<section id="H0BE2782AADDE4797BA5DF4797B476991" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Protection of Coal Industry Health Benefits</header> 
<subsection id="HB94B52837F474CFE903EB7B047004784"><enum>(a)</enum><header>Prohibition on termination or modification of benefits</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/9711">Section 9711(g)</external-xref> of the Internal Revenue Code of 1986 (relating to rules applicable to this part and part II) is amended by adding at the end the following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="H45493CCFC13F4F9BB52274F461F36B13"><enum>(3)</enum><header>Prohibition on termination and modification of benefits</header><text>Except as provided in subsection (d), the benefits required to be provided by a last signatory operator under this chapter may not be terminated or modified by any court in a proceeding under title 11 of the United States Code or by agreement at any time when such operator is participating in such a proceeding.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H1F5AAE56DF3C4CCA9800004172C5D01F"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on January 1, 2004.</text></subsection></section>
