<official-title>To direct the Secretary of Veterans Affairs to conduct a demonstration project for the improvement of business practices of the Veterans Health Administration.</official-title>

<section id="H104CE66B28C24B570074E8C4DD800AF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Medical Care Revenue Enhancement Act of 2005</short-title></quote>.</text></section> 
<section id="H6F1C24A94FCB4A8BAFF2F316FB1273EF"><enum>2.</enum><header>Demonstration project to improve business practices of Veterans Health Administration</header> 
<subsection id="HE8B72B7F9D624B1594473B6EA672391D" display-inline="no-display-inline"><enum>(a)</enum><header>Demonstration project required</header> 
<paragraph id="HB91E7F2DE7564B38AB14770322755900"><enum>(1)</enum><header>In general</header><text>The Secretary of Veterans Affairs shall conduct a demonstration project under this section for the improvement of business practices of the Veterans Health Administration.</text></paragraph> 
<paragraph id="HF47EEADF4ECE4FD7B63CE134FB6C0053"><enum>(2)</enum><header>Performance-based contract</header><text> To carry out the demonstration project, the Secretary shall enter into a performance-based contract for a contractor to carry out the functions specified in subsection (e).</text></paragraph> 
<paragraph id="H9D9D2200487A46BDAE4C831E641523A0"><enum>(3)</enum><header>Cost limitation</header><text>The total amount paid to the contractor under the contract may not exceed $10,000,000.</text></paragraph></subsection> 
<subsection id="H81D4A73530724CEDA43066483F4B9146"><enum>(b)</enum><header>Commencement and duration of project</header><text>The demonstration project shall be conducted during the two-year period beginning on the first day of the first month beginning more than 120 days after the date of the enactment of this Act.</text></subsection> 
<subsection id="H57C93C900A3143A4BAA7CFD88B4589E"><enum>(c)</enum><header>Sites for conduct of project</header><text display-inline="yes-display-inline">The Secretary shall conduct the demonstration project at two medical centers of the Veterans Health Administration within the same service area (referred to as a Veterans Integrated Service Network) of the Veterans Health Administration. The two medical centers at which the project is conducted shall be selected by the Secretary from among medical centers that are located in those services areas of the Veterans Health Administration that the Secretary determines have relatively low rates of recovery or collection of indebtedness from third-party payors under <external-xref legal-doc="usc" parsable-cite="usc/38/1729">section 1729</external-xref> of title 38, United States Code.</text></subsection> 
<subsection id="H446C17D13B204024835CAED885207C00"><enum>(d)</enum><header>Selection of contractor</header><text display-inline="yes-display-inline">The Secretary shall carry out the process for selection of the contractor for the demonstration project so that the contractor to perform the contract is selected, and the contract is awarded, not later than three months after the date of the enactment of this Act. The contractor shall be an entity or organization that has significant experience in the administrative processing of health care charges and claims. </text></subsection> 
<subsection id="H03D53B99A92B4CC38D76F8F6E324492C"><enum>(e)</enum><header>Functions of contractor</header><text display-inline="yes-display-inline">The Secretary shall provide in the contract for the following functions of the contractor with respect to each facility at which the demonstration project is conducted:</text> 
<paragraph id="H5340BDE04F2F419BA2D886005CFB0018"><enum>(1)</enum><text>Establishment of a plan to standardize and coordinate all activities related to billing for health-care items and services furnished to veterans for non-service-connected disabilities.</text></paragraph> 
<paragraph id="HC1208D14FD7249A983BA69B8976353F3"><enum>(2)</enum><text>Reengineering of the business processes for billing and accounts receivable activities.</text></paragraph> 
<paragraph id="H0F0ECDE7960C44BDBCAC89DF16B3C194"><enum>(3)</enum><text>Application of commercial-industry standards for measures of access, timeliness, and performance.</text></paragraph> 
<paragraph id="HD69CC40F34BF474EA86E85B97EFBA24D"><enum>(4)</enum><text>Establishment of a database containing third-party payor information for veterans receiving health care and services.</text></paragraph> 
<paragraph id="H3074AAF97D5840B986A0D746968FFA37"><enum>(5)</enum><text>Such other requirements with respect to business practices as the Secretary may specify.</text></paragraph></subsection> 
<subsection id="H6AE903AFEB5746E3A32BEC585297439B"><enum>(f)</enum><header>VHA project manager</header><text>As part of the demonstration project, the Secretary shall ensure that a Veterans Health Administration employee is designated to be the full-time project manager for the project and that such employee’s duty station is at one of the medical centers at which the project is conducted, with provision for visits as needed to the other medical center at which the project is conducted.</text></subsection> 
