<official-title>To amend title 28, United States Code, to clarify that the Court of Appeals for the Federal Circuit has exclusive jurisdiction of appeals relating to patents, plant variety protection, or copyrights, and for other purposes.</official-title>

<section id="H91D4AAA8431C4D00AA0009297272B3F8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Intellectual Property Jurisdiction Clarification Act of 2005</short-title></quote>.</text></section> 
<section id="HE3B8B526985043518F942E00293729B2" section-type="subsequent-section"><enum>2.</enum><header>State court jurisdiction</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/28/1338">Section 1338(a)</external-xref> of title 28, United States Code, is amended by striking the second sentence and inserting the following: <quote>No State court shall have jurisdiction over any claim for relief arising under any Act of Congress relating to patents, plant variety protection, or copyrights.</quote>.</text></section> 
<section id="HA0E0254BD7B74F3AB4E8BBCD2C60969"><enum>3.</enum><header>Court of Appeals for the Federal Circuit</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/28/1295">Section 1295(a)(1)</external-xref> of title 28, United States Code, is amended to read as follows:</text>

<paragraph id="HF4BE165E717741D1B63BE941E7F4E00"><enum>(1)</enum><text>of an appeal from a final decision of a district court of the United States, the District Court of Guam, the District Court of the Virgin Islands, or the District Court of the Northern Mariana Islands, in any civil action in which a party has asserted a claim for relief arising under any Act of Congress relating to patents or plant variety protection;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H956A463DAEAC42A0B92404EC12C4634"><enum>4.</enum><header>Removal</header> 
<subsection id="H2CBA02AF3E544107AEB177CFAAD0ABC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/89">Chapter 89</external-xref> of title 28, United States Code, is amended by adding at the end the following new section:</text>

<section id="HBD22DCFFC47A4AD6A6058EF84D912CE5"><enum>1454.</enum><header>Patent, plant variety protection, and copyright cases</header> 
<subsection id="HF301A16AB12A4EE982539448A700EFD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A civil action in which any party asserts a claim for relief arising under any Act of Congress relating to patents, plant variety protection, or copyrights may be removed to the district court of the United States for the district and division embracing the place where such action is pending.</text></subsection> 
<subsection id="HADF182DECE9343B5B24F82C15E091C12"><enum>(b)</enum><header>Special rules</header><text>The removal of an action under this section shall be made in accordance with section 1446 of this chapter, except that if the removal is based solely on this section—</text> 
<paragraph id="H2BA98E5A13444C559E395BAD004B77E1"><enum>(1)</enum><text>the action may be removed by any party; and</text></paragraph> 
<paragraph id="HBF76AE15C1454BC2A4D8568F62FCF1E"><enum>(2)</enum><text>the time limitations contained in section 1446(b) may be extended at any time for cause shown.</text></paragraph></subsection> 
<subsection id="HDC6D6201C37C45578BF94C7679DE43DF"><enum>(c)</enum><header>Remand</header><text>If a civil action is removed solely under this section, the district court—</text> 
<paragraph id="H1A1AC904B9274C45886352CB7663D4AC"><enum>(1)</enum><text>shall remand all claims that are not within the original or supplemental jurisdiction of the district court under any Act of Congress; and</text></paragraph> 
<paragraph id="H855E5BFE17E24811AE6350600239D28"><enum>(2)</enum><text display-inline="yes-display-inline">may, under the circumstances specified in section 1367(c), remand any claims within the supplemental jurisdiction of the district court under section 1367.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4DD8D601FEA149B194B63CFF5E1E006B"><enum>(b)</enum><header>Conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/89">chapter 89</external-xref> of title 28, United States Code, is amended by adding at the end the following new item:</text>

<section id="HC42C0ED642DD4BDA80A3FBED34AC4212"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply to any civil action commenced on or after the date of the enactment of this Act.</text> </section>
