<section section-type="section-one" id="H5EBEFCE1DD8346D3956B7F0311681E00" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Environmentally Responsible Windpower Act of 2005</short-title></quote>.</text></section> 
<section id="HF6CEFD79CE044C188E6FEDA6896E0078"><enum>2.</enum><header>Local control for siting of windmills</header> 
<subsection id="HB36352B690E94DA9B2E06FA2A00FAE"><enum>(a)</enum><header>Local notification</header><text>Prior to the Federal Energy Regulatory Commission issuing to any wind turbine project its Exempt-Wholesale Generator Status, Market-Based Rate Authority, or Qualified Facility rate schedule, the wind project shall complete its Local Notification Process.</text></subsection> 
<subsection id="HA3BBEBC754674656B9146D8132D770D2"><enum>(b)</enum><header>Local Notification Process</header> 
<paragraph id="H9EA8D201054C4F54A6C2A562BBFBF6A1" display-inline="yes-display-inline"><enum>(1)</enum><text>In this section, the term <term>Local Authorities</term> means the governing body, and the senior executive of the body, at the lowest level of government that possesses authority under State law to carry out this Act.</text></paragraph> 
<paragraph id="H54B4AF08EF14497096B0621E43C29DA2" indent="up1"><enum>(2)</enum><text>An applicant shall notify in writing the Local Authorities on the day of the filing of such Market-Based Rate application or Federal Energy Regulatory Commission Form number 556 (or a successor form) at the Federal Energy Regulatory Commission. Evidence of such notification shall be submitted to the Federal Energy Regulatory Commission.</text></paragraph> 
<paragraph id="H260D94966B7649EE821C28C05045522" indent="up1"><enum>(3)</enum><text>The Federal Energy Regulatory Commission shall notify in writing the Local Authorities within 10 days of the filing of such Market-Based Rate application or Federal Energy Regulatory Commission Form number 556 (or a successor form) at the Federal Energy Regulatory Commission.</text></paragraph> 
<paragraph id="H6B58470E445E40FD8F40E2DB535E8463" indent="up1"><enum>(4)</enum><text>The Federal Energy Regulatory Commission shall not issue to the project Market-Based Rate Authority, Exempt Wholesaler Generator Status, or Qualified Facility rate schedule, until 180 days after the date on which the Federal Energy Regulatory Commission notifies the Local Authorities under paragraph (3).</text></paragraph></subsection> 
<subsection id="H63606BC29CD04137819012074B269E8E"><enum>(c)</enum><header>Highly Scenic Area and Federal land</header> 
<paragraph id="H87EAAD9A275A4CB185C5D6062C653245" display-inline="yes-display-inline"><enum>(1)</enum><text>A Highly Scenic Area is—</text> 
<subparagraph id="H105CEFDBB57E49B98F2FC6B715269D57" indent="up1"><enum>(A)</enum><text>any area listed as an official United Nations Educational, Scientific, and Cultural Organization World Heritage Site, as supported by the Department of the Interior, the National Park Service, and the International Council on Monuments and Sites;</text></subparagraph> 
<subparagraph id="HA3D00A6E086E4E938CB3FD121061FE4" indent="up1"><enum>(B)</enum><text>land designated as a National Park;</text></subparagraph> 
<subparagraph id="HE60804B586464027A083D67CA8797DAF" indent="up1"><enum>(C)</enum><text>a National Lakeshore;</text></subparagraph> 
<subparagraph id="H8D1DB0FFADBA49EBA2E8E2E239E8A04F" indent="up1"><enum>(D)</enum><text>a National Seashore;</text></subparagraph> 
<subparagraph id="H7E0A86A6580B4584B344BE255EE067B9" indent="up1"><enum>(E)</enum><text>a National Wildlife Refuge that is adjacent to an ocean; or</text></subparagraph> 
<subparagraph id="H0D4A669F8FB041489FCC7D1C9244D3A9" indent="up1"><enum>(F)</enum><text>a National Military Park.</text></subparagraph></paragraph> 
<paragraph id="H98F2FBE841B741F3A222E2DBF8F671" indent="up1"><enum>(2)</enum><text>A Qualified Wind Project is any wind-turbine project located—</text> 
<subparagraph id="H7E0085F4343141CF9F068CB1A3E0A3BE"><enum>(A)</enum> 
<clause display-inline="yes-display-inline" id="H26AB705C834947D5B6ADDCF3DD5086B1"><enum>(i)</enum><text>in a Highly Scenic Area; or</text></clause> 
<clause id="HFB0FD5A801A640AFABED44813BFDA1" indent="up1"><enum>(ii)</enum><text>within 20 miles of the boundaries of an area described in subparagraph (A), (B), (C), (D), or (F) of paragraph (1); or</text></clause></subparagraph> 
<subparagraph id="HFEB18F6F9FB549C78C00740863906E20"><enum>(B)</enum><text>within 20 miles off the coast of a National Wildlife Refuge that is adjacent to an ocean.</text></subparagraph></paragraph> 
<paragraph id="H0807EC083ACE46518F05D0DF1F66CF57" indent="up1"><enum>(3)</enum><text>Prior to the Federal Energy Regulatory Commission issuing to a Qualified Wind Project its Exempt-Wholesale Generator Status, Market-Based Rate Authority, or Qualified Facility rate schedule, an environmental impact statement shall be conducted and completed by the lead agency in accordance with the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>). If no lead agency is designated, the lead agency shall be the Department of the Interior.</text></paragraph> 
<paragraph id="H9E9C3BCB87434ACBA0A74BCC818D14D" indent="up1"><enum>(4)</enum><text>The environmental impact statement determination shall be issued within 12 months of the date of application.</text></paragraph> 
<paragraph id="HE466F75757B54EF398AE7FA9E48F6CEF" indent="up1"><enum>(5)</enum><text>Such environmental impact statement review shall include a cumulative impacts analysis addressing visual impacts and avian mortality analysis of a Qualified Wind Project.</text></paragraph> 
<paragraph id="H499929967A8949148918FD8088AFF546" indent="up1"><enum>(6)</enum><text>A Qualified Wind Project shall not be eligible for any Federal tax subsidy.</text></paragraph></subsection> 
<subsection id="H9811F0B3160D461FA4B800E73B0218F4"><enum>(d)</enum><header>Effective date</header> 
<paragraph id="H4368474F7FB34F8ABE913B5EB5485576" display-inline="yes-display-inline"><enum>(1)</enum><text>This section shall expire 10 years after the date of enactment of this Act.</text></paragraph> 
<paragraph id="H0B472D3F9298462283B29DC1485B14DA" indent="up1"><enum>(2)</enum><text>Nothing in this section shall prevent or discourage environmental review of any wind projects or any Qualified Wind Project on a State or local level.</text></paragraph></subsection></section>
