<official-title>To combat terrorism financing, and for other purposes.</official-title>

<section section-type="section-one" id="H67CC27A1337442B6AF59043572BA66C2" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Combating Terrorism Financing Act of 2005</short-title></quote>.</text></section> 
<section id="H5F2D0AF584D144D1BC3E009718B4DB7"><enum>2.</enum><header>Increased penalties for terrorism financing</header><text display-inline="no-display-inline">Section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) is amended—</text> 
<paragraph id="HC1FC327CB510492BA6D485CC1BDF58BC"><enum>(1)</enum><text>in subsection (a), by deleting <quote>$10,000</quote> and inserting <quote>$50,000</quote>; and</text></paragraph> 
<paragraph id="HEDDC040FB85748AA9E83001C138E793D"><enum>(2)</enum><text>in subsection (b), by deleting <quote>ten years</quote> and inserting <quote>twenty years</quote>.</text></paragraph></section> 
<section id="HDBD00D9BC5AD4BC4BF6DB6FF8DC1C470"><enum>3.</enum><header>Terrorism-related specified activities for money laundering</header> 
<subsection id="H39D9364547C64D6FAC64671FE706EA53"><enum>(a)</enum><header>Amendments to RICO</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1961">Section 1961(1)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H7ED0E70336A04104BAA70177E82DB0FC"><enum>(1)</enum><text>in subparagraph (B), by inserting <quote>section 1960 (relating to illegal money transmitters),</quote> before <quote>sections 2251</quote>; and</text></paragraph> 
<paragraph id="H57569898D6324BDE9286FCE5FF5D4092"><enum>(2)</enum><text>in subparagraph (F), by inserting <quote>section 274A (relating to unlawful employment of aliens),</quote> before <quote>section 277</quote>.</text></paragraph></subsection> 
<subsection id="H1DE1367441664013858D48CB61007570"><enum>(b)</enum><header>Amendments to Section 1956(c)(7)</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1956">Section 1956(c)(7)(D)</external-xref> of title 18, United States Code, is amended by—</text> 
<paragraph id="H02072FD2C9584B66AB48B459D73168BC"><enum>(1)</enum><text>inserting <quote>, or section 2339C (relating to financing of terrorism)</quote> before <quote>of this title</quote>; and</text></paragraph> 
<paragraph id="HA926EF169AC745A1A989C3001E8DCEF8"><enum>(2)</enum><text>striking <quote>or any felony violation of the Foreign Corrupt Practices Act</quote> and inserting <quote>any felony violation of the Foreign Corrupt Practices Act, or any violation of section 208 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (relating to obtaining funds through misuse of a social security number)</quote>.</text></paragraph></subsection> 
<subsection id="H619B346AFF90430FB6CA9072550774C9"><enum>(c)</enum><header>Conforming amendments to sections 1956<enum-in-header>(e)</enum-in-header> and 1957<enum-in-header>(e)</enum-in-header></header> 
<paragraph id="H86CA5D9772FD40D589D34914326C00D8"><enum>(1)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/1956">Section 1956(e)</external-xref> of title 18, United States Code, is amended to read as follows:</text>

<subsection id="HC2B5C8E6B4B744FD8761F5679D081439"><enum>(e)</enum><text>Violations of this section may be investigated by such components of the Department of Justice as the Attorney General may direct, and by such components of the Department of the Treasury as the Secretary of the Treasury may direct, as appropriate, and, with respect to offenses over which the Department of Homeland Security has jurisdiction, by such components of the Department of Homeland Security as the Secretary of Homeland Security may direct, and, with respect to offenses over which the United States Postal Service has jurisdiction, by the Postal Service. Such authority of the Secretary of the Treasury, the Secretary of Homeland Security, and the Postal Service shall be exercised in accordance with an agreement which shall be entered into by the Secretary of the Treasury, the Secretary of Homeland Security, the Postal Service, and the Attorney General. Violations of this section involving offenses described in paragraph (c)(7)(E) may be investigated by such components of the Department of Justice as the Attorney General may direct, and the National Enforcement Investigations Center of the Environmental Protection Agency.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HA506257152C14C8FA7177BE78BF028A0"><enum>(2)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/1957">Section 1957(e)</external-xref> of title 18, United States Code, is amended to read as follows:</text>

