<section id="H68435BCEB7854F1DBAE023F1AF44FBC5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Terrorist Death Penalty Enhancement Act of 2005</short-title></quote>.</text></section> 
<title id="HCC8313D60AD94DDCB8B28C5681DA05B1"><enum>I</enum><header>Terrorist Penalties Enhancement Act</header> 
<section id="H097DDD52B50647F1A5BBF6E2C2FDBA2D"><enum>101.</enum><header>Terrorist offense resulting in death</header> 
<subsection id="H3ED39B187CA74FC69E2B99D24DDF0042"><enum>(a)</enum><header>New offense</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">Chapter 113B</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block id="H2276BE9FDDF44AC4A768DD4BF2AE22B3" style="USC"> 
<section id="H9FEAB4F898B247A5A37EB00100B6B734"><enum>2339E.</enum><header>Terrorist offenses resulting in death</header> 
<subsection id="H71C3EBBAC4EA4399A8A6C58767EC1359"><enum>(a)</enum><text>Whoever, in the course of committing a terrorist offense, engages in conduct that results in the death of a person, shall be punished by death or imprisoned for any term of years or for life.</text></subsection> 
<subsection id="HFEF9D1ED6D3A4883A5E3922C25469BCB"><enum>(b)</enum><text>As used in this section, the term <quote>terrorist offense</quote> means—</text> 
<paragraph id="H629198974089462FB83367001DB1BFAB"><enum>(1)</enum><text>a Federal felony offense that is—</text> 
<subparagraph id="H9FCF5216023F4203BC79832F8D197700"><enum>(A)</enum><text>a Federal crime of terrorism as defined in section 2332b(g) except to the extent such crime is an offense under section 1363; or</text></subparagraph> 
<subparagraph id="HE8A8A90CE687453688A6E2C962A31BBC"><enum>(B)</enum><text>an offense under this chapter, section 175, 175b, 229, or 831, or section 236 of the Atomic Energy Act of 1954; or</text></subparagraph></paragraph> 
<paragraph id="H15693CB3F3D846F9A8FDA479EFC7B153"><enum>(2)</enum><text>a Federal offense that is an attempt or conspiracy to commit an offense described in paragraph (1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2AE0E670FF84438DA38F8BAE2EE23B81"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">chapter 113B</external-xref> of title 18, United States Code, is amended by adding at the end the following new item:</text>

<section id="HD4B04747A178470CBAE34EA5EFE2001C"><enum>102.</enum><header> Denial of Federal benefits to terrorists</header> 
<subsection id="HE5283E1677CA482586A645A646BF9F64"><enum>(a)</enum><header>In General</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">Chapter 113B</external-xref> of title 18, United States Code, as amended by section 101 of this title, is further amended by adding at the end the following:</text>

<section id="H91AEEBDE7AE94ED5AF667EC2D5C554F7"><enum>2339F.</enum><header>Denial of Federal benefits to terrorists</header> 
<subsection id="H5450A0B0A4B647B484A28269666890D2"><enum>(a)</enum><text>An individual or corporation who is convicted of a terrorist offense (as defined in section 2339E) shall, as provided by the court on motion of the Government, be ineligible for any or all Federal benefits for any term of years or for life.</text></subsection> 
<subsection id="H57F4C2CD97C74B3F8EA3D594B480077"><enum>(b)</enum><text>As used in this section, the term <quote>Federal benefit</quote> has the meaning given that term in section 421(d) of the Controlled Substances Act, and also includes any assistance or benefit described in section 115(a) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, with the same limitations and to the same extent as provided in section 115 of that Act with respect to denials of benefits and assistance to which that section applies.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H920A832A74464CCC89026DC4C9930953"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of the <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">chapter 113B</external-xref> of title 18, United States Code, as amended by section 101 of this title, is further amended by adding at the end the following new item:</text>

