<section id="H9270957F69B3450FACBDBF99118484E0" section-type="section-one"><enum>1.</enum><header>Montana indian tribes; agreement with dry prairie rural water association, incorporated</header> 
<subsection id="HD403E0C119E04210A389EC9EA65FA2EC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Assiniboine and Sioux Tribes of the Fort Peck Indian Reservation (referred to in this section as the <quote>Tribes</quote>) may, with the approval of the Secretary of the Interior, enter into a lease or other temporary conveyance of water rights recognized under the Fort Peck-Montana Compact (Montana Code Annotated 85–20-201) for the purpose of meeting the water needs of the Dry Prairie Rural Water Association, Incorporated (or any successor entity), in accordance with section 5 of the Fort Peck Reservation Rural Water System Act of 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/382">Public Law 106–382</external-xref>; 114 Stat. 1454).</text></subsection> 
<subsection id="H8C8EB21FF6C8478792BE60C73907F8A"><enum>(b)</enum><header>Conditions of lease</header><text display-inline="yes-display-inline">With respect to a lease or other temporary conveyance described in subsection (a)—</text> 
<paragraph id="HCFFF8DB7012A4AE985A7188BA1EC940"><enum>(1)</enum><text>the term of the lease or conveyance shall not exceed 100 years; </text></paragraph> 
<paragraph id="H2E9A382B15B745BABFB231A4063EDC72"><enum>(2)</enum><text>the lease or conveyance may be approved by the Secretary of the Interior without monetary compensation to the Tribes; and </text></paragraph> 
<paragraph id="H5D80243E48874BE7B759D4F8AAFB72DB"><enum>(3)</enum><text>the Secretary of the Interior shall not be subject to liability for any claim or cause of action relating to the compensation or consideration received by the Tribes under the lease or conveyance. </text></paragraph></subsection> 
<subsection id="HA4C585E662BF402CA747192B659657F5"><enum>(c)</enum><header>No permanent alienation of water</header><text>Nothing in this section authorizes any permanent alienation of any water by the Tribes. </text> </subsection></section>