<subsection id="H18C7EB71B97045100017A4FCE3561DA0"><enum>(e)</enum><text>Violations of this section may be investigated by such components of the Department of Justice as the Attorney General may direct, and by such components of the Department of the Treasury as the Secretary of the Treasury may direct, as appropriate, and, with respect to offenses over which the Department of Homeland Security has jurisdiction, by such components of the Department of Homeland Security as the Secretary of Homeland Security may direct, and, with respect to offenses over which the United States Postal Service has jurisdiction, by the Postal Service. <section id="H9D17FB000F9A4DF3B29718FFDBE5292C"><enum>4.</enum><header>Assets of persons committing terrorist acts against foreign countries or international organizations</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/981">Section 981(a)(1)(G)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H36647478E91941F6A571CB24D9AC3771"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of clause (ii);</text></paragraph> 
<paragraph id="H341CF3C194094F56878E23C4BEF9116"><enum>(2)</enum><text>by striking the period at the end of clause (iii) and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="H90E37820A4474A4582C8839707B2CF5"><enum>(3)</enum><text>by inserting the following after clause (iii):</text>

<clause id="H7C8F51964E2E4D42B10239E100ED096C"><enum>(iv)</enum><text>of any individual, entity, or organization engaged in planning or perpetrating any act of international terrorism (as defined in section 2331) against any international organization (as defined in section 209 of the <act-name parsable-cite="SDBAA">State Department Basic Authorities Act of 1956</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/22/4309">22 U.S.C. 4309(b)</external-xref>) or against any foreign Government. Where the property sought for forfeiture is located beyond the territorial boundaries of the United States, an act in furtherance of such planning or perpetration must have occurred within the jurisdiction of the United States.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H5490D8F1B4284AF89BDC7BDB8F3712D9"><enum>5.</enum><header>Money laundering through hawalas</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1956">Section 1956</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block id="HFDB11F9E22A547C8894F8CA1F9DA3FD1"> 
<subsection id="H6BEE534C18244D0DB0CE302CE00066D8"><enum>(j)</enum> 
<paragraph id="HAC4E3CD522474218A5005B9DFEE2DBAA" display-inline="yes-display-inline"><enum>(1)</enum><text>For the purposes of subsections (a)(1) and (a)(2), a transaction, transportation, transmission, or transfer of funds shall be considered to be one involving the proceeds of specified unlawful activity, if the transaction, transportation, transmission, or transfer is part of a set of parallel or dependent transactions, any one of which involves the proceeds of specified unlawful activity.</text> </paragraph> 
<paragraph indent="up1" id="H64A0878E905B4A89AFFC00921EE1DFC"><enum>(2)</enum><text>As used in this section, a <quote>dependent transaction</quote> is one that completes or complements another transaction or one that would not have occurred but for another transaction.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H719006D21C2F4A69A682BAC7DDBBCEFB"><enum>6.</enum><header>Technical and conforming amendments relating to the usa PATRIOT Act</header> 
<subsection id="H05028EF43AAB401F93CE00E6EDCC4318"><enum>(a)</enum><header>Technical corrections</header> 
<paragraph id="HA9EA8CBCD46F49DDB2A8C002DCAED42"><enum>(1)</enum><text>Section 322 of <external-xref legal-doc="public-law" parsable-cite="pl/107/56">Public Law 107–56</external-xref> is amended by striking <quote>title 18</quote> and inserting <quote>title 28</quote>.</text></paragraph> 
<paragraph id="HCE0E76D7EC4F425EB5B1C9B9F6E2306"><enum>(2)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/31/5332">Section 5332(a)(1)</external-xref> of title 31, United States Code, is amended by striking <quote>article of luggage</quote> and inserting <quote>article of luggage or mail</quote>.</text></paragraph> 
<paragraph id="H73369BFC527D40AEB6210057062D0620"><enum>(3)</enum><text>Section 1956(b)(3) and (4) of title 18, United States Code, are amended by striking <quote>described in paragraph (2)</quote> each time it appears.</text></paragraph> 
<paragraph id="HB1AA33F1E83D44C79F17285EE19608DF"><enum>(4)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/981">Section 981(k)</external-xref> of title 18, United States Code, is amended by striking <quote>foreign bank</quote> each time it appears and inserting <quote>foreign bank or financial institution</quote>.</text></paragraph></subsection> 
<subsection id="H3703C58C94D24CD2994C33FA22CEFEE7"><enum>(b)</enum><header>Codification of Section 316 of the USA PATRIOT Act</header> 
<paragraph id="H1F181188474C492F8ECEAEF787D9AD86"><enum>(1)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/46">Chapter 46</external-xref> of title 18, United States Code, is amended—</text> 
<subparagraph id="H0DC3426635C24F36A947D60714FC3CC9"><enum>(A)</enum><text>by inserting at the end the following:</text>

