<official-title>To amend title 10, United States Code, to allow a participant in the military Survivor Benefit Plan who has designated an insurable interest beneficiary under that plan to designate a new beneficiary upon the death of the previously designated beneficiary.</official-title>

<section id="H98901AD4FD4B4ED5A727F8C1C1AF6582" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Survivor Benefit Plan Insurable Interest Fairness Act</short-title></quote>.</text> </section> 
<section id="H1B79509E52CA44C69C9FC55C4EF2C676"><enum>2.</enum><header>Military survivor benefit plan beneficiaries under insurable interest coverage</header> 
<subsection id="HD9536E55A0514967AD4676741C3E9C75"><enum>(a)</enum><header>Authority to designate new beneficiary</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/1448">Section 1448(b)(1)</external-xref> of title 10, United States Code, is amended—</text> 
<paragraph id="H42A984887EF6452B9200FD48A5831F00"><enum>(1)</enum><text>by inserting <quote>under subparagraph (F)</quote> in the second sentence of subparagraph (E) after <quote>election</quote>; and</text></paragraph> 
<paragraph id="H95E47091D2224E2DA310CA8DAECA60BC"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="HA209BAD10EFF4B02B534A11D7FB61BB"><enum>(F)</enum><header>Election of new beneficiary upon death of previous beneficiary</header><text>If the reason for discontinuation in the Plan is the death of the beneficiary, the participant in the Plan may designate a new beneficiary. Any such beneficiary must be a natural person with an insurable interest in the participant. Such an election may be made only during the 180-day period beginning on the date of the death of the previous beneficiary. Such an election shall be in writing, signed by the participant, and made in such form and manner as the Secretary concerned may prescribe. Such an election shall be effective the first day of the first month following the month in which the election is received by the Secretary.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H770A086248074C9294FB1DA372FC36E"><enum>(b)</enum><header>Transition</header> 
<paragraph id="HE7D3FDC3C6864ABE92F825C209EAD7F5"><enum>(1)</enum><header>Transition period</header><text>In the case of a person who made a covered insurable-interest election under the Survivor Benefit Plan and whose designated beneficiary under that election dies before the date of the enactment of this Act or during the 18-month period beginning on such date, the time period applicable for purposes of the limitation in the third sentence of subparagraph (F) of <external-xref legal-doc="usc" parsable-cite="usc/10/1448">section 1448(b)(1)</external-xref> of title 10, United States Code, as added by subsection (a), shall be the two-year period beginning on the date of the enactment of this Act (rather than the 180-day period specified in that sentence).</text></paragraph> 
<paragraph id="HA5C3579CF23649D69CEEAE9BD6D721E2"><enum>(2)</enum><header>Covered insurable-interest elections</header><text>For purposes of paragraph (1), a covered insurable-interest election is an election under <external-xref legal-doc="usc" parsable-cite="usc/10/1448">section 1448(b)(1)</external-xref> of title 10, United States Code, made before the date of the enactment of this Act, or during the 18-month period beginning on such date, by a participant in the military Survivor Benefit Plan to provide an annuity under that plan to a natural person with an insurable interest in that person.</text></paragraph> 
<paragraph id="H513D35AB4EC14029AA118D04B4DEFA4D"><enum>(3)</enum><header>Survivor benefit plan</header><text>For purposes of this subsection, the term <quote>Survivor Benefit Plan</quote> means the program under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/73">chapter 73</external-xref> of title 10, United States Code.</text></paragraph></subsection></section>