<subsection id="H0863AF2273BA494EB49F219EA8605FE5"><enum>(g)</enum><header>Employee protection</header><text display-inline="yes-display-inline">The Secretary shall administer the demonstration project so that during the period of the conduct of the demonstration project there is no reduction in full-time equivalent employees of the Department of Veterans Affairs at the medical centers at which the project is conducted that is attributable to the conduct of the demonstration project.</text></subsection> 
<subsection id="H8DDBAA70168B4E2994EED80B69F0044"><enum>(h)</enum><header>Reports to Congress</header> 
<paragraph id="H83F38AED13084BBC9BCC4000BF5E1D01"><enum>(1)</enum><header>Periodic progress reports on project implementation</header>
<subparagraph id="HB9AF16E973024685AF47EEF854A640DC"><enum>(A)</enum><header>Reports required</header><text>The Secretary shall submit to Congress progress reports on the implementation of the demonstration project.</text></subparagraph>
<subparagraph id="H29A51B122338434CB91862D5D6828C"><enum>(B)</enum><header>Time for progress reports</header><text> Such reports shall be submitted as expeditiously as feasible after the end of—</text>
<clause id="HE957DA9F99E5479CAD393EF109810000"><enum>(i)</enum><text>the 60-day period, the 90-day period, and the 180-day period beginning on the date of the enactment of this Act; and</text></clause>
<clause id="HA1D7DB22C3C149AEACC2FC9401004C20"><enum>(ii)</enum><text display-inline="yes-display-inline">the 60-day period, the 90-day period, and the 180-day period beginning on the date of the award of the contract under subsection (d).</text></clause></subparagraph>
<subparagraph id="H2D7ECF6A143F45AC8E087E73006926DD"><enum>(C)</enum><header>Matter to be included</header><text>Each report under this paragraph shall set out the progress to date on the implementation of the demonstration project, including—</text> 
<clause id="H09A4EB90B4084A549DA8CC09AB151069"><enum>(i)</enum><text>before the contractor has been selected, progress toward selection of the contractor (identified by the steps in the acquisition process that have been accomplished and that remain to be accomplished); and</text></clause>
<clause id="H123699EF0DC94F6DA8D61BA927322395"><enum>(ii)</enum><text>after the contractor has been selected, the contractor’s progress in initiating and carrying out the demonstration project in accordance with the requirements of this section.</text></clause></subparagraph></paragraph> 
<paragraph id="HB99CE58D14B8469FAC8B6674D17C5552" display-inline="no-display-inline"><enum>(2)</enum><header>Interim reports on project operation</header><text>After the completion of the first 12 months, and after the completion of the first 18 months, of the demonstration project, the Secretary shall submit to Congress an interim report on the operation of the demonstration project to that date. Each such report shall include the following:</text> 
<subparagraph id="H476364334C174CA384D17887850180EE"><enum>(A)</enum><text>The assessment of the Secretary as to whether the rate of recovery or collection of indebtedness owed the United States from third-party payors has improved by reason of the project.</text></subparagraph> 
<subparagraph id="H9112FB4E70C74A5C97681214F81BE4B1"><enum>(B)</enum><text display-inline="yes-display-inline">The assessment of the Secretary as to the performance of the contractor.</text></subparagraph> 
<subparagraph id="H12560928C7BE438CAD3F003FB010FCE4"><enum>(C)</enum><text>Estimated cost savings to the Department as a result of the project.</text></subparagraph></paragraph> 
<paragraph id="H9011F7FA9871428CA5FF00E2F1A96844"><enum>(3)</enum><header>Final report</header><text>After the conclusion of the demonstration project, the Secretary shall submit to Congress a final report on the project. The Secretary shall include in that report the matters specified in paragraph (2) and the Secretary’s recommendation for implementing on a permanent basis the recovery or collection system tested in the demonstration project and expanding the demonstration project to other facilities of the Veterans Health Administration. The final report shall be submitted not later than 90 days after the conclusion of the demonstration project.</text></paragraph></subsection> 
<subsection id="HC9C799EE590B491EA9F5A0560083C218"><enum>(i)</enum><header>Comptroller General review and reports</header> 
<paragraph id="HD4CA3A828E424068A757343BCE2C2443"><enum>(1)</enum><header>Review</header><text>The Comptroller General shall review the demonstration project on an ongoing basis.</text></paragraph> 
<paragraph id="H3CD89E39FB9F4EBB89CBF5024DF9BD6C"><enum>(2)</enum><header>Reports</header><text>The Comptroller General shall submit to Congress a report on the Comptroller General’s findings and recommendations concerning the demonstration project—</text> 
<subparagraph id="HFE340856545C48449D9FCB257632BB39"><enum>(A)</enum><text>after the operation of the demonstration project for a period of one year; and</text></subparagraph> 
<subparagraph id="H74FE5756A3A645F28100619D563BDE68"><enum>(B)</enum><text>after the operation of the demonstration project for a period of two years.</text></subparagraph></paragraph></subsection> 
<subsection id="HFD8B0728C24545CF92A300BBBA8F924"><enum>(j)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary of Veterans Affairs for the conduct of the demonstration project under this section the sum of $10,000,000.</text></subsection></section>