<section id="H95DCDE29EFA74846B5629C8D5EC300B4"><enum>987.</enum><header>Anti-terrorist forfeiture protection</header> 
<subsection id="HA65D854AE32B4D9D899DEDE763C325DB"><enum>(a)</enum><header>Right to contest</header><text>An owner of property that is confiscated under this chapter or any other provision of law relating to the confiscation of assets of suspected international terrorists, may contest that confiscation by filing a claim in the manner set forth in the Federal Rules of Civil Procedure (Supplemental Rules for Certain Admiralty and Maritime Claims), and asserting as an affirmative defense that—</text> 
<paragraph id="HA2C15ED7DF694FBCBFED2397F0262ED8"><enum>(1)</enum><text>the property is not subject to confiscation under such provision of law; or</text></paragraph> 
<paragraph id="H785AA1A983BC43B2804CC98809338BD1"><enum>(2)</enum><text>the innocent owner provisions of section 983(d) apply to the case.</text></paragraph></subsection> 
<subsection id="H309DAF19848646638BE4BFE88D16F179"><enum>(b)</enum><header>Evidence</header><text>In considering a claim filed under this section, a court may admit evidence that is otherwise inadmissible under the Federal Rules of Evidence, if the court determines that the evidence is reliable, and that compliance with the Federal Rules of Evidence may jeopardize the national security interests of the United States.</text></subsection> 
<subsection id="H22B10CAB58E64FF78489771B4E8614B0"><enum>(c)</enum><header>Clarifications</header> 
<paragraph id="H05CF786ACBB84C4F00DE5288DB2C4217"><enum>(1)</enum><header>Protection of rights</header><text>The exclusion of certain provisions of Federal law from the definition of the term <term>civil forfeiture statute</term> in section 983(i) shall not be construed to deny an owner of property the right to contest the confiscation of assets of suspected international terrorists under—</text> 
<subparagraph id="H0166F381C45E422DBAEE4B04CA093998"><enum>(A)</enum><text>subsection (a) of this section;</text></subparagraph> 
<subparagraph id="H0F4FFF3A6F4C4124A25275EA00DAA813"><enum>(B)</enum><text>the Constitution; or</text></subparagraph> 
<subparagraph id="H5D47501C3C9E443F9DA6ADDFEAA37089"><enum>(C)</enum><text>subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>).</text></subparagraph></paragraph> 
<paragraph id="HD29F4C41275948A5B047A07BFAAB2139"><enum>(2)</enum><header>Savings clause</header><text>Nothing in this section shall limit or otherwise affect any other remedies that may be available to an owner of property under section 983 or any other provision of law.</text></paragraph></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H7BABFB2E981C447EA42852488F9D7D15"><enum>(B)</enum><text>in the chapter analysis, by inserting at the end the following:</text>

<subsection id="H08EA3DAC92C54A39BD4234C234531B30"><enum>(c)</enum><header>Conforming amendments concerning conspiracies</header> 
<paragraph id="H50ADEA1914654F9FBC09FBA6182C4F86"><enum>(1)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/33">Section 33(a)</external-xref> of title 18, United States Code is amended by inserting <quote>or conspires</quote> before <quote>to do any of the aforesaid acts</quote>.</text></paragraph> 
<paragraph id="HB8256A1D64DD4994B4BD9E8338EBC941"><enum>(2)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/1366">Section 1366(a)</external-xref> of title 18, United States Code, is amended—</text> 
<subparagraph id="H2913D90A1361418F9F33227C232F4803"><enum>(A)</enum><text>by striking <quote>attempts</quote> each time it appears and inserting <quote>attempts or conspires</quote>; and</text></subparagraph> 
<subparagraph id="HEF1E549DD1674478951B12EECBE7B715"><enum>(B)</enum><text>by inserting <quote>, or if the object of the conspiracy had been achieved,</quote> after <quote>the attempted offense had been completed</quote>.</text></subparagraph></paragraph></subsection></section> 
<section id="H2123341ECEDD4DF5A547BD22A8EEF908"><enum>7.</enum><header>Technical corrections to financing of terrorism statute</header> <text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2332b">Section 2332b(g)(5)(B)</external-xref> of title 18, United States Code, is amended by inserting <quote>)</quote> after <quote>2339C (relating to financing of terrorism</quote>.</text></section> 
<section id="H5FBE9329774A42C0B02DCE007ECF1DA"><enum>8.</enum><header>Cross reference correction</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/5318">Section 5318(n)(4)(A)</external-xref> of title 31, United States Code, is amended by striking <quote>National Intelligence Reform Act of 2004</quote> and inserting <quote>Intelligence Reform and Terrorism Prevention Act of 2004</quote>.</text></section>
