<legis-type>A BILL</legis-type> 
<official-title>To amend the Internal Revenue Code of 1986 to increase, extend, and make permanent the above-the-line deduction for certain expenses of elementary and secondary school teachers.</official-title>

<section id="H9CFE232013B04CCBBEA078007CE93803" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Teacher Tax Relief Act of 2005</short-title></quote>.</text></section> 
<section id="H0759BD98337442A2B21458E05F2C2E61"><enum>2.</enum><header>Deduction for certain expenses of school teachers</header> 
<subsection id="HD34E16460B74440F8E4FEDAFF0A64E"><enum>(a)</enum><header>Increase in deduction</header><text>Subparagraph (D) of <external-xref legal-doc="usc" parsable-cite="usc/26/62">section 62(a)(2)</external-xref> of the Internal Revenue Code of 1986 (relating to certain trade and business deductions of employees) is amended by striking <quote>$250</quote> and inserting <quote>$400</quote>.</text></subsection> 
<subsection id="H4CEF7EA57BB14415AE1EF19331E1A5BD"><enum>(b)</enum><header>Professional development expenses</header><text>Subparagraph (D) of section 62(a)(2) of such Code is amended—</text> 
<paragraph id="H0F46D8F161E543B5A2F3AF24FE8D2700"><enum>(1)</enum><text>by striking <quote>educator in connection</quote> and all that follows and inserting <quote>educator—</quote>, and</text></paragraph> 
<paragraph id="H9E9B19F9B75D4945BCE80076C9C38876"><enum>(2)</enum><text>by inserting at the end the following:</text> 
<quoted-block style="OLC" id="H58DD025B9C23420D9EC1FEAF02CE8364" display-inline="no-display-inline"> 
<clause id="H8CEC1F733F034674B3267E583F7D5E3C"><enum>(i)</enum><text>by reason of the participation of the educator in professional development courses related to the curriculum in which the educator provides instruction or to the students for which the educator provides instruction, and</text></clause> 
<clause id="H5A04321EDB5C4065BD70D809B527303B"><enum>(ii)</enum><text display-inline="yes-display-inline">in connection with books, supplies (other than nonathletic supplies for courses of instruction in health or physical education), computer equipment (including related software and services) and other equipment, and supplementary materials used by the eligible educator in the classroom.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HC43A0A599E3741E581FEFD00B69B5321"><enum>(c)</enum><header>Permanent deduction</header><text display-inline="yes-display-inline">Subparagraph (D) of section 62(a)(2) of such Code is amended by striking <quote>In the case of taxable years beginning during 2002, 2003, 2004, or 2005, the deductions</quote> and inserting <quote>The deductions</quote>.</text></subsection> 
<subsection id="HF37E2B2A5FD84C2FAD4E9BEA1734AB32" display-inline="no-display-inline"><enum>(d)</enum><header>Eligible educator technical amendment</header><text>Subparagraph (A) of section 62(d)(1) of such Code is amended by inserting <quote>ending during the taxable year</quote> before the period. </text></subsection> 
<subsection id="HCB0016B4E62F40DAB633D2E70266DB7B"><enum>(e)</enum><header>Effective date</header> 
<paragraph id="H163120AFAA2C43A5B7716632959434EB"><enum>(1)</enum><header>In general</header><text>The amendments made by subsections (a), (b), and (c) shall apply to taxable years beginning after December 31, 2005. </text></paragraph> 
<paragraph id="HC59D31AB0ECF4288002E59B3DB13EAF"><enum>(2)</enum><header>Technical amendment</header><text>The amendment made by subsection (d) shall apply to taxable years beginning after December 31, 2001.</text></paragraph></subsection> </section>
