<section id="HC32B6A61429341979821CF9B27707370" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Industrial Hemp Farming Act of 2005</short-title></quote>.</text></section> 
<section id="HBBF3D97620A54DA6BA10005024F9A869" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Exclusion of industrial hemp from definition of marihuana</header><text display-inline="no-display-inline">Paragraph (16) of section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(16)</external-xref>) is amended—</text> 
<paragraph id="HF77D8C9235DE4D549086A57FD9B90863"><enum>(1)</enum><text>by striking <quote>(16)</quote> at the beginning and inserting <quote>(16)(A)</quote>; and</text></paragraph> 
<paragraph id="H5A3EA249B5A243BFB7BDCD4D62F5FE4"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text>

<paragraph id="HACB17654D65742558D034E4C37C90026" indent="up1"><enum>(B)</enum><text>The term <quote>marihuana</quote> does not include industrial hemp. As used in the preceding sentence, the term <quote>industrial hemp</quote> means the plant Cannabis sativa L. and any part of such plant, whether growing or not, with a delta-9 tetrahydrocannabinol concentration that does not exceed 0.3 percent on a dry weight basis.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HE011E46F21F3458882E7BF3A0EDFD7"><enum>3.</enum><header>Industrial hemp determination to be made by States</header><text display-inline="no-display-inline">Section 201 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/811">21 U.S.C. 811</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="HE8A7D39983D649EAA87E291D8F11723B"><enum>(i)</enum><header>Industrial hemp determination to be made by States</header><text>In any criminal action, civil action, or administrative proceeding, a State regulating the growing and processing of industrial hemp under State law shall have exclusive authority to determine whether any such plant meets the concentration limitation set forth in subparagraph (B) of paragraph (16) of section 102 and such determination shall be conclusive and binding.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