<toc-entry level="section">2339E. Denial of federal benefits to terrorists</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HED10931A88434BF289BA4556F64BD95B"><enum>103.</enum><header>Death penalty procedures for certain air piracy cases occurring before enactment of the Federal Death Penalty Act of 1994</header><text display-inline="no-display-inline">Section 60003 of the Violent Crime Control and Law Enforcement Act of 1994, (<external-xref legal-doc="public-law" parsable-cite="pl/103/322">Public Law 103–322</external-xref>), is amended, as of the time of its enactment, by adding at the end the following:</text> 
<quoted-block id="HD2DA887940CE45B7B4BDD6E2AB34049D" style="OLC"> 
<subsection id="HBB36EA7C6B5142499ECAB74209F0A9DA"><enum>(c)</enum><header>Death penalty procedures for certain previous aircraft piracy violations</header><text>An individual convicted of violating <external-xref legal-doc="usc" parsable-cite="usc/49/46502">section 46502</external-xref> of title 49, United States Code, or its predecessor, may be sentenced to death in accordance with the procedures established in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/228">chapter 228</external-xref> of title 18, United States Code, if for any offense committed before the enactment of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="public-law" parsable-cite="pl/103/322">Public Law 103–322</external-xref>), but after the enactment of the Antihijacking Act of 1974 (<external-xref legal-doc="public-law" parsable-cite="pl/93/366">Public Law 93–366</external-xref>), it is determined by the finder of fact, before consideration of the factors set forth in sections 3591(a)(2) and 3592(a) and (c) of title 18, United States Code, that one or more of the factors set forth in former <external-xref legal-doc="usc" parsable-cite="usc/49/46503">section 46503(c)(2)</external-xref> of title 49, United States Code, or its predecessor, has been proven by the Government to exist, beyond a reasonable doubt, and that none of the factors set forth in former <external-xref legal-doc="usc" parsable-cite="usc/49/46503">section 46503(c)(1)</external-xref> of title 49, United States Code, or its predecessor, has been proven by the defendant to exist, by a preponderance of the information. The meaning of the term <quote>especially heinous, cruel, or depraved</quote>, as used in the factor set forth in former <external-xref legal-doc="usc" parsable-cite="usc/49/46503">section 46503(c)(2)(B)(iv)</external-xref> of title 49, United States Code, or its predecessor, shall be narrowed by adding the limiting language <quote>in that it involved torture or serious physical abuse to the victim</quote>, and shall be construed as when that term is used in <external-xref legal-doc="usc" parsable-cite="usc/18/3592">section 3592(c)(6)</external-xref> of title 18, United States Code.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HAD4A1E2A446544328B5F273084BD2795"><enum>104.</enum><header>Ensuring death penalty for terrorist offenses which create grave risk of death</header> 
<subsection id="H5F379446055E43209DE117D422C3DD93"><enum>(a)</enum><header>Addition of terrorism to death penalty offenses not resulting in death</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3591">Section 3591(a)(1)</external-xref> of title 18, United States Code, is amended by inserting <quote>, section 2339D,</quote> after <quote>section 794</quote>.</text></subsection> 
<subsection id="HD7873EBDA63E4CF1A4FCDC51AED84C69"><enum>(b)</enum><header>Modification of aggravating factors for terrorism offenses</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3592">Section 3592(b)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H0526BE4AB3E94205A7A6EAC34E23A1C"><enum>(1)</enum><text>in the heading, by inserting <quote>, terrorism,</quote> after <quote>espionage</quote>; and</text></paragraph> 
<paragraph id="H9C9414D7E1124673967494D1B58518D3"><enum>(2)</enum><text>by inserting immediately after paragraph (3) the following:</text>

