<section section-type="section-one" id="H03A1A084203647EE9DCA8754D6B7056D" display-inline="no-display-inline"><enum>1.</enum><header>Tax treatment of civilian employees of Department of Defense in combat zones</header> 
<subsection id="HE865FA25827E4A5A8D1345DFE2844F6"><enum>(a)</enum><header>Exclusion of combat zone compensation</header> 
<paragraph id="H02D46E31FE3C4A0394E1D043624CA735"><enum>(1)</enum><header>In general</header><text>Subsection (d) of <external-xref legal-doc="usc" parsable-cite="usc/26/112">section 112</external-xref> of the Internal Revenue Code of 1986 (relating to prisoners of war, etc.) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H325EA790A5AC4F38B3BB6915A77991E8"><enum>(4)</enum><header>Civilian employees of Department of Defense</header> 
<subparagraph id="HA16F667A8D9141738808A5FFA4640042"><enum>(A)</enum><header>Service in combat zone</header><text>Gross income does not include so much of compensation as does not exceed the maximum enlisted amount received for active service as a civilian employee of the Department of Defense serving in support of the Armed Forces of the United States for any month during any part of which such employee—</text> 
<clause id="H1FE89386889140FBA9DFBBA1D65B0D5"><enum>(i)</enum><text>served in a combat zone,</text></clause> 
<clause id="H531B8AE1A39744798BD92878DB97D3A7"><enum>(ii)</enum><text>was hospitalized as a result of wounds, disease, or injury incurred while serving in a combat zone, or</text></clause> 
<clause id="H5F3D2E462A19498283251C005412637D"><enum>(iii)</enum><text>is in a missing status as a result of such service.</text></clause><continuation-text continuation-text-level="subparagraph">Clause (ii) shall not apply for any month beginning more than 2 years after the date of the termination of combatant activities in such zone.</continuation-text></subparagraph> 
<subparagraph id="H0E907ABD8D2E424BB5F81F72824EE8E8"><enum>(B)</enum><header>Missing status</header><text>For purposes of this paragraph, the terms <term>active service</term> and <term>missing status</term> have the respective meanings given to such terms by <external-xref legal-doc="usc" parsable-cite="usc/5/5561">section 5561</external-xref> of title 5 of the United States Code.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<subparagraph id="HDBCD592665E047209E009333CF96EA7"><enum>(A)</enum><text>The heading for section 112 of such Code is amended to read as follows:</text>

<subparagraph id="H4A5B1ECB633044409864297D296C9578"><enum>(B)</enum><text>The item relating to section 112 in the table of sections for part III of subchapter B of chapter 1 of such Code is amended to read as follows:</text>

<subsection id="HD4CE4D801D344E87B935FB7510D4E468"><enum>(b)</enum><header>Additional estate tax not to apply</header> 
<paragraph id="H963348B23384442C99B8D026B35F121F"><enum>(1)</enum><header>In general</header><text>Subsection (b) of section 2201 of such Code is amended by inserting <quote>or while in service as a civilian employee of the Department of Defense serving in support of the Armed Forces of the United States,</quote> after <quote>United States,</quote>.</text></paragraph> 
<paragraph id="H5A51E2A06242425284E7D552D8410012"><enum>(2)</enum><header>Clerical amendments</header> 
<subparagraph id="H6AD546B2F2CC4499A2DE3B781CE69333"><enum>(A)</enum><text>The heading for section 2201 of such Code is amended by inserting <quote><header-in-text>and department of defense civilians</header-in-text></quote> after <quote><header-in-text>members of the armed forces</header-in-text></quote>.</text></subparagraph> 
<subparagraph id="H4D32FD99F4CC4C29AF30004C26F11265"><enum>(B)</enum><text>The item relating to section 2201 in the table of sections for subchapter C of chapter 11 of such Code is amended to read as follows:</text>

<paragraph id="H0F43A2EEAC5A49C0002562DC36D23557"><enum>(3)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply to decedents dying after December 31, 2004.</text></paragraph></subsection> 
<subsection id="HD7B930199A294048ADE04405FD97164D"><enum>(c)</enum><header>No tax on toll telephone service in combat zone</header> 
<paragraph id="H408E0520BD2548DD9199C625E0AC22EC"><enum>(1)</enum><header>In general</header><text>Subsection (d) of section 4253 of such Code (relating to servicemen in combat zone) is amended by inserting <quote>, or from a civilian employee of the Department of Defense,</quote> after <quote>United States</quote>.</text></paragraph> 
<paragraph id="HB21AE2473579416B9E96121E38465600"><enum>(2)</enum><header>Effective date</header><text>The amendment made by this subsection shall apply with respect to amounts paid after the date of the enactment of this Act for services rendered on or after such date.</text></paragraph></subsection></section>
