<official-title>To amend title 9 of the United States Code to exclude all employment contracts from the arbitration provisions of chapter 1 of such title; and for other purposes.</official-title>

<section section-type="section-one" id="H47576C6086B944D8BC9B67CBCBC1DFEE" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preservation of Civil Rights Protections Act of 2005</short-title></quote>.</text></section> 
<section id="H628677A5BAF940E4B092002F7D80AA9"><enum>2.</enum><header>Amendment to Federal arbitration Act</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/9/1">Section 1</external-xref> of title 9, United States Code, is amended by striking <quote>of seamen</quote> and all that follows through <quote>commerce</quote>.</text></section> 
<section id="HB54DBF3146B9475CBE30490771D5AC3F"><enum>3.</enum><header>Unenforceability of arbitration clauses in employment contracts</header> 
<subsection id="H6E469DD9D7D84B1CA2BD92C6BECD677B"><enum>(a)</enum><header>Protection of employee rights</header><text>Notwithstanding any other provision of law, any clause of any agreement between an employer and an employee that requires arbitration of a claim arising under the Constitution or laws of the United States shall not be enforceable.</text></subsection> 
<subsection id="H2588A0F9A53644C181EF53C4D06B4B4"><enum>(b)</enum><header>Exceptions</header> 
<paragraph id="HAE5998485A774AFE80CE20BD531CC616"><enum>(1)</enum><header>Waiver or consent after claim arises</header><text>Subsection (a) shall not apply with respect to any claim if, after such claim arises, the parties involved voluntarily consent to submit such claim to arbitration.</text></paragraph> 
<paragraph id="HB0076D3ED6AA4B08A8E723B01290FE96"><enum>(2)</enum><header>Collective bargaining agreements</header><text>Subsection (a) shall not preclude an employee or union from enforcing any of the rights or terms of a valid collective bargaining agreement.</text></paragraph></subsection></section> 
<section id="H3758C67897F44BCEBB8C8BF225177663"><enum>4.</enum><header>Application of amendments</header><text display-inline="no-display-inline">This Act and the amendment made by section 2 shall apply with respect to all employment contracts in force before, on, or after the date of the enactment of this Act.</text></section>