<title id="H5274296F354C4ECB86DA8455088EDFE1"><enum>II</enum><header>Prevention of Terrorist Access to Destructive Weapons Act</header> 
<section id="H79F89142F27F401CA4688F18A9427F67"><enum>201.</enum><header>Death penalty for certain terror related crimes</header> 
<subsection id="HBDDC98B46CF34014B917ED03BA7764D1"><enum>(a)</enum><header>Participation in nuclear and weapons of mass destruction threats to the United States</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/832">Section 832(c)</external-xref> of title 18, United States Code, is amended by inserting <quote>punished by death or</quote> after <quote>shall be</quote>.</text></subsection> 
<subsection id="HDD6550AD9BA8470C8911FA4555581CF5"><enum>(b)</enum><header>Missile systems to destroy aircraft</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2332g">Section 2332g(c)(3)</external-xref> of title 18, United States Code, is amended by inserting <quote>punished by death or</quote> after <quote>shall be</quote>.</text></subsection> 
<subsection id="H9EF0EA780E8648629C72262BFE005F2"><enum>(c)</enum><header>Atomic weapons</header><text>Section 222b.of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2272">42 U.S.C. 2272</external-xref>) is amended by inserting <quote>death or</quote> before <quote>imprisonment for life</quote>.</text></subsection> 
<subsection id="HC717F927816745ACB74C55D20995EC"><enum>(d)</enum><header>Radiological dispersal devices</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2332h">Section 2332h(c)(3)</external-xref> of title 18, United States Code, is amended by inserting <quote>death or</quote> before <quote>imprisonment for life</quote>.</text></subsection> 
<subsection id="HDB26F3BDEAF64F3D9464A432D041575F"><enum>(e)</enum><header>Variola virus</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/175c">Section 175c(c)(3)</external-xref> of title 18, United States Code, is amended by inserting <quote>death or</quote> before <quote>imprisonment for life</quote>.</text></subsection> </section></title> 
<title id="H2FC0E0DD21214676B575C3147B1F09E0"><enum>III</enum><header>Federal Death Penalty Procedures</header> 
<section id="H878566D345A046A199A56BEADD04D96F"><enum>301.</enum><header>Modification of death penalty provisions</header> 
<subsection id="H8248611AF35049FA9CF36FF3F1F51F41"><enum>(a)</enum><header>Elimination of procedures applicable only to certain Controlled Substances Act cases</header><text>Section 408 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/848">21 U.S.C. 848</external-xref>) is amended by striking subsection (g) and all that follows through subsection (r).</text></subsection> 
<subsection id="HB5796542E964467D872F155B36D95087"><enum>(b)</enum><header>Modification of mitigating factors</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3592">Section 3592(a)(4)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H0ED705EA7E864C368E4EA07DB669A133"><enum>(1)</enum><text>by striking <quote>Another</quote> and inserting <quote>The Government could have, but has not, sought the death penalty against another</quote>; and</text></paragraph> 
<paragraph id="HC6C0D56CD50F4738ABC31615F8198E4F"><enum>(2)</enum><text>by striking <quote>, will not be punished by death</quote>.</text></paragraph></subsection> 
<subsection id="HFEFDA72EB536474990EBFBCBAA7B13B4"><enum>(c)</enum><header>Modification of aggravating factors for offenses resulting in death</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3592">Section 3592(c)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="HDA82010118AC4C4CBB5759AAD3C4E800"><enum>(1)</enum><text>in paragraph (7), by inserting <quote>or by creating the expectation of payment,</quote> after <quote>or promise of payment,</quote>;</text></paragraph>

<subsection id="H549844970DA64E568BBFFF94CB141C43"><enum>(d)</enum><header>Additional ground for impaneling new jury</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3593">Section 3593(b)(2)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H77E6BA1E69E249E38072F36269B745B2"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of subparagraph (C);</text></paragraph> 
<paragraph id="H53A918FA37B74B50B26700794928DA69"><enum>(2)</enum><text>by inserting after subparagraph (D) the following:</text>

<subsection id="H0518F3E6DAAD4C059B03E49FDE1272EB"><enum>(e)</enum><header>Juries of less than 12 members</header><text>Subsection (b) of <external-xref legal-doc="usc" parsable-cite="usc/18/3593">section 3593</external-xref> of title 18, United States Code, is amended by striking <quote>unless</quote> and all that follows through the end of the subsection and inserting <quote>unless the court finds good cause, or the parties stipulate, with the approval of the court, a lesser number.</quote>.</text></subsection> 
<subsection id="H091D28A74C734D5290B780F6FF3067F6"><enum>(f)</enum><header>Impaneling of new jury when unanimous recommendation cannot be reached</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3594">Section 3594</external-xref> of title 18, United States Code, is amended by inserting after the first sentence the following: <quote>If the jury is unable to reach any unanimous recommendation under section 3593(e), the court, upon motion by the Government, may impanel a jury under section 3593(b)(2)(E) for a new sentencing hearing.</quote>. </text></subsection> 
<subsection id="H918A469ABE9B45C29F32DDB2D5DF5D51"><enum>(g)</enum><header>Peremptory challenges</header><text>Rule 24(c) of the Federal Rules of Criminal Procedure is amended—</text> 
<paragraph id="HA28EF4F1EBC147A19C1007B92EBB0013"><enum>(1)</enum><text>in paragraph (1), by striking <quote>6</quote> and inserting <quote>9</quote>; and</text></paragraph> 
<paragraph id="H33E613959B66492E9BB47BA7351F1DE3"><enum>(2)</enum><text>in paragraph (4), by adding at the end the following:</text>
