<official-title>To give States the flexibility to reduce bureaucracy by streamlining enrollment processes for the Medicaid and State children’s health insurance programs through better linkages with programs providing nutrition and related assistance to low-income families.</official-title>

<section commented="no" display-inline="no-display-inline" id="HA40CE98C193641DE957610AA3FE53293" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Children’s Express Lane to Health Coverage Act of 2005</short-title></quote>.</text></section> 
<section commented="no" display-inline="no-display-inline" id="H012032565DF44CE7AB8F4DAFA3D5D24E" section-type="subsequent-section"><enum>2.</enum><header>Findings; purpose</header> 
<subsection commented="no" display-inline="no-display-inline" id="H65B63CB1074E455F9B4BA4573FD743BF"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HF4554B956E9B43F80000328E7D4CF4BC"><enum>(1)</enum><text display-inline="yes-display-inline">Despite gains made in recent years, 8,900,000 children in the United States are uninsured. Of those, 6,900,000 are eligible for public health insurance coverage.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HD19B3518EF384506911FE5B69488D079"><enum>(2)</enum><text display-inline="yes-display-inline">Most low-income uninsured children are enrolled in nutrition and related programs that operate under income guidelines similar to those of the medicaid program. In fact, 63 percent, or 4,300,000, low-income uninsured children are in families that receive benefits through the food stamps program, the National school lunch program, or the special supplemental nutrition program for women, infants and children (commonly referred to as <quote>WIC</quote>).</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H78BFE0D78CD148729C29D54B15458E2E"><enum>(3)</enum><text display-inline="yes-display-inline">The public would be well served if Federal means-tested public programs were able to improve administrative efficiency and coordination as well as reduce unnecessary bureaucracy.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H5ACC02B1B48A4B3B9EB6CF00F2831026"><enum>(4)</enum><text display-inline="yes-display-inline">Uninsured children would be well served if their enrollment in a nutrition-based or other means-tested program could serve as a gateway to health coverage.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HAA4DA36367DF4411AD6824AF04674F1"><enum>(5)</enum><text display-inline="yes-display-inline">Existing law already allows children to be found income eligible for WIC based on their enrollment in the medicaid program. Current law does not, however, give States adequate flexibility to make an income determination for eligibility for the medicaid or State children’s health insurance program based on an uninsured child’s enrollment in WIC or another public program.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HB7BB4B2B52134E63986D392900E3E044"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to give States the flexibility to find children income eligible for the medicaid program or State children’s health insurance program based on the fact that the children are eligible for nutrition assistance or similar public programs with comparable income standards and methodologies.</text></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H8EB111EDBF3D454A9FAFCD7086FB7E" section-type="subsequent-section"><enum>3.</enum><header>State option to provide for simplified determinations of a child’s financial eligibility for medical assistance under medicaid or child health assistance under SCHIP</header> 
<subsection commented="no" display-inline="no-display-inline" id="H2DB1EAF5384841B8A3C7CCAA02F316D1"><enum>(a)</enum><header>Medicaid</header><text display-inline="yes-display-inline"> Section 1902(e) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(e)</external-xref>) is amended by adding at the end the following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="H8D897969A0AE4213A8676000245CD984" indent="up1"><enum>(13)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HB359ACFBC99445CC8B1522C3003712E4"><enum>(A)</enum><text display-inline="yes-display-inline">At the option of the State, the plan may provide that financial eligibility requirements for medical assistance are met for an individual who is under an age specified by the State (except as provided in subparagraph (C), not to exceed 21 years of age) by using a determination made within a reasonable period (as determined by the State) before its use for this purpose, of the individual’s family or household income, or if applicable for purposes of determining eligibility under this title or title XXI, assets or resources, by a Federal or State agency, or a public or private entity making such determination on behalf of such agency, specified by the plan, including (but not limited to) an agency administering the <act-name parsable-cite="FSA77">Food Stamp Act of 1977</act-name>, the Richard B. Russell <act-name parsable-cite="NSLA">National School Lunch Act</act-name>, or the <act-name parsable-cite="CNA66">Child Nutrition Act of 1966</act-name>, notwithstanding any differences in budget unit, disregard, deeming, or other methodology, but only if—</text> 
<clause commented="no" display-inline="no-display-inline" id="H6E50B100D5ED44989E272880504919E2" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">the agency has fiscal liabilities or responsibilities affected or potentially affected by such determination; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H16B5947B6E50444B85C0302291BE9290" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">any information furnished by the agency pursuant to this subparagraph is used solely for purposes of determining eligibility for medical assistance under this title or for child health assistance under title XXI.</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF0230278FB0E48DEACC73F006000B194" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Nothing in subparagraph (A) shall be construed—</text> 
<clause commented="no" display-inline="no-display-inline" id="H137BA56696164697A1806D44A195AB64"><enum>(i)</enum><text display-inline="yes-display-inline">to authorize the denial of medical assistance under this title or of child health assistance under title XXI to an individual who, without the application of this paragraph, would qualify for such assistance;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HD413BD05754540469683A692DB00A099"><enum>(ii)</enum><text display-inline="yes-display-inline">to relieve a State of the obligation under subsection (a)(8) to furnish medical assistance with reasonable promptness after the submission of an initial application that is evaluated or for which evaluation is requested pursuant to this paragraph; or</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H91D156FF2B3743A500151B63CAEB7EC3"><enum>(iii)</enum><text display-inline="yes-display-inline">to relieve a State of the obligation to determine eligibility for medical assistance under this title or for child health assistance under title XXI on a basis other than family or household income (or, if applicable, assets or resources) if an individual is determined ineligible for such assistance on the basis of information furnished pursuant to this paragraph.</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HE53E70298BA8433FB3C9F385D5BE5A0" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">At the option of a State, the financial eligibility process described in subparagraph (A) may apply to an individual who is older than age 21 if the individual’s eligibility for medical assistance under this title is based on pregnancy or if the individual is a parent, guardian, or other caretaker relative of an individual found eligible under subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H4DF9CB60360449F592601E355FD49BA3"><enum>(b)</enum><header>SCHIP</header><text display-inline="yes-display-inline"> Section 2107(e)(1) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1397gg">42 U.S.C. 1397gg(e)(1)</external-xref>) is amended by adding at the end the following:</text>

<subparagraph commented="no" display-inline="no-display-inline" id="HB3BE4478DF094E1399FE697D62D21C7"><enum>(E)</enum><text display-inline="yes-display-inline">Section 1902(e)(13) (relating to the State option to base an individual's eligibility for assistance on financial determinations made by a program providing nutrition or other public assistance (except that the State option under subparagraph (C) of such section shall apply under this title only if an individual is pregnant)).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H33A6196AE3AB42000095301544112DC6"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section take effect on October 1, 2005.</text></subsection></section>
