the Administrator</header><text display-inline="yes-display-inline">In any case in which a State prescribes and enforces a control or prohibition under clause (i), the Administrator, at the request of the State, shall enforce the control or prohibition as if the control or prohibition had been adopted under the other provisions of this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H31C985CFBD064638B71976876E491DAC"><enum>206.</enum><header>Fuel system requirements harmonization study</header> 
<subsection id="HF8C8324245DB47A18BAE7759A7249005"><enum>(a)</enum><header>Study</header> 
<paragraph id="H5FB248357C84464E9B0088F96B3B58BB"><enum>(1)</enum><header>In general</header><text>The Administrator of the Environmental Protection Agency and the Secretary of Energy shall jointly conduct a study of Federal, State, and local requirements concerning motor vehicle fuels, including—</text> 
<subparagraph id="HCF268780E40A4777A44700F316338FE4"><enum>(A)</enum><text>requirements relating to reformulated gasoline, volatility (measured in Reid vapor pressure), oxygenated fuel, and diesel fuel; and</text></subparagraph> 
<subparagraph id="H688C262266184CBABED5FB00975D91F8"><enum>(B)</enum><text>other requirements that vary from State to State, region to region, or locality to locality.</text></subparagraph></paragraph> 
<paragraph id="H240C63E7FDB74418A84571D878A8DC89"><enum>(2)</enum><header>Required elements</header><text>The study shall assess—</text> 
<subparagraph id="H7C98C06404254DC3A4F9CFCEA2C1D16"><enum>(A)</enum><text>the effect of the variety of requirements described in paragraph (1) on the supply, quality, and price of motor vehicle fuels available to the consumer;</text></subparagraph> 
<subparagraph id="H249BB24A7B3B4C8093EF707C33241956"><enum>(B)</enum><text>the effect of the requirements described in paragraph (1) on achievement of—</text> 
<clause id="HD877B8F30AFD47F0A3BBA7463BC731C"><enum>(i)</enum><text>national, regional, and local air quality standards and goals; and</text></clause> 
<clause id="HE552C7AA7F9F43FA90942193E6B61B2"><enum>(ii)</enum><text>related environmental and public health protection standards and goals;</text></clause></subparagraph> 
<subparagraph id="HFC85246245F04DF18D063998D720003F"><enum>(C)</enum><text>the effect of Federal, State, and local motor vehicle fuel regulations, including multiple motor vehicle fuel requirements, on—</text> 
<clause id="H014DFE304704424397A784F676B2D275"><enum>(i)</enum><text>domestic refineries;</text></clause> 
<clause id="H254A3E57AD764FEE9C00FEF8FEA83E81"><enum>(ii)</enum><text>the fuel distribution system; and</text></clause> 
<clause id="H0FECA65DECCE47CEA414A9F46E57C5CB"><enum>(iii)</enum><text>industry investment in new capacity;</text></clause></subparagraph> 
<subparagraph id="HFF358118B85E4B0D8987605DE0ECDC88"><enum>(D)</enum><text>the effect of the requirements described in paragraph (1) on emissions from vehicles, refineries, and fuel handling facilities;</text></subparagraph> 
<subparagraph id="HC9188EC23BD149FEA23361D1A72D5436"><enum>(E)</enum><text>the feasibility of developing national or regional motor vehicle fuel slates for the 48 contiguous States that, while protecting and improving air quality at the national, regional, and local levels, could—</text> 
<clause id="H4E5FE0A0009540F994A16009F02DC98"><enum>(i)</enum><text>enhance flexibility in the fuel distribution infrastructure and improve fuel fungibility;</text></clause> 
<clause id="H1FB0818353554207B48E47F161EF3315"><enum>(ii)</enum><text>reduce price volatility and costs to consumers and producers;</text></clause> 
<clause id="H54AEDB424E454280A7AF8CB3191CB47"><enum>(iii)</enum><text>provide increased liquidity to the gasoline market; and</text></clause> 
<clause id="H81EB4B4DB8A04E9796BA8EA8DD73C93"><enum>(iv)</enum><text>enhance fuel quality, consistency, and supply; and</text></clause></subparagraph> 
<subparagraph id="HABB79944AA9041E197AF00E5CC80C2CC"><enum>(F)</enum><text>the feasibility of providing incentives, and the need for the development of national standards necessary, to promote cleaner burning motor vehicle fuel.</text></subparagraph></paragraph></subsection> 
<subsection id="H00E0D5C402304D579E002F005D6B52CE"><enum>(b)</enum><header>Report</header> 
<paragraph id="HC4738A938B7741A0B5B757BEF4005B00"><enum>(1)</enum><header>In general</header><text>Not later than June 1, 2006, the Administrator of the Environmental Protection Agency and the Secretary of Energy shall submit to Congress a report on the results of the study conducted under subsection (a).</text></paragraph> 
<paragraph id="H6F380EA00F3C4B3D81CCD2356B427F2"><enum>(2)</enum><header>Recommendations</header> 
<subparagraph id="H21C39E16F6C4417EAD91307C2C8CCB14"><enum>(A)</enum><header>In general</header><text>The report shall contain recommendations for legislative and administrative actions that may be taken—</text> 
<clause id="HCFF3BC2173D440EBA4D17074F2E96EC3"><enum>(i)</enum><text>to improve air quality;</text></clause> 
<clause id="HE58615D1F6FE49789411D3D2BBAE91"><enum>(ii)</enum><text>to reduce costs to consumers and producers; and</text></clause> 
<clause id="H2CAD27C427A94225A185DBB327215674"><enum>(iii)</enum><text>to increase supply liquidity.</text></clause></subparagraph> 
<subparagraph id="H947586E03A8B4E8F92DFC723B0E84E04"><enum>(B)</enum><header>Required considerations</header><text>The recommendations under subparagraph (A) shall take into account the need to provide advance notice of required modifications to refinery and fuel distribution systems in order to ensure an adequate supply of motor vehicle fuel in all States.</text></subparagraph></paragraph> 
<paragraph id="HC39994ED49064FFF8320A9876856ACE7"><enum>(3)</enum><header>Consultation</header><text>In developing the report, the Administrator of the Environmental Protection Agency and the Secretary of Energy shall consult with—</text> 
<subparagraph id="H57DADF707EC841F385081FBF2D09F8EA"><enum>(A)</enum><text>the Governors of the States;</text></subparagraph> 
<subparagraph id="HD62A7013449C4A98AEA168D17CE6ABE"><enum>(B)</enum><text>automobile manufacturers;</text></subparagraph> 
<subparagraph id="HC58DDB781D5D4A9F992ED9C9EDDA41B9"><enum>(C)</enum><text>motor vehicle fuel producers and distributors; and</text></subparagraph> 
<subparagraph id="H33A152A097514E6B96CE980077DA141F"><enum>(D)</enum><text>the public.</text></subparagraph></paragraph></subsection></section> 
<section id="HE458F5FB82D749639996108C39ACDE08"><enum>207.</enum><header>Review of Federal procurement initiatives relating to use of recycled products and fleet and transportation efficiency</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator of General Services shall submit to Congress a report that details efforts by each Federal agency to implement the procurement policies specified in Executive Order No. 13101 (63 Fed.
