<official-title>To amend the Homeland Security Act of 2002 to clarify the investigative authorities of the privacy officer of the Department of Homeland Security, and for other purposes.</official-title>

<section id="HD17647CD2479437789150945FF029FE0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Privacy Officer With Enhanced Rights Act of 2005</short-title></quote> or the <quote><short-title>POWER Act</short-title></quote>.</text></section> 
<section id="HFD1DF9100BDB4EE6A261EB56993D3D00"><enum>2.</enum><header>Authorities of the privacy officer of the Department of Homeland Security</header><text display-inline="no-display-inline"> Section 222 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/142">6 U.S.C. 142</external-xref>) is amended—</text> 
<paragraph id="H0F7953C7F92245D58C782DB312731504"><enum>(1)</enum><text>by inserting before the first sentence the following: <quote>(a) <header-in-text level="subsection" style="OLC">Appointment and responsibilities</header-in-text>.—</quote>; and</text></paragraph> 
<paragraph id="H88791B9B0E7040E3BD787FE340D690B2"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="H7BB8D64650134D2B937D3DA6DD8CB30"><enum>(b)</enum><header>Authority to investigate</header> 
<paragraph id="HE49D23ABB41749A3A98EAE9EB58B5D41"><enum>(1)</enum><header>In general</header><text>The senior official appointed under this section is specifically authorized—</text> 
<subparagraph id="HE457D8ED9B714C5F994BEF636400A9A5"><enum>(A)</enum><text>to have access to all records, reports, audits, reviews, documents, papers, recommendations, and other materials available to the Department that relate to programs and operations with respect to which the senior official has responsibilities under this section;</text></subparagraph> 
<subparagraph id="HF02ED5DD46114E798DEC8BDBD33E7610"><enum>(B)</enum><text>to make such investigations and reports relating to the administration of the programs and operations of the Department as are, in the senior official’s judgment, necessary or desirable;</text></subparagraph> 
<subparagraph id="H6E6FAA0B50FF49C6A211641923C05E86"><enum>(C)</enum><text>to require by subpoena the production, by persons other than Federal agencies, of all information, documents, reports, answers, records, accounts, papers, and other data and documentary evidence necessary to performance of the functions of the senior official under this section;</text> </subparagraph> 
<subparagraph id="H463397C525C54373A4FB4CCCE83D4520"><enum>(D)</enum><text display-inline="yes-display-inline">to administer to or take from any person an oath, affirmation, or affidavit, whenever necessary to performance of the functions of the senior official under this section; and</text></subparagraph> 
<subparagraph id="H9C69C52FBB3748A9AD7B91467D3F1623"><enum>(E)</enum><text>to take any other action that may be taken by the Inspector General of the Department, as necessary to require employees of the Department to produce documents and answer questions relevant to performance of the functions of the senior official under this section.</text> </subparagraph></paragraph> 
<paragraph id="HD0FF839C43684817B85F477E953B0907"><enum>(2)</enum><header>Enforcement of subpoenas</header><text> Any subpoena issued under paragraph (1)(C) shall, in the case of contumacy or refusal to obey, be enforceable by order of any appropriate United States district court.</text></paragraph> 
<paragraph id="HC8E6C7A6F3DC43939700AC9EEA4E5B6E"><enum>(3)</enum><header>Effect of oaths, etc</header><text>Any oath, affirmation, or affidavit administered or taken under paragraph (1)(D) by or before an employee of the Privacy Office designated for that purpose by the senior official appointed under subsection (a) shall have the same force and effect as if administered or taken by or before an officer having a seal of office.</text></paragraph> </subsection> 
<subsection id="H51E68E34BE2E4A0FA5756330AA442177"><enum>(c)</enum><header>Term of office</header><text>The term of appointment of a senior official under subsection (a) shall be 5 years.</text></subsection> 
<subsection id="H093488A77179458794AA7BA3B549FE99"><enum>(d)</enum><header>Reports to Congress</header><text>The senior official appointed under subsection (a) shall submit reports directly to the Congress regarding performance of the responsibilities of the senior official under this section, without any prior comment or amendment by the Secretary, Deputy Secretary, or any other officer or employee of the Department or the Office of Management and Budget.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
